Introduction The Clean Air Act (CAA) requires the United States Environmental Protection Agency (EPA) to establish the national ambient air quality standards (NAAQS) for various criteria air pollutants. Areas where air quality monitoring shows a violation of the NAAQS are designated “nonattainment.” In accordance with the CAA, the New York State Department of Environmental Conservation (NYSDEC) is required to produce a plan, known as the State Implementation Plan (SIP) that details how sufficient emission reductions, including reductions in the transportation sector, will be achieved to meet the NAAQS. All nonattainment areas are subject to a provision in CAA §176(c) known as transportation conformity. The intent of the transportation conformity process is to fully coordinate transportation and air quality planning to ensure that the implementation of transportation plans, programs and projects will not 1) cause or contribute to any new violation of the NAAQS, 2) increase the frequency or severity of any existing NAAQS violations, or 3) delay timely attainment of the NAAQS or any required interim emissions reductions or other milestones in any area. The New York State Department of Transportation (NYSDOT) has proposed significant changes to the Capital Program of Transportation Projects in Chautauqua County. As a result of this action, a new transportation / air quality conformity determination is required for the Jamestown, NY non-attainment area. This report presents the results of the regional emissions analysis and documents the process and methods undertaken by NYSDOT to demonstrate that the Capital Program of Transportation Projects conforms to the SIP. Attainment / Non-Attainment History and Status of Chautauqua County, NY Chautauqua County has historically been classified as an attainment area for all criteria air pollutants that are regulated under the Clean Air Act, including the 1-hour ground level ozone standard. On July 16, 1997, EPA established a new concentration-based 8-hour ozone standard and set the standard at 0.08 parts per million (ppm). Specifically, the “design value” used to establish whether or not an area attains the NAAQS for 8-hour ozone is the 3-year average of the annual 4th-highest daily maximum 8-hour ozone concentrations. An area attains the standard when the 3-year average of the annual 4th-highest daily maximum 8-hour concentrations is less than or equal to 0.08 ppm. Effective June 15, 2004 the EPA designated the Jamestown, New York area to be nonattainment under the 1997 8-hour ozone standard. Based on 2001-2003 air quality monitoring data, the 8-hour ozone design value for the area was 0.097 ppm, and Chautauqua County was classified as a Clean Air Act Sub Part 1 “Basic” non-attainment area under the 1997 standard. On June 8,

2007, the United States Court of Appeals vacated the Subpart 1 portion of EPA’s Final Phase 1 Rule To Implement the 8-Hour Ozone NAAQS. As a result of this court ruling, EPA classified all “Subpart 1 Basic” areas as "Former Subpart 1" until reclassification of the areas is finalized. Proposed reclassifications were published on January 16, 2009. However, these reclassifications have not yet been finalized. The current 8-hour ozone design value for Chautauqua County is 0.077 ppm based on 2008-2010 air quality monitoring data. On March 12, 2008, EPA once again strengthened the 8-hour ozone NAAQS to a level of 0.075 ppm. However, USEPA has not made final area designations for the new ozone standard and the conformity requirements for the new ozone standard do not yet apply. In addition, based on certified ambient air quality monitoring data, EPA determined that the Jamestown, NY area attained both the 1997 8-hour ozone standard on January 6, 2010. However, EPA’s determination did not constitute a formal redesignation to attainment and the transportation air quality conformity requirements still apply to the area. However, this determination did suspend certain SIP requirements including the need to develop a motor vehicle emissions budget in the SIP. Air Quality Classification of Transportation Projects The federal conformity regulation provides a list of projects that are Aexempt@ from transportation conformity requirements, since they are expected to have no impact on air quality. Exempt projects are typically road and bridge rehabilitation projects where the existing transportation system is being maintained, and no roadway capacity changes are being made that would significantly change regional travel patterns. The entire 12-year Capital Program of Transportation Projects in Chautauqua County, including those determined to be exempt from the regional emissions analysis per 40 CFR Part 93.126 and 93.127, is included in Appendix A. This list was reviewed by the Environmental Science Bureau in consultation with the NYSDOT Region 5 Planning & Program Management office to initially identify exempt or non-exempt classifications for all projects. Additional information was then gathered for the non-exempt projects, and then this listing was provided for review and comment to the Interagency Consultation Group (ICG) for air quality conformity in New York State. The ICG operates on a consensus basis and, consistent with federal regulation, is comprised of representatives of NYSDEC, NYSDOT, EPA, the Federal Highway Administration (FHWA) and the Federal Transit Administration (FTA). There are two non-exempt transportation projects scheduled for future construction in Chautauqua County: PIN 503498: The NY Route 5/ US Route 20 Bridge over the Cattaraugus Creek (PIN 5034.98) was classified as a non-exempt project in 2007. This bridge carries approximately 18,000 vehicles per day. It includes two 12-foot wide travel lanes, a 12-foot wide center median, and

