On June 4, 2015, statutes were enacted regarding the use of seclusion and restraint in schools.

These statutes created an Emergency Safety Intervention Task Force to study and review the use of emergency safety interventions; and to prepare a report for the governor and the legislature on its findings and recommendations concerning the use of those interventions.

On July 1, 2016, House Substitute for Senate Bill No. 193, amending the emergency safety intervention statutes, went into effect.

Incident is defined Written statement from medical provider Same day parent notification Written documentation of the incident Flexibility in the delivery form of the required parent information Parent meeting requirements Meeting for student parentally placed in a private school Student attendance at meeting to discuss emergency safety

intervention incident(s) 10 school day requirement when emergency safety intervention

resource officer used seclusion, physical restraint, or mechanical restraint

Data reporting by KSDE

Additional language regarding the use of physical escort and time-out to further clarify that these are not emergency safety interventions.• The following shall not be deemed an emergency safety

intervention, if its use does not otherwise meet the definition of an emergency safety intervention:(1) Physical escort; and(2) time-out.

Previous requirement: Did not include the language underlinedabove.

Proposed regulatory change: At the Kansas State Board of Education’s May meeting, it voted 7-3 to incorporate clarification language related to physical escort and time-out in K.A.R. 91-42-3(h).

KSDE staff will bring these proposed regulations to the State Board as an Action Item at its September meeting. The State Board could then vote to send these proposed regulations through the approval process.

On December 10, 2015 President Obama signed into law the Every Student Succeeds Act (ESSA), which reauthorizes the Elementary and Secondary Education Act of 1965 (ESEA). This latest update, will revise provisions in the No Child Left Behind Act of 2001. The ESSA includes many reforms that return returns flexibility to the state while maintaining accountability for the success of all children.

Who is homeless?•An individual who lacks a fixed, regular, and adequate nighttime residence, including children and youth who are:

Sharing housing due to loss of housing, economic hardship or similar situation Living in motels, hotels, trailer parks, or camping grounds due to lack of alternative

adequate housing. Living in emergency or transitional housing. Abandoned in hospitals. Awaiting foster care. (Until December 10, 2016) Living in cars, parks, public spaces, abandoned buildings, substandard housing, or

bus or train stations. Children and youth who have a primary nighttime residence that is a public or private

place not designed for, or ordinarily used as, regular sleeping accommodations. Migratory children who qualify as homeless because they are living in the

circumstances described above.

Migrant Summer Data• This Summer we offered two more summer opportunities for

migrant students at Fort Hays State and the Cosmosphere, in addition to existing opportunities at Seward County and KU.

• 15 Districts received additional funding through the Migrant Summer Services Grant. (Four more than 2015)

• Please be sure that all migrant funded summer services are accounted for in the Migrant 2 Data System.

• Summer Counts will play a critical role in funding when the new formula goes into effect for 2017-18.

2. The Significance of Your Role• Three requirements for LEA rep:

• Qualified to provide or supervise provision of special education services;• has knowledge of the general education curriculum; and • is knowledgeable about the availability of the school’s resources.

• Primary responsibility is to commit district resources and ensure that the services written in the IEP will be provided.

• District has ultimate responsibility for FAPE.

4. Vote v. Consensus• The IEP team should work toward consensus.• It is not appropriate for an IEP team to make IEP decisions based upon a

majority vote.• If the IEP team cannot reach agreement the LEA representative at the meeting

has the ultimate authority to make a decision and then to provide the parents with appropriate notice and request consent of the proposed action when needed.

5. Placement v. LocationThe LRE mandate demands that students be educated in regular classroom settings, with supports,

to the maximum extent appropriate.

• Placement does not refer to the physical location where services will be provided, rather, it refers to the type of educational environment where the services will be provided.

• Placement is not determined by the name of the building, rather it is the place on the continuum of service environments.

• If the IEP specifies a certain classroom or a certain school, then parent consent would be needed to make a change.

• However, if the IEP refers to the type of educational environment and the LEA has multiple locations where this type of environment is offered, then the LEA may decide which location the student will attend.

• The only placement specified in an IEP should be the educational placement that the IEP team determines meets the student needs.

6. Empower Those Implementing the IEP• Give your staff information and make sure they understand it

• Give everyone responsible for implementing (or supervising the implementation of) the relevant portions of the IEP

• Ensure that everyone responsible for implementing has a full description of their responsibilities• Include teachers and service providers when writing IEP goals• Ensure that your staff understand their responsibilities• Ensure that all staff responsible for implementing an IEP have access to the IEP

• Encourage and empower your staff• Let them know they can ask for help and who to ask• Check with them• Are there obstacles to implementation?

• Don’t forget your paras!• Include paras in professional development

• Support new teachers and long-term substitutes• Use resources (early career special education mentoring (eMSS), Kansas Mentor & Induction Center

(KMIC), and Kansas Educational Leadership Institute (KELI))

7. When to Review an IEP• Review IEPs at least annually

• Important to remember that the annual review requirement is focused on the meeting where the IEP is reviewed, not on the date that services are implemented under a new IEP. Realize that certain dates may raise a red flag for auditors or reviewers.

• Review more often if the student is having problems.• Every reporting period, consider an IEP team meeting for a student not making

progress.• School cannot ignore a clearly failing IEP.

8.Early Childhood Least Restrictive Environment

• For preschool children ages 3-5 with disabilities, placement and LRE requirements are the same as for school-aged children.

• This means that preschool children with disabilities are to have a continuum of placement options available and have the right to be educated with their peers without disabilities to the maximum extent appropriate.

• Most preschoolers benefit from placement in a preschool program with typically developing peers.

9. Help the IEP Team Draft an IEP That is Clear and Unambiguous

• Stranger test• When a team produces an IEP that is not clear, and a controversy arises, the

ambiguity will be construed against the party with the obligation to write an IEP that is clear, which is always the district.

• The IEP is the written document developed by the IEP team. Accordingly, when determining the content of an IEP, the review should be restricted to an examination inside the four corners of the document. Evidence outside of the document, including oral discussions, promises, or compromises may not be considered.
