IOWA CODE 803.2(2) (2014). If the court is satisfied from a motion for a change of venue and the evidence introduced in support of the motion that such degree of prejudice exists in the county in which the trial is to be held that there is a substantial likelihood a fair and impartial trial cannot be preserved with a jury selected from that county, the court must transfer the action to a county where this condition does not exist. IOWA R. CRIM. P. 2.11(10)(b). 4. The defendant, Alexander Kozak, is charged by Trial Information with the crime of Murder in the First Degree in violation of sections 707.1 and 707.2(1)(A) of the Iowa Criminal Code.5. Pretrial publicity can result in the defendants inability to receive a fair trial and/or to impanel an impartial jury in the venue in which the alleged crime took place.As the Iowa Supreme Court has recognized, where there has been extensive pretrial publicity a trial court should be more willing than in prior years to look favorably upon such a motion.State v. Robinson, 389 N.W.2d 401, 404 (Iowa 1986) (granting new trial because the trial judge had failed to grant defendants motion for change of venue). 6. Prejudice resulting from pretrial publicity warrants a change of venue when the defendant is able to show: (1) publicity attending the trial that is so pervasive and inflammatory that prejudice must be presumed, or (2) actual prejudice on the part of the jury. State v. Siemer, 454 N.W.2d 857, 860 (Iowa 1990). 7. To sustain a claim of presumptive prejudice, the defendant must prove that the publicity attending the case was pervasive and inflammatory. Id. (quoting State v. E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT3 Harris, 436 N.W.2d 364, 367 (Iowa 1989)). In determining whether publicity meets this standard, a court may consider the following: a.Whether the media accounts indicate the defendant is guilty of the charges against him. State v. Walters, 426 N.W.2d 136, 139 (Iowa 1988) (citing State v. Spargo, 364 N.W.2d 203, 207 (Iowa 1985)). b.[W]hether enough time has passed between publication of the material and the trial date so as to dissipate any prejudicial effect that may have been initially created by adverse publicity. Walters, 426 N.W.2d at 139 (citing Spargo, 264 N.W.2d at 208). c.[W]hether there were any editorial denunciations of the defendant or emotional stories regarding the defendant or the victim. Walters, 426 N.W.2d at 139 (citing State v. Johnson, 318 N.W.2d 417, 422 (Iowa 1982)). d.Whether the county was a sparsely populated rural one . . . saturated with news accounts of the crime. State v. Robinson, 389 N.W.2d 401, 403 (Iowa 1986). 8. Applying this law to the situation at hand, Mr. Kozak respectfully submits that there has been pervasive media coverage and extensive publicity surrounding this case such that there is a substantial likelihood that Mr. Kozak cannot receive a fair trial in J ohnson County. IOWA R. CRIM. P. 2.11(10)(b).9. Local newspaper articles, websites, and television news coverage have saturated the community with information about this case ever since the alleged incident took place at the Coral Ridge Mall on Friday, J une 12, 2015. Examples include, but are not limited to, the following: E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT4 a.Between J une 12, 2015, and August 9, 2015less than two months since the alleged crime took placecoverage of the case has appeared at least sixteen times in online and/or print versions of the Iowa City Press-Citizen.See Iowa City Press-Citizen Appendix. b.In addition to the sheer number of articles covering case developments in the two months since the alleged crime, one of the articles published on J une 15, 2015, alludes to a high number of potential witnesses who may have called 911 in the seconds after the alleged shooting.The Press-Citizen reported that [i]n the seconds after the shooting Friday, 911 calls began to flood dispatchers at the J oint Emergency Communications Center for J ohnson County and that so many emergency calls were made that an overflow system redirected calls to Cedar Rapids.See Iowa City Press-Citizen Appendix (J osh OLeary, Overflow system used for 911 calls Friday (6/15/2015)).So many calls were received by four dispatchers operating seven lines that even though the article appeared three days after the incident, the J oint Emergency Communications Center for J ohnson County was still tallying the total number of 911 calls received.Iowa City Press-Citizen Appendix (J osh OLeary, Overflow system used for 911 calls Friday 6/15/2015)).The extensive number of 911 calls received means that either the State of Iowa or the defendant may decide to call an extensive number of witnesses to testify about what they saw or heard.The potentially enormous number of witnesses or callers who are laypeople in the community thus has a