TITOLO IPRINCIPI FONDAMENTALI

TITLE IFUNDAMENTAL PRINCIPLES

Art. 1 Article 1Il Veneto è Regione autonoma, nell’unitàdella Repubblica italiana, secondo i principi enei limiti della Costituzione, e si dà ilpresente Statuto.

The Veneto is an autonomous region, within the unityof the Italian Republic, pursuant to the principles andwithin the limits of the Constitution, and is governedby this Statute.

La Regione è costituita dalle comunità dellapopolazione e dai territori delle province diBelluno, Padova, Rovigo, Treviso, Venezia,Verona e Vicenza. Capoluogo è Venezia.

The Region comprises the communities of thepopulation and the Provinces of Belluno, Padua,Treviso, Venice, Verona and Vicenza. Its chief townis Venice.

Art. 2 Article 2L'autogoverno del popolo veneto si attua informe rispondenti alle caratteristiche etradizioni della sua storia.

The self-government of the people of Veneto isimplemented in forms corresponding to the featuresand the traditions of its history.

La Regione concorre alla valorizzazione delpatrimonio culturale e linguistico dellesingole comunità.

The Region contributes to the enhancement of thelinguistic and cultural heritage of its individualcommunities.

Art. 3 Article 3La Regione ha per fine l’affermazione dellapersona umana e la partecipazione di tutti icittadini alla organizzazione politica,economica e sociale della Repubblica.

The aim of the Region's activities is to favour thefulfilment of human personality and to support theparticipation of all citizens in the organization of thepolitical, economic and social life of the Republic.

La Regione per rendere effettive la libertà el’uguaglianza, promuove lo sviluppo socialeed economico con riforme idonee adaffermare il ruolo dei lavoratori nella società,a favorire le libere attività delle comunità, adeliminare gli squilibri territoriali e settoriali.

In order to make freedom and equality effective, theRegion shall foster social and economic developmentthrough suitable reforms, with a view to reaffirmingthe workers' role within society, as well as favouringfree activities within the communities, so as toremove any territorial or sectoral imbalance.

Art. 4 Article 4A questi fini la Regione veneta esercita ipropri poteri:

The Region of Veneto shall exercise its own powersin order to attain the following objectives:

- per rendere effettivo l’esercizio del dirittoallo studio, al lavoro e alla sicurezza sociale, edei diritti della famiglia;

- to enable effective exercise of the right to study, towork and to enjoy social security, as well as of familyrights;

- per rendere effettiva la parità sociale delladonna;

- to obtain social equality for women;

- per determinare l’assetto sociale edeconomico del territorio, rispettandone lecaratteristiche naturali e promuovendone lapiena valorizzazione, con particolare riguardo

- to define the social and economic set-up of theterritory, in the full respect of its natural features andwith a view to promoting the enhancement of itsassets, with particular regard to underdeveloped

alle aree depresse, alle zone e comunitàmontane, e per eliminare le causedell’emigrazione;

areas, as well as mountain districts and communities,so as to remove the causes of workers' migration;

- per predisporre e attuare piani per la difesadel suolo, la regolazione delle acque, la lororazionale distribuzione e la bonifica delleterre;

- to devise and implement plans for soil protection,water management and rational distribution, as wellas land reclamation;

- per risanare e salvaguardare gli ambientinaturali e umani nel loro insieme, con unapolitica ecologica intesa a prevenire edeliminare le cause di inquinamento dell’aria,delle acque e del suolo;

- to reclaim and safeguard the natural environmentand human settlements as a whole, through anenvironmental policy striving to prevent and removethe causes of air and water pollution, as well as soilcontamination;

- per garantire la conservazione e il ripristinodel patrimonio ambientale, storico e artisticodel Veneto e di Venezia.

- to ensure the preservation and the recovery of theenvironmental, historical and artistic heritage ofVeneto and Venice;

- per promuovere la piena occupazione deilavoratori, nella tutela dell’esercizio dei lorodiritti, e assicurarne la formazione e lariqualificazione professionale;

- to promote full employment, while ensuring the fullexercise of workers' rights, as well as guaranteeingtheir access to continuous vocational training;

- per realizzare lo sviluppo dell’agricoltura,della pesca, dell’artigianato, delle attivitàindustriali, commerciali e turistiche;

- to ensure the development of farming, fishing,handicraft production, industrial activities, trade andtourism;

- per promuovere nei vari settoridell’economia il metodo della cooperazione acarattere di mutualità e senza fini dispeculazione;

- to promote the use of the methods of non-speculative mutual cooperation in the differentsectors of the economy;

