Are the resources forpostgraduate students good?I like the library very much it is avery nice area to study; you canget a book and a coffee, justperfect. There is a lot to get involvedin. For example the Global SkillsAward is a very good opportunityto develop your skills. There is aseries of workshops on leadership,negotiation and mediation skillsas well as guest lectures on currenttopics.

And the city of Canterbury is verypicturesque, with lots of shops andrestaurants. It’s a lovely place tospend time.

What are your future plans?My lecturers have alreadymentioned the possibility of doinga PhD. I hadn’t really considered itbefore, but I am considering it now.If I decide not to do a PhD, I amconvinced that my Master’s willhelp me when I return to work. Ithas given me time to research areasI am interested in, to analyse the lawand to discuss my ideas with otherpeople. Every day I put anotherbrick in my wall of knowledge.

Would you recommend thiscourse?Absolutely. The facilities are great,the people are great and it is awonderful location. I enjoy the styleof learning here, you have to workindependently and takeresponsibility for your learning,which I think is a good thing. I thinkdoing this course has changed mefor the better, so come with an openmind and you will definitely benefit.

Prior to studying for anLLM at Kent, LuminitaOlteanu had beenpractising law forsix years.

What attracted you to Kent?One of the main reasons was theamount of choice Kent’s LLM offers.Having the opportunity to choosefrom so many modules was veryattractive. Initially, my specialisationwas in intellectual property lawbut as my modules overlappedwith those on the internationalcommercial law specialisation,I now have a double specialisation.I was also attracted to the criticallaw ethos of the School.

Did you visit Kent before youbegan your studies?Only virtually, it is actually better inreal life! I am from Bucharest andthis is the first time I have spent anextended period away from home.I have settled in fairly quickly. Peopleare very nice here and the staff tryhard to give you the best experiencethey can. There is a lot of energyand resources invested in thewelfare of students and you areencouraged to give feedback if youthink something could be improved.

I live on campus in Woolf College,which is very nice. At first, I wasn’tsure, but now I am convinced thatit is a good thing because you havea chance to socialise and networkwith people from other countries.It is time efficient as well becauseeverything is here and you don’thave to commute.

Was it difficult to return tostudying?I always wanted to do a Master’sabroad and having been at work forsix years I thought this was my lastchance. I felt it would be good forme personally and would also helpme to move forward in my career.

How is the course going?The lecturers are very flexible andfriendly and give good feedback.I have only good things to say aboutthem. My modules have exceededmy expectations; the convenors areinspiring, they broaden your mindwith their ideas – sometimes I thinkabout a question they raise for daysafterwards. I used to think mainly ina practical, client-related, solution-oriented way, I didn’t challenge thepremises behind the law, but nowI think more creatively about the lawand its impact.

What about your fellowstudents?I think there are around 100 lawpostgraduate students but giventhe number of available modules(around 70), the class sizes inindividual modules are often quitesmall. There are around 15 peoplein my seminars, which means theconvenor can focus on all thestudents and you always get thechance to contribute. We area diverse group, I know peoplefrom countries in Africa, Asia andEurope, it is a great experiencebecause talking directly to themgives you the chance to developyour own ideas about a countryand its people rather than relyingon stereotypes.

It is possible to design your ownprogramme of study, (see p9).

Teaching and assessmentAll our programmes can be studiedfull-time or part-time. (See p11 forone student’s experience of part-time study.) You can start your LLMstudies in September or in January.

September startOn the LLM programme inCanterbury starting in September,you study one year full-time or twoyears part-time. You study threemodules in the autumn term(September-December) and three inthe spring term (January-April). Themodules are normally assessed bya 5,000-word essay. You also writea dissertation of 15,000 words overthe summer.

January startOn the LLM programme inCanterbury starting in January,you study 15 months full-time or 28months part-time. You study threemodules in the spring term (1)(January-April) and three in thefollowing autumn term (September-December). You write yourdissertation in the following yearin spring term (2) (January-April).

Our LLM and Diplomaprogrammes are open andflexible. You can specialisein one area (pathway) oflaw, study one major andone minor pathway or takea broad approach with nospecialist pathway.

Choosing your pathwayYou do not have to choose yourpathway until after you arrive atKent. Your choice of pathway isshaped by the modules you takeand your dissertation topic. Tobe awarded an LLM in a singlepathway, at least three of yoursix modules must be chosen fromthose associated with that pathwayand your dissertation must focuson that area of law. The other threemodules can be chosen from anyoffered in Kent Law School.

To be awarded a major/minorpathway you take three modulesassociated with one pathway, andthree from another pathway, withthe dissertation determining whichis your ‘major’ pathway.

