"Be it enacted by the Legisb.tive Assembly of Goa,Daman and Diu in the 'I'hirty-first Year .of the Re­public of India as follows: -

CHAP'l'ER I

Preliminary,

1. Short title) extent and commciwemcnt. - (1)This Act may be called the Goa, Daman and DiuMarine Fishing Regulation Act, 1~80. . .

.. (2) It extends' Lo t11C\ whole of theUnion territoryof Goa, Daman' and Diu. . .

(3) It vshall come into force all such dale ;H; theGovernment may· liy notification in Ihe OfIlciulGazette,1tppoint.

2. Definitions. - In this' Act, unless the contextotherwise requires i c-,

. (a), "arljudicating Officer" means a special" Judicial Magistrate appointed under the provisions- of the Code of Criminal Procedure, UJ7a (Central-Act 2"o! 1974) 'for the purposes-of this Act;. .

(b) . "Appellate Board"means an AppellateBoard consti tuted under section 22:

(i) a catamaran,

(ii) a country craft aud

(iii) a canoe

engaged in sea Iishing ;

(e) "Government" means the Government ofGoa, Daman and Diu;

(f) "port" means the space within such limitsas may from time to time be defined by the Go­vernment by notification in the Official Gazette,for the purpose of this Act;

(g) "registered fishing vessel" means

(i) . a fishing vessel registeredunder section 11 of the Marine Central'Products Export Development ActAuthority Act, 1972 or; 13 of 1972.

(Ii) a fishing vessel registered under sec­tion 12;

(h) "specified area" means such area in thesea along the entire coastline of the Union terri­tory, 'or such poi-Lion of it, but not beyond theterritorial waters, as may be specified by theGovernment by notification in the Official Gazette;

(i) "Union territory" means the Union territory. of Goa, Daman and Diu and includes the territorial

waters along the entire coastline of the. Unionterritory. .

3. Al,thori.sation oj officers [or the purpose ofany provi,sions of this Act. - The Government mayby notification in the Official Gazette, authorise-

(a) any officer of the Government not being anofficer below the rank of a Gazetted Officer; or

(b) any Officer of the Central Government, notbeing any officer below the rank of a GazettedOfficer or a Commissioned Officer in the armedforces of the Union, with the consent of that Go­vcrnment, to exercise the powers conferred all rinddischarge the duties imposed upon any suchauthorised officer under this Act in such area asmay be specified ill the nolification. .

1. Pouier to reget/ate restrict or li}'ohilJif. ccri auiniaitere within sped/fed area. - (1) The Govern­ment may, having regard to the matters referred toin sub-section (2) by fill order notified in the Offi­cial Gazette, regulate, restrict or prohibit-

(a) the fishing ill any specified area by suchclass or classes of fishing vessels as may beprescribed; 01'

{b) the number of fishing vessels which maybe used for fishing in any.::,>pecified area; or

(c) the catching in any specified area of suchspecies of fish and for such period as may bespecified in the notification; or,

(d) the use of such fishing gear in any speci­fied urea as may be prescribed: or

,(e) the fishing in any specified area duringsuch period of day or night as may be prescribed.

(2) In making an order under sub-section (1) theGovernment shall have regard to the following mat-ters, namely: - . .

(a) the need to protect the interest of differentsections of persons engaged in fishing, particularlythose engaged in fishing! using traditional fishingcraft:..: such as catamaran, country craft or a canoe;

(b) the need to conserve fish and to' regulatefishing on a scien tifie basis; . .

(c) the need to maintain law and order in thesea;

(c1) any other matter that may be prescribed.

5. P1'oldbition o] w;e of fishing vessels -in contra­ocniion. [0 the Iccqulaiions made under section 4.­No owner or master of a fishing vessel shall usc, orcause 01' allow to be used, such fishing vessels [0}'fishing in any manner which contravenes an ordermade under section 1:

Provided further that. tho passing of such fishingvessel Lluough any specified area shall not in anymanner cause filly damage to any fbhing nets ortackles belonging to any person who is engngcd infi.f.ihillg in the specified water area by using anytraditional fishing craft such as catamaran, COLln­

try craft, or canoe.

