    ANTI-UNION, ANTI-WORKER PROPOSITION 113 TO APPEAR ON 2010 BALLOT

    CORRECTION: Previous release incorrectly stated the name of the initiative to appear on theballot. The revised version is Proposition 113, not Proposition 108.

    TUCSON, AZ. August 26, 2010 Recently the Arizona State Legislature convened a last-

    minute special session to revise Proposition 108, a ballot measure targeting unionization, to

    ensure such legislation will appear before voters this November.

    Governor Jan Brewer called the special session after the bills original language was ruled

    unconstitutional by the Arizona Supreme Court. The proposed legislation now applies only to

    union elections, establishing a constitutional amendment that employees must have a secret vote

    to determine whether or not to unionize.

    Campaigns for similar legislation are underway nationwide, led by groups like Save our Secret

    Ballot (SOS) and funded by the U.S. Chamber of Commerce and other conservative businesslobbying groups. In contrast, proposed federal legislation would give employees considering

    unionization the choice of a secret ballot or card check.

    While secret ballots seem innocuous and democratic, it is important to consider the context,

    said Laura Dent, union organizer and Las Adelitas Arizona member. She explained that several

    weeks may elapse between the moment a company realizes its workers are trying to organize and

    the point an election date is set: During this period, a company has ample time to administer an

    anti-union campaign. With weak federal employment laws and minor penalties for unfair laborpractices, pressuring workers into voting against unionization can become simply a cost of doingbusiness.

    Wendy Cevallos, chair of Las Adelitas Arizona, declared: Las Adelitas Arizona supports the

    fundamental right of workers to organize and form unions free from intimidation and coercion.

    Employers are already in a position of control, and if the amendment passes, they likely will gain

    additional leverage that could directly impact a workers decision to support a union.

    Cevallos added that the amendment, intended to preempt federal legislation, would almost

    certainly be challenged if it takes effect -- resulting in a lengthy legal battle and a waste ofArizona taxpayer dollars similar to what is currently unfolding with SB 1070.

    Working Arizonans should not have to finance legislation that infringes on their rights, said

    Cevallos. During a time when Arizonas working families are struggling with so many other

    pressing challenges, Governor Brewer has shown us where her true priorities lie.
