NEWS

The Supreme Court on Wednesday accepted an undertaking given by property developer DLF Ltd to pay the remainder of a

penalty imposed by the antitrust regulator in instalments. On 28 November, the apex court had directed the real estate com-

pany to pay the Competition Commission of India (CCI)-imposed penalty in a staggered manner through instalments of

Rs.75 crore each month. DLF was to give an undertaking to the effect. The first instalment is due on 15 January. DLF has

already deposited Rs.150 crore with the court out of the Rs.630 crore penalty levied by the antitrust watchdog in 2011. The

penalty is being deposited with the court registry. A bench of justices S.K. Mukhopadhaya and N.V. Ramana will hear the

case on 11 February. The main issue to be decided, judge Mukhopadhaya said, is whether the CCI had the jurisdiction to

hear the case or if it should have gone to the consumer forum. The case is an appeal against a decision of the Competition

Appellate Tribunal (Compat) which upheld a CCI ruling that DLF had abused its dominant position in relation to its agree-

ments with buyers of three Gurgaon projects—the Belaire, Magnolia and Park Place.
