CONCERNING APOLOGIES.

We have been no apologist forMr. Gibson and his Cabinet. P.6'. Advertiser.

It is quite true that the Advertiserhas never apologized for Mr. Gibson.On the contrary it lias steadilyupheld Mr. Gibson as a man forwhom no apology was needed. Itis only last week that it stated Mr.Gibson was "an honest, energeticand capable public official." Apublic servant who combines all thesequalities certainly needs no apology.We may add that a public journalcapable of giving such an endorse-

ment to a man with Mr. Gibson'srecord, has passed bcyend the stagewhere any apology would be of thoslightest use.

SHOULD THE MINISTERS VOTE UPONA QUESTION OF WANT OF CON-

FIDENCE IN THEMSELVES?

Unhesitatingly tho common senseof every one answers, No? The pro-

position is exactly parallel, of allow-

ing a man charged with crime to situpon tho jury which is to decideupon his guilt or innocence. It is

claimed that the Ministers do notpossess the confidence of the coun-

try, and the constitutional methodof deciding this question is by a voteof the Assembly ; now if a majorityof the Representatives and Noblesvote against the Ministry, and theMinisters by their own votes, nullifythe expression of the feeling of thecouutry, there can be no doubt thatthe expression of the will of the peo-

ple has been defeated.The answer to the question is

then without doubt, that the Mini-sters onqif. not to vote, and the rules

of our Lcgislatuio should bo sochanged as to correspond with com-

mon sense, and to execute and notdefeat the popular will

We would urge upon the Assembly

t the necessity of changing the presentmethod of appointing tax assessors

, and collectors. Under the existing.' system these olllccs are simply the

prey of the administration, parceledout to personal friends, relatives andpolitical woikers, nud with few ex-

ceptions, without regard to fitness,character or intelligence on tho partof iho appointees. The country now

needs all the income that can bo

made available but taxes will notand can not bo equitably assessedand properly collected by ignorantand inefficient men.

The Auditor General in his repot tsays: "Our assessments have notbeen made with that care and intel-

ligence that our revenue system de-

mands. We have every reason tobelieve that property has steadilyadvanced in value since 1870 ; ourexports show a steady gain ; the va-

riation in the assessment must be at-

tributed to the inefficiency of theAssessors." Speaking of last yearhe says: "The Assessors outsideof Honolulu, with a few exceptions,were men entirely deficient of aknowledge of their duties ; they weretiot skilled as valuators of property,on a large scale, and therefore want-

ing in knowledge and force ofcharacter to make them efficientpublic officers, and thereby not onlywas there no increase in personalproperty heretofore deducted, butthe scncrul increase fell short offormer years." "The im-

portance of selecting men qualifiedto fill the office of Assessor is one ofmore than ordinary importance;nothing will irritate- the public morethan unequal taxation, which is cer-

tain to be the case with incompetentpersons in office."

The whole burden of the lay is in-

efficiency, ignorance, lack of char-

acter. And yet inefficient, ignorantnud characterless men aic year afteryear appointed, and will continue tolie appointed as long as the power ofappointment is likewise in the hnndsof inefficient or unscrupulous jnen,and as long as the tenure of theoffice depends upon subset viency,and a ictuui of political support forvalue received.

Take away from the Minister thepower of appointing new men everyyear, and one prolific sou ran of cor-

ruption will be lemoved. Takeaway from the tax assessors and col-

lectors the power to act at the sametime as members of the Legislature,and we shall have a truer represen-

tation and less i ruckling to thepowers that be, for purposes of pri-

vate gain.

THE REMEDY.

The foiegoing article was writtenover a month ago, and how trulyhave events borne out the statementsthoiein contained.