G, UCGlIsin!J of fi-shiny »cssct«. -- (1) The ownerof a fishing vessel may make an application to theauthorised officer for the grant of a licence f~r usingsuch fishing vessel for fishing in any specifledarea. r

(2) Every application under sub-section (1) shallbe in such form, containing such particulars, andbe accompanied by such Ices, as may be prescribed.

(.1) In grauting or refusing such licence undersub-section (3) the authorised officer shall havo

(a) Whether the fishing vessel is a registeredfishing vessel;

(b) The condition of the fishing vessel inclu­dint; the accessoi-ics and fishing gear with whichit is filled;

(c) any order that may be made undersection 4;

(d) any other matter that may be prescribed.

(G) A licence granted under this section shall bevnlid for thc period specified therein or' for suchextended periods as the authorised officer may thinkfit to allow in any case.

7. Power to l'e!lHl((tc Ow mesh 81:::tJ of fishil1Ynets. - The Oovet-mnont may having regard to thenature and mode of fishing and the need to conservefish and to regulate fishing on a scientific basis byan order notified in the Official Gazette regulateor restrict the size of mesh of a fishing net.

8. Licencing of Fishing nets. - (1) The owner ofa fisldnR net. may' make an application to the autho­rized officer for grant of licence for using u fishing­net. ..

(2) Such application shall be in such form con­taining such particulars and be accompanied by suchIces UR may be. prescribed, . .

(3) A licence granted under this section shall bein such form and subject to such conditions as topayment of such fees 'and furnishing of such secu­I'i ly for duo perfor-mance of the conditions as maybe prescribed.

Provided that different fees and different amount,'by wny of secur-ity may be prescribed in respect of

licences, for different classes of fishing nets....

(4) A licence gn1Htec1 under this section shall bevnlld for the period snccified therein 01" f'or suchextended 'periods as- the authorized officer maythink fit to allow in any case.

9. Prohibition of fishil/g USinf! f isluru: - »esse;«which are not licenced. - No person shall, afterthe commencement of this Act,' carryon fishing inany specified area using a fishing vessel which is not1icanced under section 6:

Provided that nothing' in thi~-l section shall applyto any fishing vessel, which was h(dl1~ usodimmc­diately before the commencement of this Act, for, .

10. Oontroi on nunuijacturc, suie or WiG of {Ishinynets. - No person shall after the commencement ofthis Act manufacture or usc for fishing any net incontravention of any order passed under section 7or without obtaining any licence as required undersection 8.

11. Oancellatiori; suspension and amendment oflicences. - (1) If the authorised officer is satisfiedeither on a reference made to him in this behalf orotherwise, that-

(a) a licence granted under section 6 or sec­tion 8 has been obtained by misrepresentation asto .an essential fact; or !

(b) the holder of the licence has, without. reasonable cause, failed to comply with the

conditions subject 'to 'which the licence has beengranted or has contravened any of the provisions

. of this Act or any order or rule made thereunder,then, without prejudice to 'any other pennlty towhich the holder of the licence may be liable under'this Act, the authorised officer may, after ?:iving'the holder of the licence a reasonable opportunityof showing cause, elm cancel or suspend thelicence or forfeit the whole or any part of thesecurity, if any, furnished for the due performanceof the conditions subject to which the licence hasbeen granted.

(2) Subject to any rules that may be made in thisbehalf, the authorised officer may also vary oramend va licence granted under section 6 or sec­tion 8.

12. Registration of vessels. - (1) Theowner of every vessel used or intendedto be used for the purposes of flshing'and kept' all the Union territory sha.Ilregister 'such vessel under this Actirrespective of whether or not it is regis­tcred under section 11 of the Marii1C Pro-ducts Export Development' Authority Central Act

Provided that the authorised officer may, forsufficient reasons to be recorded in writing, extendthe I.ime limit for reglstration by such periods ashe thinks fit. However, such period shall notextend three months. .

