Subject: ULDC Revisions, Changes from First Reading to Second Reading
The Village Planning & Zoning Board recommended approval of the draft ordinance to amend the
Village's Unified Land Development Code (ULDC) on September 4, 2018. The Village Commission then
held a public hearing for first reading of that ordinance on October 9, 2018. A public hearing for the
second reading (adoption) of that ordinance is now scheduled for the February 28, 2019 Commissionmeeting. Some changes have been made to the ordinance since the first reading as follows:
(1) The previous draft of the ordinance included a compete reorganization of Chapter 8. Though a
reorganization of Chapter 8 is still recommended to address duplicative code sections and
confusing hierarchy of code sections, the current draft no longer includes the reorganization.
(2) The previous draft of the ordinance included a reduction of required setbacks from Kennedy
Causeway for properties in RM-70 and CG zoning districts. The current draft of the ordinance
maintains the same Kennedy Causeway setbacks as the existing code.
(3) The previous draft of the ordinance removed two requirements for development in the RM-70district; the requirement that brick pavers be used for all exterior paved surfaces and the
requirement for street tree lighting. The current draft maintains these existing code
requirements.
(4) The previous draft of the ordinance added the requirement for strictly commercial properties to
provide a baywalk. The current draft maintains this requirement but reworks the existing
language for the baywalk requirements in order to clarify and strengthen the existing
requirements. The current draft allows the Commission to require either a public baywalk or
public boardwalk.
(5) The previous draft of the ordinance reduced the number of required parking spaces for three-
bedroom (and larger) multi-family dwelling units from three parking spaces to two parking
spaces for all multi-family developments. The current draft continues this change except that
the multi-family parking standards remain the same for Harbor Island.
(6) The previous draft of the ordinance included changes to the Bay View Overlay Districtregulations, which included increased building height (400 feet maximum) and revised setbacks.
The current draft also includes increased building height (400 feet maximum) and revised
setbacks but accomplishes the changes differently. The proposed changes allow for increased
height to 300 feet in exchange for increased front setbacks and an additional fee. Then
additional building height to 400 feet is proposed in exchange for increased side setbacks.
(7) The previous draft included changes to the bonus height provisions to allow strictly commercial
properties to request bonus height. The current draft maintains that change but revises the
bonus height fee structure.

(8) The previous draft increased the maximum height of sw/imming pools and their appurtenances
from 2 feet above grade to 3 feet above grade. The current draft no longer includes that change.
(9) The previous draft included a change to allow administrative approval, instead of requiring
Village Commission approval, of boat lifts and/or mooring piles which are not proposed toextend farther from the seawall than existing dock structures and which will not cause a lifted or
moored boat to extend farther from the seawall than is possible using the existing dock
structures. The current draft no longer includes that change.
(10) The previous draft removed the requirement for signage in multi-occupant commercial
buildings to be the same type and color. The current draft no longer includes that change.
(11) The previous draft included a proposed revision to clarify that fences on corner lots should be
no more than 5 feet tall on both street frontages. The proposed draft no longer includes that
change.