We have scon the demoralizingand disgraceful spectacle of nineRepresentatives of the people, whileacting as Representatives, deliber-

ately stultifying themselves andabandoning the interests of theirconstituents, at the beck of a shame-

less and unprincipled official, simplybecause he lias it in his power to ap-

point the Tax Assessors.It reduces our Legislature from a

"representative" body into a ma-

chine, in which the will of the peopleis a cipher, and the commission of aRepresentative is simply a basis formaking money by selling the voteincident thereto, to the Ministry foran office. The remedy is not far toseek. Let a law be passed for-

bidding any man holding a Govern-

ment office from being a member ofthe Assembly. Let it extend furtherthan this, and forbid any person de-

riving profit from the Government,whether through contracts or other-

wise, from holding a seat in the As-

sembly.If the Ministry are deprived of

this power of buying votes, the primesource of corruption in our Legisla-

ture will be removed, and the senseof decency in the community will

not be shocked by such shameless,open, bare-face- d bribery as that withwhich it has been insulted within thepast week.

PRESIDENT RHODES' RULING UPON

THE QUESTION OF ALLOWINC

MINISTERS TO VOTE ON A QUES-

TION OF WANT OF CONFIDENCE.

Mr. Rhodes' ruling was as fol-

lows :

"Theio is considerable conllictbetween our rules and those of for-

eign nations, and the rules of foreignnations conflict with each other.The rule in the U. S. House of Rep-

resentatives is that ' no member shallvote on any question in the event ofwhich he is immediately and particu-larly interested.'"

In the British House of Parlia-

ment, in questions of this description,all members of both Houses vote,including tho Ministers.

"Our rule, 142, is ambiguous. Itrends, 'No member shall be per-

mitted to vote on any question whenhis private right, distinct from pub-

lic interest, io immediately con-

cerned.' I must, therefore, rulo inaccordance with tho English prece-

dent, that the Ministers have theright to vote."

Mr. Rhodes deserves the. highestpraise for his impartiality in the rul-

ing made, as his own feelings andprejudices arc all the other way, butwc can not agree with him as to theconclusion drawn. The Ministershold scats in the House under Art.13 of the Constitution, which reads:"The Ministry hold seatsas Nobles, in the Legislative As-

sembly." They are not Nobles, nordo they represent any constituency,but they have n seat among theNobles simply by virtue of theiroffice.

As they represent the policy ofthe Government, it is proper thatthey should be present to answerquestions, and to discuss questionsof policy. Rut when it comes to aquestion of whether or not thecountry has confidence in the Min-

istry, it cannot be said that theyMinisters themselves represent anybody, that they should vote uponthe question. The English prece-

dent cited by Mr. Rhodes would notseem to be in point, for the EnglishMinisters hold their seats In theHouse of Commons by reason oftheir being elected representatives,and not by reason of their beingMinisters; a Minister there does nothave a rcat io in Parliament,and consequently when he votes onsuch a question, it is not his ownindividual vote, as is the case here,but it is the vote of the constituencywhich he represents.

Whether Mr. Rhodes is correct ornot, the common sense of the com-

munity demands that their shall beno longer an ambiguity in the matterand that tho rule be made definitethat Ministers shall not vote upontheir own acceptability to the country.

THE POSITION OF THE CABINET.

The fact stands undenied, and itis undeniable, that the Cabinet existssolely by virtue of the individualballots of the members thereof.

Take away the four votes of theMinistry, and they would be in theminoritj', and a vote of want of con-

fidence would pass against theminstantly. This being the case, is

it not a perfect farce to say thatthis Government is a representativeone. When a majority of the As-

sembly not only say that they haveno confidence in the policy of theMinistry, but denounce them as in-

competent, inefficient and dishonest,and bring forward incontestable andundeniable facts to substantiate suchcharge, is it not an insult to thepublic to have these four men calm-

ly deposit their ballots in favor ofthemselves, and by the power of thoseballots alone, retain their offices?Yet this is the position of the pre-sent Cabinet, and because they saythat they have" confidence in them-

selves, we arc asked by a sojcalledindependent newspaper to calmlyaccept their verdict, as being a de-

cisive and unaswerable reply to thefacts, not charges, which have beenshown against them.

OAHU JAIL.