For example, a student whocompletes at least three modules inInternational Commercial Law andcompletes a dissertation in this area

In addition to thespecialist pathwaysfeatured on the followingpages, we also offer anLLM that allows you totake a broader view of thelaw, giving you expertiseacross a range of areas.

This LLM is particularly useful forthose who wish to broaden as wellas deepen their legal knowledge.

On this LLM, you are able to createa programme of study that meetsyour particular needs. Designingyour own programme gives you a

high level of flexibility and controland allows you to study modulesin very different legal areas.

You select your modules from thewide and exciting range availableon contemporary legal issues. Youcan choose modules from any ofthe pathways listed in this brochure.

A supervised dissertation on arelevant agreed subject is thenundertaken. Working with yoursupervisor, you develop an in-depthstudy of a particular area of law.Writing the dissertation allows youto hone your legal research andwriting skills.

Students who successfully completean individualised programme oflegal studies will obtain an LLM inLaw.

CRIMINAL JUSTICE

This pathway coverscriminal law andprocedure in the UK,internationally andcomparatively.

It examines criminal justice systemsfrom a range of perspectives,including the management oforganisations, human rights, thepsychological and sociologicalcauses of criminal behaviour andsocial and economic perspectives.

This pathway is designed for thosewho already work, or intend to work,within the criminal justice system,whether for the police, probationservice, prison service or otherorganisations with an interest insuch matters.

There is close co-operation withthe MA in Criminology, run by theSchool of Social Policy, Sociologyand Social Research. (For detailsof this programme, seewww.kent.ac.uk/pg/173) Studentson the LLM are able to take amodule from the MA in Criminology.Criminology has specialists in manyareas including criminologicaltheory, research methods, youthcrime, gender, cultural criminologyand terrorism.

StructureStudy is divided between taughtmodules, which last for one termeach, and dissertation work. Forfull-time students, a total of sixmodules must be taken over the firsttwo terms. A supervised dissertationon a relevant agreed subject is thenundertaken.

You take a minimum of threemodules associated with thissubject pathway but considerableflexibility is offered in allowingyou to select your optional modulesfrom the full range of law modules.See p7.

What would you mostrecommend about part-timestudy?I could not have completed theLLM full-time – I was not timerich! – so being part-time allowedme to juggle being a mum and paidwork in court. Being part-time didn’tmean that I was on my own though,I met lovely colleagues who werealso in the same boat and we wereable to support each other over thetwo years.

What advice would you givesomeone who is thinking aboutstudying for an LLM part-time?If you have a real interest in yourarea of study – go for it! You willfind drive and enthusiasm fromthe stimulating environment hereat Kent, the passionate teachingstaff and being among inspiringstudents. Kent’s critical approachto the study of law allowsinterdisciplinarity and freedom topursue the aspects of law and lawin society that pique your curiositymost.

How did you reach the decisionto study an LLM part-time atKent?Having practised since 2002as a criminal lawyer (both as adefence solicitor and then crownprosecutor), the criminal justicesystem in practice was familiar tome. However, I had questions aboutthe system I was in. I wanted tounderstand the theory of what Idid, its context and how the criminaljustice system might better meetthe needs of those caught within it.

What specialism did you studyand why?I specialised in Criminal Justice.At Kent, modules such as penology,the critical introduction to criminaljustice, policing, the sociology ofviolence and transnational criminallaw were particularly appealing.

What was it like to study for anLLM part-time while working?Studying for the LLM part-time wasreally rewarding. Taking two yearsto complete the programme allowedtime for proper reflection on mystudies – despite the time pressures

of family and work life. Of courseI had to get organised and be prettydisciplined about ‘knuckling down’during the time I had for study butI found a real motivation to learnmore and dig deeper.

How do you think studying foran LLM has influenced yourcareer? Having completed the LLM, I knewthat I wanted more of academia!I moved on to pursue a PhD andhave enjoyed this in ways I couldnot have imagined. I am now inmy third year and also work as aGraduate Teaching Assistant atKent Law School. At this stage it’sa little too soon to say in tangibleterms how my study will influencemy career path, but I do know thatwhen I prosecute in court thesedays I do so with my eyes open,alert to conversations andperspectives that really animatemy practice (I hope for the better!).

HUMAN RIGHTS LAW

On this pathway, youexamine human rightsprotection at national,regional and internationallevels.

It is particularly suited to those whocurrently work in, or hope to workin, international organisations,non-governmental organisations,international law firms and foreignaffairs departments. It is also suitedto those who want to develop ahuman rights practice in a domesticlaw context.

You are encouraged to participatein the activities, including workshopsand guest lectures, of the Centre forCritical International Law (CeCIL)(see p30).

