The Arizona Legislature looked into theissue o parking regulation in plannedcommunities during its 2012 session. Thebill was to prohibit homeowner associationsrom regulating public roadways that areowned by a government entity. Yet again,however, the issue ell by the way-side, withno new legislation produced on the subject.While parking issues in general are neverreally o the radar or most associations,one particular acet o the discussion iso ten overlookedspecifcally, A.R.S. 33-1809 and the regulation o parkingpublic service and public sa ety vehicles.A.R.S. 33-1809 provides that,
notwithstanding any provision in thecommunity documents, an associationshall not prohibit a resident rom parkinga motor vehicle on a street or drivewayin the planned community under certainconditions, which are broken down intotwo categories: (1) public service vehiclesand (2) public sa ety vehicles. In orderor a particular resident and a particularvehicle to all within the protections o thisstatute, the resident and vehicle must meetall o the qualifcations listed in one o thetwo categories. Please re er to the statuteor more specifcs on the qualifcations.