- per instaurare equi rapporti economici esociali nelle campagne, favorendo l’aziendafamiliare, la proprietà coltivatrice direttasingola e associata, e la professionalitàagricola;

- to establish equitable economic and socialrelationships in the rural areas, while favouring thedevelopment of family-owned businesses, thespreading of individual or collective farmer-ownedfarms, as well as the enhancement of the farmers'professional expertise;

- per garantire a tutti i cittadini i servizisociali, con particolare riguardoall’abitazione, alla scuola, alla tutela dellasalute, ai trasporti, alle attrezzature sportive;

- to ensure the availability of social services for allcitizens, with particular regard to housing, education,health protection, transport, and sports facilities;

- per assicurare la funzione sociale dellaproprietà privata nello spirito degli articoli 42e 43 della Costituzione;

- to ensure the social function of private property, inthe spirit of Articles 42 and 43 of the Constitution;

- per svolgere una politica intesa apromuovere le attività culturali e al ricercascientifica e tecnologica.

- to conduct policies aiming to promote culturalactivities, as well as technological and scientificresearch.

Art. 5 Article 5Per il conseguimento delle sue finalità laRegione veneta assume la programmazionecome metodo di intervento, in concorso con loStato. Essa partecipa come soggetto autonomoalla programmazione nazionale e definisce gliobiettivi e i criteri della propria azionemediante piani e programmi, generali e

To this end, the Region shall promote studies andresearch into economic and social issues and townplanning, with the help of local agencies, TradeUnions and social and economic organizations.

La partecipazione democratica è momentoimportante nella formazione e nella attuazionedei piani e dei programmi di sviluppo. Talipiani e programmi sono stabiliti con leggiregionali che devono contenere norme le qualiassicurino l’effettivo concorso degli entilocali, nonchè l’apporto autonomo deisindacati e di altre organizzazioni sociali.

People's democratic participation is an importantelement in shaping and implementing developmentplans and programmes. These are established byregional laws, which must contain provisions toensure the effective cooperation on the part of localagencies, as well as the autonomous contribution ofTrade Unions and other social organizations.

Nell’esercizio delle proprie attività ecompetenze realizza il più ampiodecentramento con la delega delle funzioniamministrative agli enti locali.

In carrying out its activities and in the fulfilment ofits duties, the Region shall attain the widest possibledecentralization by delegating its administrativefunctions to local agencies.

La Regione veneta coordina la propria azionecon quella delle altre Regioni d' Italia.

The Region of Veneto coordinates its own actionwith that of the other Regions of Italy.

Art. 6 Article 6Sono organi della Regione il Consiglioregionale, la Giunta e il suo Presidente.

The organs of regional government are the RegionalCouncil, the Regional Executive, and the President ofthe Executive.

Art. 7 Article 7Il sistema di elezione, il numero e i casi diineleggibilità e di incompatibilità deiconsiglieri regionali sono stabiliti con leggedella Repubblica.

The election system, the number and the cases ofnon-eligibility are established by state laws.

Art. 8 Article 8Il Consiglio regionale determina l’indirizzopolitico e amministrativo della Regione e necontrolla l’attuazione; esercita tutte le potestàlegislative e regolamentari atribuite allaRegione e adempie le altre funzioniconferitegli dalla Costituzione, dalle leggi edallo Statuto; opera le scelte fondamentali

The Regional Council defines the political andadministrative course of the Region's actions, and haspowers of control over their implementation. Itexercises such legislative and regulatory powers asare attributed to the Region and fulfils such otherfunctions as were conferred upon it by theConstitution, by state laws and the Statute; it makes

Art. 9 Article 9Il Consiglio regionale: The Regional Council :a) approva i pareri di cui all’articolo 133 dellaCostituzione e ogni altro parere formalmenterichiesto alla Regione dagli organicostituzionali della Repubblica;

a) adopts the opinions as at Article 133 of theConstitution, as well as any other opinion as isformally required of the Region by the Republic'sconstitutional organs;

b) designa i tre delegati per la elezione delPresidente della Repubblica a terminidell’articolo 83 della Costituzione;

b) appoints three delegates to assist in presidentialelections, pursuant to Article 83 of the Constitution;

c) fa le proposte e approva gli atti con i qualila Regione partecipa alla programmazionenazionale;

c) presents proposals and adopts those acts withwhich the Regions participates in national planning;

d) nomina i rappresentanti della Regione inenti od organi statali, regionali o locali, salvi icasi in cui la stessa potestà sia attribuita dalleleggi della Repubblica ad altri organi dellaRegione;