How do you think your studiesat Kent will affect youremployment prospects? I have acquired a more analytical,critical perspective on things andhave made vast improvements inmy research and writing skills.I think these are important skillsthat employers look for in the legalprofession.

Any advice for those thinkingabout taking this course?Choose modules that fit yourinterests but don’t shy away fromtrying something different. Makethe most of the course: engagewith the seminar material, join inwith discussions in seminars andask questions. Why did you choose thisparticular pathway? Before my postgraduate studiesat Kent, I practised law in Karachi,Pakistan. I chose the LLM inInternational Commercial law (witha minor in Intellectual Property)because much of my work relatedto commercial law and I wanted toimprove my career prospects inthis area of law. I also wanted tounderstand how the global politicaleconomy works and why law hasdeveloped in the way that it has. Ithought Kent Law School’s criticallegal perspective, where subjectsthat you would normally expectto be doctrinal are taught withdifferent critical or multidisciplinaryperspectives, would really helpme with these ambitions.

Why did you choose Kent?Kent is one of best critical lawschools, ranked in the top 20 inthe UK. My brother studied lawat Kent a few years ago and it washis experience of Kent’s excellentacademic tradition and the qualityof research and teaching that finallyconvinced me. I had a very specificidea about what I wanted from mypostgraduate experience, and I feltthat Kent would provide what I waslooking for.

What are you enjoying aboutyour studies here?I enjoy the interactive seminar/groupdiscussion approach to teaching.

Most students come from differentbackgrounds so everyone’scontribution is unique, whichmakes the seminars a greatlearning experience. I alsoenjoy researching and writing myessays. Having essays instead ofexaminations gives you more timeto engage with the material on yourown terms, so you gain a more in-depth knowledge of specific areasthat are of interest to you.

Academically, my postgraduateprogramme has given me a greatdegree of freedom in how toapproach my work. I have beenable to ask deeper questionsabout the law and the world.

Do you have a favouritemodule?Generally, I have enjoyed all mymodules. I found the moduleson the World Trade Organizationand international law on foreigninvestment particularly interestingand challenging. They gave mea better perspective on how theglobal political-economy works.

What about the teaching?I knew from my brother’s experiencethat Kent Law School had excellentteachers. However, the qualityof teaching exceeded myexpectations. I liked all the moduleconvenors I had and feel verylucky to have been taught bysuch excellent teachers.

How would you describe yourfellow students?My fellow students were kind,respectful, helpful and intelligent.

STUDYING LAW AT BRUSSELS

Kent’s Brussels Schoolof International Studiesis a multidisciplinarypostgraduate school. Itoffers taught programmesin international studiesdelivered by leadingacademics and skilledpractitioners.

Programme structureIn Brussels, you can take yourdegree as a standard 12-month,90 ECTS credit version (whichcomprises six taught modules plusa dissertation) or as an extended,18-month 120 ECTS credit version(which comprises nine taughtmodules plus a dissertation).

It is also possible to take asecondary minor subject pathwayin another available area of law orpolitics and international relations(see p25). This is done through theoptional modules chosen.

You can begin your studies inSeptember or in January and if youare studying on a standard 90 ECTScredit programme you can studypart-time.

On this LLM, you examinethe theory and practiceof human rights law,international criminallaw, humanitarian law,transitional justice,migration law and otherfields in the context ofdifferent policy areasand various academicdisciplines.

This pathway providesa detailed understandingof the role, potential andlimitations of publicinternational law ininternational affairs.

After recent decades of rule oflaw promotion, the need to ‘legally’harm, detain, profit or pollute hastransformed how policy moves arenow performed and contested onthe world stage. This has elevatedthe significance of internationallegal rules for a range ofgovernmental, corporateand societal actors, which allcompete to devise legal norms,characterisations and strategiesto address global political andeconomic problems. Internationallaw has therefore become a centraldomain of struggle across a varietyof pressing policy challenges,ranging from robotised militarystrategies, territorial claims spurredby climate change, or the globalprojection of EU rules, totransnational blacklists.

This LLM pathway respondsto increasing complexity in theinternational legal order; whereinternational law evolves throughtransformations such as globalcounter-terrorism, global valuechains, and foreign investmentarbitration.

Its interdisciplinary approach isparticularly suited to those involvedwith, or hoping to work for,

international organisations,non-governmental organisations,foreign affairs departments andinternational law firms.

Describe a typical day in yourcurrent role.There really isn’t one. I couldbe inspecting an industrial site,responding to an appeal, defendinga decision we have made, orresponding to a consultation onthe transposing of EU legislation,relating to my area of work.

