EXECUTIVE COMMITTEE DISCUSSION AND ACTION ITEMS

OCTOBER 8, 2015

Paul Anthony called the meeting to order at 4:03 p.m. at Employers' Training Resource, 1600 East Belle Terrace, Bakersfield, CA 93307.

Members Present: Paul Anthony, Les Clark, Deborah Hess, Teresa Hitchcock, Karen King, George Lartigue, Michael Rock, John Spaulding, and Alissa Thome.

Members Absent: Leo Bautista, Allen Lyda, and Clare Pagnini.

Staff Present: Elaine Basham, Aaron Ellis, Monica Jeffries, Anne Meert, Bill Stevenson, and Lori Castro.

PUBLIC COMMENTS

There were no comments.

NEW WORKFORCE DEVELOPMENT BOARD AND YOUTH COUNCIL MEMBERS

Teresa Hitchcock notified the members that there are new Workforce Development Board Members and Youth Council Members that were nominated and approved by the Board of Supervisors without going to the Executive and Workforce Development Board first. She explained that in an effort to fill the business vacancies on our Workforce Development Board, the Board of Supervisors had found candidates and nominated and approved them. Teresa and Employers' Training Resource (ETR) staff have talked to the Clerk of the Board and this will not continue to happen and that the correct procedure will be followed in the future.

Teresa reviewed the names and business associations of the new member: Keith Wolaridge - Come! Capital & Consulting, Clint Phillips - Walter Mortenson Insurance, Michelle Kehoe - Gazelle Transportation, Tamara Chapman - Johasee Rebar, Laura Barnes - Associated Builders and Contractors and Karen Blake - Hobby Energy.

REVIEW OF BOARD AND COMMITTEE ATTENDANCE

Elaine Basham reminded the Committee of the attendance policy that was drafted last year and presented to this Committee in November 2014 and the Workforce Development Board voted to accept the policy at its December 2014 meeting. Elaine explained that the Youth Council was not informed of the policy until their May 2015 meeting. Therefore, the Program and Business Services Committee, Executive Committee and Workforce Development Board attendance policy is valid for a calendar year but the Youth Council is valid for a program year. Elaine stated that staff can work around two different calendars or it can be discussed at this meeting and/or the Workforce Development Board meeting next week and could be decided to keep everyone on the same calendar - either calendar year or program year.

Elaine then stated that two Workforce Development Board Members had missed the last two Board meetings with unexcused absences. The attendance policy states that the chair of the Executive

Committee will be given the contact information of any individuals that have two consecutive unexcused absences. Elaine said she would meet with Paul Anthony after the meeting to give him the information he needs.

APPROVAL OF THE MAY 7, 2015, EXECUTIVE COMMITTEE MEETING MINUTES

John Spaulding made a motion to approve the proposed agenda for the May 21, 2015, Workforce Investment Board Meeting. Michael Rock seconded the motion. Deborah Hess abstained. The motion carried.

APPROVAL OF THE PROPOSED AGENDA FOR THE OCTOBER 15, 2015, WORKFORCE DEVELOPMENT BOARD MEETING

Michael Rock made a motion to approve the proposed agenda for the October 15, 2015, Workforce Development Board. Deborah Hess seconded the motion. All Ayes. The motion carried.

APPOINTMENTS TO THE WORKFORCE DEVELOPMENT BOARD YOUTH COUNCIL

John Spaulding made a motion to approve to forward the names of potential new Youth Council Members, Todd Yepez, Ngoc Pham, Karen Blake and Veronica Vega, to the Workforce Development Board (WDB) for nomination and appointment consideration. Les Clark seconded the motion. All Ayes. The motion carried.

BOARD MEMBER TRAVEL POLICY

Anne Meert presented Members with a draft travel policy and a recommended travel budget of $4,000. Anne explained that when WDB and Committee members have traveled in the past to trainings or conferences, the costs had been paid by the member' s employer. by the members themselves, or underwritten by Employers' Training Resource using non-Workforce Investment Act monies.

