(c) Require the original dealer to cool oysters to an internaltemperature of 50°F (10°C) or below within 10 hours or less asdetermined by the Authority after placement into refrigerationduring periods when the risk of Vibrio parahaemolyticus illnessis reasonably likely to occur. The dealer’s HACCP Plan shallinclude controls necessary to ensure, document and verify thatthe internal temperature of oysters has reached 50°F (10°C) orbelow within 10 or less as determined by the Authority hoursof being placed into refrigeration. Oysters without properHACCP records demonstrating compliance with this coolingrequirement shall be diverted to PHP or labeled “for shuckingonly”, or other means to allow the hazard to be addressed byfurther processing.

Virginia has 123 Shellstock Shippers 82 SS are Boat Operations.

All VA certifications are issued for no longer than 12 months in accordance with the NSSP and expire October 30 of each year.

As part of Division of Shellfish Sanitation’s Vp management plan VA

implemented regulations restricting harvest for shellfish taken during

the months of May through September.

From June 15 through August 31, it shall be unlawful, for any person or person aboard a vessel, to harvest oysters, from public or private grounds, after 10 a.m., and oysters harvested before 10 a.m. shall be offloaded and placed in VDH Division of Shellfish Sanitation-approved mechanical refrigeration or storage containers, with ice, by 10 a.m. that same day.

Shellstock Shipper Boat Operators currently are allowed to harvest oysters and sell the same day of harvest to predetermined markets.

These operations will be certified from October 1 until April 30 and will not be able to sell shellstock wholesale but have to sell to a dealer who

can refrigerate the shellstock.

Certified dealers who have adequate refrigeration will continue to be certified from October through September. We will not allow ice to be

used as a means of refrigeration.