What are your future goals?I would like to work in a centralgovernment department*, in policyformulation or in an internationalorganisation using both my lawbackground and frontlineexperience.

Did Kent live up to yourexpectations?Yes, and beyond! When you leavea good career to study in a foreigncountry it is normal to have a fewworries. But I (and my then critics)now know it was the best decisionI ever made. My LLM from Kenthas helped me to make the careerchange I was looking for.

Any memories of Kent thatyou would like to share?Winning the Kent Law SchoolOverseas Scholarship was ahighlight, but there are manyothers – too many to mention here.

What advice would you giveto someone coming to Kent?Coming to Kent was one of thebest decisions I have made in mylife. Whatever your background,wherever you are from, whateveryour ambitions are, Kent will havesomething special to offer.

Nilanka Ranasinghecompleted his LLM in2008, specialising inEnvironmental Law. Henow works for Neath PortTalbot County BoroughCouncil regulatingindustrial pollution.

Why did you choose Kent?Kent offered everything I waslooking for. I wanted to focus onenvironmental law, and Kent offereda well-balanced LLM, whichcovered a wide range of areas inenvironmental law, including moduleoptions from different disciplines.Also, Kent had very good ratings forresearch, and it looked like a lovelyplace to be.

How did you find the teaching?Teaching at Kent was not justclassroom-based. In the autumnterm we spent a weekend in Wales,listening to talks by a variety ofacademics while sitting in front ofa log fire, drinking hot chocolate!

My tutors were very knowledgeableand imparted their knowledge withan open mind, creating a relaxedatmosphere in classes, whichencouraged us to contribute.This helped us to develop ourpresentation skills and to learnfrom each other. Kent, in my opinion,has incorporated innovation intoits teaching without losing the valueof traditional methods.

What was your experience ofthe academic community?At Kent you are valued as a student.The School is very welcoming and

there is a real camaraderie betweenstudents and academic staff. Whatamazed and inspired me was thebreadth of knowledge of theacademic staff; they are notonly specialists, but are alsoknowledgeable about a wide rangeof areas. Many of the academicsI met have had a positive influenceon my future.

What did you particularly enjoyabout Kent?

The people and the hospitality.Everyone, staff and students, wasvery welcoming. I was met by amember of the International Team atthe airport and supported by themthroughout my time at Kent; peoplein the postgraduate office were veryhelpful and a member of staff alsohelped me to phone my parents inSri Lanka to let them know that I hadarrived safely. The people at Kentmade the University a home awayfrom home.

How did your LLM lay thefoundations for your career?

I have been working in localauthorities for the last seven years,regulating industrial pollution. Beingat the front line of implementingenvironmental regulations requiresa sound knowledge of both EU anddomestic environmental legislationand my LLM has given me anexcellent grounding in these. I amquite surprised at how often theknowledge learnt in my LLM hascome into play. In my role, I dealwith many relevant topics from mystudies, from the ‘polluter pays’principle to the Aarhus Convention.

Criminal JusticeCo-ordinator: Dr Flora RenzFlora’s research interests lie in thearea of gender, sexuality and lawand the legal regulation of identities.She is concerned with the legalregulation of (trans)gender identitiesand sexuality in society and broaderquestions focusing on the interfacebetween structural inequalities, law,gender, sexuality, and emotion.She is currently working with othermembers of Kent Law School onan ESRC-funded socio-legal projectasking whether government shouldretain the current system of a legalgender assigned at birth.

Human Rights LawCo-ordinator: Sian Lewis-AnthonySian’s current research aimsto assess mental health serviceprovision in the UK from theperspective of a human right tohealth. The government’s austeritymeasures will be examined todetermine how, and the extent towhich, they undermine the rights ofthose with mental health problems –and specifically, the essentialelements of the right to health,namely availability, acceptability,accessibility, and quality.

Intellectual Property LawCo-ordinators: Dr Jose Bellido/Dr Hyo Yoon KangJose’s research interests includeintellectual property law and itshistory; legal theory; and evidence.Recent funded projects havecovered music copyright, the historyof copying patents (PASSIM), andcontributions to an oral historyof intellectual property, a projectfunded by CREATe, Universityof Glasgow. Jose is a memberof the Governing Board of theInternational Society for the Historyand Theory of Intellectual Property(ISHTIP). In 2016, he was visitingFellow at the UNSW, Sydney andin 2017, he was research Fellowat The National Museum of Play inthe USA. Jose studies the historyof intellectual property in the late19th and 20th century, especiallyin Britain. His latest book, is theedited collection, Landmark Casesin Intellectual Property (2017).

