Charles B. Wilkerson, Jr. , Secretary-Treasurer, David S. Citron, Bryant L. Galusha, Jr. , J. Jerome Pence, Jr. , Frank Edmondson, and E. Wilson Staub were present. Dr. Vernon W. Taylor, Jr. , President of the Board, was absent from this meeting due to illness. Also present were Bryant D. Paris, Jr. , Executive Secre- tary, Mr. Lee Denney, Ms. B. Joe Cooke, and Mrs. Diane Freeman. The Board convened for business and reviewing credentials of applicants for license by endorsement of credentials. RE: Dr Maurice Bakaleinik, Staten Island, N. Y. The Board reviewed Dr. Bakaleinik's request for special consideration for license by endorsement of cre- dentials as he has not taken the FLEX examination and does not hold certification by an American specialty board and he is a foreign medical graduate. Dr. Pence moved that Dr. Bakaleinik's request for special consideration for license by endorsement of credentials be denied, but he be advised that he can apply for the FLEX examination in North Carolina as a route to licensure in this state. Seconded by Dr. Edmondson and duly passed. RE: Insurance covera e for Board em lo ees Increased cost in employer contributions for Blue Gross Blue Shield for insurance coverage, effective October 1, 1976. Dr. Edmondson moved that the Board continue paying the same percentage of the monthly premium for Blue Gross/Blue Shield coverage for health insurance for Board employees as is done for state government employees. Seconded by Dr. Pence and duly passed. RE: License certificates -- change in wording requested. Dr. Staub moved that the change in wording on the license certificates for female physicians to indicate the feminine gender when applicable be approved as presented by the Execu- tive Secretary. Seconded by Dr. Pence and duly passed. RE: License endorsement interview procedures. The Board discussed possible changes in the interview process for applicants for license by endorsement of credentials which would involve individual interviews by a Board member when applicable. The Board of Medical Examiners of the State of North Carolina met at TheHilton Inn, Raleigh, North Carolina, June 14-17, 1976 for the purpose of conduct-ing examinations for licensure, interviewing applicants for license by endorse-ment of credentials and conducting other business.

Drs. Charles B. Wilkerson, Jr. , Secretary-Treasurer, David S. Citron, BryantL. Galusha, Jr. , J. Jerome Pence, Jr. , Frank Edmondson, and E. Wilson Staub werepresent. Dr. Vernon W. Taylor, Jr. , President of the Board, was absent from thismeeting due to illness. Also present were Bryant D. Paris, Jr. , Executive Secre-tary, Mr. Lee Denney, Ms. B. Joe Cooke, and Mrs. Diane Freeman.

The Board convened for business and reviewing credentials of applicants forlicense by endorsement of credentials.

RE: Dr Maurice Bakaleinik, Staten Island, N.Y. —The Board reviewed Dr.Bakaleinik's request for special consideration for license by endorsement of cre-dentials as he has not taken the FLEX examination and does not hold certificationby an American specialty board and he is a foreign medical graduate.

Dr. Pence moved that Dr. Bakaleinik's request for special consideration forlicense by endorsement of credentials be denied, but he be advised that he canapply for the FLEX examination in North Carolina as a route to licensure in thisstate. Seconded by Dr. Edmondson and duly passed.

RE: Insurance covera e for Board em lo ees —Increased cost in employercontributions for Blue Gross Blue Shield for insurance coverage, effective October1, 1976.

Dr. Edmondson moved that the Board continue paying the same percentage of themonthly premium for Blue Gross/Blue Shield coverage for health insurance for Boardemployees as is done for state government employees. Seconded by Dr. Pence andduly passed.

RE: Conversion —limited to full license: Dr. Marco A. Caceres has appliedfor conversion of his geographically limited license to full license. Dr. Edmondson

moved that if all credentials are in order, Dr. Caceres be approved for conversionof his limited license to full license. Seconded by Dr. Pence and duly passed.

RE: Biennial Re istration —Reinstatement: The following physicians' licenseshave been suspended for failure to register as required by N. C. G.S. 90-15. They

have now registered:

Following this two-hour meeting, Dr. Citron moved that whenever information issubmitted to the Board about a physician in which charges may be indicated, thatinformation be reviewed by one Board member, and this procedure be routinely rotatedamong the members, and this information be discussed by the member with the Board'sattorney and he report to the Board on whether charges should or should not be pre-ferred, and i.f charges are not to be preferred, this information be reported to theBoard as investigative information only, and if charges are to be preferred, that oneBoard member who reviewed the information be disqualified from sitting as a Boardmember at the hearing for that individual physician. Seconded by Dr. Pence and dulypassed.

