Chapel House, Cold Kirby, Thirsk, North Yorkshire, YO7 2HL.

The appeal is made under section 78 of the Town and Country Planning Act 1990 against

a refusal to grant planning permission.

The appeal is made by Dr Giles Hawkes against the decision of the North York Moors

National Park Authority.

The application Ref: NYM/2018/0073/FL, dated 1 February 2018, was refused by notice

dated 5 April 2018.

The development proposed is alterations and extensions to house- Revised scheme to

approval Ref: NYM/2016/0215/FL.

Procedural Matter

1. It was apparent at my site visit that work was well advanced in relation to an

earlier scheme Ref: NYM/2016/0215/FL (the former permission).

Decision

2. The appeal is allowed and planning permission is granted for alterations and

extensions to house- Revised scheme to approval Ref: NYM/2016/0215/FL, atChapel House, Cold Kirby, Thirsk, North Yorkshire, YO7 2HL, in accordance with

the terms of the application Ref: NYM/2018/0073/FL, dated 1 February 2018,subject to the Schedule of Conditions appended to this Decision.

Main Issue

3. The main issue in this appeal is the implications of the proposal for the characterand appearance of the area.

Reasons

4. The appeal building is a detached former chapel building currently undergoingrenovation and extension. The former permission allowed a two storey side

extension to the property along with the insertion of four dormers to the rearelevation and two dormers to the front elevation. The appeal proposal would see

two additional dormers introduced to the front elevation and a single storey sideextension added to the earlier approved side extension.

5. The Authority say that the proposals would erode the form and character of the

original chapel building and result in a property of much grander domesticproportions and character. I accept that it would result in a slightly larger dwelling

on the site, but cannot concur that it would be of much grander proportions;

rather the property would be modestly larger. It would be appreciably larger than the original chapel, but the form of the original building would still be clearly

discernible and the extensions would have a subordinate relationship thereto.

6. Moreover, whatever the historic charm and character of the original chapel building, the fact is that the former permission imparted a much stronger

domestic character and appearance to the property and included the alteration of what appear from the evidence to be the original vertical window openings and

the addition of several dormer windows. A casual glance at the building the subject of that approval would give no cue as to its former use and indeed even

to the informed observer, only inspection of the inscribed stone plaque at close quarters above the front door would reveal its history.

7. In these circumstances, I consider the appeal proposal would effectively amount

to more of the same. The two additional front dormers would simply replicate those approved on the rear elevation and the single storey addition would amount

to a modest and unassuming extension, which following the traditional principles of architectural hierarchy, would have an appreciably lower eaves and ridge height than both the original building and the side extension the subject of the

former permission.

8. The guidance in Design Guide Part 4: The Re-use of Traditional Rural Buildings

Supplementary Planning Document (August 2011) (SPD) states that traditional rural buildings should be capable of conversion to a new use without the need for any extension. Policy 8 of the North York Moors National Park Authority Local

Development Framework Core Strategy and Development Policies Document (November 2008) (CS) adopts a more lenient position of significant extensions.

However, the proposal is not strictly for a conversion because the Authority say it was converted into a residential dwelling in the 1970’s. Moreover, the fact that the previous scheme received approval suggests that the Authority applies these

terms with a degree of latitude and I shall do likewise, especially given my findings at paragraph 6 above.

9. For these reasons, I conclude on the main issue that the proposal would integrate comfortably with both the host building and wider character and appearance of the area. I thus find no conflict with Policies 3 and 19 of the CS. These seek to

ensure that development is of a high standard of design that maintains and enhances the distinctive character of the National Park and that residential

extensions do not detract from the character and form of the original dwelling. It would not comply with the advice in the SPD or the letter of Policy 8 of the CS, but I nonetheless consider it acceptable for the reasons given.

10. In addition to the standard condition in relation to the time limit for the commencement of development, a condition confining the approval to specified

plans is necessary for certainty. Conditions dealing with external lighting, inscribed stones, details of the stonework to the exterior walls, rooflights and details of door and window frames and their setting in the walls, are all necessary

to secure a satisfactory external appearance, particularly given the prominence of the building at a road intersection. Although the application forms specify

stonework to match existing, as the building incorporates both random and coursed stonework, I agree this is a detail that should be subject to written

approval. The suggested conditions in relation to windows and doors can be

consolidated without losing their intention. The condition relating to matching roof

tiles is superfluous as this is stated to be the case on the application forms. Six of the conditions dealing with first floor apex glazing, the vehicle access, outbuilding

and tree protection measures in relation to the latter all appear to relate to the former permission which included these matters, but which are not relevant to this appeal. I shall therefore omit them. A condition requiring a Construction

Method Statement is suggested, but I have been furnished with no reason why the Authority consider this necessary. Having regard to the site context on a

quietly trafficked country lane, I do not consider this condition is necessary.

SCHEDULE OF CONDITIONS

1) The development hereby permitted shall begin not later than three years from the date of this decision.

2) The development hereby permitted shall be carried out in accordance with the

following approved plans: Site Location Plan 1:1250 @ A4; Drg No: 04-A: Proposed elevations; Drg No: 03-A Revision C: Proposed floor plans.

3) No external lighting shall be installed on the development hereby permitted until details of such have been first submitted to and agreed in writing by the local planning authority. Any installed lighting shall be in accordance with the

approved details.

4) All existing inscribed stones built into the external walls of the building shall be

retained in-situ. If any additional inscribed stones shall be revealed in the west facing gable elevation, they shall be retained in-situ or removed and re-used elsewhere in the external walls of the building, in accordance with the prior

written agreement of the local planning authority.