Anne explained that the WDB would approve a travel budget annually. Members requesting cost reimbursement must be in good standing and if they represent an agency that cou ld also benefit from this conference, they must request sponsorship or cost sharing from their employer first. She explained that the initial approval will be sought by the Executive Committee, if time permits due to the meeting schedule or the WDB chairperson. Final approval must be granted by the County Administrative Office and the Kem County Board of Supervisors.

Anne explained that the allowed expenses would follow the County of Kern travel, meals, and lodging policies, which change from time to time, and that documentation of expenses is required. Employers' Training Resource (ETR) will assist in making conference registration and travel arrangements. She also stated that members that attend will be required to provide a report of that training or conference at the next scheduled WDB or Youth Counci l Meeting.

Anne also said that County Counsel is still reviewing the draft policy and she will let the WDB know if there are any changes or additions to what she is presenting.

Several members expressed concern that $4,000 per year did not seem like it would be enough. Anne discussed registration fees for conferences, lodging fees, mileage reimbursement and reminded them that this would be updated yearly. Members decided that they would like to recommend $10,000 as the budget for the first year.

Michael Rock made a motion to approve and recommend the draft Kem, Inyo, Mono Counties Consortium Workforce Development Board and Youth Council Travel Policy and Procedures and a revised annual budget of $10,000 to the full WDB at is October 15, 2015, meeting, subject to any changes adopted by the Board. George Lartigue seconded the motion. All Ayes. The motion carried.

LEGISLATIVE UPDATE AND LOCAL AREA AND BOARD DESIGNATION

Elaine Basham stated that at this time the House in is disarray and the appropriations that she was going to present would likely not be accurate.

Elaine stated that on August 7, 2015, the state granted final approval our application for initial Local Area designation through June 30, 2017 and Local Board certification through June 30, 2016.

WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) UPDATE

Elaine Basham explained to Members that the Clerk of the Board had contacted her and she is working with them on ensuring that Workforce Development Members are designated in the correct categories on the County Website. Elaine stated that once everything looks accurate, she will release an updated list to Members and report on the composition.

Elaine had stated that the composition of the committees and the Youth Council will be discussed at the October 15, 2015, full Workforce Development Board meeting because under WIOA there have been changes. The Youth Council membership will not be required to be posted on the County website.

FOURTH QUARTER BUDGET VS. ACTUAL REPORT

Monica Jeffries updated the Committee on the third quarter Budget vs. Actual report by summarizing the spreadsheet provided in the agenda packet.

COMMITTEE MEMBER COMMENTS

George Lartigue asked if the new Workforce Development Members would be provided a new members orientation. Teresa Hitchcock said she hoped to have that implemented prior to the December 17, 2015, meeting for all new members.

MISCELLANEOUS FILINGS

Members received miscellaneous filings for the fourth quarter enrollment plan vs actual report, grants summary update, and the Kern, Inyo, Mono Workforce Investment Board and Committees' 2015 Meeting Schedule.

WORKFORCE INNOVATION AND OPPORTUNITY ACT UPDATE AND BOARD COMPOSITION

Dear Committee Member:

TRANSITIONING THE 2013-2017 FIVE-YEAR LOCAL PLAN TO WIOA

The California Workforce Development Board (State Board) is currently drafting a unified state plan, combining individual plans for four Core programs under the Workforce Innovation and Opportunity Act (WIOA). The State Board intended to issue the draft WIOA State Plan in October, but at this writing it had not been released. The final approved plan is due to the Department of Labor (DOL) in March 2016, following public forums.

WORKFORCE DEVELOPMENT BOARD {LOCAL BOARD) COMPOSITION

In December 2014, your Local Board chose to retain the existing membership by not removing One-Stop Partners or other non-Business members, and instead adding Business members in order to be in compliance. Also, under the Workforce Investment Act (WIA) all 21 One-Stop Partner programs were required to be represented on the Board with some agency members representing multiple categories. For example, the Employment Development Department represented (1) Wagner-Peyser Employment Services; (2) Unemployment Insurance; (3) Veterans; and (4) Trade Adjustment Assistance. Under WIOA, the only One-Stop Partners mandated to be on the Local Board are Vocational Rehabilitation and Wagner-Peyser Employment Services.