Executive Secretary instructed to write Nr. Keith Bulla thanking him for appearingwith the otners and assuring them the Board had thought about the conference exten-sively and appropriate action would be taken as necessary.

RE: Mobile Intensive Gare Nurse —examination. Dr. Staub reported that theexamination for certification of the NIGN is being re-worked and will be presented tothe Board at its August, 1976 meeting.

RE: Mobile Intensive Gare Technician —applications. Dr. Staub, after reviewof applications, moved that all applications be approved as presented with thefollowing exceptions:

1) ~Allan Los : Needs clarification as to being marked aeeak —needs improve-ment" and has an overall rating of "unsatisfactory", which possibly shouldhave marked his application as not to be sent to the Board for approval atthis time.

2) Donald Cole: No indication that he has had clinical experiences, whichcould possibly be an oversight in checking off on the form. If it is anoversight only, Nr. Cole to be approved if and when form i.s properlycompleted and satisfactory to the Executive Secretary. If it is not anoversight and he actually has not had any clinical experience, Mr. Coleis denied approval at this time.

RE: Re istered nurses erformin medical acts and assistants to h sicians-drug formulary. Dr. Pence reported on this Board's subcommittee's meeting withthe Board of Pharmacy subcommittee and the subcommittee from the Board of Nursingregarding the drug formulary being drawn up as the guideline for assistants tophysicians and registered nurses to write prescriptions. The new formulary forassistants to physicians and registered nurses to use in writing prescriptionswhich was presented to the Board for approval will not list in detail all drugs per-mitted, but will state that all drugs are permitted which are a part of the standingorders for that practice, with certain exceptions, which will be listed, such as:

No controlled substancesNo parenteral preparations except insulinAll remaining exceptions relate to various classes of drugs, such as:

AntihistaminesAnti-infective agentsAnti-neoplastic agents, etc.Under each of these categories, exceptions have been listed that are not

considered safe for registered nurses and assistants to physicians toprescribe.

A copy of this formulary will be sent to supervising physicians of assistantsand registered nurses performing medical acts with a cover letter explaining howthis formulary was arrived at, and which will indicate other criteria by whichprescriptions may be written, such as:

Every prescription written must be entered on the patient's chart andcountersigned by the supervising physician within 72 hours;Prescriptions will be valid for no longer than a 90-day supply or canbe written for no more than 100 dosage units, whichever is less;No refills on a prescription written by an assistant or registered nurse;every refill will have to be authorized specifically by an individual,i.e. , that assistant or registered nurse by telephone, or some otner means,so that a record will be made in the chart that a refill has been issued.

The formulary will be circulated with a statement that if any physician has anyquestions about which drugs are included in each of these groups, he can call hispharmacist for the answer. Pharmacy Board will be sending this out to all pharma-cists in the state and telling them that these drugs are grouped according to theAmerican Society of Hospital Pharmacists formulary.

Upon the subcommittee's recommendation of approval of the formulary and guidelinesas drawn up by the three committees from the Board of Pharmacy, Board of MedicalExaminers and Board, of Nursing, Dr. Galusha moved that the formulary be approved aspresented, with a copy of same to be sent to each Board member and any request foradditional new drugs to be added to the formulary to be reviewed by the three committeesbefore being approved by the Board. Fordham Dean Universit of North CarolinaSchool of Nedicine —Board reviewed letter from Dr. Fordham regarding holding aconference to explore the approaches to developing mechanisms of assuring physiciancompetence in this state. The Executive Secretary was instructed to advise Dr.Fordham that the Board would certainly be in favor of a conference that would besponsored by the North Carolina medical societies regarding physician competenceand would be glad to participate in any discussion at such a conference.

RE: FLEX examination —increased cost of examinations: Executive Secretaryreported to the Board that the Federation of State Medical Boards had advised thatthe cost of the examinations would be increased from $65.00 each to 468.00 each,beginning with the December, 1976 examination. Received as information by the Board.