5) No work shall commence on the construction of the walls of the development

hereby permitted until details or samples of the stone for the walls and dressings, have been first submitted to and approved in writing by the local planning authority. The stone used shall be in accordance with the approved

details or samples.

6) All new windows, glazing bars, external doors and door frames shall be of

timber construction. No work shall commence on any door or window in the development hereby approved until detailed specifications of the constructional details and appearance (including cross sections and means of opening), have

been first submitted to and approved in writing by the local planning authority. The doors and windows shall be installed in accordance with the approved

details.

7) The rooflights to be installed in the development hereby permitted shall be conservation style rooflights fitted flush with the face of the roof slope.

8) The external face of the frame to all new windows shall be set in reveals to match those of the existing windows.

Applications Determined by the Director of Planning on Expiry of Advertisement, Receipt of Further Amended Plans and Observations NYM/2018/0244/FL & NYM/2018/0353/FL Both applications for erection of general purpose agricultural building with hardstanding area and associated access tracks at Valley View Farm, Old Byland

The above planning applications were approved by the Planning Committee on 20 September 2018, subject to the receipt of amended drawings showing revised materials to the exterior of the building comprising Yorkshire boarding to the upper parts of all elevations in place of the proposed Ventair cladding and locally quarried stone to the lower parts of the walls where they are visible in the wider landscape (i.e. the south and west elevations). In addition Members requested an amended landscaping scheme comprising large trees to help reduce the visual impact of the proposal on the wider landscape and details of an access track across the field to the southeast to provide suitable access for farm vehicles to and from the site across the area of archaeological importance. These amended details have been received and in response the Authority’s Archaeologist and Historic England have confirmed that the route and constructional details of the proposed access track across the field to the southeast are satisfactory. With regard to the landscaping scheme Officers considered that the proposed planting of Sessile Oak along the various field boundaries at some distance to the west of the site will have a filtering effect and break up view of the buildings on the approach to Old Byland from the west. The neighbours, Mr & Mrs Jarman at Fair View, Old Byland have commented that the planting of Oak trees is a surprising choice within fields grazed by livestock as they are toxic to sheep, cattle and horses and requested that the oak adjacent to their boundary is replaced. They also commented that no provision has been made for the screening of the new track over the archaeology and requested consideration to the planting of a hawthorn hedge along the shared boundary to help screened the development from the village. In response to these comments the Authority’s Woodland Officer has responded that whilst acorns and other parts of Oak tree can cause issues with livestock if ingested in quantity, he is unaware of a single actual case where this has happened. He goes on to comment that Oak trees generally produce a significant amount of fruit on average once every seven years and in the Park most trees produce very little on average. Acorns fall over a short window of about two weeks and are rapidly gathered up by squirrels and birds. They are heavy and therefore spread little distance from the crown of the trees. In years where there are heavy falls it might be prudent to exclude livestock for a short period until they are naturally removed. He concludes that given the importance of Oak trees in our landscapes he would not wish to exclude them from planting schemes.

However the applicant has removed the Oak tree from the landscaping scheme which was to be planted on the shared boundary with the neighbour to the east of the site and has replaced this with an Ash tree. This is considered appropriate as a hawthorn hedge planted so close to the buildings would provide very little screening. Additional comments have also been received from Mr C Barnard of Garden Cottage, Old Byland in response to the amended plans. He commented that they are a significant improvement of the original proposal with the barns being set down at a lower level and the inclusion of mature trees on nearby farmland to provide screening in long distance views. He regrets that the barns will still be at some distance from the other farm buildings but welcomes the proposed access across the field linking the two. In view of the above the decision notices have been issued with conditions. These notices can be viewed using the hyperlinks provided.

1. Background

The Hedgerow Removal Notice was for the removal of 5 no. 5 metre sections ofhedgerow. The reason given in the Notice for the removal of these lengths of hedgerowwas to accommodate the construction of a new 1850 metre water main to replace theexisting pipeline located between Grinkle Lane, Easington, along towards Boulbyvillage and connecting to the Boulby Potash Mine meter house.

2. Decision

Following a field survey and an examination of existing records, the hedgerows were found to meet the criteria for an ‘important hedgerow’ under the Regulations on historical grounds, due to the hedgerows being recorded on either the Easington Draft Enclosure Map dated 1817 held at the County Records Office or the Easington Tithe Map dated 1838 held at the Borthwick Institute, York.

Although the hedgerows have been found to be important, having taken into account the reasons put forward for the hedgerows removal the Authority gave its consent for removal of a limited length subject to the following conditions:

i) Removal is to be limited to 5 metres within each hedgerow as shown on the mapsupplied with the application.

ii) Removal is to be undertaken outside of the bird breeding season (March –September).

iii) Replanting is to be undertaken on the sections of hedgerow removed.

iv) Planting should be undertaken at a density of no less than 6 plants per metre andprotected with spiral guards. Hedge gaps must be replanted with native shallowrooted species that won’t disturb the pipe but will retain the integrity of the hedgeline. The species mix should reflect the existing mix of species within thehedgerow.

The area of disturbed ground must be minimised and any soil dug out from the hedgerows should be kept separate from other soils, and returned to the hedge line once the pipe has been laid to secure the organisms present within the soil.

v) The hedge should be fenced to protect from stock with the fence placed at least 1metre from the line of the planting. Post-planting maintenance must be carriedout to ensure successful establishment.

vi) The site is known to be locally important for harvest mice. As the mice breed intolate autumn (up to mid-December if temperatures are warm enough) work shouldbe undertaken between mid-December – March in order to prevent disturbance tonesting sites. Prior to removal the sections of hedgerow should be checked forharvest mice nests and any found should be left undisturbed until the young haveleft the nest.
