Notice is hereby given of the commencement of the selection process for engineering services at Fort Hays State University for the replacement of two boilers in the central steam plant, as well as modifications to a third boiler. Work also includes replacement of other mechan-ical equipment associated with the steam plant.

Notice to ContractorsElectronic copies of the letting proposals and plans are

available on the KDOT website at https://kdotapp.ks-dot.org/Proposal/Proposal.aspx. The website will allow the contractor to request approval from KDOT to bid as a prime contractor and be included on the “Bid Holders List,” or to be included on the “Non-Bid Holders List” as a subcontractor/supplier. KDOT’s approval is required to

bid as a prime contractor. To bid as a prime contractor, KDOT needs to be notified of the intent to bid no later than the close of business on the Monday preceding the sched-uled letting date. Failure to obtain prior approval to bid as a prime contractor on any projects listed below will be reason to reject your bid. The secretary reserves the right to reject bids that do not comply with all requirements for preparing a bidding proposal as specified in the 2015 edi-tion of the Kansas Department of Transportation Standard Specifications for State Road and Bridge Construction.

Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications

In accordance with Kansas Administrative Regula-tions 28-16-57 through 63, 28-18-1 through 17, 28-18a-1 through 33, 28-16-150 through 154, 28-46-7, and the au-thority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been pre-pared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.

The proposed actions concerning the draft documents are based on staff review, applying the appropriate stan-dards, regulations, and effluent limitations of the state of

Kansas and the Environmental Protection Agency. This facility manufacturers, tests, and overhauls aircraft instruments, helicopter parts, oil coolers, and pumps. A foundry used to cast lead/kirksite is also performed on-site but does not use water and is considered a dry operation. Executive Order 17-01 for Regional Emergencies Conditional and Temporary Relief from Motor

Carrier Rules and RegulationsWHEREAS, K.S.A. 48-925(b) provides that the Governor may issue orders and proclamations which shall have the force and effect of law under subsection (b) of K.S.A. 48-924; andWHEREAS, large grass wildfires have spread across areas of Kansas causing severe damage and loss of life, livestock, and other property, as well as affecting elec-tric, gas, and communications utilities, thereby creating a need for the immediate transportation of large quanti-ties of hay, feed, fencing materials, and other supplies, which require the operation of motor carriers and drivers of commercial motor vehicles for the purposes of provid-ing direct assistance to supplement State and local efforts in the restoration of services and relief in the affected area(s) of the State of Kansas; andWHEREAS, this disaster has caused or threatens to cause an emergency as defined in 49 C.F.R. 390.5, as adopted by K.A.R. 82-4-3f and which has or threatens to interrupt the delivery of essential services or essential supplies or otherwise immediately threatens physical harm or injury to persons, the public welfare and/or substantial damage to property; andWHEREAS, The Kansas Emergency Management Act (K.S.A. 48-924 et seq.) states that the Governor shall be responsible for meeting the dangers to the state and its people from disasters, including fire.NOW, THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, I hereby acknowl-edge a state of emergency exists in Kansas and declare it necessary to assist and expedite all disaster recovery ef-forts. In order to accommodate this need and to provide assistance to the citizens of Kansas in this emergency sit-uation, I hereby order the following:

1. This declaration applies to motor carriers directly participating in relief efforts; and

2. In accordance with Title 49 C.F.R. § 390.23, the re-quirements contained in the Federal Motor Carrier Safety Regulations, Title 49 C.F.R. Parts 390-399 are hereby suspended through the duration of the mo-tor carrier’s assistance in the disaster relief effort not to exceed a period of thirty (30) days from the date of the initial declaration unless the order is rescind-ed or expanded by executive order or concurrent resolution of the legislature; and

3. All other applicable state and federal regulations shall apply to include but not limited to: Title 49 C.F.R. Part 382, Controlled Substances and Alcohol Use and Testing; the Kansas Motor Vehicle Driver’s License Act, K.S.A. 8-234 et. seq. and Title 49 C.F.R. Part 383 Commercial Driver’s License Standards as adopted by the Kansas Uniform Commercial Drivers’ License Act, K.S.A. 8-2,125 et. seq., the fed-eral Minimum Levels of Financial Responsibility (insurance requirements) Title 49 C.F.R. Notice of Hearing on Proposed RegulationA public hearing will be conducted at 9:00 a.m. Tues-

day, May 23, 2017, in Room 509 of the Landon State Office Building, 900 SW Jackson, Topeka, KS 66612 to consider the adoption of an amended administrative regulation.

This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed amendments to the regulation. All interested parties may submit writ-ten comments prior to the hearing to the Board of Emer-gency Medical Services, Room 1031, Landon State Office Building, 900 SW Jackson, Topeka, KS 66612 or by email to [email protected]. All interested parties will be given a reasonable opportunity to present their views orally on the adoption of the proposed amendments to the regu-lation during the hearing. The regulation is being proposed for adoption on a permanent basis. A summary of the proposed regulation follows:

109-2-8. Standards for ground ambulances and equipment, is a current regulation that is being revised to only require equipment and supplies that are re-quired by an ambulance service’s scope of practice and protocols, and minor cleanup to language. K.A.R. 109-2-8(l), K.A.R. 109-2-8(m), K.A.R. 109-2-8(n), K.A.R. 109-2-8(o), K.A.R. 109-2-8(p).

There will be no anticipated economic impact to the Kansas Board of Emergency Medical Services associated with this regulatory revision. There will be no econom-ic impact on other governmental agencies, private busi-ness, or individuals with this regulatory revision.