E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT5 high probability of making it extremely difficult to select an impartial J ohnson County juror who does not know at least one of the witnesses or 911 callers.c.In addition to covering this story prominently during the weekend of J une 12, 2015, and in addition to the large number of 911 calls received on J une 12, 2015, The Press Citizen has also authored at least one editorial addressing the incident. This editorial assumes certain facts about the case and takes positions in relation to the alleged crime which make it impossible for Mr. Kozak to receive a fair trial in J ohnson County.For example, in an editorial The Press-Citizen published on J une 19, 2015, under the header Our View:We cant wait to stop violence, The Press-Citizen states that [l]aw enforcement has said that Alexander Kozak admitted to the shooting, and that he went home to retrieve his gun with the intent of returning to the mall to shoot Farrington. See Iowa City Press-Citizen Appendix (Our View: We cant wait to stop violence, 6/19/2015).The editorial goes on to state, We dont know why he decided to commit such a violent and senseless act, and continues, We do know that Farrington was shot three times in the back while she was working in the mall, and that she died as a result.What we do know is that everyonemale and femalehas a right to feel safe and be safe when they go to work.See Iowa City Press-Citizen Appendix.The editorial ends with the sentence, What we do know is we cant wait to prevent violence in our community.See Iowa City Press-Citizen Appendix. d.In addition to the above-described editorial, more than one month after the alleged incident, The Press-Citizen published an Op-Ed about Andrea E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT6 Farringtons death.See Iowa City Press-Citizen Appendix (Christopher H. Marks, Farrington murder is an outrage, 7/20/2015). In that Op-Ed, the writer calls for reinstatement of the death penalty in Iowa and that states that Kozaks motivation, whatever it may turn out to be, is irrelevant.Id.The writer also declares that his upbringing, psychological immaturity, medical history, or any of the other ruses used to defend murders are also irrelevant.Id.The tone of the Op-Ed mirrors the headline, expressing the writers deep outrage toward Kozak, the criminal justice system, and Iowas inability to prosecute Kozak with the death penalty. Id.e.In addition to the articles and editorials The Iowa City Press-Citizen has published over the last two months, the Cedar Rapids Gazette has also provided extensive, ongoing coverage, including at least eleven print and/or online articles. See Cedar Rapids Gazette Appendix.These articles include an Op-Ed published in the Sunday paper on J une 28, 2015, in which the writer quotes author Margaret Atwoods statement that [w]omen are afraid that men will kill them. See Cedar Rapids Gazette Appendix (Alison Gowans, Heartbroken in Iowa about a sickness in our society, 6/28/2015 at 9A). While the writer clarifies that she is not saying that all men are violent toward women, the writer further explains she is just saying that womens fears are far from unfounded.Id.f.In addition to published articles, the Gazettes online coverage includes Facebook discussion about Kozaks $10 million bond.See Cedar Rapids Gazette Appendix, Your thoughts on current events in eastern Iowa E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT7 (Facebook discussion).In this online discussion, writers convey opinions such as the following: a.I think he should be held without bail. The public should not have to worry about this person having a remote chance of getting out of jail.b. Wanna make sure he stays put.Wish we had the death penalty.c.Triple it, then double it, then triple it again. See Cedar Rapids Gazette Appendix, Your thoughts on current events in eastern Iowa (Facebook discussion).10. Television news networks have further saturated the J ohnson County community with reports about this case. Examples include, but are not limited to, the following: a.Since J une 12, 2015, KCRG-TV 9 has aired a number of stories regarding the matter. These stories have been reproduced in video and written format on KCRGs website. See Television Appendix. This online content includes a Twitter1 feed and Facebook coverage. b.Since J une 12, 2015, KWWL-TV 7 has aired a number of stories regarding the matter. These stories have been reproduced in video and written format on KWWLs website, including Facebook coverage. See Television Appendix. c.In short, the media has covered this event consistently since the date of the alleged incident. Recent coverage includes, but is not limited to, updates about Mr. Kozaks trial date and speculations about whether this very motiona request for a change of venuewill be granted. See Television Appendix.