(3) 1'110 authorised officer shall issue to the ownerof the vessel registered by him, a certificate ofregistration in the prescribed form and shall enterin the Register to be kept by him, in such form asmay be prescribed, the pai-ticulu..s of such certifi­cate.

(G) No vessel, other than a registered fishingvessel, shall be entitled to a licence under section I),

'of such fishing vessel shall give information tothat effect, in the prescribed manner, to the autho­rised officer, by whom such fishing vessel wasr-egistered and also to Port Officer having juris­diction over the area whereto such fishing vesselhas been moved.

14. Returns to be made by owners of fishing vc,,;­sols. - (1) Every owner of a registered fishingvessel shall furnish to the authorised officer at the

(2) The authorised officer may inspect any regis­tered fishing vessel at any time to verify the accu­ro.cy of any returns made under. this section.

15. fi'illulit.y of orders under sections 6J 11 (md 12.­Every decision of lhe authorised officer under BCC­

tion 6, section 11 or section 12) granting or refusingto grant licence for a fishing vessel or a fishing netor cancelling, suspending, varying or amending suchlicence or registering or cancelling the registrationof a vessel shalf, 'subject to any right of appeal nudersection 16, be final. .

16. lippeals against orders 1'efu8ing grant of li­crnte!] etc. - (1) Any person aggrieved by an order ,of all allLlJorisecI offi<;el' z'c[llf>illg to grant licencefor a fishing vessel or a fishing net or cnnceltiug,suspending or varying or amending such licence orrefusing to register a vessel or cancelling the regis­tration of such vessel may) within thirty days fromthe date on which the order is communicated tohim. prefer an appeal to such authority as may beprescribed (hereinafter in this section referred toas the Appellate Authority) :

Provided that the Appellate Authority may enter­tain the appeal after the expiry of the said periodof thirty days if it is satisfied lhat the appellantwas prevented by sufficient cause from filing theappcal~l1 time. .

. (2) On receipt of an appeal under sub-section (1),the Appellate Authority shall, after glvlngthe appel­lant a reasonable opportunity of being heard, passsuch orders thereon as it deems fit as expeditiouslyas· possible.' . . .

(3) Every order passed by the Appellate Autho­rity under this section-shall be final.

17. Demarcation of specijiecl areas. - The Go­vernment shall subject to such conditions as maybe prescribed demarcate the specified areas.

19. Disposal of seized. [isl», eic, - (1) 'l'hc autho­rised officer shall keep the fishing vessel impoundedunder section 18 in such place and in such manneras may be prescribed,

(2) In the absence of s'uitable facilities for thestorage of fish seized, the authorised officer mayif he is of opinion that the disposal of such fish isnecessary, dispose of such fish and deposit tho pro­ceeds thereof in the prescribed manner in t!woffice of the adjudicating officer.

20. Adjlldicatfon. - (1) Where any authorisedofficer, l'c(errCtl to hi section 13, has reason tobelieve that any fi~illi[jg vc~;~:d b being O!- han heonused in contravention of any I f the provisions of tIli~.l

Act or any order or rule made thereunder, or anyof the conditions of the licence, he shall make nreport thereof to the adjudicating office!',

(2) The adjudicating officer shall hold an enquiry,into the mutters mentioned in the report in the pres­cribed manner, after giving all the parties concerneda reasonable opportunity of being heard,

'21. Penalty. - (I) The adjudicating officer shall,·nfter the enquiry under section 20, decide whetherany person has used orcaused orallowed to be usedany fishing vessel in contravention of any of theprovisions of this Act or of any order or rule madethereunder or any of the couditlons of licence nnrlany such person on being found guilty by the adju­dicating officer, shall be liable to such penalty notexceeding: -

(a) five thousand rupees, if the value of the fishinvolved is onc thousand rupees or less: or

(b) five times the value of the fish, if the valueof tho fish involved is more than one thousand

(c) fivc Lhousaud rupee», ill (Illy ol.hcr cnnn,being a case not involving in any flsh, as may beadjudged by the adjudicating officer.

sible to the company for the conduct of the businessof the company as well ns the company, shall hedeemed La be guilty of the offence and shall be liableto be proceeded against and punished accordingly:

Provided that nothing contained in this sub-sec­lion shall render any such person .Iiable to anypunishment, if he proves that the offence wascommitted without his knowledge or that he hasexercised all due diligence to prevent the commis­sion of such offEmce.