Under WIA, Labor and Community-Based Organizations (CBO) were separate categories and had to have at least two Board members in each category. In 2007, the State of California passed a law requiring Labor represent a minimum of 15 percent of the Local Board.

Under WIOA, Labor, CBOs and Youth organizations are now grouped as "representatives of the workforce within the local area." Labor membership must be 20 percent of the Board unless the Board has CBO or Youth organizations as members. Those non-labor agencies must have

demonstrated experience in addressing the employment needs of those with barriers to employment (e.g., veterans, individuals with disabilities) and organizations with experience addressing the employment needs of Youth. State law still mandates that Labor represent 15 percent of membership. Under WIOA, Labor is a minimum of four members representing labor organizations and joint labor-management apprenticeship programs.

On November 9, 2015, Morgan Clayton resigned from the Board after 15 years of service.

The Board Chair will also bring a Business member name to your committee for removal due to unexcused absences. Board applications were also received for your committee to review.

Under WIA, the Local Board had to have two CBOs, two Education, and two Economic Development members. In May 2015, the Board had an extra WIA member under the CBO and Education categories. Both of those members also represented One-Stop Partner programs for Community Services Block Grant and Perkins Post-Secondary Education. At its October 15, 2015, meeting the Local Board chose to count them under the One-Stop Partner category and Education and CBO, respectively. A third CBO member changed employers and moved to the Business category to replace Phillip Peters.

• Adding one "workforce representative" (i.e. CBO, Labor or Youth provider) to the Board would make the ratio 9:45 = 20%

• A Board size of 45 would be 51.1 % Business • A member from One-Stop Partner Department of Human Services (CalWORKS and

TANF) is pending. Job Corps is not available locally. Mental Health, a former partner, was a non-mandated partner and is currently not on the Board.

We are waiting on guidance from the State on how to locate Second Chance Act grantee(s) to add them as a partner, but not necessarily as a Board member. In order to add One-Stop Partner agencies on the Board, the number of Business and Workforce/Labor/CBO representatives would need to be adjusted accordingly.

Therefore, it is recommended that your Committee discuss your preference for the composition of the Board moving forward, taking into account the Program and Business Services Committee's recommendations, and make a recommendation to the Workforce Development Board.

RECOMMENDATION TO REMOVE A WORKFORCE DEVELOPMENT BOARD MEMBER

Dear Committee Member:

At the Workforce Development Board (Local Board) meeting of December 11, 2014, your Board adopted an Attendance Policy. Per the amended Board Bylaws, the Executive Committee shall routinely review member attendance of Local Board and committee meetings.

Board members who miss two (unexcused) consecutive full Local Board meetings will be considered inactive and subject to removal. After a member is absent and inactive, the Board Chair will contact the member to find out what problems exist and if the member still has an interest in serving on the Local Board. The inactive member will have one more opportunity to attend a meeting. If the member misses a third meeting, the Board Chair will notify the Executive Committee in writing that the inactive member should be considered for removal.

A removal is to be proposed and discussed at an Executive Committee meeting. Then a Recommendation for Removal from the Executive Committee shall be brought before the full Local Board for a discussion and a vote. The member whose removal is being considered shall be invited to present reason(s) why their removal should be reconsidered at both the Executive Committee and full Local Board meetings. Removal from the Board shall require a two-thirds majority and affirmative vote of the Kem, Inyo, and Mono Workforce Development Board at a regularly scheduled meeting, in which a quorum has been established.

The Local Board is appointed by the chief elected official(s) in the local area in accordance with State criteria established under WIA section 1l7(b). Therefore, the Local Board will refer removal recommendations to the Chief Local Elected Official for their review and approval.

