As part of this program, the City is required to hold an annual meeting to encourage public discussion and participation regarding its storm water quality and steps it is taking to address the six minimum control measures. A copy of the SWPPP is available by contacting the City Engineer. An annual SWPPP report will be submitted to the MPCA in June 2010. The meeting will be held as part of the regular city council meeting at City Hall. The goal is to preserve open space, protect wetlands and retain existing vegetation through the efficient/ shared use of land, transitional and buffer landscapes. All future lots that are developed are to be reviewed based upon the development use and standards listed below. The Neighborhood Business District regulations shall apply except as modified by this ordinance. All submittals are to consist of: Architectural site plan Rendered building elevations Material board Grading and utility plans to conform to current city standards in effect when the proposed new development is submitted for review. Landscape plan to conform to the city landscape ordinance and these standards. Color rendering/photo- composite images of the new work proposed as seen from Highway 5 midpoint along the wetland in Outlot A, the intersection of Highway 5 and Galpin and the intersection of Galpin and West 78th Street. Three total. Mutual access, cross easements and maintenance agreements are required of all property owners. If discrepancies arise between the PUD and other sections of the city ordinances, the stated PUD shall govern for a period of up to two years after the final plat approval for Galpin Business Park. An owner may appeal an assessment to district court pursuant to Minn. Stat. § 429.081 by serving notice of the appeal upon the mayor or clerk of the City within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the mayor or clerk. Under Minn. Stat. §§ 435.193 to 435.195, the Council may, in its discretion, defer the payment of this special assessment for any homestead property owned by a person 65 years of age or older for who it would be a hardship to make the payments. When deferment of the special assessment has been granted and is terminated for any reason provided in that law, all amounts accumulated plus applicable interest become due. Any assessed property owner meeting the requirements of this law and the ordinance (resolution) adopted under it may, within 30 days of the confirmation of the assessment, apply to the city clerk for the prescribed form for such deferral of payment of this special assessment on his property. Notice is hereby given that theCity Council of Victoria will meet atCity Hall at 6:30 p.m. on Monday,May 24, 2010, to conduct a publicmeeting to encourage publicdiscussion and participationregarding its storm water qualityand Storm Water PollutionPrevention Program.

A 1987 Amendment to theFederal Clean Water Act requiredimplementation of a two-phasecomprehensive national program toreduce pollution from storm waterrunoff. A National PollutantDischarge Elimination System(NPDES) permit from theMinnesota Pollution ControlAgency (MPCA) is required as partof this program. The permitidentifies a number of measures thatmust be met or implemented by eachcommunity. The six minimummeasures are:

Public Education and OutreachPublic Involvement and

ParticipationIllicit Discharge Detection and

EliminationConstruction Site Storm Water

ControlsPost-Construction Storm Water

Management for development andredevelopment

Pollution Prevention/GoodHousekeeping for MunicipalOperations

The City’s Storm WaterPollution Prevention Program(SWPPP) specifies bestmanagement practices intended tosatisfy the permit requirements foreach of the minimum measures. Aspart of this program, the City isrequired to hold an annual meetingto encourage public discussion andparticipation regarding its stormwater quality and steps it is takingto address the six minimum controlmeasures. A copy of the SWPPP isavailable by contacting the CityEngineer. An annual SWPPP reportwill be submitted to the MPCA inJune 2010.

The meeting will be held as partof the regular city council meetingat City Hall. The agenda for thismeeting will include:

1) A presentation aboutimplementation of the City’sSurface Water Pollution PreventionProgram in 2009,

2) Affording interested personsthe opportunity to make oralstatements concerning the StormWater Pollution PreventionProgram,

3) Consideration of relevantwritten materials that interestedpersons submit concerning theStorm Water Pollution PreventionProgram; and,

Under Minn. Stat. §§ 435.193 to435.195, the Council may, in itsdiscretion, defer the payment of thisspecial assessment for anyhomestead property owned by aperson 65 years of age or older forwho it would be a hardship to makethe payments. When deferment ofthe special assessment has beengranted and is terminated for anyreason provided in that law, allamounts accumulated plusapplicable interest become due. Anyassessed property owner meetingthe requirements of this law andthe ordinance (resolution) adoptedunder it may, within 30 days of theconfirmation of the assessment,apply to the city clerk for theprescribed form for such deferral ofpayment of this special assessmenton his property.
