Request

Consider a request from Bradley and Michelle Kraemer (applicant) for a rezone located on property at

S9540 Rahl Rd, Prairie du Sac, WI.

Legal Description

The property is generally described as being located within the NW ¼, SE ¼, Section 33, T10N, R6E,

Town of Prairie du Sac, Sauk County, containing approximately 4 acres. Tax parcel identification number

028-0962-01000.

Background

The residence and detached garage that exists on the property was permitted in 1993. The rest of the

property has no land use records.

The applicant is requesting a rezone of 4 acres, which is currently described as Lot 1 of Rolling Prairie

subdivision plat (Exhibit B).The proposed rezone is from a Residential Zoning District to an Agricultural

Zoning District to allow for the future construction of a larger pole shed and the addition of horses.

Analysis

The current zoning is Residential. The proposed zoning is Agricultural Zoning District. Relevant plans

include the Town of Prairie du Sac Comprehensive Plan and Sauk County Comprehensive Plan.

The Town of Prairie du Sac Comprehensive Plan’s Land Use District Map 9B (Exhibit E) show the area

currently mapped as residential, surrounded by Agricultural lands, but allows for mixed uses of ag and

residence.

Plan Commission/Town Recommendation

On June 9, 2020, the Town Board of the Town of Prairie du Sac recommended approval of the rezone .

Zoning Ordinance Standards and Criteria

In reviewing zoning map amendment standards, the agency (LRE Committee) shall follow these

standards (7.150(9)):

In its review and action on the application, the agency shall make findings with respect to the following

criteria:

(a) The proposed map amendment is consistent with the overall purpose and intent of this chapter

(Sauk County Zoning Ordinance).

Staff comment: The rezone as proposed is consistent with the overall purpose and intent of the

Sauk County Zoning Ordinance which is to protect public health, safety and welfare of Sauk

County residents and the public, to plan for future development of communities, and to further

the purposes contained in Wis. Stat. § 59.69(1). The proposed zoning of Agriculture supports a

broad range of agricultural and residential uses. If the property is rezoned, the property

owner/applicant would need to apply for and receive a land use permit to construct any additional

accessory structures for personal storage or for the housing of horses.

(b) The proposed map amendment is consistent with the Sauk County Comprehensive Plan and the

Farmland Preservation Plan, if applicable.

Staff comment: Page 1 of the Sauk County Comprehensive Plan states that the purpose of the

plan as “Wisconsin Statutes require that any program or action of a local governmental

unit that affects land use shall be consistent with their comprehensive plan. This Plan

consciously refers to locally adopted municipal comprehensive plans for guidance as to

whether proposed changes in land use are appropriate.”

The Sauk County Comprehensive Plan supports preserving agriculture and rural character as well

as promoting economic diversity such as local business start-ups. The Plan also defines

managing development and focusing “on efficient land use patterns that promote

redevelopment of under-utilized lands. It sets limits on outward growth, incorporates

permanent land preservation techniques, and achieves livable communities.”

The property is not subject to Farmland Preservation Plan.

(c) Factors have changed from the time of initial ordinance adoption that warrant the map change, or

an error, inconsistency, or technical problem administering this chapter as currently depicted has

been observed.

Staff comment: The County zoning ordinance was repealed, recreated, and adopted by the Sauk

County Board of Supervisors in February 2014. The official zoning maps included as part of the

new zoning ordinance are not meant to anticipate future land uses. The zoning ordinance does

include a map amendment or rezoning process to evaluate zoning changes based upon current

conditions and needs of the property owner. The requested rezone would appear to either allow

the agricultural and residential uses proposes by the property owner.

Land Resources and Environment Staff Recommendation

The Land Resources and Environment Committee must review the request and make appropriate findings

based upon the record and evidence provided with respect to the criteria for and standards for granting a

zoning map amendment.

publication dates noted.

Land Resources and Environment Committee Action Options:

Postpone the Decision on Petition 13-2020. Motion to postpone the decision for the requested rezone

from a Residential zoning district to an Agricultural zoning district, for additional information

Approve Petition 13-2020. Motion to approve the requested rezone from a Residential zoning district to

an Agricultural zoning district based upon the findings of fact and conclusion of law subject to the staff

analysis.

Disapprove Petition 13-2020. Motion to disapprove the requested rezone from a Residential zoning

district to an Agricultural zoning district based upon the findings of fact and conclusion of law subject to

the staff analysis noted herein.

Modify and Approve Petition 13-2020. Not Recommended.