d) appoints the representatives of the Regions withinstate, regional or local organs or bodies, except forthose cases where the same powers are attributed bystate laws to other regional organs;

e) istituisce enti dipendenti dalla Regione e neapprova gli statuti; istituisce aziende eagenzie regionali;

e) sets up bodies which are subordinate to the Regionand adopts their Statutes; it establishes regionalcompanies and agencies;

f) riesamina gli atti amministrativi regionalirinviati a norma dell’articolo 125 dellaCostituzione;

f) reconsiders such regional administrative acts as areremanded to it pursuant to Article 125 of theConstitution;

g) delibera l’assunzione e la cessione dipartecipazioni regionali;

g) makes decisions on the acquisition or transfer ofregional participations;

h) istituisce e disciplina i tributi propri dellaRegione; emette prestiti e contrae mutui;concede fideiussioni o altre garanzie;

h) adopts and regulates regional taxes; it issues bondsand contracts loans; it stands surety or grants otherguarantees;

i) approva il bilancio di previsione, le note divariazione al bilancio, il rendiconto generale;

i) it adopts the budget, budget amendments and theaccount of expenditure for the past financial year;

l) delibera su ogni altro provvedimento per ilquale lo Statuto o la legge stabiliscono lagenerica attribuzione alla Regione.

Nella prima riunione il Consiglio procede allaelezione dell’Ufficio di Presidenza, costituitodal Presidente, da due Vice Presidenti e dadue Segretari, in modo che venga assicurata lapresenza della minoranza.

During its first sitting, the Council shall proceed toelect the Presidential Bureau, including the President,two Vice-Presidents and two Secretaries, so as toensure the presence of the minority.

Il Presidente del Consiglio è eletto a scrutiniosegreto e a maggioranza dei consiglieriassegnati alla Regione. I Vice Presidenti e iSegretari sono eletti a scrutinio segreto e amaggioranza relativa con due separatevotazioni, votando ogni consigliere per unsolo nome.

The President of the Council is elected by secretballot by the majority of the councillors assigned tothe Region. The Vice Presidents and the Secretariesare elected by secret ballot by a plurality of voterswith two separate votings, with each councillorvoting for a single name.

I componenti l’Ufficio di Presidenza duranoin carica per l’intera legislatura, e fino allaprima riunione del nuovo Consiglio.

The members of the Presidential Bureau will serve intheir respective positions throughout the Council'sterm of office, and until the first meeting of the newCouncil.

Art. 11 Article 11Il Presidente del Consiglio regonale convoca epresiede il Consiglio, assicura il buonandamento dei lavori consiliari,nell’osservanza del Regolamento, provvedeall’insediamento delle Commissioni e necoordina i lavori con quelli del Consiglio.

The President of the Regional Council shall conveneand preside over the meetings of the Council, ensurethat the Council's activities proceed smoothly, incompliance with the Rules and Regulations, see to itthat Committees are set up and coordinate their workwith the Council's.

Il Presidente del Consiglio regionale, entrosette giorni dalla prima riunione del Consiglioo della revoca, dimissioni o decadenza delPresidente della Giunta e della Giunta,convoca i Presidenti dei Gruppi consiliari peruna consultazione in ordine all’elezione delnuovo Presidente e della nuova Giunta.

Within seven days from the first meeting of theCouncil, or from the revocation, resignation, orexpiry of the term of office of the President of theExecutive, or of the Regional Executive itself, thePresident of the Regional Council shall convene ameeting with the Presidents of the Councillors'Groups, in order to consult them on the elections ofthe new President and the new Executive.

Il Presidente esercita ogni altra funzioneattribuitagli dallo Statuto o dal Regolamento.

The President shall fulfil any other duty as isattributed to him or her by the Statute or by the Rulesand Regulations.

Art. 12 Article 12L’Ufficio di Presidenza garantisce e tutela leprerogative e i diritti dei consiglieri, tiene irapporti con i Gruppi consiliari, amministra ifondi deliberati per il funzionamento delConsiglio ed esercita le altre funzioniattribuitegli dallo Statuto o dal Regolamento.

The Presidential Bureau shall guarantee andsafeguard the Councillors' prerogatives and rights,entertain relations with the Councillors' Groups,administer the funds earmarked for the functioning ofthe Council, and perform such other functions as areassigned to it by the Statute or the Rules andRegulations.



Art. 13 Article 13Il Consiglio regionale si riunisce di diritto neimesi di febbraio, giugno e ottobre di ognianno.

The Council shall meet in the months of February,June, and October each year.

