Why is Copyright Important?

• Copyright, Designs and Patents Act (CDPA) 1988

• What works are covered and for how long?

• Permission is often needed, however there are some exceptions.

Consider the following when deciding what, if any, 3rd party materials to include in

your learning and teaching materials:

1. Do you have a licence to use it?

2. Do you have permission to use it?

3. Do you have an exception/defence under the CDPA 1988 to use it?

• University staff must consider the implications of what materials they place online

Ownership• S.11 CDPA 1988 states that the first owner of copyright in a work is usually the

author of that work. However, if created by an employee in the course of his/her employment, then the employer is the owner (S.11(2)).

• Check the T&C’s of your Contract of Employment to ascertain the exact position, but generally presume that all materials are owned by the University.

• The University will therefore normally be considered to be the publisher of material produced by staff in their normal day to day activities.

Research and Publication• Externally funded contract terms may supersede your Contract of Employment

T&C’s.

• Publishing agreements – copyright is usually assigned to the publisher, but this can be open to negotiation. A useful site to check publishers’ standard terms is www.sherpa.ac.uk/romeo
