    Concession and Benefits accrued to ESMs by States and UTs through RSBs

    1. The States / UTs during various meetings and directives were requested to enhance support to ex-ser-vicemen (ESM) and help them obtain better/ status equivalent second career options in addition to working upongetting the State/UTs to make favourable recruitment rules and reservations policies in this regards. In additionmany other domains were required to be addressed and information on all these is being sought in the formatprojected in the subsequent paragraphs.

    2. Census of ESM and Widows. During the KSB meetings, it was highlighted that the volume of ESMsregistering/ enrolling in various schemes has seen a quantum increase during the last two years. In order toascertain the efficacy of welfare measures being undertaken vis-à-vis its enhancement scope and commensu-rate projected budgetary requirements, there is a need to take stock of the number of ESMs and widows from thehorse's mouth, that is the respective RSBs and ZSBs. It was therefore decided during the KSB meetings, that allRSBs be approached to forward consolidated data (of all ZSBs under them) and forward the same to KSB at theearliest. The State and Districts wise details are given below :-

    3. Re-Employment Benefits

    (a) Amendments to Recruitment Rules to help ESM find a Second Career. The States/UTs during variousmeetings of Kendriya Sainik Board were requested to amend the recruitment rules for providing relaxation inage/educational qualifications for ex-servicemen on the lines adopted by the Central Govt. Provisions for provid-ing relaxation for ESM in Central Govt jobs already exist. The States/Uts were also requested to amend theserules especially for posts where military experience in a given discipline or trade is suitable for a second careeroption. The benefit of relaxation of upper age limit by the length of military service plus three years, at present isavailable for appointment only to reserved vacancies in Groups 'C' and 'D' posts. RSBs were requested to takeup cases for appointment against unreserved vacancies.

    (b) The State Govts/ RSBs which have not incorporated the same were requested to take up cases on thelines of Central Govt taking clue from other States where they are effectively being perused at an early date. Thedetails of amendments in corporate by different States/UTs are given below:-

    4. Reservations.The following directions regarding reservations were passed to RSBs regarding employ-ment reservation efforts :-

    (a) Lateral Induction Into Group 'A' & 'B' Posts during the last year of service. During variousmeetings of KSB, the issue of reservation to ex-servicemen in these jobs has been discussed and it has beenobserved that States/UTs were providing 2 to 10% reservation in Govt jobs in Groups 'C' & 'D' posts whilstmajority of them were not providing reservations in Group 'A' & Group 'B' posts. Also, jobs were not beingprovided against reserved vacancies as the subject of reservation of ESM did not have statutory backing. Also,ban on fresh recruitment for ESMs by the States was another cause and many states have removed the sameon request of Hon'able PM/ RM.     (b) Carry forward of reserved Vacancies. The High Level Committee (HLC) had recommended that thereserved vacancies of ESMs be kept vacant and carried forward for at least one year before these arede-reserved and filled by others. The Hon'ble Raksha Mantri had also made similar request to the Stateswithout reservations for ex-servicemen to make such reservations, introduce regular monitoring system throughroster and carry forward unutilized reserved vacancies, at least for one year.     (c) Induction of ESM at suitable levels In State Police Force, State Jobs etc. The issue of induction of ex-servicemen at suitable levels in State Police was discussed and the State Govts requested to make provisionsin this regard. State Govts which do not have the provision for induction in State Police Forces are requested todo so at the earliest. The details of induction in the State Police force by different States are therefore being sort.The need for absorbing the trained ESM workforce automatically after retirement from Service in suitable civiljobs, so that they can continue to be employed in Govt jobs upto the age of 60 years.     5. Self - Employment. The High Level Committee set up under the Chairmanship of then Raksha RajyaMantri in 1984 recommended allotment of industrial plots/sheds for ESM to enable them to set upself-employment ventures. During various meetings of KSB including the XXIXI meeting held on 23 Jun 2011 andDSW meeting held on 21 Nov 2014 the States/UTs were requested to make at least 10% reservation of industrialplots/sheds with a view to assist ESMs undertake self-employment ventures.     6. Amendment to State Rent Control Acts and Land Tenancy Act. To enable ESM to take possession oftheir house/land for self utilization after retirement from service, it was proposed that States/UTs should amend their Rent Control Act and Land Reforms Acts in favour of Ex-Service-men. The Hon'ble Raksha Mantri, vide his letter dated 11 Oct 96 addressed all the State Govts, had requestedthe States/Uts which had not amended the Land Tenancy Acts and Rent Control Acts to do so on a time boundbasis.     7. Exemption Of House Tax For Self-Occupation. A large number of ESM associations and War Widowsassociations had represented to MoD requesting exemption from taxes on houses owned or rented out by ESM,war widows and widows of ESMs levied by Municipalities and Gram Panchayats. It was brought out that majorityof the Defence personnel retire at the age of 35 to 40 years and settle down in or near hometowns. The processof rehabilitation calls for considerable readjustment in their life styles as they are suddenly deprived of their fullsalary, ration and other benefits and hence their earning capacity is more than halved. Considering theresettlement and rehabilitation of these ESM as a National responsibility, it was felt that their demands forexemption from taxes on salaries, professions and houses deserve a sympathetic look. In this regard, theDefence Minister vide his letter dated 11 Oct 96 had requested the concerned States/UTs Chief Ministers/LtGovernors to sympathetically view the matter of exempting ex-Servicemen of their States/UTs from paying house/property tax. The concessions extended, by various States, include exemption of Stamp fee, Examination fee,Registration fee, Hospitalization fee, Entertainment tax and Provision of free legal assistance. The States/UTs,which have not incorporated exemption of house/property tax for ESM and war widows/widows were requestedto do so at the earliest.     8. Reservation of Seats for Wards of ESM In Professional Colleges. During the Kendriya Sainik Boardheld on 27 Jun 2011, 21 Jul 2016 and Directors, DSW meeting held on 21 Nov 2014, 06 Apr 2017 all the Centraland State Universities/ professional institutes were requested to make provision for reservation for widows/wives/wards of Armed Forces personnel and ESM. They were also requested to fill up the reserved seats strictlyin accordance with priorities laid down by MoD for reservations of seats under the defence category. It wasgenerally felt that the Central as well as the State Universities and the professional institutes were not making 5%reservations for dependents of Defence personnel and also not filling them up as per under mentioned prioritieslaid down subsequently by MoD, vide GoI MoD DESW letter No. 6(1) 2017/D(Res.II) dated 21 May 2018 forreservation of seats under defence category. :-

