Comments are not taken on this determination.A single-family residence is planned on a 0.958-acre Conservation District property, with a total of 2,265 square feet of living area, lānai, carport, and porch, with a 3,000-gallon water tank. Other features include a driveway, solar panels, a water well, and an individual wastewater system. The structure has been sited and designed to minimize impact to existing sight lines from the Red Road to the sea. A hedge bordering the property will be trimmed to four feet or shorter. The home is setback from the shoreline a minimum of 73 feet in order to avoid the effects of waves, sea spray and potential future erosion. Landclearing over less than a quarter-acre would produce short-term impacts to noise, air and water quality, and scenery, mitigated by Best Management Practices. The vegetation has been repeatedly disturbed in the past and is now primarily non-native, with no rare, threatened or endangered plants. Impacts to the islandwide-ranging endangered Hawaiian hoary bat and Hawaiian hawk will be avoided through vegetation removal timing. An archaeological survey determined that two sites were present, both of them low-stacked livestock walls. Although not required to be preserved, they will remain on the property as-is.

The County selected MANA through an RFP process for a renewable energy and sludge drying solution. MANA will install an anaerobic digester and associated appurtenances onsite to digest energy crops grown on former Hawaiian Commercial & Sugar plantation lands and sourced locally from Central Maui Feedstocks, LLC. The product of the anaerobic digestion process is re-newable methane (biogas) that is treated on site and used to fuel a combined heat and power (CHP) engine for electrical power generation. Waste heat from the CHP with additional biogas will provide the required heat for the drying of all the municipally generated wastewater biosolids produced on Maui. The Project is not designed to export electrical energy to the grid. All energy crops will be grown on existing agricultural land. The Project goals are to provide locally sourced renewable energy to assist the County of Maui in achieving its renewable goals and to provide a long term sustainable solution for biosolids management.

The Department of Education proposes to construct a three-level locker room building to address Title IX gender equity require-ments, correct space issues in the existing P.E. building, comply with Americans with Disabilities Act accessibility requirements, and provide support facilities at the athletic field. The existing P.E. Locker Room Building is shared by boys and girls P.E. classes and athletic teams. The new building will provide a dedicated girls P.E. locker room and associated facilities. In conjunction with the new building, the existing P.E. building will be renovated and the existing girls locker room dedicated for use by girls athlet-ic teams. Utility rooms will be located on the ground floor, girls P.E. facilities on the second floor, and a judo/wrestling room and weight training facility on the third floor. Access to all floors will be provided by an elevator. The project also proposes constructing a concession stand and restroom facilities at the athletic field. An elevator will be installed at the back of the cafeteria to access the athletic field. The elevator will be installed adjoining a stairway to the athletic field. The cost of the project is estimated at $14.391 million and will be funded by the State of Hawai‘i. Construction is projected to commence in early to mid-2018 with completion in 18 months.

The Department of Education (DOE) is proposing to build a new middle school in East Kapolei, named East Kapolei Middle School (EKMS). EKMS will be located on an 18-acre parcel dedicated to the DOE. The parcel is vacant and bound by Keahumoa Parkway on the south, Maunakapu Street on the west, and Maweke Street on the east. The proposed action involves the construction of six buildings organized around a central commons area with provisions for future classroom buildings. In addition to the school buildings and central commons areas, the campus includes physical education areas consisting of a covered play court, an open play court, and two play fields sized to accommodate soccer and softball. The school will be designed for an enrollment of 1,050 students with plans for expansion to accommodate an additional 350 students in the future. The site design includes provisions for the future construction of one additional House (House No.4) and five portable classrooms that will allow enroll-ment to increase to 1,400 students. In total, the school is expected to accommodate 1,520 students and staff.

Comments are not taken on this action.Kalaeloa Barbers Point Harbor (KBPH) is the second busiest commercial harbor in the state. KBPH serves as the primary ‘bulk’ harbor for liquid-bulk (i.e., petroleum products, biofuels and asphalt) and dry-bulk (i.e., coal, cement, sand and aggregate) cargos. The purpose of the Proposed Action is to add berthing, yard space and other infrastructure to optimize operational efficiencies at KBPH. Separating liquid- from dry-bulk cargo transfers that currently occur at Piers 5 and 6 will improve efficien-cy and enhance safety. The Proposed Action will create a dedicated Fuel Pier at Piers 3 and 4, adding 1,325 lineal feet of berth space with industry-standard infrastructure to modernize the facility. Fuel Pier development will displace an existing tenant from Pier 3, and will require demolition of a Finger Pier used for harbor support vessels. Relocation of the tenant to the Pier 9 area and construction of a pier for support vessels at Pier 8 are proposed as part of the Proposed Action. Additional improve-ments to optimize the harbor include construction of the Pier 7 Extension and the Pier 10 Layberth, and to provide supporting infrastructure on fastlands for tenant use.