Impaneling an impartial jury is made more difficult because of press coverage discussing deceased victim Andrea Farrington in connection to Mr. Kozaks charge.The media has provided unequivocally positive coverage of Ms. Farrington. See, e.g., Press-Citizen Appendix (J eff Charis-Carlson, Family, friends remember shooting victim as always smiling, 6/14/2015)). Given Ms. Farringtons reported positive reputation in the community, jurors are likely to harbor prejudice toward Mr. Kozak such that he will not be able to receive a fair trial. Walters, 426 N.W.2d at 139 (citing State v. Johnson, 318 N.W.2d 417, 422 (Iowa 1982)). 12. Furthermore, coverage of Mr. Kozaks case has been linked to increased exposure to and coverage of societal violence. The media has discussed Mr. Kozaks case in the context of workplace violence, and has even referenced such incidents as the recent church massacre in Charlestown, South Carolina, while discussing Mr. Kozaks pending charges. See Cedar Rapids Gazette Appendix (Alison Gowans, Heartbroken in Iowa about a sickness in our society, 6/28/2015 at 9A). Linking Mr. Kozaks case to an increase in societal violence unfairly prejudices community members against Mr. Kozak by causing them to associate Mr. Kozak with reported violence in other areas of the country. 13.In addition to the media in J ohnson County and Linn County saturating its readers with ongoing coverage, the media coverage has extended to other parts of the state, especially including Scott County, the Quad Cities, and even the Tri-States region of western Illinois, southeastern Iowa, and northeastern Missouri. Some reasons for this extended press coverage include the fact that Mr. Kozak was arrested in Scott County and that the Coral Ridge Mall is a popular shopping destination for greater E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT9 eastern Iowa.In addition to these factors, the Quad Cities Times published an article on J une 15, 2015, entitled, Branstad saddened by Coral Ridge Mall shooting. See Eastern/Southern Iowa Appendix.That article paints Farrington as a vibrant young person in a stark contrast to its implicit description of Kozak. The article alludes to Kozak by recommending legislation to toughen Iowa laws dealing with stalking offense[s], while describing Farrington as a vibrant part of the Iowa City-Coralville community and someone who was passionate about engaging with our young people through the Childrens Museum at the Coral Ridge Mall.Id.The Tri-States news station WGEM continues this same portrayal of describing Farrington in glowing terms by publishing an article describing Ms. Farrington as a 2012 high school graduate who was working her dream job at the Childrens Museum at Coral Ridge Mall when she was killed. See, e.g., Eastern/Southern Iowa Appendix (Amie Steffeneicher, Shooting victim was Montezuma grad, worked at Childrens Museum, (6/15/2015 on WGEM.com)). 14.In sum, because of the extensive print and media coverage in J ohnson County and the greater eastern Iowa region, Mr. Kozak has provided sufficient evidence that the publicity attending the trial is so pervasive and inflammatory that prejudice must be presumed. State v. Siemer, 454 N.W.2d 857, 860 (Iowa 1990).Indeed, the substance of the media coverage to date, as well as the social media discussion about those articles, rises to the level of establishing actual prejudice in the potential jury pool. See Siemer, 454 N.W.2d at 860. E-FILED2015 AUG 11 1:27 PM JOHNSON - CLERK OF DISTRICT COURT10 WHEREFORE counsel for Mr. Kozak respectfully submits there is such a strong degree of prejudice in J ohnson County that trying Mr. Kozak in J ohnson County would violate Mr. Kozaks Constitutional right to an impartial jury and to due process under the Fifth, Sixth, and Fourteenth Amendments to the United States Constitution, and Article I, Sections 9 and 10 of the Iowa Constitution. Counsel respectfully asks this Court to set this matter for hearing, and upon that hearing, grant Mr. Kozaks motion to change venue to a location not including J ohnson County, Linn County, eastern Iowa (including Blackhawk County, the Quad Cities, and Dubuque), Poweshiek County, and Wapello County.The defendant respectfully suggests that the Court consider changing venue to the following counties (in alphabetical order):Cerro Gordo, Pottawattamie, Story, and Woodbury. Thereis .nosma!lmeasureof naivety anda touchof hubrisinthis thinking.The fact of the matter is that suchanact of cold-bloodedmurder shouldn't happenanywhere,but it does withalarming frequency. Theharshrealityof todayis that Iowaisconnected to the wider world;not immune tothe ever roilingsocial and cultural trends that afflict our youth from coast tocoast. The fine people of this statelike somany other Americans long for the days before Internet predators andbullies, Amber Alerts,locked doors,increasingcrime inallmajor categories,andthe sense that the worldismoving far toorapidly. The youngman who callously murdered Farrington was possessedof thesame psychopathology that has beenevidencedby others who committed similarly heinous acts;a boilingstew of anger,resentment andperhaps insanity that isvirtually impossible to detect.Oftenit isonly anact of murder is committed that the signs andsymptoms of theperpetrator are seen inhindsight.