    (a) Priority I : Widows/wards of Defence personnel killed in action.

    (b) Priority II : Wards of disabled inaction and boarded out from service.

    (c) Priority III : Widows/Wards of defence personnel who die in service with death attributableto military service.

    (d) Priority IV : Wards of disabled in service and boarded out with disability attributable to military service.

    (e) Priority V : Wards of ex-servicemen and serving personnel who are in receipt of Gallantry Awards:-

    10. Reservation for dependents of ESM in Professional Colleges: Removal of DomiciliaryRestrictions. Serving defence personnel and ex-servicemen face serious difficulties in getting their childrenadmitted to professional college owing to varying domiciliary pre-conditions imposed by some States/UTs. Theissue was discussed during various KSB meetings and following criteria accepted by the State Governmentsfor Defence personnel with regard to their domicile and eligibility in various educational and other welfareconcessions:-

    (a) Proof of permanent residence/immovable property without any specific period of stay.

    (b) Proof of his/her posting to the State issued by parent's Head of the Department in the State.

    11. During the KSB and DSW meetings it was recommended that RSBs in respective States/UTs must im-mediately take up case for lifting of domiciliary restrictions in favour of defence personnel to enable wards /dependents of serving armed forces personnel and ESM seek admission in professional colleges. The domicili-ary restrictions as followed by States/UTs are as under:-

    Those applicants of this category who satisfy the eligibility criteria ofGeneral Category will be eligible for both the categories.

    8. Gujarat Domiciliary restriction is there.9. Haryana Being a large strength of ESM/ serving personnel in Haryana. It is not possible

    for Haryana to relax the domiciliary restrictions. State Govt. is providing priorityto the ex-servicemen who belong to Haryana State.

Maharashtra The ex-servicemen and their family members who are domiciles of this stateby birth are eligible to avail of the benefits of various schemes for the ex-ser-vicemen declared by the State Government. The ex-servicemen who havemigrated to this State are not entitled for such benefits unless and until theyprove that they are residing in the State continuously for the last 15 years afterretirement and obtain a domicile certificate to that effect.

    (a) Domicile Certificate is not required if the son/daughter of the DefencePersonnel has passed X and XII standard examination from the MaharashtraState.

    (b) Domicile Certificate would not be required if the son/daughter of DefencePersonnel is transferred to Maharashtra State during the year, even if he/shehas passed the XII standard examination from outside the State.

    (c) However, Domicile Certificate would be required only in case of sons anddaughters of Defence Personnel belonging to Maharashtra State and postedoutside Maharashtra State and if his son/daughter has passed the X and XIIstandard examination from other State.

    (d) However, if such a person is transferred to Maharashtra, the conditionrelating to domiciliary restriction already stand removed.

    13. Cash Grants/ Land Grant to Gallantry / Non-Gallantry Award Winners. The cash grants being pro-vided by the States/UTs to their Gallantry Award Winners vary from state to state. It was felt that the stategovernments/Uts should consider uniform grant of cash awards to the gallantry award winners so that there isno discrimination between service personnel hailing from different states while serving in the same units forsimilar acts of bravery. The point was discussed during the KSB meetings and the Hon'ble Raksha Mantrirequested the States/UTs vide letter No. 2 (2)/XXVIII/KSB/A/520-F/RM dated 23 Aug 2016, to accept the ratesrecommended by MOD for cash grants and implement the same at the earliest.
