    LEASE DEED/AGREEMENT

    This lease deed is made on 01-08-2013 between, Maj. Yogesh Guleria s/o Mr. G.S.Guleria resident of Vill & Po Katholi, Nagrota Surian, Distt Kangra HP hereinafter referredto as LESSOR (which expression shall unless repugnant to the context include his/herheirs, successors, executors, administrators, legal representatives and assigns of the one

    part)

    And II part of

    Smt. Rajwant Kaur W/o Sh. Harcharan Singh Resident of #1055 Phase I Ram DarbarChandigarh hereinafter called the LESSEE (which expression shall unless repugnant to thecontext include his/her heirs, successors, executors, administrators, legal representativesand assigns of the second part). For identification & records it is noted that PANNo:_____________ (Copy Attached).

    Whereas the lessor is the absolute owner of the premises House No 2557, Sunny Enclave,Village Desu Majra, Punjab (hereinafter called the said House / flat) having full and

    unfettered rights to let out the same or any portion thereof, on such terms and conditions ashe/she may think fit and has agreed to let out and the lessee has agreed to take on leasethe ground floor of said house for residential purposes comprising of:

    Two (2) bedrooms

    One (1) drawing room & Dining room each,

    One (1) Modular Kitchen

    Two (2) toilets,

    Curtain Rods

    01 Chimney

    Now that the LESSOR represents and warrants that he is fully empowered and authorizedand able to make this lease and that he will hold the LESSEE free and harmless of anydemands, claims actions or proceedings by others in respect of the said House. Furtherterms of the lease shall be as follows:

    1. That the period of LEASE will be (11) eleven months from ----------------------- to-------------------------------. It is expressly understood that the period is (11) elevenEnglish calendar months.

    2. That the Lease Rent shall be Rs. Ten Thousand Only per month, summing up to Rs.One Lakh Ten Thousand only for the eleven (11) months term.

    3. The LESSEE is to pay a security deposit of Ten Thousand only refundable at thetime of vacating the possession after deducting all arrears of rent and other sumswhich may then be due from the lessee to the lessor including but not limited to legalagency or other fees as a result of any breach of any of the lessees obligation underthis agreement and It is hereby declared and understood that the lessee shall not beentitled to repayment of the deposit or any part thereof until possession shall beyielded to the lessor or his authorised representative.

    5. Given one months notice, the lessor or his authorized representative will carryout a check at the time of handing over the possession of house in the presenceof lessee or his authorised representative to verify if there has been any loss or

    damage in the house and determine if any deduction from the security deposit isrequired to that effect.6. That the lessor can terminate this agreement during the course of the agreement

    by issuing one month notice. In the event of termination of agreement by lessor,the advance rent will be refunded after deduction of rent applicable for theduration for which House has been occupied by lessee. However this clausedoes not apply in case the lessee is in breach of contract.

    7. That no notice is required to be served by the lessor and he/she is granted theright to get the house vacated with immediate effect in case the lessee defaults inpayment of rent for One month, does something which is objectionable to theneighbours, the society management and / or violates any of the conditions of

    this agreement.8. That the lessor shall pay all taxes, fees, municipals taxes or any other charges,demands that may be levied by the government from time to time and theexpenses for major repairs and rectification. The lessor shall comply with all laws,rules and regulations of the government as owner of the said house.

    9. Lessee to pay the total cost of making & notifying of this lease agreementincluding but not limited to stamp paper charges, notifying charges and legal fee.

    10.That the maintenance charges, related charges, electricity bills and all suchcharges of recurring nature (monthly/bimonthly or likewise) for the maintenanceof the house and for the welfare of the residence in the said house, whosoever hemay be such as water/power/generator/electricity/telephone bills etc. And thecharges payable to any local residents welfare Association or to any authorizedperson /agency nominated by the society providing the services of gardener,plumber, electrician, security, guards, day to day cleaning, up keeping andmaintenance of the local area adjoining the house shall be paid by the lessee.

    11. The Lessee (s) shall keep the scheduled premises in as good a condition as it isat present and shall deliver the same to the Lessor on the expiry of the tenancyor sooner determination thereof, in the same tenable condition subject to normalwear and tear, any loss or damage to the property or fixtures due to any acts ofthe Lessee during the occupation of the Lessee (s) shall be made good be theLessee(s).

    12.The lessee shall keep the drains gutters and pipes of the property clear andproperly maintained.

    13. That the Lessee will not sublet, transfer or assign in part or whole of the leasedpremised without the prior agreement in writing of the lessor. That no alteration ofany kind to the house or any part thereof or any of the installation thereon, shallbe carried out by the lessee without the written consent of lessor. That the lesseeundertakes to maintain the said house in good condition.

    14. The Lessee shall use the scheduled premises as and for residential purposesonly and Lessee shall not carry on or permit to be carried on in the property anytrade or business whatsoever or to use the house for any other immoral or illegalpurpose in the scheduled premises, which will be punishable under Law.

    15. That all the sanitary, electrical, kitchen (Inalsa Chimney) and other fittings andfixtures in the premises shall be restored by the lessee to the lessor at the time of

    handing over of the premises to the lessor in as good condition as they are at thetime of taking possession by the lessee from the lessor, otherwise the cost of

    such damages occurring purely on account of negligence, mishandling etc. onthe part of lessee shall be recovered from the Security Deposit.

    16. Not to change or install any new locks at the property17. The Lessor or his authorized representative / agent will at all reasonable time be

    at liberty to inspect the schedule premises to inspect the condition of the building

    or otherwise reasonable advance notice is given on this behalf by the Lessor tothe representative of the Lessor the representatives of the Lessee (s) in thescheduled premises.

    18. The rent will be deposited by the lessee in the Lessor nominated account numberon or before 4th day of every month.

    19. That the Vacant Possession of the House in its original condition will be given tothe Lessor by the Lessee on the completion of the Lease term unless renewedotherwise.

    20. If the Lessor decides the lease may be extended for eleven more months with anincrease of 10% (ten percent) on the value of already mentioned per month rent.