two 2-foot wide shoulders. Structural deficiencies have been identified on the bridge since 1997. The bridge was posted with an 18-ton limit in 2007 and NYSDOT Region 5 planned to build a new four-lane structure on a new alignment to replace the current bridge. Emergency repairs were performed and the bridge has been restored an unrestricted weight capacity. Right-of-way acquisition for the new bridge option on new alignment is no longer being pursued. The most recently proposed preferred scope of PIN 503498 will consist of a complete bridge replacement very close to the current alignment. The new bridge will feature two 12-foot wide travel lanes, a striped median, and 8-foot wide shoulders. The primary objectives of the project are: 1) mitigate structural deficiencies, 2) provide adequate level of service of the bridge carrying NY 5/US 20 over the Cattaraugus Creek on the border of Erie and Niagara Counties, 3) meet local planning goals while minimizing adverse social, economic, and environmental impacts, 4) improve mobility through the project area for pedestrians, bicyclists, and large dimension vehicles, and 5) reduce or eliminate the potential of vehicular conflicts/accidents in the project area. PIN 503498 is also being combined with PIN 503411 in Erie County to construct a roundabout approximately 500 feet north of the 5/20 bridge at the intersection of NY Route 438 where NY Route 5 and US Route 20 split. This conformity determination, limited to the Jamestown, NY nonattainment area, only considers vehicle activity within the Chautauqua County portion of the project limits. Thus, the emissions analysis is appropriately conservatively and is consistent with the transportation conformity regulation requirement to include all travel activity within the nonattainment area. None of the direct emissions benefits that will be achieved at the roundabout in Erie County are included in the build vs. no-build emissions analysis. The emissions impact of PIN 503498 in Erie County is appropriately considered in the regional emissions analysis for the Buffalo, NY nonattainment area conducted by the Greater Buffalo-Niagara Regional Transportation Council. PIN 575755 Millennium Parkway: The Millennium Parkway project is a federally funded project being administered by the Chautauqua County Department of Public Works. Since the project was anticipated to include the construction of a new “by-pass” roadway on new alignment, the ICG recommended that the project be classified “non-exempt” in 2008. At the time, the design alternatives for the project varied widely and there were no traffic details available to support a project emissions analysis. Since that time, a preferred alternative was selected, a traffic and emissions analysis has been performed, and design approval is being sought in late October 2011. The primary objective of the Millennium Parkway Project is to improve tractor-trailer truck traffic access from NY Route 60 to an industrial corridor, including districts zoned for industrial uses along Werle Road, Harrington Road, Progress Drive, and County Route 82 in the City of Dunkirk. The preferred alternative will consist of minor geometric improvements to existing facilities in the project area, and the construction of a new road for approximately 4,000 feet, Millennium Parkway, through the industrial corridor. This alternative starts at the intersection of NY Route 60 and Talcott Street in the City of Dunkirk, and ends at the intersection of

Millennium Parkway and Middle Road, near Progress Drive, in the Town of Dunkirk. The project will reduce distance traveled and the number of turning movements that will be necessary for trucks to access and depart from the project area. No other non-exempt or non-federal regionally significant transportation projects have been identified or proposed in Chautauqua County, NY. Latest Planning Assumptions The Federal and State conformity regulations require conformity determinations to be based on the latest planning assumptions available at the time the regional emissions analysis to support the conformity determination begins. Specifically, the latest demographic data, transit operating policies, transit service levels, transportation control measures, and other key assumptions must be utilized in the regional emission analysis. The regional emissions analysis began on July 7, 2011. This requirement is met as described below. Demographic Data – Population, Employment, Travel and Congestion: The Jamestown area is not subject to the metropolitan planning requirements set forth by USDOT. Therefore, the NYSDOT Region 5 Office in Buffalo, NY is responsible for the most recent estimates of travel and congestion on the roadway system. The estimates of county-wide VMT used in the regional emissions analysis are based on the most recently observed and estimated counts collected and processed via the NYSDOT Highway Performance Monitoring System (HPMS) program. Future VMT estimates are based on projecting historical VMT trends into the future. This HPMS data projection was most recently conducted in 2008 and considers future economic activity, transit alternatives, and transportation system policies. Speeds on the various transportation facilities used in the regional emissions analysis are the weighted average daily speeds for rural counties in New York State as developed by the NYSDOT Planning and Strategies Division. These speed estimates are the most recent and best available data available for the purpose of system-wide regional analysis. In order to estimate the effect of the NY Rt. 5 / US Rt. 20 bridge reconstruction and Millennium Parkway projects on future year emissions, mesoscale-level emissions analyses were performed and the changes in emissions between the “no-build” and “build” conditions for these projects were summed and added into the county-wide estimate of on-road emissions. The NY5/US20 project analysis is predicated upon a slight increase in roadway speeds. The Millennium Parkway project is expected to slightly reduce VMT due to shorter routes to access the light industrial operations in the immediate project area The results of these “mesoscale” emissions analyses and county-wide emissions analysis are presented in Appendix B. Transit Operating Policies, Service Policies, Fares, and Ridership: Chautauqua Area Regional Transit System (CARTS) is a municipally owned and operated bus service that serves the