Recommendation of Removal

Matthew Cauthron was nominated and accepted as a Board Member in March 2013. He has exhibited an extensive pattern of absence without leave from all Board meetings. The contact information he provided to staff was from his former employer. After attempts by staff to locate a person with current contact information for Mr. Cauthron, staff initiated an Internet search. To date Mr. Cauthron has not responded to RSVP requests for Local Board meetings, and no new contact information has been discovered. His former employer was not able to provide any new contact information. This left the Board Chair unable to contact Mr. Cauthron to see if he wanted to continue to serve on the Local Board, or present himself to explain his absences. In addition to the prior years of absence, Mr. Cauthron has now missed three consecutive WDB meetings in 2015. Under your current Board Bylaws, he is therefore considered inactive and subject to removal from the Board.

Therefore, it is recommended that your Committee make a Recommendation of Removal for Matthew Cauthron to the Workforce Development Board.

REVIEW PROPOSED WORKFORCE DEVELOPMENT BOARD MEMBERS

Dear Committee Member:

The Workforce Development Board (Local Board) Bylaws offer the means to fill vacancies on the Board by allowing your Committee to solicit and review nominations. Both solicited and unsolicited nominations are retained in a pool of member candidates.

After 15 years of exemplary service, Morgan Clayton has submitted his resignation from the Local Board. Along with the removal of a Business member for non-attendance (see prior letter), these two reductions maintains the Board's Business majority, moving it from 54 percent down to 52 percent.

With a new Board size of 44 members the category of "representatives of the workforce within the local area" moves from 17.4 percent up to 18.2 percent. However, that category under the Workforce Innovation and Opportunity Act (WIOA) is mandated at 20 percent of Board size. Therefore, in order to be in compliance, the Board will need to add a minimum of one member from Community-Based Organizations (CBO), Youth agencies or Labor.

Under WIOA, CBOs must have demonstrated experience in addressing the employment needs of those with barriers to employment (e.g., veterans, individuals with disabilities). Youth agencies must have demonstrated experience and expertise in addressing the employment, training, or education needs of eligible youth, including representatives of organizations that serve out-of­school youth.

In the October 8, 2015 packet for your Committee, the letter about new Board and Youth Committee members appointed by the Board of Supervisors, Ms. Karen Blake was inadvertently included, although she was not among the group appointed by the Supervisors at that time.

Ms. Blake is a geologist and the Executive Director of STEMdelivered.org, which she co­founded. She has a personal passion in working with educators and youth in Kern County to develop a technical workforce through Science, Technology, Engineering and Mathematics (STEM) education. She edits a professional journal, has co-authored papers in her field, as well

as founding Rhizome Books which publishes science-based educational products. She is applying as a Community-Based Organization Representative but may also be considered for her work in Youth education. Ms. Blake is nominated by the Kem Economic Development Corporation.

We also have an industry nomination for Labor, Ron James, Operating Engineers Local 12. Mr. James was nominated by the Kem, Inyo and Mono Central Labor Council. Mr. James has been a member of Local 12 for over 37 years. He has worked as a Job Steward, served on the Executive and Advisory Boards, and worked as a Business Representative. He is the District Representative for District 3 and serves as auditor for Local 12. Mr. James is Chairman of the Joint Apprenticeship Committee and is on the Executive Board of the Kern, Inyo and Mono Central Labor Council.

Mr. Christopher Gerry is currently an Administrative Analyst III with the City of Bakersfield, City Manager's Office, Administration Division. He worked for the City of Anaheim in a variety of positions, including Human Resources recruitment and in the Workforce Development Division. He has a doctorate in Human Resource and Workforce Development. He is nominated by the Assistant City Manager and could fill a Local Board slot in the Government and Economic Development category.

Without replacing Business members, your Committee may choose to recommend either the Labor or CBO applicant for the "representatives of the workforce within the local area" in order to bring the Board into compliance at 20 percent. A recommendation to add both would drop the Business majority to 50 percent, and would therefore require seeking a minimum of one new Business member.

