ordinance, is hereby amended by amending the Lakeside Planned UnitDevelopment Design Standards Section a. Intent, as follows:

a. IntentThe purpose of this zone is to create a PUD for a mix housing type

multi-family development. The use of the PUD zone is to allow for moreflexible design standards while creating a higher quality and more sensitiveproposal. The PUD requires that the development demonstrate a higherquality of architectural standards and site design. Ancillary uses may bepermitted as listed below once a primary use has occupied the site. Exceptas modified by the Lakeside PUD ordinance, the development shall complywith the requirements of the R-16 High Density Residential District.

Section 2. Chapter 20 of the Chanhassen City Code, the City’s zoningordinance, is hereby amended by amending the Lakeside Planned UnitDevelopment Design Standards Section b. Permitted Uses, as follows:

b. Permitted UsesThe permitted uses in this zone shall be twin homes, townhouses, and

three one condominium buildings and their ancillary uses. If there is aquestion as to whether or not a use meets the definition, the PlanningDirector shall make that interpretation. The type of uses to be providedon common areas shall be low-intensity neighborhood-oriented accessorystructures to meet daily needs of residents. Such uses may include a busshelter, community building, development signage, fountain, garden,gazebo, maintenance shed, picnic shelter, pool, playground equipment ortennis courts.

Section 3. Chapter 20 of the Chanhassen City Code, the City’s zoningordinance, is hereby amended by amending the Lakeside Planned UnitDevelopment Design Standards Section c. Setbacks, as follows:

c. SetbacksThe PUD ordinance requires setbacks from roadways and exterior

property lines. The following table displays those setbacks.

#Decks, patios, porches, and stoops may project up to seven (7) feet into the required yard.

*The entire development, including the public and private streets andOutlots, may not exceed 50 percent hard coverage. Individual lots willexceed the 50 percent site coverage.

A 1987 Amendment to theFederal Clean Water Act requiredimplementation of a two-phasecomprehensive national program toreduce pollution from storm waterrunoff. A National PollutantDischarge Elimination System(NPDES) permit from theMinnesota Pollution ControlAgency (MPCA) is required as partof this program. The permitidentifies a number of measures thatmust be met or implemented by eachcommunity. The six minimummeasures are:

The City’s Storm WaterPollution Prevention Program(SWPPP) specifies bestmanagement practices intended tosatisfy the permit requirements foreach of the minimum measures. Aspart of this program, the City isrequired to hold an annual meetingto encourage public discussion andparticipation regarding its stormwater quality and steps it is takingto address the six minimum controlmeasures. A copy of the SWPPP isavailable by contacting the CityEngineer. An annual SWPPP reportwill be submitted to the MPCA inJune 2010.

The meeting will be held as partof the regular city council meetingat City Hall. The agenda for thismeeting will include:

1) A presentation aboutimplementation of the City’sSurface Water Pollution PreventionProgram in 2009,

2) Affording interested personsthe opportunity to make oralstatements concerning the StormWater Pollution PreventionProgram,

Under Minn. Stat. §§ 435.193 to435.195, the Council may, in itsdiscretion, defer the payment of thisspecial assessment for anyhomestead property owned by aperson 65 years of age or older forwho it would be a hardship to makethe payments. When deferment ofthe special assessment has beengranted and is terminated for anyreason provided in that law, allamounts accumulated plusapplicable interest become due. Anyassessed property owner meetingthe requirements of this law andthe ordinance (resolution) adoptedunder it may, within 30 days of theconfirmation of the assessment,apply to the city clerk for theprescribed form for such deferral ofpayment of this special assessmenton his property.