Il Consiglio regionale è inoltre convocato periniziativa del Presidente, o su richiesta delPresidente della Giunta o di un quarto deiconsiglieri assegnati alla Regione.

The Regional Council can also meet either on its owninitiative or at the request of the President of theExecutive, or of one fourth of the Councillorsassigned to the Region.

La convocazione è disposta dal Presidente delConsiglio, con preavviso di almeno cinquegiorni. L’atto di convocazione deve contenerel’ordine del giorno della riunione. In caso diassoluta urgenza, la convocazione può esseredisposta con preavviso di quarantotto ore.

The meeting is convened by the President of theCouncil, with at least five days' prior notice. Thedocument convening the meeting shall contain theAgenda of the Meeting. In times of extreme urgency,the meeting can be called with a 48-hours' priornotice.

Qualora il Presidente della Giunta o un quartodei consiglieri ne abbiano presentato richiestaal Presidente del Consiglio, la convocazionedeve essere disposta entro dieci giorni e ilConsiglio deve essere riunito nei dieci giornisuccessivi.

If the President of the Executive or one fourth of theCouncillors have submitted a request to this effect tothe President of the Council, the meeting must beconvened within ten days and the Council must meetwithin the following ten days.

Ove il Presidente del Consiglio non provvedaalla convocazione nei termini previsti dalcomma precedente, o non vi provveda nei casidi cui l primo comma, il Consiglio èconvocato da uno dei Vice Presidenti, con lemodalità e nei termini previsti dalRegolamento.

Should the President of the Council fail to convenethe meeting within the terms envisaged by theparagraph above, or should he or she fail to do so inthe cases shown in the first paragraph above, theCouncil Meeting shall be convened by one of the twoVice-Presidents, with the procedures and within theterms provided by the Rules and Regulations.

Art. 14 Article 14Alla convalida della elezione dei consiglieriregionali provvede il Consiglio regionale, anorma del Regolamento.

The validation of the election of the regionalcouncillors is one of the duties to be performed by theRegional Council, in compliance with the Rules andRegulations.

Il Consiglio delibera su relazione della Giuntadelle elezioni, eletta nella prima seduta ecomposta con riguardo alla consistenzanumerica dei Gruppi consiliari.

The Council shall deliberate on the report submittedby the Committee of the Elections, appointed duringthe first session, whose composition is based on thesize of the Councillors' Groups.

Art. 15 Article 15I consiglieri rappresentano l’intera Regione edesercitano le loro funzoni senza vincolo dimandato.

The Councillors represent the whole Region withoutconstraints ensuing from their mandates.

I consiglieri non possono essere chiamati arisondere per le opinioni espresse e i voti datinell’esercizio delle loro funzioni

The Councillors cannot be penalized for opinionsexpressed or votes cast in the fulfilment of theirduties.

Ogni consigliere ha potere di interrogazione,interpellanza e mozione.

Each Councillor has the power to submit questions,interpellations and motions.

Ogni consigliere ha diritto di ottenereinformazioni e dati e di esaminare gli atti e idocumenti concernenti l’attività della Regionee degli enti, aziende e agenzie regionali,

Each Councillor has the right to obtain informationand data and to peruse the acts and documentsconcerning the activities of the regional authorities,agencies, companies and bodies. The exercise of such

Art. 16 Article 16Il Consiglio regionale adotta e modifica ilproprio Regolamento a maggioranza deiconsiglieri assegnati alla Regione.

The Regional Council shall adopt and amend its ownRules and Regulations with a majority vote by theCouncillors assigned to the Region.

Il Regolamento disciplina l’organizzazione eil funzionamento del Consiglio e dei suoiorgani interni, nel rispetto delle disposizionidello Statuto.

The Rules and Regulations govern the organizationand the functioning of the Council and its internalorgans, pursuant to the provisions contained in theStatute.

Art. 17 Article 17Il Consiglio regionale ha autonomiaorganizzativa e, nell’ambito dellostanziamento assegnato in bilancio,autonomia amministrativa e contabile, cheesercita a norma dello Statuto e delRegolamento.

The Regional Council enjoys administrativeautonomy and, within the limits of the funds allocatedto this end in the budget, it also enjoys administrativeand accounting autonomy, which it exercises incompliance with the Statute and the Rules andRegulations.

Il Consiglio regionale ha propri uffici, deiquali si avvalgono l’Ufficio di Presidenza, leCommissioni e i Gruppi consiliari, nei modistabiliti da apposito regolamento.

