Minutes of Meeting

The Board of Professional Engineers and Professional Land Surveyors held a regular meeting on January 28 & 29, 2016 at the Board Office, 1510 E. Watertower St., Ste. 110, Meridian, ID 83642 to conduct Board business. The meeting convened at 8:00 a.m. (MST) on Thursday, January 28, 2016 with the following Board members present: John Elle, George Murgel, David Bennion, Glenn Bennett, George Wagner, Dusty Obermayer and Raymond Watkins. Also present was Keith Simila, Executive Director and Jim Szatkowski, Deputy Director, Jennifer Rowe, Administrative and Mike Kane, Board Attorney.

I. READING OF MINUTES

1. Meeting Minutes for the November 5 & 6, 2015 meeting.

2. Meeting Minutes for the December 1, 2015 teleconference meeting. Moved by Dr. Murgel, seconded by Mr. Wagner to approve the minutes from the November 5 & 6, 2015 meeting and the December 1, 2015 meeting as distributed. Motion passed unanimously. II. REVIEW AND APPROVAL OF CONSENT AGENDA 1. Voluntary license retirement requests were received from Chris Allison, William

Gordon Eisinger, Dan Frank, Kerry J. Gaul, Gerald William Spencer, Scott Lane Basolo and a voluntary license surrender in lieu of discipline was received from William Baird McNaught.

2. The state mileage reimbursement rate changed from 55.5 to 54 cents per mile effective January 1, 2016.

3. Gary Briant, PLS retired his license earlier this month and submitted a note to the Board.

2. Subcommittee Updates

a. Item Writing (Mr. Elle, Mr. Bennett and Mr. Obermayer): The subcommittee is up to date on questions for the exam. The subcommittee will review the State Specific exam for any necessary changes due to recent law and rule changes. The subcommittee completed new items for the item bank and will forward those to Mr. Simila.

b. Surveying FAQ (Frequently Asked Questions) Page Subcommittee (Mr.

Obermayer, Mr. Bennett and Mr. Elle): The subcommittee reviews changes to the surveying laws and assists staff with updating the Surveying FAQ web page. Mr. Bennett and Mr. Elle are working with Mr. Szatkowski to keep the FAQ current. There are no updates needed at this time.

c. QBS Subcommittee (Mr. Wagner, Mr. Bennett and Me. Elle): The

subcommittee will study whether sub consultant services should be procured using QBS and whether a change in the law for the definition of “agent” will accomplish this. This matter was continued.

VI. CONSIDERATION OF DISCIPLINARY MATTERS FY11.11 Erickson, Chad, Standard of Care. This docket has been extended

indefinitely. Dr. Murgel is acting Chair for this item as Mr. Elle is recused. Moved by Dr. Murgel, seconded by Mr. Bennion to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). Roll call vote results; Mr. Bennett, yes; Mr. Wagner, yes; Dr. Murgel, yes; Mr. Bennion, yes; Mr. Watkins, yes and Mr. Obermayer, yes. After meeting in executive session, the Chairman directed the Board to return to regular session. Moved by Mr. Bennion, seconded by Mr. Bennett to dismiss counterclaim citing no jurisdiction. Motion passed unanimously with Mr. Elle recused. Moved by Mr. Wagner, seconded by Mr. Obermayer to deny motion to dismiss. Motion passed unanimously with Mr. Elle recused. Moved by Mr. Watkins, seconded by Mr. Bennion to grant order compelling discovery with provision to strike date line and add ability for Attorney Kane to hold a scheduling conference. Motion passed unanimously, with Mr. Elle recused. Moved by Mr. Bennett, seconded by Mr. Bennion to assign Attorney Kane to set up and conduct a pre-trial scheduling conference. Motion passed unanimously with Mr. Elle recused.

Mr. Elle returned to Chair the remainder of the meeting. V. CONSIDERATION OF APPLICATIONS NON-STANDARD – COMITY Mr. Ronald L. Schmidt joined the meeting to discuss his application for Professional Engineer by comity. Moved by Mr. Wagner, seconded by Mr. Watkins to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). Roll call vote results; Mr. Bennett, yes; Mr. Wagner, yes; Dr. Murgel, yes; Mr. Bennion, yes; Mr. Watkins, yes; Mr. Elle, yes and Mr. Obermayer, yes. After meeting in executive session, the Chairman directed the Board to return to regular session. Moved by Mr. Bennion, seconded by Dr. Murgel to continue the application of Ronald L. Schmidt for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his license in Montana pending additional documentation. Motion passed unanimously. VI. CONSIDERATION OF DISCIPLINARY MATTERS FY15.04 Meckel Engineering & Surveying. An individual raised an issue regarding

Meckel Engineering and Surveying’s business practices on a project in Sagle, ID. This docket has been extended indefinitely.