Your Committee may also choose to recommend adding the proposed Government applicant. This will not bring the "workforce" membership to 20 percent, but would maintain a Business majority of 51 percent.

Your committee may also choose to recommend all three applicants for Board membership. This would also bring the "workforce" membership into compliance, but would not maintain a Business majority.

Therefore, it is recommended that your Committee review this pool of applicants, and based on your prior discussion about Board composition, make a recommendation for membership to the Board. Depending on your recommendation for the above applicants, your Committee may also need to include a recommendation to recruit additional Business members in order to retain a majority.

LEGISLATIVE UPDATE

Dear Committee Member:

FISCAL YEAR 2016 APPROPRIATIONS

On November 2, 2015, the President signed the Bipartisan Budget Act of 2015. The bill raises the debt ceiling until early 2017 and eliminates about 90 percent of the sequester reductions (from the Budget Control Act of 2011) slated for Federal Fiscal Year (FY) 2016. It also eliminates about 60 percent of the cuts in FYI 7 (the sequester cuts were already slotted to be less in FYI 7, so total funding for non-defense programs in FYI 7 will be roughly the same as in FY16). The bill raises federal post-sequestration caps $80 billion; $50 billion for 2016 and $30 billion for 2017. The bill sets non-defense discretionary funds about 5 percent above Fiscal Years (FY) 2014 and 2015; adjusted for inflation, the FY16 level is about 12 percent below 2010 for non-defense spending.

Now that Congressional appropriators have final budget amounts, they can begin to renegotiate budget line-items in appropriations bills. The initial version of the House bill kept Workforce Innovation and Opportunity (WIOA) formula funding level, at the expense of National Emergency Grant (NEG) funds; NEG is reduced by more than 65 percent. The initial Senate Labor bill would have reduced WIOA funds 5 percent with the NEG level down 9.4 percent. Since both bills are drafted already it may simply take moving funds into lie-items that had been reduced. Final House and Senate bills would then need to be reconciled. If the bills are not all completed by December 11th, then another short term Continuing Resolution(s) would be required.

WORKFORCE I NNOVATION AND OPPORTUNITY ACT (WIOA)

The Departments of Labor and Education released WIOA Notice of Proposed Rulemaking in early April 2015 although the Act called for January 18, 2015. Final regulations are supposed to be issued January 22, 2016; however, its currently rumored they may actually be issued in February.

The purpose of the NF JP is to strengthen the ability of eligible Migrant and Seasonal Farmworkers and their families to achieve economic self-sufficiency.

The Adult Program is designed to provide quality employment and training services to assist eligible Individuals in finding and qualifying for meaningful employment, and to help employers find the skilled worlters they need to com"""e and succeed In business

A year-<ound youth program emphasizes attainment of basic skills competencies, enhances opportuntttes for academic and occupational training, and provides exposure to the job market and employment.

The Dislocated Worker Program is designed to provide qualrty employment and training services to assist eligible individuals in finding and qualifying for meaningful employment, and to help employers find the ski lled workers they need to compete and succeed in business.

Funds shOuld be used to defray the cost of required and allowable RR activities in response to layoffs. business closures. and natural d isastecs.

Monitoring reports with no findings:

Inyo County (10/12/15) Fiscal report.

Monitoring reports with findings:

Kern High School District (KHSD) (10/13/15) Program report. Findings were for 90-day gaps in service; insufficient documentation of services; insufficient work site monitoring; paying a participant an incorrect wage; and providing services to youth prior to their enrollment.

In response, KHSD provided staff with additional training, hired additional staff, implemented new policies and procedures, and utilized stand-in costs for their disallowed costs. These findings are closed.

Proteus, Inc. (9/30/15) Program report. Finding was providing services to a non-Kern County resident.

In response, Proteus, Inc. provided documentation of the services and associated Employers' Training Resource costs spent on the non-Kern County customer and reimbursed Employers' Training Resource for the costs. In the future, Proteus, Inc. will obtain written authorization prior to providing services to any Non-Kern County customer. This finding is closed.