The Regional Council has its own offices, which areused by the Presidential Bureau, the Committees andthe Councillors' Groups, pursuant to the proceduresestablished by the special regulations.

Art. 18 Article 18Per garantire il libero esercizio del loromandato, spetta ai consiglieri regionali unaindennità, in relazione alle rispettive funzioni,con legge regionale.

In order to guarantee the free exercise of theirmandates, the regional councillors shall receivespecial emoluments, in relation to their respectivefunctions, pursuant to a regional law.

Art. 19 Article 19Le sedute del Consiglio regionale sonopubbliche.

The sittings of the Regional Council are public.

Il Regolamento stabilisce i casi in cui ilConsiglio si riunisce in seduta segreta.

The Rules and Regulations define those cases whenthe sittings of the Council are secret.

Per la validità delle deliberazioni è richiesta,salva diversa disposizione dello Statuto, lapresenza in aula della maggioranza deiconsiglieri assegnati alla Regione, che nonabbiano ottenuto congedo a norma delRegolamento, e il voto favorevole dellamaggioranza dei presenti.

For the Council's deliberations to be valid, except asotherwise provided in the Statute, the majority of theCouncillors assigned to the Region - who have notbeen discharged based on the Rules and Regulationsmust be present in the Council's Hall, and thedeliberations are carried with a majority vote by themembers present.

Agli effetti di cui al comma precedente, iconsiglieri sono considerati in congedo entroil numero massimo di un quinto, con lemodalità stabilite dal Regolamento.

With reference to the provisions contained in theprevious paragraph, the number of Councillors whomay be regarded as discharged shall not exceed amaximum of one fifth, pursuant to the proceduresestablished in the Rules and Regulations.

Le deliberazioni del Consiglio vengonoadottate a scrutinio palese; tre consiglieripossono chiedere la votazione per appello

The Council's deliberations shall be adopted bypublic ballot. Three Councillors may require that thevotes be cast by roll-call. Voting on persons shall be



nominale. Le votazioni concernenti persone sifanno a scrutinio segreto, salva diversadisposizione dello Statuto.

by secret ballot, except as otherwise provided in theStatute.

Art. 20 Article 20I consiglieri regionali si costituiscono inGruppi.

The Regional Councillors shall form Councillors'Groups.

L’ufficio di Presidenza assegna ai Gruppiconsiliari, per l’esercizio delle loro funzioni,contributi a carico dei fondi deliberati per ilfunzionamento del Consiglio.

The Presidential Bureau shall assign to theCouncillors' Groups, for the fulfilment of their duties,contributions taken from the funds earmarked for thefunctioning of the Council.

Art. 21 Article 21Il Consiglio regionale istituisce proprieCommissioni permanenti, competenti pergruppi di materie affini.

The Regional Council shall set up its own StandingCommittees, which are responsible for groups ofrelated issues.

Il Regolamento disciplina la costituzione ed ilfunzionamento delle Commissioni garantendola partecipazione o la presenza di tutti iGruppi consiliari.

The Rules and Regulations define the procedures forthe establishment and the functioning of theCommittees while ensuring the participation or thepresence of all Councillors' Groups.

Le Commissioni esaminano preventivamente iprogetti di legge e di regolamento e gli altriprovvedimenti di competenza del Consiglio,avvalendosi eventualmente, previa intesa conl’Ufficio di Presidenza, della collaborazionedi esperti, o, previa intesa con la Giuntaregionale, della collaborazione degli ufficicompetenti.

The Committees shall examine in advance bills, draftregulations, and the other provisions for which theCouncil is responsible. In doing so, based on a prioragreement with the Presidential Bureau, theCommittees may avail themselves of the services ofexperts, or, based on a prior agreement with theRegional Executive, they may avail themselves of thecooperation offered by the offices responsible.

Il Consiglio istituisce anche Commissionitemporanee per lo studio di problemi speciali.

The Council may also set up temporary Committeesto study special issues.

Il Presidente e gli altri membri della Giuntahanno il diritto e, se richiesti, l’obbligo dipartecipare ai lavori delle Commissioni, senzadiritto di voto.

The President and the other members of the Giuntahave the right and, if so required, the obligation totake part in the work of the Committees, withoutvoting rights.

The Rulesand Regulations provide for suitable forms ofpublicity of the agenda and the Committees'proceedings.

Within the framework of the issues they areresponsible for, the Coucil's Committees have thepower to order the disclosure or production of actsand documents, and to summon, with prior noticebeing sent by the Regional Executive, the heads ofthe Regional Secretariats and the administrators, or,again with prior notice being sent to them, themanagers of regional bodies, companies or agencies.The persons so summoned have the obligation toprovide to the Committees all the data and theinformation they require, or in any way concerningthe fulfilment of their duties. The Committes'requests cannot be rejected on the grounds of secrecy.