FY15.06 Edwards, Et. Al. – ROPR. This docket has been extended indefinitely.

Mr. Elle has been assigned to the investigative team for this docket. FY15.20 Engineer A & Engineering Company A, ROPR.

Moved by Mr. Wagner, seconded by Mr. Obermayer to dismiss this matter as unfounded. Motion passed unanimously. FY15.21 Gallea, Brian, ROPR. A signed Stipulation and Consent Order was

received for the Board’s review. Moved by Dr. Murgel, seconded by Mr. Bennett to accept Stipulation and Consent Order. Motion passed unanimously. FY16.01 Engineering Company A, ROPR. This matter was continued. FY16.02 Herbst, Amy, ROPR Moved by Dr. Murgel, seconded by Mr. Wagner to dismiss this matter as unfounded. Motion passed unanimously.

FY16.03 Wellington, Steven Charles, ROPR. This matter was continued. FY16.04 Ketcham, C.H. Pete, ROPR. This matter was continued. FY16.05 Thomason, Kenneth L., Violation of ROPR. Moved by Dr. Murgel, seconded by Mr. Bennett to dismiss this matter as de minimis. Motion passed unanimously. III. UNFINISHED BUSINESS 5. Mr. Simila presented talking points on mediation. Moved by Mr. Bennett, seconded by Mr. Obermayer to approve talking points as revised. Motion passed unanimously. IV. NEW BUSINESS 14. Negotiated rule change proposals for 2017. Faculty licensure discussion will be

continued to the March meeting so that Larry Stauffer of U of I can join the discussion.

Moved by Mr. Bennett, seconded by Mr. Obermayer to approve electronic filing and storage of survey documents rule as well as talking points for distribution. Motion passed unanimously. Moved by Dr. Murgel, seconded by Mr. Bennett to distribute the Authoritative Surveying Mapping rule suggestions to ISPLS for comments. Motion passed with Mr. Wagner voting against the motion. Moved by Dr. Murgel, seconded by Mr. Bennion to amend draft survey education rule to include cartography as a course option for related science degrees. Motion passed unanimously. 17a. Questions for the Board: Is it a conflict of interest for engineers or surveyors to

compete for grant money on behalf of a jurisdiction as the city engineer/surveyor and then perform the work once the grant is received? Board determined that this is not a conflict of interest.

17d. Questions for the Board: Is GIS collection of data considered “authoritative” if it

is used to locate utilities? The Board has determined that there is not enough information to decide if the non-authoritative exemption under the definition of land surveying applies.

24. Mr. Simila updated the Board on the legislative session. Moved by Mr. Bennion, seconded by Dr. Murgel to authorize Mike Kane to negotiate changes and provide analysis to the civil penalty law proposal as part of this legislative proposal. Motion passed unanimously.

21. Mike Kane sent a letter to the Office of Performance Evaluations about Hearing Officers.

Moved by Mr. Wagner, seconded by Mr. Bennion to authorize Mike Kane to testify on behalf of the Board and to relay the Board’s concerns as written in the Hearing Officer Report letter. Motion passed unanimously.

20. The Department of Labor would like access to our database information to aid in an educational study of engineers and surveyors.

Moved by Dr. Murgel, seconded by Mr. Bennion to authorize the Executive Director to sign the MOU when presented. Motion passed unanimously. Attorney Kane left the meeting.

III. UNFINISHED BUSINESS 2. Subcommittee Updates

d. Survey Program Evaluation: (Mr. Bennett and Mr. Obermayer): The subcommittee will evaluate the survey programs and courses at Great Basin College and the University of Wyoming. The evaluation is ongoing and will be continued to the next meeting.

4. Staff provided an update on the progress of online applications and COA

renewals. The Board noted the information. IV. NEW BUSINESS

1. Reports by Board Members and Staff of activities since the November meeting. Mr. Bennett attended the ISPLS Board of Governors meeting as well as chapter meetings; worked on Idaho state specific test questions; responded to phone questions and participated as a judge for NCEES in the Future Cities competition. Dr. Murgel attended a FE Exam Cut Score committee meeting; attended a FE Exam Writing committee meeting and attended an EPE committee meeting. Mr. Elle participated in the QBS subcommittee discussions; attended ISPLS chapter meetings and worked on disciplinary matters. Mr. Watkins responded to phone questions. Mr. Simila attended the ISPLS Board of Governors meeting; attended

an ISPE chapter meeting; attended the NCEES MBA meeting in Florida and attended ACEC-Idaho meetings. Mr. Obermayer worked on Idaho state specific test questions, responded to phone questions; attended the ISPLS Annual Conference subcommittee meeting and worked on evaluating the University of Wyoming surveying program.

2. Staff provided an update on the Board’s financial status as of December 31, 2015.

The Board noted the information. 3. Staff prepared an Expense Reimbursement Summary for the Executive Director

for October 16, 2015 through December 31, 2015 for the Board’s review. Moved by Mr. Wagner, seconded by Dr. Murgel to approve the expense summary as presented. Motion passed unanimously. 4. An individual requested that the Board refund his late fee. Moved by Mr. Bennion, seconded by Dr. Murgel to refund this individual’s late fee. Motion passed unanimously with Mr. Watkins and Mr. Wagner recused. 5. An individual requested that the Board review his CPD and allow some of his

teaching for credit as it is not a requirement of his job. Moved by Mr. Watkins, seconded by Mr. Bennett to deny CPD credits for teaching. Motion passed unanimously. 6. Changes were made to the EAC ABET Criteria. The Board noted the

information. 7. Email notices that the Board Newsletter was available online were sent to all

licensees that had email addresses on file. The responses were favorable. The Board noted the information.

V. • Ali Ghamkar for licensure as a professional engineer especially qualified in electrical engineering on the basis of comity with his licensure in Colorado.

• Syed Khaia Haneefuddin for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his licensure in Texas.

• Keith Kosar for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his licensure in California.

• Thomas A. Rice for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his licensure in Canada.

Motion passed unanimously. Moved by Mr. Bennion, seconded by Dr. Murgel to continue the application of Jack A. Butler for licensure as a professional land surveyor on the basis of comity with his license in Missouri pending additional information. Motion passed unanimously. IV. NEW BUSINESS 22. Ed Snyder met with the Board to discuss a request for waiver of the CPD

requirement. Mr. Snyder joined the meeting at 10:00 a.m. on January 29th. Moved by Mr. Elle, seconded by Mr. Bennion to enter into executive session to consider records that are exempt from disclosure as provided for by Idaho Code 74-206(1)(d). Roll call vote results; Mr. Bennett, yes; Mr. Wagner, yes; Dr. Murgel, yes; Mr. Elle, yes; Mr. Bennion, yes; Mr. Watkins, yes and Mr. Obermayer, yes. After meeting in executive session, the Chairman directed the Board to return to regular session. Mr. Snyder left the meeting. 17b. Questions for the Board: Clarification on when monuments for easements are

needed. Joe Canning and Tim Fox joined the meeting to discuss this matter.

Moved by Mr. Bennion, seconded by Dr. Murgel to delegate to the surveyors on the Board writing a clarification to the monumentation requirements for easements and lease areas and respond to ACHD’s letter. The response will be posted on the website and facebook as well. Motion passed unanimously. Mr. Canning and Mr. Fox left the meeting.

22. Ed Snyder met with the Board to discuss a request for waiver of the CPD requirement.

Moved by Mr. Bennion, seconded by Dr. Murgel to continue this matter and request further documentation of completion of CPD requirements. Motion passed unanimously.

V. CONSIDERATION OF APPLICATIONS NON-STANDARD – COMITY Moved by Dr. Murgel, seconded by Mr. Bennett to continue the application of James Byron John Ford for licensure as a professional engineer especially qualified in electrical engineering on the basis of comity with his license in Washington pending additional documentation. Motion passed unanimously. Moved by Mr. Bennion, seconded by Mr. Bennett to deny the application of Bishnujee Singh for licensure as a professional engineer especially qualified in mechanical engineering on the basis of comity with his license in the United Kingdom. Motion passed unanimously. Moved by Dr. Murgel, seconded by Mr. Bennett to continue the application of Robert L. Walden for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his license in Alaska pending additional documentation. Motion passed unanimously. Moved by Mr. Bennion, seconded by Dr. Murgel to continue the application of Ronald L. Schmidt for licensure as a professional engineer especially qualified in civil engineering on the basis of comity with his license in Montana pending additional documentation. Motion passed unanimously. NON-STANDARD – EXAM Moved by Mr. Bennett, seconded by Dr. Murgel to assign Ana Maria Arango Rodriguez to the Principles and Practice of Engineering examination, environmental discipline. Motion passed unanimously with Mr. Bennion abstained. Moved by Mr. Wagner, seconded by Mr. Bennett to deny assignment of David Evan Weeks to the Principles and Practice of Engineering examination, civil discipline. Motion passed unanimously with Dr. Murgel abstained. NON-STANDARD – ENGINEER INTERN Moved by Dr. Murgel, seconded by Mr. Wagner to approve issuance of an Engineer Intern certificate to Sayonsom Chanda based on his passage of the FE exam. Motion passed unanimously. IV. NEW BUSINESS 26. Staff asked if the Board considers a ‘D’ a passing grade.

Moved by Dr. Murgel, seconded by Mr. Watkins to determine that a ‘D’ is not a passing grade for purpose of college credits needed for examination failures or additional education necessary for examination or licensure. Motion passed unanimously. 19. Would the Board consider an archeology degree as a related science degree in

respect to meeting the survey education requirements? Moved by Mr. Bennett, seconded by Dr. Murgel to approve this as a related science degree with an additional course in physics or biology with a lab and calculus 1 or other approved mathematics course. Motion passed unanimously. Dr. Murgel left the meeting. 16. Does the Board want to send the Executive Director and the Surveyors to the

ISPLS conference to present law/rule changes? Moved by Mr. Bennett, seconded by Mr. Watkins to send Mr. Bennett, Mr. Obermayer, Mr. Elle and Mr. Simila to the ISPLS conference. Motion passed unanimously. 13. Law changes proposals for 2017. Moved by Mr. Wagner, seconded by Mr. Watkins to delegate finalization of the draft of revisions to 55-1902 to the surveyors for distribution. Motion passed unanimously. 8. Why is a PE stamp needed on an as-built drawing set? Moved by Mr. Bennion, seconded by Mr. Watkins to respond to Mr. Walker and suggest we discuss as a Board at the ISPE meeting in June. Motion passed unanimously. 9. A license holder requested an exemption from the CPD requirements due to

extenuating circumstances. Moved by Mr. Wagner, seconded by Mr. Bennett to deny request for waiver due to extenuating circumstances. Motion passed unanimously. 10. An individual submitted a question about PE experience requirements. Moved by Mr. Bennion, seconded by Mr. Bennett to respond that documented work on engineering projects will be credited toward experience and non-engineering education and work experience will not. Motion passed unanimously. 11. The NCEES 2016 Awards Nominations need to be submitted by January 31,

2016. Moved by Mr. Wagner, seconded by Mr. Bennion to nominate Dr. Murgel for the NCEES Distinguished Service Award. Motion passed unanimously.

12. The NCEES Western Zone meeting will be held in Anchorage, AK May 19-21,

2016. The Board noted the information. 15. Budget passback from the Governor’s Office. The Board noted the information. 17a. Questions for the Board: With the change in the definition of surveying, when a

surveyor writes a legal description, does it require a field survey? Moved by Mr. Bennett, seconded by Mr. Watkins to direct Mr. Obermayer to respond to this individual. Motion passed unanimously. 17c. Questions for the Board: Cody McGammon email question – are both lot and

block numbers necessary on a Plat?

Moved by Mr. Bennett, seconded by Mr. Obermayer to respond that yes, lot and block numbers are required. Motion passed unanimously.

17f. Questions for the Board: If a surveyor completes a new CP&F, do the instrument

numbers of both the new CP&F and the one just previous to this both need to be on the record of survey?

Moved by Mr. Bennett, seconded by Mr. Obermayer to present this issue at the ISPLS conference to evaluate the clarity of the statute change. If clarification needed, delegate to the surveyor’s on the Board to write a clarifying opinion for the next news bulletin. Motion passed unanimously. 18. An individual requested that his $100 renewal fee be refunded since he does not

practice in Idaho. Moved by Mr. Bennett, seconded by Mr. Bennion to deny the refund of his renewal fee. Motion passed unanimously. 23. An individual is required under 54-1214(3) to submit evidence of having

completed an additional eight (8) semester credits of college level academic education relating to the examination. He submitted some courses to see if the Board will accept them towards this requirement.

Moved by Mr. Wagner, seconded by Mr. Bennett to require this individual to submit upper level engineering courses related to the examination. Motion passed unanimously. 25. A question came in from ITD asking if SWPP plans (Storm Water Pollution

Prevention) require a PE seal and signature, especially since they are often modified during construction by the contractor?

Moved by Mr. Wagner, seconded by Mr. Obermayer to respond that SWPP Plans that contain engineering work are required to be signed and sealed by an Idaho PE for all projects physically located in Idaho. Motion passed unanimously. 17g. Questions for the Board: Mr. Obermayer received an email question from Scott

Rasor. Mr. Obermayer will respond to Mr. Rasor’s question. The Board noted the issuance of professional engineer licenses to the following individuals since the last meeting of the Board.