citizens of Chautauqua County. CARTS runs 14 bus routes in Jamestown and Dunkirk between 6:30am and 5:30pm. The fare system is as follows:

In addition to providing on-demand reserve service for disadvantaged riders, these transit systems serve a very modest share of overall daily trips in Chautauqua County. There are no significant changes in transit service trends assumed as a part of these future forecasts of the Chautauqua County transportation system. It is expected that transit operating policies, fares and service levels will continue as they exist now, with adjustments as needed with changes in future population and transportation needs as they arise. Timely Implementation of TCMs: 40 CFR Part 93.113 requires the all transportation plans and programs to provide for the timely implementation of any Transportation Control Measures (TCMs) in the applicable State Implementation Plan (SIP) and to ensure that no project in the program interferes with the implementation of any TCM. The applicable SIP does not include any TCMs for Chautauqua County. Therefore, this requirement does not apply to this conformity determination. In addition, no elements of the Chautauqua County Program of Transportation Projects will interfere with the timely implementation of TCMs in other areas. Other key assumptions: As noted previously, PIN 5034.98, NY Rt. 5 / US Rt. 20 over Cattaraugus Creek, and PIN 5757.55, Millennium Parkway, are the only non-exempt or regionally significant projects in Chautauqua County. The emission estimates for the no-build and preferred alternatives were based on the vehicle volume and speed for each segment of the affected roadway in Chautauqua County as described in the most recent design reports for these projects dated June 2011 and December 2010, respectively. Consistent with assumptions in the Statewide motor vehicle emissions inventory developed by NYSDEC, the analysis of county-wide VMT uses a seasonal traffic adjustment factor of 1.12 for all facility types considered to experience low seasonal variability and 1.16 for facility types that experience moderate seasonal variability. These seasonal adjustment factors were confirmed to be appropriate by NYSDOT Main Office and Region 5 Planning Staff. The tables in Appendix B provide details of the county-wide seasonally adjusted daily vehicle miles traveled, weighted average daily vehicle speeds by roadway functional class, corresponding emission factors, and the resulting emissions estimates.

Latest Emissions Model EPA officially released the Motor Vehicle Emissions Simulator (MOVES) model for use in conformity determinations and SIP development on March 12, 2010. As part of the release, a two-year grace period was established for use of the MOVES model. Until the grace period expires on March 12, 2012, the previous EPA motor vehicle emissions model, MOBILE6.2, may be used to estimate mobile source emissions in regional emissions analyses. Accordingly, the emission factors used in the regional emissions analysis for Chautauqua County were generated using the EPA motor vehicle emissions model, MOBILE 6.2. The modeling inputs and parameters used to develop the emission factors are the most recent MOBILE 6.2 inputs for Chautauqua County established in consultation with the New York State Department of Environmental Conservation (NYSDEC) and the New York State Air Quality Conformity Interagency Consultation Group (ICG). On June 15, 2011 the ICG concurred that these emission factors may be used for the Chautauqua County emissions analysis. Specific modeling inputs used to develop the emission factors for Chautauqua County are described below: Evaluation Month - The month of July (i.e., summertime conditions) was specified in the input files. Vehicle Registration Age Distribution – Year 2007 vehicle age distribution data was used to all analysis years. Vehicle Mileage Accumulation Rate – The EPA default mileage accumulation rate data were used for all analysis years. I/M Programs - NYSDEC inspection and maintenance (I/M) program data were used in the emission modeling. The NYSDEC file, NYVIPup.d, contains data for the Upstate New York I/M program. This file was used for modeling all analysis years. Anti-Tampering Program – The emissions control equipment anti-tampering program data described in the table below was used to model all analysis years:

Temperature and Humidity - For the summer season, county-specific hourly temperatures and relative humidity levels as verified by NYSDEC in Spring 2009 were used in the modeling. Diesel Sale Fractions - Diesel sale fractions for NYSDOT Region 5 were used in the modeling. Year 2007 diesel sale fractions were used to model all future analysis years. VMT by Hour - County-specific VMT data (allocated by hour of day) as verified by NYSDEC in Spring 2009 were used in the modeling. Low-Emission Vehicle (LEV) Standards: The following files were used to model the effects of implementing California’s LEV I/LEV II programs in New York State:

• L2CERT.d – Specifies the LEV II 50,000-mile certification standards • L2EVAP.d – Specifies the phase-in schedule for the LEV II evaporative emission

standards • L2EXH.d – Specifies the phase-in schedule for the LEV II exhaust emission

standards • LEV2.d – Provides fleet penetration fractions for light-duty gasoline vehicles

under the LEV I/LEV II programs Weighted emissions by vehicle type - The emission factors for each individual vehicle type were weighted according to the NYSDOT Region 5 vehicle distributions by roadway functional class and then summed to obtain composite emission factors. These model inputs include the latest existing and future emissions control programs included in NYSDEC’s statewide mobile source emission inventory, and the latest MOBILE 6.2 input assumptions on characteristics of the existing and future vehicle fleets traveling on Chautauqua County roadways. The MOBILE 6.2 input files used are available by contacting the NYSDOT Environmental Science Bureau. Regional Emissions Analysis Emissions Reduction Test: Since there is no emissions budget established for Chautauqua County, the interim emissions reduction test per 40 CFR Part 93.109(l) is required for this conformity determination. Per 40 CFR Part 93.119(b)(2), a comparison of future emissions with base year 2002, showing that all future emissions remain below 2002 levels, or a demonstration that the emissions burden of the “Build” condition are less than or equal to the “No-Build” condition is required to satisfy the emissions reduction test for “Former Subpart 1” nonattainment areas under the 8-hour ozone standard. This regional emission analysis will demonstrate conformity by passing the “build no greater than no-build test.” Analysis Years: There is no motor vehicle emission budget in place for Chautauqua County, therefore, the analysis years requirements prescribed by 40 CFR Part 93.119(g) apply to the regional emissions analysis. Analysis year 2014 meets requirement that the first analysis year must be no more that five years beyond the year in which the transportation conformity determination is being made. Analysis year 2030 meets the requirement to analyze the last year of the applicable long range transportation plan because the last year of the Statewide Transportation Master Plan is 2030. Since 2035 is the horizon year of the Metropolitan

Transportation Plan for all MPOs in Upstate New York nonattainment areas the year 2035 was also analyzed for informational purposes. Analysis year 2020 meets the requirement that future analysis years be no more than ten years apart. Results: The regional emissions results presented below demonstrate that implementation of the Chautauqua County Capital Program of Transportation Projects will result in lower VOC and NOx emissions than the emissions burdens for both pollutants in the “No-Build” condition in each analysis year. The results of the regional emissions analysis are presented in Table 4 below. Refer to Appendix B for the regional emissions analysis details.

other milestones in any area

Interagency Consultation The 2011-2023 Capital Program of Transportation Projects in Chautauqua County was previously presented to NYSDEC, the U. S. Environmental Protection Agency (EPA), the U. S. Department of Transportation=s involved agencies: the Federal Highway Administration (FHWA) and Federal Transit Administration (FTA). This Interagency Consultation Group (ICG) reviewed the Capital Program and concurred with the proposed exempt or non-exempt air quality classification for each project on June 20, 2011. This draft conformity narrative and regional emissions analysis have undergone interagency review. Public Participation & Review In accordance with the EPA transportation conformity requirements, as well as the procedures for public participation in NYSDOT Region 5, this air quality conformity determination was subject to public review from August 24 to September 23, 2011. No comments were received on the draft conformity determination and supporting documentation. A copy of the evidence of public notice is included in Appendix C. Conclusions This conformity determination has been conducted in accordance with EPA=s transportation conformity rule, 40 CFR Part 93, especially §93.109(l) which outlines the criteria and procedures for determining conformity of transportation plans, programs, and projects in Aisolated rural non-attainment and maintenance areas.@ The criteria and procedures outlined in the New York State Department of Environmental Conservation=s (NYSDEC) conformity regulation, 6 NYCRR Part 240, have also been followed for this air quality conformity determination. The NYSDEC regulation outlines the details of the interagency consultation and public participation process being followed in New York State. NYSDOT has determined that conformity of the 2011-2023 Chautauqua County Capital Program of Transportation Projects with the New York State Implementation Plan for Air Quality (SIP) has been demonstrated in accordance with 40 CFR Parts 51 and 93 and 6 NYCRR Part 240.