The Regional Council can order that investigations becarried out into regional administrative management,by setting up a special Committee.

The Committee shall be set up through a regional lawestablishing its duties, the subject matters it will beresponsible for, its composition on the basis of thenumber of Group members, as well as the proceduresfor its functioning.

Gli amministratori e i dipendenti dellaRegione e degli enti, aziende e agenzieregionali hanno l’obbligo di rispondere allerichieste della Commissione e di esibire tuttigli atti e i documenti di cui siano in possessoper ragioni d' ufficio, anche in esenzione delsegreto d' ufficio.

The administrators and the employees of regionalauthorities, bodies, companies and agencies have anobligation to answer to the requests submitted by theCommittee and to disclose or produce all the acts anddocuments they possess for reasons related to theiroffice, also in the presence of official secrets.

The members of the Committee are obliged to keepthis information secret during the preliminaryinvestigations.



CAPO IIIL PRESIDENTE E LA GIUNTA REGIONALE

HEADING II THE PRESIDENT AND THE REGIONAL EXECUTIVE

Art. 25 Article 25La Giunta è composta dal Presidente e da unnumero di membri non superiore a un quintodei consiglieri assegnati alla Regione, ed èeletta dal Consiglio fra i suoi membri, con lemodalità stabilite dall’articolo seguente.

The Regional Executive comprises its President and anumber of members that must not exceed one fifth ofthe Councillors assigned to the Region. It is electedby the Council from among its own members, incompliance with the procedures established by thefollowing article.

Art. 26 Article 26L’elezione del Presidente e della Giuntaavviene sulla base di documentiprogrammatici, presentati da uno o più Gruppiconsiliari, e collegati a liste bloccate recanti ilnome del Presidente e degli altri membri dellaGiunta.

The elections of the President and the RegionalExecutive shall take place on the basis of documentsand programmes submitted by one or moreCouncillors' Groups, related to non-modifiable listsreporting the name of the President and the othermembers of the Executive.

Il Consiglio procede, dopo la discussione suidocumenti programmatici, alla elezione delPresidente e della Giunta, con voto perappello nominale e a maggioranza assolutadei consiglieri assegnati alla Regione.

After a discussion on such documents andprogrammes, the Council shall proceed to elect thePresident and the Executive by an absolute majorityvote by roll-call on the part of the Councillorsassigned to the Regions.

The resignations and cases of discontinuance ofoffice on the part of single members of the Executiveshall be announced by the President of the Executive,who shall inform the President of the Council of theoccurrence within ten days. The latter shall in turnimmediately inform the Council for it to make itssubsequent decisions.

Should the President or the Executive cease to servein their capacities, the President of the Council,having complied with the provisions contained inArticle 11, Paragraph II, shall convene a meeting ofthe Council within thirty days, in order to elect thePresident and the Executive.

The President of the Executive shall represent theRegion; promulgate regional laws and regulations;direct the administrative functions delegated by theState to the Region.

Convoca la Giunta regionale, la presiede e necoordina l’azione amministrativa;sovraintende agli uffici e ai servizi regionali;presenta al Consiglio il bilancio e ilrendiconto generale, unitamente alla relazionegenerale sull’attività svoltadall’amministrazione regionale; esercita lealtre attribuzioni conferitegli dallaCostituzione, dallo Statuto e dalle leggi.

He or she shall convene the meetings of the RegionalExecutive, preside over it and coordinate itsadministrative action; supervise the activities ofregional offices and services; submit to the Councilthe budget and the general account of expenditure,together with a general report on the activities carriedout by the regional administration services; andperform such other functions as are attributed tohim/her by the Constitution, the Statute or other laws.

The President shall appoint - from among themembers of the Executive - the Vice-President, whoshall replace him when he is absent or unable to servein his capacity.

The Executive, the Regional Council and theGovernment Commissioner shall all be informed ofthe appointment.

Art. 31 Article 31L’Ufficio di Presidente o di membro dellaGiunta regionale è incompatibile con quellodi amministratore di altro ente pubblicoeconomico o di interesse pubblico, che operinella Regione.

The office of the President or of the members of theRegional Executive is not compatible with the tasksof an administrator managing another public agencyof an economic nature, or in any way affecting theinterests of the public within the Region.

Non possono contemporaneamente far partedella Giunta regionale ascendenti ediscendenti, fratelli, coniugi, affini di primogrado, adottante e adottato.

