involved in investigating claims of gender-based discrimination and harassment.

Ms. Shipper's curriculum vitae is attached as Exhibit 1.

Ms. Shipper is expected to offer opinions in this case regarding whether the

conduct of the Pepperdine employees charged with investigating and responding to

the claim of harassment and discrimination by the plaintiffs was reasonable. Her

opinions and the bases therefor will be included in her written report to be produced

at the time agreed upon by counsel in this case.

Ms. Shipper charges $275 per hour for providing deposition testimony.

2. Mark Levy, M.D./Ronald Roberts, Ph.D., Forensic Psychiatric

Associates Medical Corporation, 655 Redwood Highway, Suite 271, Mill Valley,

CA 94941.

Dr. Levy is a Board Certified Psychiatrist whose curriculum vitae is attached

as Exhibit 2. Dr. Roberts is a Board Certified Forensic Psychologist whose

curriculum vitae is attached as Exhibit 3.

Drs. Levy and Roberts are expected to offer opinions regarding the natt.~re,

extent and cause of any of the emotional damages being claimed by the plaintiffs in

this case. Their opinions and the bases therefor will be included in their written

report to be produced at the time agreed upon by counsel in this case.

Dr. Levy and Dr. Roberts charge $700 per hour and $600 per hour,

respectively, for providing deposition testimony.

3. Richard J. Mouw, Ph.D., Fuller Theological Seminary, Pasadena, CA.

Dr. Mouw is a professor of Christian philosophy and ethics. His curriculum

vitae is attached as Exhibit 4.

Dr. Mouw is expected to opine on how areligiously-affiliated institution of

higher education supports all of its community, including LGBTQ+ students, faculty

and staff, in a manner that is consistent with and reflects the religious mission and

heritage of that institution. These issues include, but are not limited to, how

Pepperdine University, as an independent, private Christian university, can adhere to

certain Biblical principles while serving, including and supporting with dignity and

respect in all manners and aspects students who identify as LGBTQ+ and whether it

did so in the time frame relevant to this litigation.

Dr. Mouw charges $350 per hour for providing deposition testimony.

4. Chris Schoemann, Bond, Schoeneck &King, 7500 College Blvd., Suite

~ 910, Overland Park, KS 66210.

Mr. Schoemann is a Compliance Consultant in the Collegiate Sports practice

group of Bond Schoeneck &King and has expertise with regard to NCAA

compliance issues. Prior to joining the fine in December, 2000, he was a member

of the NCAA legislative services staff for five years and then served as the Director

of Compliance at the University of Minnesota for four years. Mr. Schoemann

obtained his M.ED. from Springfield College in 1989.

Mr. Schoemann is expected to testify with regard to whether there were

legitimate and reasonable bases for Pepperdine's handling of various issues

involving the plaintiffs that related to NCAA rules and regulations. These issues

include, but may not be limited to stipend issues, NCAA year-in-residency waiver,

the purpose and use of NCAA publications including, but not limited to the

"Champions of Respect" publication, NCAA mandatory drug testing and banned

substances, academic integrity issues and clearance to play issues. Mr. Schoemann

i) is also expected to testify regarding the plaintiffs' alleged damages to the extent that

they are impacted by whether the plaintiffs could have been eligible to play

basketball and receive a scholarship after they left Pepperdine. Mr. Schoemann's

opinions and the bases therefor will be included in his written report to be produced

at the time agreed upon by counsel in this case.

Mr. Schoemann charges $285 per hour for providing deposition testimony.

Dr. Luna is an economist in the accounting and litigation services firm of

White, Zuckerman, Warsaysky, Luna &Hunt, LLP. Her resume and list of

published articles are attached as Exhibit 5.

Dr. Luna is expected to testify regarding the value and cause of the economic

damages alleged by the plaintiffs including, but not limited to issues involving

educational and living expenses and lost earnings. Dr. Luna's opinions and the

bases therefor will be included in her written report to be produced at the time

agreed upon by counsel in this case.

Dr. Luna charges $495 per hour for deposition testimony.

6. Sourav Poddar, M.D., Associate Professor, Family Medicine,

University of Colorado, Denver, CO.

Dr. Poddar is the Director of Primary Care Sports Medicine and the Team

Doctor and Medical Director for the University of Colorado Buffaloes. His

curriculum vitae and list of articles published are attached as Exhibit 6.

Dr. Poddar is expected to testify regarding whether there were reasonable and

legitimate reasons for the manner in which the plaintiffs' medical conditions,

injuries and decisions while student athletes at Pepperdine were handled and made

by Pepperdine's athletic training staff and team physician. The issues expected to

be addressed by Dr. Poddar include, but are not limited to, the need for the medical

information and documentation requested by Karissa Schemer and the training staff,

the importance of following certain procedures within the athletic training facility,

and the decisions regarding clearing or not clearing the plaintiffs for practice and

play during their tenure at Pepperdine. Dr. Poddar's opinions and the bases therefor

will be included in his written report to be produced at the time agreed upon by

counsel in this case.

Dr. Poddar charges $900 per hour for deposition testimony.

7. M. Dianne Murphy, Ph.D., Senior Partner, The PICTOR Group,

Dr. Murphy was the Athletic Director at the University of Denver from 1998

to 2004 and at Columbia University from 2004-2015. She also coached collegiate

women's basketball for 13 years. Her profile is attached as Exhibit 7.

Dr. Murphy is expected to testify regarding whether there were reasonable

and legitimate reasons for the manner in which the Pepperdine coaching staff and

~ administration handled the situations that arose with the plaintiffs, and specifically

the issues as set forth in the Third Amended Complaint and in discovery in this

litigation. The issues on which she is expected to offer opinions include, but are not

limited to, the coaches' handling of complaints or concerns addressed by the

plaintiffs' teammates, including asking players if the plaintiffs were dating, the

treatment by and interactions with Pepperdine's athletic training staff, concerns

raised by the plaintiffs regarding the academic adviser, Layana White's request for a

waiver of the year-in-residency requirement, team disciplinary measures,

Pepperdine's handling of the plaintiffs' departure from the Pepperdine women's

basketball team including what effects, if any, that had regarding their scholarships,

and clearance to play issues. Dr. Murphy is also expected to testify regarding

statistics relating to salaries earned by professional women basketball players in the

WNBA, the average longevity of those players and whether the plaintiffs possessed

the skill and qualities to be successful professional players.

Dr. Murphy's opinions and the bases therefor will be included in her written

report to be produced at the time agreed upon by counsel in this case.

Dr. Murphy charges $400 per hour for deposition testimony.

1. Brian Barrio

Mr. Barrio is expected to offer opinion testimony regarding the reasonable

bases for Pepperdine's handling of: (1) Layana White's request for a waiver of the

NCAA year-in-residency requirement; (2) concerns raised by Adi Conlogue that the

of the fact that a stipend check issued to Haley Videckis was deposited by her twice;

and (4) other issues relating to compliance that may become relevant at the trial in

this matter (See Brian Barrio's deposition testimony for the general bases for his

opinions). Mr. Barrio's opinions are based on his experience as the Director of

Compliance for several colleges and universities and his current position as Senior

Associate Athletics Director at the University of Nevada, Reno.

2. Ryan Weisenberg

Mr. Weisenberg is expected to offer opinion testimony regarding the plaintiffs

not possessing sufficient skill and qualities to be successful professional basketball

players. His opinions are based on his experience as a coach in the WNBA and for

other professional teams and college teams, and his familiarity with the professional

opportunities available to women collegiate basketball players.

3. Jordan Smith

Ms. Smith is expected to offer opinion testimony regarding the plaintiffs not

possessing sufficient skill and qualities to be successful professional basketball

players. Her opinions are based on her experience as a collegiate basketball coach,

as a player in the WNBA and her familiarity with the professional opportunities

available to women collegiate basketball players.

4. Trisha Raniewicz

Ms. Raniewicz is expected to offer opinion testimony regarding the plaintiffs

(not possessing sufficient skill and qualities to be successful professional basketball

players. Her opinions are based on her experience as a collegiate basketball coach

and her familiarity with the professional opportunities available to women collegiate

basketball players.

8. Tabatha Jones Jolivet

Dr. Jones Jolivet is expected to offer opinion testimony as to the bases for her

conclusions that there was not sufficient evidence to support a finding of

harassment, discrimination and retaliation based on sexual orientation, including but

not limited to opinions based on her training as a social scientist in oppression

theory and other relevant theories.

9. Mark Davis

Dr. Davis is expected to offer opinion testimony as to how a Christian

educational institution such as Pepperdine can adhere to a particular Biblical view of

homosexuality and still treat its students who identify as LGBTQ+ with dignity and

respect as well other relevant issues that may arise at trial with regard to handling

concerns of college students regarding LGBTQ+issues.

10. Kevin Wright

Mr. Wright is expected to offer opinion testimony as to the reasonableness of

the requests made of the plaintiffs by Karissa Schemer for plaintiffs' medical records

and Ms. Schemer's handling of concerns raised by the plaintiffs in this litigation.

Dr. Green is expected to offer opinion testimony regarding whether there

were reasonable and legitimate reasons for the manner in which the plaintiffs'

medical conditions, injuries and decisions while student athletes at Pepperdine were

handled and made by Pepperdine's athletic training staff. The issues expected to be

~ addressed by Dr. Green include, but are not limited to, the need for the medical

.information and documentation requested by Karissa Schemer and the training staff,

the importance of following certain procedures within the athletic training facility,

and the decisions regarding clearing or not clearing the plainriffs for practice and

play during their tenure at Pepperdine. Dr. Green's opinions are based on his

education, training and experience as a medical doctor specializing in sports

medicine, his knowledge of what is required and requested by doctors when

assessing whether a player should be cleared to play and what the NCAA requires

and requests with regard to medications taken by student athletes.
