OWNER: Dino and Pia Molella FILE(S): A117/13 Location:

11 Germana Place, Vaughan Ward 1, Vicinity of Teston Road and Dufferin Street

Proposal:

The Owner is requesting permission to construct an accessory structure (cabana) with the following variances:

Variance Proposed Required 1 Maximum area of

accessory structure (cabana)

44.6m2 10m2

2 Minimum rear yard setback to accessory structure (cabana)

3.9m 7.5m

3 Maximum building height of accessory structure (cabana)

Official Plan:

The subject lands are designated “Executive Residential” by in-effect OPA #332 (North Maple), as amended by OPA #681, and “Settlement Area” by in-effect OPA #604 (Oak Ridges Moraine Conservation Plan). The subject lands are also designated “Low-Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The proposed cabana reflects a massing and built form that is compatible with the character and scale of the existing neighbourhood. Accordingly, the Development Planning Department has no objections to the proposal, provided that the Owner installs landscape screening along the rear lot line to appropriately screen the cabana from Dufferin Street. A condition to this effect is included in this report. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A117/13, subject to the following condition:
