CALL TO ORDER
Pursuant to Section 15(h), Rule IV of the Rules of the House, Senior Deputy Majority Leader Jesus Crispin C. Remulla called the session to order at 3:00 p.m. of Monday, September 14, 2020.
INVOCATION AND NATIONAL ANTHEM
Rep. Ruth Mariano-Hernandez delivered the invocation via Zoom videoconferencing. Thereafter, the Members sang the National Anthem.

The day being a Monday, on motion of Rep. Kristine Singson-Meehan, there being no objection, the Chair declared a Privilege Hour.
Thereafter, on motion of Representative Singson-Meehan, the Chair recognized Rep. Arlene D. Brosas to deliver her privilege speech via Zoom videoconferencing.
PRIVILEGE SPEECH OF REPRESENTATIVE BROSAS
Representative Brosas criticized President Rodrigo Roa Duterte’s recent decision in granting absolute pardon to US Marine LCpl Joseph Scott Pemberton. She said that as the decision was met by many as very upsetting, the subsequent release and return to the United States of Mr. Pemberton was distressing and offensive because it showed that the government failed to bring justice to his victim, Jennifer Laude, and other comfort women like her who had suffered the same fate. She believed that Mr. Pemberton’s release finally manifested President Duterte’s deceitful threat to end the Philippines-US Visiting Forces Agreement, which was disguised as an independent foreign policy.
Representative Brosas then condemned what she considered as the President’s betrayal of people’s trust; and stated that together with the masses, Gabriela Women’s Party will continue to fight for justice, genuine democracy, and national sovereignty, and against foreign military intervention.
REFERRAL OF PRIVILEGE SPEECH OF REPRESENTATIVE BROSAS
On motion of Representative Delos Santos, there being no objection, the Body referred the privilege speech of Representative Brosas to the Committee on Rules for its appropriate action.
On a subsequent motion of Representative Delos Santos, the Chair recognized Rep. Jose L. Atienza Jr. in the Zoom videoconference, for his privilege speech.
PRIVILEGE SPEECH OF REPRESENTATIVE ATIENZA
Representative Atienza talked about the ongoing controversy involving the Manila Bay white sand project being carried out by the Department of

Environment and Natural Resources. He first recalled the clean waters and beautiful shoreline of the Manila Bay many years back; and maintained that over time, it has been neglected and abused by some people.
Thereafter, he discussed the writ of continuing mandamus issued by the Supreme Court to continue the cleanup and rehabilitation of Manila Bay’s waters; and opined that said mandamus does not include the beautification of Manila Bay. He stated that President Duterte’s directive, in compliance with the Supreme Court decision, was for DENR Secretary Roy A. Cimatu to oversee the cleaning of the Manila Bay; and pointed out that beautification and cleaning are two different things.
Representative Atienza adverted to the issue regarding the failure of the Manila Water Company, Inc. and Maynilad Water Services, Inc. to provide the wastewater treatment facility despite charging consumers for environmental fee and borrowing money from financial institutions with sovereign guarantee. He then stressed that while he agrees with the beautification of the Manila Bay, he stated that he would contradict such effort if it comes before the commitment to clean up the bay.
On motion of Representative Singson-Meehan, the Chair recognized Rep. Carlos Isagani T. Zarate for his interpellation.
INTERPELLATION OF REPRESENTATIVE ZARATE
Representative Zarate discussed with Representative Atienza the issues on the use of dolomite sand in relation to the cleanup of Manila Bay, and its hazards; the compliance of the “beach nourishment” project with environmental regulations; and whether the budget allocation for the DENR is being used appropriately.
Representative Zarate said that during the DENR presentation in the budget briefing, it was revealed that the “beach nourishment” project was not even part of the Manila Bay master plan. He then asked Representative Atienza about the unfulfilled duty of the two water companies to provide wastewater treatment facilities and the total environmental fees being collected by these concessionaires from the consumers.
Representative Atienza forewarned about the renewal of the concessionaires’ contracts and said that they should be required to submit a report on actual environmental fees collection and be obliged
to comply with the agreement to install wastewater treatment facilities.
Lastly, on Representative Zarate’s suggestion for a conduct of a special audit by the Commission on Audit of these special funds, Representative Atienza fully subscribed to the idea and called on Speaker Alan Peter “Compañero” S. Cayetano to support the efforts to investigate the matter and to bring justice to the people who have been paying for environmental fees but are getting nothing in return. He suggested that the collection must be stopped to end the people’s suffering from the hands of unscrupulous big corporations.