RE: Dr Youn Kwon Chu, Richmond, Va. —Request to take FLEX in North Carllinaafter failing the examination twice in Virginia and taking only p arts of theexamination twice. Dr. Edmondson moved that Dr. Chu not be allowed to take theexamination in North Carolina. Seconded by Dr. Citron and duly passed.

RE: Certification examination for the Emer enc Medical Technician-IV theMobile Intensive Gare Technici n and the Mobile Intensive Gare Nurse —Followingreview by Dr. Staub of the certification examination presented by the Office ofBnergency Medical Services, he advised the Board it appeared to be a fair examina-tion and generally comprehensive, but felt that office should be encouraged toimprove and upgrade the examination periodically. Dr. Staub moved that the examina-tion format be approved and the examination be approved as presented. Seconded byDr. Galusha and duly passed.

RE: ilational Commission on Certification of Ph sician's Assistants —TheBoard reviewed information received regarding certification of assistants to physiciansby the National Commission and the possibility of making national certification of anassistant an additional requirement for approval of an assistant. This was receivedas information by the Board and the Executive Secretary was instructed to put this onthe agenda of a subsequent Board meeting if and when more information is receivedregarding this, at which time the opinions of the physician's assistant programdirectors be requested prior to any Board action.

RE: Subcommittee re ort —Board of Nursing and Board of Medical Examiners:Dr. Pence reported that the subcommittee had received information that Ms. LynetteRussell, a nurse midwife, was leaving the Gastonia area and the employ of thephysician she had been approved to function under as a registered nurse performingmedical acts. Consideration of site visits: Dr. Pence reported that the subcommitteehad reviewed a tentative plan drawn up by Ms. McRee, Executive Director of the NursingBoard and Mr. Paris, Executive Secretary of the Board of Medical Examiners for sitevisits to the clinics in the state with registered nurses approved to performmedical acts. It was suggested that one member from the Board of Nursing and onemember from the Board of Medical Examiners make the site inspection together, andthe clinics in the Piedmont and Eastern part of the state which appear to have few,if any, problems be visited first.

Pro am a rovals: Dr. Pence reported that the joint practice commissionhad reviewed the East Carolina University program and the Mountain Area HealthEducation Center and had approved their training programs for registered nursesperforming medical acts. Dr. Pence moved that the Board approve these programs atthis time. Seconded by Dr. Citron and duly passed.

Dr. Pence also reported that the Family Nurse Practitioner conference grouphad approved 20 hours a year as a minimum of continuing education for regi terednurses performing medical acts, to become effective in 1977, for the FNP, and thatthe minimum standards for the Family Planning Nurse Practitioner had been approvedby tne subcommittee, which the Board received as information.

Orders from assistants to h sicians —Dr. Pence also presented to theBoard a letter from a nurse in Asheville at Memorial l'fission Hospital regarding herfollowing orders from an assistant to a physician, and her question as to thelegality of this practice. Dr. Pence advised the Board that the subcommittee feltthis was not legal, although possibly the orders could be written by the assistantat the direction of the physician, with his name followed by the assistant's name.The Board directed that she be referred to the law covering this matter, and alsobe advised that the Board feels she would be in violation of the law if she takesorders only from the assistant, without the physician's name being on them, andthat this matter should be taken up with the hospital administration.

Following this hearing and the presentation ofevidence, the Board found and concluded that Dr. Daniel D. Lovelace was convictedof the commission of a felony as set forth in the Charges preferred against him bythis Board, and grounds exist for the revocation of his license to practice medicinein North Carolina. Upon motion duly made and seconded, and passed unanimously,Dr. Lovelace's license to practice medicine in the State of North Carolina wasrevoked.

IIedlin, Jr. did appear and stated he did not wish to be representedby counsel. Following this hearing and the presentation of evidence, the Boardfound and concluded that Dr. Jasper R. IIedlin, Jr. be found guilty as charged inCount One of the Charges preferred against him by this Board, and grounds exist forthe revocation of his license to practice medicine in North Carolina. Upon motionduly made and seconaed, and passed unanimously, Dr. Medlin's license to practicemedicine in the State of North Carolina was revoked. The charge contained in CountTwo of the Charges and Accusations was found not to be supported by evidence andsuch charge was dismissed.