Comments are not taken on this determination.Public safety and preserving public access to the shoreline is the primary objective of this project. The Doris Duke Foundation for Islamic Art is proposing to dismantle most of the Diamond Head Breakwater from a former boat basin fronting its museum of Islamic art, culture and design (known as “Shangri La”) to increase public safety along the shoreline. High risk activities—such as diving and jumping from the top of the shoreline walkway and the Diamond Head Breakwater into shallow water, particu-larly during low tide—result in serious injuries. Dismantling most of the Diamond Head Breakwater will decrease high risk ac-tivities. This proposed action will result in increased wave action along the concrete seawall fronting the basin. Boulders from the breakwater will be used to reinforce the concrete seawall along the shoreline and form a more natural configuration con-sisting of a rocky coastline similar to surrounding areas by the basin. The public will continue to be able to enjoy access the shoreline.

The United States Department of the Navy (DoN) proposes to replace an existing primary water transmission main that supplies potable, fire protection, and industrial water from its Waiawa Pump Station to Joint Base Pearl Harbor-Hickam (JBPHH). The Proposed Action would replace the existing transmission main with an approximately 2.7-mi long, 42-in diameter water main providing the same capacity. It would extend from the DoN’s Waiawa Pump Station, along Waihona Street and Kamehameha Highway, through the University of Hawaiʻi’s Oʻahu Urban Garden Center to a connection point near the Lehua Avenue-Second Street intersection. Secondary lines/laterals would also be installed to replace existing service to the DoN’s Mānana Housing Area and Hawaiʻi Army National Guard Armory. The project purpose is to provide adequate infrastructure to supply the required water service from Waiawa Pump Station to JBPHH and military family housing areas. The project is needed because the exist-ing line provides infrastructure for JBPHH operations and mission support activities and—at over 60 years old—has reached the end of its reliable service life.

Agency ActionsAny department, office, board, or commission of the state or county government which is part of the executive branch of that government per HRS 343-2.

Applicant ActionsAny person who, pursuant to statute, ordinance, or rule, requests approval for a proposed action per HRS 343-2.

Draft Environmental AssessmentWhen an Agency or Applicant proposes an action that triggers HRS 343, an Environmental Assessment shall be prepared at the earliest practicable time to determine whether the actions’ environmental impact will be sig-nificant, and thus whether an environmental impact statement shall be required per HRS 343-5(b), for Agency actions and HRS 343-5(e), for Applicant actions. For actions for which the proposing or approving agency anticipates a Finding of No Significant Impact (AFNSI), a Draft EA (DEA) shall be made available for public review and comment for 30 days and public notice is published in this periodic bulletin.

Final Environmental Assessment and Find-ing of No Significant ImpactThe Agency shall respond in writing to comments on a DEA received during the 30-day review period and prepare a Final EA (FEA) that includes those responses to deter-mine whether an environmental impact statement shall be required. If there are no significant impacts, then the Agency will issue a Finding of No Significant Impact (FONSI). An Environmental Impact Statement (EIS) will not be required and the project has cleared HRS 343 requirements. The public has 30 days from the notice of a FONSI in this bulletin to ask a court to require the preparation of an EIS.

Final Environmental Assessment and Envi-ronmental Impact Statement Preparation NoticeAn EIS shall be required if the Agency finds that the proposed action may have a significant effect on the environment. The Agency shall file notice of such deter-mination with OEQC, called an EIS Preparation Notice (EISPN) along with the supporting Final EA. After the notice of the FEA-EISPN is published in this bulletin, the public has 30 days to request to become a consulted party and make written comments. The public (including the Applicant) has 60 days from the notice of the EISPN in this bulletin to ask a court to not require the prepara-tion of an EIS.

Act 172-2012, Direct-to-EIS, Environmental Impact Statement Preparation Notice (with no EA)Act 172 in 2012 amended HRS 343 by providing for an agency to bypass the preparation of an environmental assessment for various actions that in the experience of the agency would clearly require the preparation of an EIS. Until administrative rules have been drafted, the agency must submit its determination that an EIS is re-quired for an action (Act 172-2012, EISPN) with a com-pleted OEQC publication form detailing the specifics of the action to enable the public a 30-day period to request to be consulted parties in the preparation of the Draft EIS. Comments and responses on the EISPN must be incorporated into the subsequent Draft EIS.