At the same time the Regional Executive cannotinclude amongst its members relatives in ascending ordescending lines, brothers, spouses, first-degreerelatives, adopters or adoptees of such anadministrator.

Art. 32 Article 32La Giunta è l’organo esecutivo della Regionee, in conformità con gli indirizzi politici eamministrativi determinati dal Consiglio,esercita funzioni di promozione, di iniziativae attuazione.

The Regional Executive is the Region's executivebody. It shall perform such functions as to promoteand implement policies and take initiatives incompliance with the political and administrativeguidelines defined by the Council.

La Giunta regionale: The Regional Executive shall:a) provvede all’esecuzione delle deliberazionidel Consiglio;

a) attend to the implementation of the Council'sdecisions;

b) esercita l’attività amministrativa di suacompetenza;

b) carry out such administrative activities as liewithin the limits of its responsibilities;

c) predispone e presenta alle Commissioniconsiliari competenti i documenti dellediverse fasi di elaborazione dei piani eprogrammi, generali e particolari, economici eterritoriali, e quindi al Consiglio i relatividocumenti finali;

c) draw up and submit to the Council's responsibleCommittees the documents relating to the variousstages of development of general and particular,economic and territorial plans and programmes; itshall then submit the relevant final documents to theCouncil;

d) redige annualmente una relazionesull’attività dell’amministrazione regionale;

d) draw up an annual report on the activity of theregional administration services;

The sittings of the Executive are public, except asotherwise indicated by the Executive itself.

Art. 35 Article 35La Regione promuove la partecipazionedemocratica alla determinazione delle propriescelte legislative e amministrative mediante ilconcorso dei cittadini e degli enti locali, e gliapporti autonomi dei sindacati, delleorganizzazioni sociali, economiche eprofessionali.

The Region shall encourage democratic participationin the process to define the Region's legislative andadministrative options with the help of the citizensand the local agencies, and through the autonomouscontributions made by Trade Unions and the social,economic and professional organizations.

A tale scopo, la Regione riconosce il dirittodei cittadini, degli enti locali, delleorganizzazioni sindacali, sociali, economichee professionali alla informazione sulla attivitàlegislativa e amministrativa regionale comecondizione indispensabile per una completapartecipazione.

To this end, the Region acknowledge the right of thecitizens, local bodies, Trade Unions, as well as ofsocial, economic, and professional organizations, toreceive information on the regional legislative andadministrative activities as an essential prerequisitefor their full participation.

The Region' duty to inform the public shall also bedischarged, based on the provisions contained in theregional legislation, with the use of specialcommunication tools and through direct meetingsbetween representatives of the regional organs and ofsuch agencies and organizations as are described inthe first paragraph.

La Regione consulta le predetterappresentanze sulle questioni di interessegenerale promuovendo conferenze regionalisu specifici problemi e in particolare perquanto attiene la programmazione regionale.

The Region shall consult the above-mentionedrepresentatives on questions of general interest bysponsoring regional meetings on specific problemsand in particular with refrence to regional planning.

Le Province, i Comuni e gli altri enti locali e idirettivi regionali dei sindacati e delleorganizzazioni sociali, economiche eprofessionali, quando ne facciano richiesta,sono sentiti dalla Giunta e dalle Commissioniconsiliari.

The Provinces, the Munipalities, and the other localbodies and regional managements of the TradeUnions, as well as of the social, economic andprofessional organizations can, if they so require,transmit their opinions to the Executive and theCouncil's Committees.

Art. 36 Article 36Ogni cittadino, associazione o ente ha dirittodi far pervenire al Consiglio, nei terministabiliti dal Regolamento, osservazioni eproposte sui progetti di legge in discussione.

Each citizen, association, or agency has the right tosubmit to the Council remarks and proposals on thebills under discussion, within the terms established bythe Rules and Regulations.

Tali osservazioni e proposte sono esaminatedalla Commissione competente che ne faadeguata menzione nella relazione alConsiglio.

Such remarks and proposals shall be examined by theresponsible Committee, and appropriate mention ofthis shall be made in the report to the Council.

Su richiesta di un quarto dei componenti, laCommissione, prima di riferire sul progetto, ètenuta a procedere all’audizione dei cittadini,associazioni o enti che si siano avvalsi deldiritto di cui al primo comma.

At the request of one fourth of the members, beforereporting on the bill, the Committee has theobligation to hold a hearing in order to listen to thevoice of the citizens, associations or agencies whoavailed themselves of the right mentioned in the firstparagraph above.