Narciso R. Bravo Jr., chairperson of the Committee on Public Order and Safety and one of the authors of the Bill, to sponsor the measure.
SPONSORSHIP SPEECH OF REPRESENTATIVE BRAVO
Representative Bravo highlighted the importance of the Bureau of Fire Protection as the lead agency in-charge of fire suppression operations and in helping the public through its various services, such as emergency medical services, hazardous materials protection, and technical search and rescue services notwithstanding the inadequacy in its manpower complement and firefighting equipment. He said that despite said deficiencies and given the appropriate training of its personnel, the BFP manages to deliver its mandated functions and even expanded its scope of responsibility to include disaster management and preparedness, emergency response, and rescue operations.
He pointed out that its latest challenge was the new coronavirus or COVID-19 pandemic in view of which it became part of the Joint Task Force Coronavirus Shield that was tasked to implement guidelines and protocols to control the transmission of the virus. He said that, among other activities, the bureau is assisting in monitoring checkpoints and providing security for the Emergency Subsidy Program of the Department of Social Welfare and Development.
Thereupon, Representative Bravo focused on House Bill No. 7406 and explained how it strengthens the mandates of the BFP and institutionalizes the latter’s response to all kinds of disaster and emergency. He also discussed the following components of the BFP modernization program under the measure: fire protection service; capability, material, and technology development; and human resources development.
Thereafter, Representative Bravo urged his colleagues to support the passage of the Bill.

PRIVILEGE SPEECH OF REPRESENTATIVE BAUTISTA
Representative Bautista spoke in behalf of public transportation drivers and commuters, the backbone of the country’s transportation system and the economy, who may have been overlooked in the midst of the pandemic.
She presented the following concerns: the current lack of public transport to match the demand of commuters; the health risks that commuters have to bear as they are forced to endure long lines under the heat of the sun or rain and at risk of catching the dreaded virus; the number of stranded workers at present as compared to pre-COVID-19; and how public transportation can increase the rate of COVID-19 infection.
Representative Bautista then called for an immediate increase in the number of permitted public utility vehicles or PUVs and in the operational capacity for rail transportation, with strict observance of proper health protocols. She added that by allowing more public transport vehicles to ply the roads, drivers will regain their jobs thus having a stable source of income for their families, instead of waiting for donations or assistance; and would mean less exposure for commuters queueing in long lines.
Moreover, Representative Bautista maintained that the proposal of allowing more PUVs is one way to jumpstart the economy. She however called on the drivers and commuters not to be complacent in observing health protocols.
Representative Bautista then reiterated her appeal to allow the public transport sector to be part of the great effort of rebuilding the nation.
MANIFESTATION OF REPRESENTATIVE DELOS SANTOS
Recognized by the Chair upon motion of Representative Singson-Meehan, Rep. Alfred C. Delos Santos expressed his support to Representative Bautista’s call for additional PUVs as the transport sector has been paralyzed and has greatly affected the drivers since the start of the community lockdown. As he believed in the link between transportation and the economy, Representative Delos Santos stated that raising the quality of life of drivers and of public mass transportation will revitalize the economy.
On motion of Representative Singson-Meehan, the Chair next recognized Rep. Sharon S. Garin for a manifestation through Zoom videoconferencing.

Representative Garin likewise manifested her support to Representative Bautista’s call for

Representative Co commended Representative Bautista and manifested her support to the latter in addressing the issue of lack of transportation as commuters are the ones suffering from the problem. She maintained that additional transportation can facilitate better physical distancing among commuters.

INTERPELLATION OF REPRESENTATIVE GARIN (J.)
Representatives Garin and Bautista exchanged views on the equal importance of both public health and livelihood amidst the pandemic; the real condition of public transport drivers and transport operations with reduced vehicle capacity; and the practice and proper implementation of health and safety protocols inside PUVs. Representative Bautista explained that some jeepney drivers whom she met said that they would prefer to operate even with less vehicle capacity than have no income at all.
Both Members agreed that in order to move forward, Filipinos should work together; learn to adapt to the “new normal” and coexist with the virus and not just idly wait for the vaccine; and allow people to continue with their livelihood without compromising the health and safety of everyone.

“AN ACT IMPOSING VALUE-ADDED TAX ON DIGITAL TRANSACTIONS IN THE PHILIPPINES AMENDING FOR THE PURPOSE SECTIONS 105, 108, 109, 110, 113, 114, AND 236 AND ADDING A NEW SECTION 105-A OF THE NATIONAL INTERNAL REVENUE CODE OF 1997, AS AMENDED.”