"The condition of the Prison ismost creditable to Marshal Parkeand his assistants. Nothing couldbe more cleanly than the cells andcorridors, and every part of theestablishment is in perfect order."P. 0. Advertiser, July 2d, 1884.

In reference to the same subject;,the majority Report of the Legisla-tive "Committee of Thirteen,"says: "The accommodations arcinsufficient, tho crowded conditionof the Prison making it necessaryoften to place 8 prisoners in a cell."(The cells are 7 feet long and 4 feetwide.)

"There is no suitable place forthe occupants to take their meals ;

rangements are inadequate and in afilthy condition, and located in suchproximity to the eating place as tobo most objectionable." This isthe testimony of Governor Doininis,the Attorney-Gener- al (Paul Neu-mann), lions. W. O. Smith, J. Kaae,S. B. Dole, J. Kaunamano, CecilBrown and J. Nawahi ; and DoctorBrodie, the attending physician,says in his Report: "Increasedaccommodation is necessavy, as at

times three prisoners have to occupyone cell, while in my estimation,there should not bo more than onein a cell." lie says, further, that"the building is almost constantlyoverrun" with "bed-bugs- " ; and,that "the water-close- ts as at prcsciitsituated and constructed are a posi-

tive nuisance.""We can scarcely believe that all

of these gentlemen have deliberatelylied, the P. 0. Advertiser to thecontrary, notwithstanding.

istry have robbed this country ofher credit and of her good name ;

they have robbed the people of theirright of representation, by publiclyseducing their Representatives withoffice bestowed in exchange forvotes ; they have robbed the Treas-

ury of public funds, bj' drawingmoney therefrom, not only withoutsanction of law, but in violation ofthe direct command of laws so plainthat the English language cannotspeak plainer; and yet they havebeen brought to trial, before theonly tribunal competent to takecognizance of their crime, the Legis-

lature, and by entering their fourseparate pleas of "not guilty," theyhave defeated justice and made aconviction impossible. But for thefour votes of the four Ministers,the vole of want of confidencewould have passed last Saturday.

Brown, in support of hisresolution said that by Section 32 ofthe law relating to taxes, tliejr couldnot be members of the Legislatureand Tax Assessors at the same time.They should resign cither one or theother. If they had any self respect,they would never have taken theoffice, nor would the Ministers haveconferred office upon them. It looksas if the Ministers were trying to birytheir votes.

Mr. W. 0. Smith, said, tins is nota new thing, it never has done anygood and never will. It is highlyimproper they should be appointedassessors. The Tax Assessor byAuthority notice in the P. C. Ad-

vertiser says : "All returns must bemade to the Assessor not later thanJul' 81 or no appeals can by law begranted."

If assessments are not made in

July people may refuse to pay theirtaxes. The matter of taxation is avery important one. If we are goingto lose money we had better lookout.

Mr. Kaulukou' moved the resolu-

tion bo indefinitely postponed, andalso the previous question.

Mr. Dole replied for Mr. C. Brownthe introducer of the resolution asfollows: It is plainly seen that thereis friction here, one. man has toperform two duties at the same time.The Hon. member for South Kona is

Editor Bulletin: It would beof great interest to me, and probablyto many in this community, thatsome one "who knows" should tellus whether the ruling by which Pre-

sident Rhodes authorized the Minis-

ters to take part in the ballot on lastSaturday, was correct and legal ornot. In the constitutional govern-ments of Continental Europe, Iknow that when Ministers vote onany question, it is not in their Minis-

terial capacity, but on account oftheir being also deputies or of theirrepresenting some electoral college.They would never think or dare tovote on any question in which theyarc personally interested, and muchless in such an important one as a"Want of Confidence." But is itnot also realty the same in GreatBritain , aud when Ministors docast their ballots in the British Par-

liament, it is not because they arceither Lords or Representatives ofthe people of some college orborough.

If such is realty the case, then theabove mentioned ruling was incor-

rect, and Mr. Kapena only ought tohave voted, on account of his beinga Noble. It would not have mate-

rially changed the vote, but wouldhave appeared more dignified.