Act 312-2012, Secondary Actions in the Highway or Public Right Of WayAct 312-2012, amended HRS 343, by adding a new section (HRS 343-5.5., entitled “Exception to applicability of chapter.”) HEPA now allows for a statutory exception for “secondary actions” (those that involve infrastructure in the highway or public right-of-way) provided that the permit or approval of the related “primary action” (those outside of the highway or public-right-of-way and on private property) is not subject to discretionary consent and further provided that the applicant for the primary action submits documentation from the appropriate agency confirming that no further discretional approvals are required. An aid to understanding this is to visualize residential driveway improvements in the public right-of-way, versus, retail outlet driveway improvements in the public right-of-way.

Draft Environmental Impact StatementAfter receiving the comments on the EISPN, the Agency or Applicant must prepare a Draft Environmental Impact Statement (DEIS). The content requirements of the DEIS shall contain an explanation of the environmental con-sequences of the proposed action including the direct, indirect and cumulative impacts and their mitigation measures. The public has 45 days from the first publica-tion date in this bulletin to comment on a DEIS. The DEIS must respond to comments received during the EISPN comment period in a point-by-point manner.

Final Environmental Impact StatementAfter considering all public comments filed during the DEIS stage, the Agency or Applicant must prepare a Final EIS (FEIS). The FEIS must respond in a point-by-point manner to all comments from the draft and must be included in the FEIS. See here for style concerns. For Applicant projects, the Approving Agency is authorized to accept the FEIS and must do so within 30-days or the FEIS is accepted as a matter of law. For an Agency project, the Governor or the Mayor (or their designated repre-sentative) is the Accepting Authority, and unlike applicant actions, there is no time limit on the accepting authority reviewing the FEIS. Only after the FEIS is accepted may the project be implemented.

AcceptabilityIf the FEIS is accepted, notice of this action is published in this bulletin. The public has 60 days from the date of notice of acceptance to ask a court to vacate the accep-tance of a FEIS. For Applicant actions, non-acceptance by the Approving Agency is cause for the Applicant to administratively appeal to the Environmental Council. For Agency actions, there is no such administrative appeal. In both instances, the Applicant or the proposing Agency can prepare a revised DEIS after a non-acceptance de-termination.

National Environmental Policy ActThe National Environmental Policy Act (NEPA) requires federal projects to prepare an EA or EIS. In many ways it is similar to Hawaiʻi’s law. Some projects require both a State and Federal EIS and the public comment procedure should be coordinated. OEQC publishes NEPA notices in this bulletin to help keep the public informed of import-ant federal actions.

Conservation DistrictAny use of land in the State Conservation District requires a Conservation District Use Application (CDUA). These applications are reviewed and approved by the Board of Land and Natural Resources. Members of the public may intervene in the permit process. Notices of permit appli-cations are published in this bulletin.

Special Management Area and Shoreline Setback AreaThe Special Management Area (SMA) is along the coast-line of all islands and development in this area is gener-ally regulated by HRS 205A, and county ordinance. A special subset of the SMA that is regulated by HRS 343, is the Shoreline Setback Area. Most development in this area requires a Special Management Permit. This bulle-tin posts notice of these SMA applications to encourage public input.

Shoreline CertificationsState law requires that Hawaiʻi shorelines be surveyed and certified when necessary to clearly establish the shoreline setback from the certified shoreline. The public may participate in the process to help assure accurate regulatory boundaries. Private land owners often petition to have their shoreline certified by the State surveyor prior to construction. This bulletin publishes notice from the Department of Land and Natural Resources of shore-line certification applicants and final certifications or rejections.

Environmental CouncilThe Environmental Council is a 15-member citizen board appointed by the Governor. They serve as a liaison between the Director of OEQC and the general public concerning ecology and environmental quality. The Council makes the rules that govern the Environmental Impact Statement process (HRS 343). Agendas of their regular meetings are posted on the Internet and the public is invited to attend.

Administrative Exemption ListsGovernment agencies must keep a list describing the minor activities they regularly perform that are exempt from the environmental review process. These lists and any amendments shall be submitted to the Council for review and concurrence (HAR 11-200-8(d)). This bulletin will publish an agency’s draft exemption list for public comment prior to Council decision making, as well as notice of the Council’s decision on the list.

Endangered SpeciesThis bulletin is required by HRS 343-3(c), to publish notice of public comment periods or public hearings for Habitat Conservation Plans (HCP), Safe Harbor Agreements (SHA), or Incidental Take Licenses (ITL) under the federal En-dangered Species Act, as well as availability for public inspection of a proposed HCP or SHA, or a proposed ITL (as a part of an HCP or SHA).