SENATE BILL No. 43AN ACT concerning elections; dealing with vacancies in the office of

United States representative to congress; amending K.S.A. 25-3504, as amended by section 2 of 2017 House Bill No. 2017 and 25-3507, as amended by section 3 of 2017 House Bill No. 2017 and repealing the existing sections.

Be it enacted by the Legislature of the State of Kansas:

Section 1. K.S.A. 25-3504, as amended by section 2 of 2017 House Bill No. 2017, is hereby amended to read as follows: 25-3504. (a) When-ever a vacancy has occurred to which this act applies, except in cas-es where K.S.A. 25-3503(b) or (c), and amendments thereto, applies, a congressional district convention of the district party of each political party that has obtained official recognition shall be called by the state chairperson of the party, or if there is no state chairperson, by the par-ty’s candidate for governor at the next preceding general election. The convention shall be called for a date not less than 15 days and not more than 25 days after the proclamation of election is issued by the governor in the cases to which K.S.A. 25-3503, and amendments thereto, does not apply, and within 15 days in cases to which K.S.A. 25-3503(a) or (b), and amendments thereto, apply. In accordance with the rules of the district party and the provisions of this act, each convention shall nominate a candidate to fill the vacancy which has occurred and shall file a certif-icate of the nomination with the secretary of state immediately. Every certificate shall be signed by the presiding officer and secretary of the convention making the nomination. Independent candidates may be nominated by petition of registered voters of the district equal in num-ber to not less than 3,000 qualified voters electors of the congressional district. Such petitions may not be circulated for signatures prior to the governor proclaiming the date of the election. Any such petition shall

be filed with the secretary of state not later than 25 days after the proc-lamation of election is issued by the governor. Except as is provided in K.S.A. 25-3503(b) or (c), and amendments thereto, no candidate shall be nominated to fill such vacancy by any means other than provided by this section.

(b) The amendments made by this act to this section shall be effec-tive on and after January 1, 2017.

Sec. 2. K.S.A. 25-3507, as amended by section 3 of 2017 House Bill No. 2017, is hereby amended to read as follows: 25-3507. (a) In cas-es to which K.S.A. 25-3503(b) or (c), and amendments thereto, apply, The canvass of the election shall be conducted as for other elections of United States congressmen. In all other cases to which this act applies, intermediate canvass of the election shall be made by the county boards of canvassers at 10:00 a.m. on the third day following the election, un-less such day is a Sunday or holiday, in which case the canvass shall be on the next following day which is not a Sunday or holiday pro-vided in K.S.A. 25-3104, and amendments thereto. County election officers shall dispatch the abstract of the intermediate canvass to the secretary of state immediately upon completion of the canvass by the board of county canvassers. The state board of canvassers shall meet in the office of the secretary of state on the sixth third day following the intermediate canvass of the election held in all counties, unless such day is a Sunday or holiday, in which case the canvass shall be on the next following day which is not a Sunday or holiday. The state board of canvassers shall make the final canvass, and the certificate of election of the candidate receiving the highest number of votes shall be issued in the same man-ner as is provided for regular elections of national officers.

(b) The amendments made by this act to this section shall be effec-tive on and after January 1, 2017.

Sec. 3. K.S.A. 25-3504, as amended by section 2 of 2017 House Bill No. 2017 and 25-3507, as amended by section 3 of 2017 House Bill No. 2017 are hereby repealed.

Sec. 4. This act shall take effect and be in force from and after its publication in the Kansas register.

HOUSE BILL No. 2387An Act concerning sales and compensating use tax; exemption for

repairing, rebuilding or replacing certain property destroyed by wildfires; amending K.S.A. 2016 Supp. 79-3606d and repealing the existing section.

Be it enacted by the Legislature of the State of Kansas:

Section 1. K.S.A. 2016 Supp. 79-3606d is hereby amended to read as follows: 79-3606d. (a) The following shall be exempt from the tax imposed by the Kansas retailers’ sales tax act: All sales of tangible per-sonal property and services purchased during calendar year 2016 years 2017 and 2018, necessary to construct, reconstruct, repair or replace any fence which that was damaged or destroyed by fire wildfires occurring during calendar year years 2016 and 2017, and the purpose for which is to enclose land devoted to agricultural use. Sales tax paid on and after January 1, 2016 2017, but prior to the effective date of this act upon the gross receipts received from any such sale shall be refunded. Each claim for a sales tax refund shall be verified and submitted to the direc-tor of taxation upon forms furnished by the director and shall be ac-companied by any additional documentation required by the director. The director shall review each claim and shall refund that amount of sales tax paid as determined under the provisions of this section. All re-funds shall be paid from the sales tax refund fund upon warrants of the director of accounts and reports pursuant to vouchers approved by the director or the director’s designee. Any person reconstructing, repairing or replacing such property, or any person who shall contract for the reconstruc-tion, repair or replacement of any such property shall obtain from the state an exemption certificate for the project involved. The certificate shall be furnished to the person or contractor to purchase materials and lease machinery and equipment for such project. The person or contractor shall furnish the number of such certificate to all suppliers from whom such purchases are made, and such suppliers shall execute invoices covering the same bearing the number of such certificate. Upon completion of the project the contractor shall furnish to the person that obtained the exemption certificate, a sworn statement, on a

form to be provided by the director of taxation, that all purchases so made were entitled to exemption under this subsection.

(b) The provisions of this section shall be deemed to be supplemen-tal to the Kansas retailers’ sales tax act.

Sec. 2. K.S.A. 2016 Supp. 79-3606d is hereby repealed.

Sec. 3. This act shall take effect and be in force from and after its publication in the Kansas register.