Hyo’s research interests are inthe areas of intellectual properties,history of sciences and practicesof knowledge-making. Sheapproaches research problemsfrom varying cross-disciplinaryperspectives, drawing insightsfrom humanities, qualitative andquantitative social sciences. Shehas published on the concept of thehuman person implicated in patentsrelated to human genetic materialand information; the organisationof legal and scientific informationin patent law; material media andbureaucracy of intellectual propertylaw. She is working on a book whichexamines the value and valuation

practices of intellectual property,focusing on patents. Other currentprojects include an analysis of thecreative process of composing andthe figure of the composer in musiccopyright law, a European ResearchCouncil-sponsored project on therelationship between the patent textand scientific information (part ofPASSIM Patents as ScientificInformation), as well as co-convening an Arts and HumanitiesResearch Council Legal MaterialitiesResearch Network, which exploreshow certain things come to matterto law and acquire legal meaning.

International CommercialLawCo-ordinator: Dr GbengaOduntanGbenga has research interests inpublic and private international lawparticularly international courts andtribunals; arbitration; internationalcommercial law, anti-corruption law,international economic law and oiland gas law. He is a recognisedexpert in sovereignty and boundaryissues, as well as in air and spacelaw. He is the author of severalbooks including International Lawand Boundary Disputes in Africa(2015) and Sovereignty andJurisdiction in Airspace and OuterSpace (2012). He is also a memberof the Chartered Institute ofArbitrators and of the Nigerian BarAssociation (Barrister and Solicitor).

Brussels programmesYutaki Arai, Professor of LawYutaka’s research interests include:international humanitarian law;international human rights law;international criminal law; Europeanhuman rights law (especiallyEuropean Convention on HumanRights); theories of publicinternational law. Yutaka’s workinglanguages are English, French andJapanese, and he enjoys readingknowledge of Spanish, Italian andChinese. He has published widely,including in the Yearbook ofInternational Humanitarian Law;International Review of the RedCross; Yearbook of EuropeanLaw. He is currently undertakingresearch for the purpose of writinga book on the drafting records ofthe Geneva Conventions of 1949.

Harm Schepel, Professor ofEconomic Law and Directorof Law Programmes at BSISHarm’s research interests lie inthe broad fields of European andinternational economic law, law anddevelopment, legal sociology, socialtheory and political economy. Harmrecently completed two majorprojects: one on the public/privatedistinction in European economiclaw, the other on the role of privategovernance regimes in marketintegration. He is starting work on amajor project on the spread of legalneo-liberalism from a sociologicalperspective. The first instalments ofthis are in the areas of investmenttreaty arbitration law and Europeancorporate governance.

Emilyhas published on the treatmentand construction of victims ininternational criminal law; on therelationships between internationalcriminal law and civil society; andon international criminal legalhistory. Her current research,which draws on archival research,examines 19th-century slave tradeabolition litigation.

International EnvironmentalLaw and PolicyCo-ordinator: Professor BillHowarthBill’s main research interests are inenvironmental and ecological law,at European Union and nationallevels. He is particularly interestedin laws relating to the protectionand conservation of the waterenvironment and aquaticecosystems. He is a prolificauthor and has acted in anadvisory or consultancy role forvarious government departmentsand public bodies. He is a memberof the Committee of Fish Legal anda Fellow of the Royal Society of Artsand the Institute of Water andEnvironmental Management.

International Law/International Law withInternational RelationsCo-ordinator: Dr Sara KendallSara’s research addresses legalresponses to – and complicitywith – forms of violence, broadlyunderstood. Sara has publishedwidely on areas including: the

implications of the victim as a legalcategory in international criminallaw; the political economy ofinternational criminal tribunals;legal pluralism and ‘hybridity’ atthe Special Court for Sierra Leone,and the rise of expert knowledge inpost-Cold War constitution-draftingpractices. She is currently workingon a book-length project on theInternational Criminal Court, inwhich she uses approaches andinsights drawn from the humanities,the interpretive social sciences, andcritical legal theory.

Medical Law and EthicsCo-ordinator: Dr Karen DevineKaren’s interests lie primarily inthe area of medical law and ethics,particularly in the removal, use andstorage of bodily materials andthe legal obligations that this maygenerate. Other interests lie withinclinical negligence, the law ofconsent and the law of tort moregenerally. Karen’s PhD entitled,‘Unravelling the (dis)cord: the social,legal and ethical implications ofumbilical cord blood collection’(2009) highlighted the possiblehealth risks to pregnant womenand babies associated with thecollection process and examineda previously unconsidered area oflaw – the legal risks faced by thehealth professionals that facilitatethe collection process, in particularfor the non-disclosure of risk.