Bills or draft regulations shall be examined by theCouncil's responsible Committee and adopted by theCouncil article by article and with a final vote,pursuant to the Rules and Regulations.

Ogni legge regionale che importi nuove omaggiori spese, o minori entrate, deveindicare i mezzi per farvi fronte.

Each regional law implying new or largers items ofexpenditure, or reduced revenues, must indicate themeans through which such higher costs will be met.

Art. 40 Article 40La Giunta e ogni consigliere possono chiederel’esame con procedura d' urgenza di ogniprogetto di legge o di regolamento. Spetta alConsiglio decidere sulla richiesta.

The Executive and each Councillor may require that abill or draft regulation be urgently examined. It is upto the Council to decide on the request.

La procedura d' urgenza è in ogni casoadottata per il riesame delle leggi rinviate dalGoverno ai sensi dell’articolo 127, terzocomma, della Costituzione.

The emergency procedure shall in any case beadopted for reconsideration of the laws remanded bythe Government pursuant to Article 127, Paragraph3, of the Constitution.

Art. 41 Article 41I soggetti legittimati a presentare proposte dilegge o di regolamento possono richiederel’assistenza dell’ufficio legislativo regionale.

The subjects who can legitimately submit a bill or adraft regulation to the responsible bodies can requirethe assistance of the regional legislative office.

Le Commissioni consiliari ammettono alladiscussione delle proposte il primo firmatario,con le modalità stabilite dal Regolamento.

The Council's Committees shall admit the firstsignatory to the discussion on the bills, based on theprocedures established by the Rules and Regulations.

The General Planning Secretariat offers its assistanceto the organs of the regional government in draftingthe documents and acts of regional planning, itcoordinates the activities of the other Secretariats,and ensures that the general duties of the Region aredischargeded.

The regional law shall define the employees' legaland economic status and the relevant organizationchart in compliance with the principles established bythe Statute after suitable consultations with the TradeUnions. It shall also define the rules for incorporatingthe offices and the staff transferred from the Statelevel into the regional offices.

Il personale della Regione è inserito in ununico ruolo regionale e si distingueesclusivamente per qualifiche, corrisondentialle attribuzioni e responsabilità ricoperte, edè assunto mediante concorso, salvi i casistabiliti dalla legge.

The regional staff members are included in a singleregional roll with distinctions exclusively consistingin varying titles and professional qualifications,which correspond to the different assignments andresponsibilities shouldered. The staff shall be hiredon the basis of competitive examinations, except asotherwise provided by the law.

In order to ensure smooth performance and animpartial approach to administrative action, theregional laws regulate the procedures for the adoptionof regional administrative acts.

La Regione promuove la partecipazioneeffettiva dei cittadini e dei gruppi allaformazione dei provvedimenti amministratividi interesse generale e garantisce ilcontraddittorio dei soggetti direttamenteinteressati in tutte le fasi dei procedimentiamministrativi.

The Region shall encourage the effectiveparticipation of citizens and groups in the process ofadoption of administrative provisions of generalinterest and shall ensure a free exchange of opinionsbetween the subjects who are directly involved in allof the different stages of development ofadministrative proceedings.

The power to delegate the administrative functions tothe Provinces, the Muncipalities, and other localbodies, pursuant to Article 118, last paragraph, of theConstitution, is conferred, after suitable consultationswith the bodies concerned, through a law establishingthe guiding criteria, the conditions, the term and theprocedures for their performance. The law alsoregulates the consequent financial relations with thedelegates, as well as possible transfers of personnel.

L’esercizio provvisorio del bilancio puòessere concesso con apposita legge, in viaeccezionale, per periodi complessivamentenon superiori a quattro mesi. The power to attend to the provisional running of thebudget may be granted by means of a special law, asan exception, for periods no longer than four monthsoverall. The regional bodies, companies and agenciesshall submit their own budgets, concurrently with theregional budget, to the Council for approval.

Art. 59 Article 59La Giunta regionale predispone e presentaogni anno al Consiglio una relazione sullostato di attuazione del piano o dei pianiregionali, con indicazioni di previsione, nonoltre il 15 settembre.

No later than by 15th September each year, theRegional Executive shall draw up and submit to theCouncil a report on the progress made in theimplementation of the regional plan or plans,including a number of forecasts.

The General Account of the Region, also includingthe accounts of the bodies, companies and agenciesanswering to the Region, shall be submitted by thePresident of the Executive to the Regional Council by30th June the following year. The Account shall bereferred to the responsible Committee for thenecessary controls.