Representative Bondoc stated that the Bill was in the period of sponsorship and debate, and on his motion, the Chair recognized Rep. Joey Sarte Salceda, chairperson of the Committee on Ways and Means, to sponsor the measure.
SPONSORSHIP SPEECH OF REPRESENTATIVE SALCEDA
Representative Salceda stated that House Bill No. 7425 aims to fuel the government by imposing tax on digital transactions and urged its passage because the measure also seeks (1) to tax big businesses who are unfairly raking huge money without paying taxes and not to impoverish small online sellers who are provided with safety nets through other tax laws; (2) to level the playing fi eld between traditional and digital businesses and maintain the integrity of the tax system; (3) to share the benefi ts of the fl ourishing digital economy; and (4) to enable the government to tap this new source of revenue.
He explained that the measure had been altered to conform with current global practices, thus focusing on the value-added tax rather than income tax. He stated that as Speaker Alan Peter “Compañero” S. Cayetano instructed the Committee on Ways and Means to fi nd ways to fund new stimulus packages, the Bill is part of the fi rst installment of the eff orts to help the country in recovering more quickly, meaningfully, and broadly from the adverse impact of the COVID-19 pandemic. Thereafter, he sought for the immediate passage of the Bill.

MANIFESTATION OF DEPUTY SPEAKER VILLANUEVA (E.)
On motion of Representative Bondoc, the Chair recognized in the Zoom videoconference, Deputy Speaker Eduardo “Bro. Eddie” C. Villanueva who thanked his colleagues for giving him the opportunity to explain his vote to House Bill No. 7575.
Thereafter, he relayed to everyone that he was scheduled to interpellate during the period of sponsorship and debate, but the chairperson of the Committee on Economic Aff airs had prevailed upon him to instead submit his proposed amendments for the improvement of the Bill. However, he said that probably due to some technical problems, his amendments were not properly addressed.

Deputy Speaker Villanueva also explained that he was prepared to explain his vote during the consideration of the Bill on Third Reading the previous day, but noticed that his name was removed from his computer screen which he said could be attributed to technical issues. Nonetheless, he thanked Majority Leader Ferdinand Martin G. Romualdez for the chance to explain his vote.
He then expressed disappointment for not being able to participate and be heard during the consideration of House Bill No. 7575 which he stated was very close to his heart as it will greatly aff ect Bulacan Province. He asked that his manifestation be inserted as his explanation of vote to the said Bill.
As a loyal son of the great Province of Bulacan, he stressed that he will seek and support any eff ort that will protect and promote the best interest of the Bulakenyos; but pointed out that development should be holistic such that it must be measured not only in terms of promised jobs, economic growth, and even increased revenues.
Deputy Speaker Villanueva opined that the Bill is one-sided in its quest for development because it did not refl ect his proposed amendments which sought to expressly prohibit the conduct and operation of any form and kind of gambling and thus mirror a kind of economic development devoid of any immorality and apostasy. He then pointed out that the measure is silent on gambling; and added that while it will improve the economy, it will also open the country, especially the Bulacan community, to the damaging eff ects and moral ails – such as reduced familial stability, indebtedness, money laundering, prostitution, and proliferation of drugs and crimes – that may be brought about by gambling.
He also asked why measures are being passed despite complete disregard of God’s precepts and in defi ance of His commands. He stated that the religious groups in Bulacan and in the whole country are ready to oppose the Bill even through public assembly.
In closing, Deputy Speaker Villanueva maintained that the Bill carries with it a poison that would kill the values, moral sensitivities, families, and even domestic businesses in Bulacan, and thereafter cast his negative vote on House Bill No. 7575.

Thereupon, on motion of Representative Singson-Meehan, there being no objection, the Body resumed the consideration on Second Reading of House Bill No. 7425 contained in Committee Report No. 426 as submitted by the Committee on Ways and Means, entitled:
“AN ACT IMPOSING VALUE-ADDED TAX ON DIGITAL TRANSACTIONS IN THE PHILIPPINES AMENDING FOR THE PURPOSE SECTIONS 105, 108, 109, 110, 113, 114, AND 236 AND ADDING A NEW SECTION 105-A OF THE NATIONAL INTERNAL REVENUE CODE OF 1997, AS AMENDED.”
Representative Singson-Meehan stated that the parliamentary status was that the Bill was in the period of sponsorship and debate and thereafter, on her further motion, the Chair recognized Rep. Sharon S. Garin to sponsor the measure.
SPONSORSHIP REMARKS OF REPRESENTATIVES GARIN (S.)
Representative Garin stated that current tax laws do not fi t in the growing digital economy and that House Bill No. 7425 which seeks to impose VAT on digital transactions would address the same.
She thereafter explained the proposal’s intent to (1) reduce the burden for taxpayers by simplifying payment without compromising accountability; (2) generate revenues from both local and foreign sources; (3) provide a clear-cut process in treating digital service providers; and (4) provide regulatory power for the government over digital businesses, and thus give consumers a sense of security, considering that most digital transactions are unregulated.
Representative Garin further pointed out that the Bill would ensure a healthier competition between traditional and digital businesses; enhance the tax administration system of the country; encompass entities that were otherwise outside of regulatory jurisdiction and thus provide for additional revenue; and evolve the country’s tax system to be at par with new technologies and innovations.