(2) Notwithstanding anything conlaincd in sub­

-sccl.iou (1), where .riny offence under Lhis Act hasbeen committed with the consent or connivance of oris attributable to any neglect on the part of, anydiJ"(~elor, mnnnrrer', f,ccrnL:t.ry 01" ol.hcr officer, nuchdirector, manager, Hecrclary or other officer shallbe deemed to be guilty of that offence and shall beliable to, be .proceeded against and punishedaccordingly.

Explanation. - for the purposes of this section: -

(a) "company" means any Body Corporate andincludes a firm or association of individuals; and

(b) "dlrector'{Ju relation to a firm means apartner in the firm.

(2) If the Government is of the opimou that,having regard to the purpose of this Act, it wouldnot be in the public interest to apply all or' any oftlJ(~ prov lnious of thin AcL to nny chum or classes offishing vessels used for fishing in specified urea orareas, it may by notification in the Official Gazette,exempt, subject to such conditions as it may thinkfi t to impose, such classes or classes of fishingvessels used for' fishing in such specified area orareas as it may specify in the notification, from theoperation of all or any of the provisions of this Act.

27. Protection of action taken in good faith. - (1)No suit, prosecution or other legal proceeding shalllie against the Government or any officer or autho­rity for anything which is in good faith done orintended to be done in pursuance of this Act orany order or rule made thereunder.

(2) No suit or legal proceeding shall lie againstthe Government or any officer or authority forany damage caused or likely to be caused by any-.thing which is in good faith dona-or intended tobe done in pursuance of this Act or any order orrule made thereunder..

28. Power to c1nalce rnle,~.~ (1) Government may,by notification in the Official Gazette, make rulesfor carrying out the provisions of this Act.

(2) In particular, anrl without prejudice to thegenerality of the foregoing power, such rules maybe provided for all or any of the following matters,namely: - .

(a) the matters to which regard shall be hadin making an order' under sub-section (1) ofsection 4;

(b) the form of application for licence undersub-section .(1) of section 6, the particularswhich it shall contain and the fees which shallaccompany it..

(0) the form of application for registration ofa vessel under section 12; the particulars whichsuch application shall contain and. the -fees whichshall accompany the application, the form of thecertificate of registration and the form of theregister referred to in sub-section (3) of thatsection, the manner in which the registration mark

. referred to in sub-section: (4) . of . that· sectionshall be displayed;

(f) t.hc manner in which the Informa.tion re­ferred to in· section 13 shall be given;

(g) the itcm and manner in which their returnsreferred to in sub-section (1) of section 14 shallbe furnished;

(h) the authority to whom appeals shall bepreferred under sub-~ecti<:~n (I) of secticnJfl;

0) the place and the maimer in which an im­pounded fishing vessel shall be kept under sub­-section (1) of section 10 and the manner in whichthe proceeds of the disposal of the seized fishshall be deposited with the adjudicating officerunder sub-section (2).,of that section;

(j) the procedure of the enquiry by the adjudi­cating officer under sub-section (2) of section 20;,

(k ) the qualifications of the members of theAppellate Board other than the Chairman, thefees and allowances payable to the Chairman andother members of the Appellate Board; the pro-

. cedure of the Appellate Board;

- (1) the fees payable; for supply of copies ofdocuments or orders or for any. other purposeor matter involving the rendering of any serviceby any officer or authority under this Act;

(m) any other matter which is to be or maybe provided for by rules under this Act.
