The 2019 NTRA Legislative Action Campaign Annual Report includes details on this year’s aforementioned economic relief legislation and other legislation from 2019 that impacts the industry. Specifically, the NTRA focused on the return of three-year racehorse depreciation for all racehorses, the expansion of sports betting, credit card acceptance of Advance Deposit Wagering (ADW) transactions, consensus-building for nationwide anti-doping and medication control, and immigration issues.

LEGISLATIVE SUMMARYAs the trade association for the Thoroughbred industry, NTRA focuses its lobbying on legislation having a direct material effect on its members and their business activities as they relate to horse racing, breeding and pari-mutuel wagering. With the American Horse Council (AHC), the NTRA also supports Congressional education programs on issues such as agricultural matters and immigration, which affect the horse industry as a whole.

Certainly, the COVID-19 pandemic has and will continue to affect Congressional activity this year. The NTRA remains focused on the industry’s concerns described below, while we also advocate for horse racing and breeding in legislation related to economic relief for individuals and businesses affected by the pandemic. The following is a summary of the major legislative issues for the industry in the second half of the 2019/2020 Congress.

Coronavirus – Economic Relief LegislationIn March and early April 2020, Congress began to grapple with the economic fallout from the coronavirus pandemic and quickly passed legislation described below. The NTRA developed a microsite (ntra.com/covid-19) dedicated to related information and will continue to provide guidance as to how individuals and employers in horse racing are affected.

The Coronavirus Preparedness Response and Supplemental Appropriations Act allows $1 billion in loan subsidies to be made available to help small businesses, small agricultural cooperatives and non-profit organizations which have been impacted by financial losses as a result of the coronavirus.

The Families First Coronavirus Response Act provides paid leave, establishes free testing, protects public health workers and provides important benefits to children and families for those impacted by the coronavirus. Protections for the employers of affected workers also are included in the legislation in the form of tax credits to offset the costs of providing emergency sick leave.

The Coronavirus Aid, Relief, and Economic Security Act or CARES Act, provides an economic relief package valued at $2 trillion. The bill provides direct payments to many Americans, including individuals and couples; $130 billion to hospitals that are seeing their resources stretched to the brink and beyond in their battle to combat the coronavirus, $500 billion for corporations; $367 billion for small businesses; $150 billion in aid for local and state governments; and billions of dollars in extended unemployment benefits for furloughed workers.

With this crisis continuing unabated, Congress passed a fourth emergency bill in April 2020. This new law addresses various technical corrections and provides coverage for certain economic sectors not previously helped. The NTRA was successful in making our case at the federal level for horse racing and breeding, a $36.6 billion industry that accounts nationwide for nearly half a million jobs and has been adversely impacted with racetrack and casino closures, the postponement of equine sales, and other negative economic events necessitated by federal, state and local leaders. Farms with 500 or fewer employees whose primary activity is breeding horses are now eligible to apply for a separate Economic Injury Disaster Loan (EIDL) program. The new law also provides $310 billion to replenish the Paycheck Protection Program (PPP) for small businesses, which was oversubscribed. The additional appropriation will allow financial institutions to make additional forgivable loans to eligible small businesses in order to keep employees on the payroll for eight weeks.

Separately, the Treasury and Small Business Administration (SBA) released updated interim final rules that contain a key clarification that will provide essential relief to racetracks and other businesses that rely on gambling income and otherwise qualify for an SBA loan. Under the new rules, businesses that receive legal gambling income are eligible to apply for the PPP loan forgiveness program.

Future emergency bills may be considered as the economic fallout from the COVID-19 pandemic dictates.

Three-year Depreciation of Racehorses – Matching Deductions with IncomeIn the 2008 Farm Bill, NTRA secured a provision that allowed for the uniform and accelerated depreciation of Thoroughbreds. The provision subsequently carried forward in the 2015 Protecting Americans from Tax Hikes (PATH) Act, which extended three-year tax depreciation for all racehorses through 2016. That provision, along with dozens of others, was extended to 2017 on February 8, 2018, when President Trump signed into law the Bipartisan Budget Act, a bill that among other measures extended uniform three-year racehorse depreciation retroactively for 2017.

Unfortunately, Congress did not renew three-year depreciation for 2018 as part of the Tax Cuts and Jobs Act (TCJA) passed in December 2017, which meant a seven-year schedule would now apply to yearlings in some cases. The TCJA did include 100% bonus depreciation and a $1 million Section 179 expense allowance for qualified depreciable property, two important

investment incentives that lessened the need for three-year depreciation in many cases. However, three-year depreciation continues to be a beneficial option for many racehorse owners.

This is because many horse owners are not eligible for Section 179 expensing due to the net income requirement and choose to elect out of the 100% bonus depreciation. One of the main reasons to elect out of the bonus depreciation is to better match the deductions with corresponding income. A 3-year life (depreciated over a 4-year period) is more realistic for a horse’s racing career versus the 7-year life (8 years).

As we have done several times over the past few years, the NTRA, the AHC and many others representing diverse business, energy, transportation, real estate and agriculture sectors, sought a legislative vehicle to address expired or expiring tax provisions such as three-year depreciation. We asked that at a minimum, the House and Senate retroactively extend three-year depreciation through 2020 in order to minimize potentially severe disruptions to the 2018 and 2019 tax-filing season. We urged that action was warranted because uncertainty with regard to eventual congressional action on tax extenders was undermining the effectiveness of these incentives and stands as a needless barrier to additional job creation and economic growth in the private sector.

On December 20, 2019, President Trump signed into law the Taxpayer Certainty and Disaster Relief Act of 2019 (the “Act). The Act retroactively reinstated or extended several individual and business federal income tax provisions including three-year tax depreciation for all racehorses through the end of 2020.

Because three-year depreciation is important for horse racing, the NTRA will continue to advocate for passage of extenders in 2021 as we work toward a longer-term or permanent legislative resolution.

Sports Betting In May of 2018, the U.S. Supreme Court overturned the Professional and Amateur Sports Protection Act (PASPA) in the landmark Murphy v. National Collegiate Athletic Association (NCAA) decision. Previously, PASPA banned all but 4 state from legalizing sports gambling. Several states have acted quickly to implement sports gambling at the state level. At the federal level, during the final days of 2018, Sens. Orrin Hatch (R-UT) and Chuck Schumer (D-NY), introduced the “Sports Wagering Market Integrity Act of 2018,” a bill designed to grant significant federal control over sports betting nationwide. The proposal’s central feature is a provision giving the U.S. Department of Justice authority to approve or deny a state sports betting program.

While no sports betting legislation has been introduced in the 116th Congress, the NTRA continues to assess the potential threats and opportunities that such legislation would present and is engaged in conversations with its Congressional allies and other stakeholders, notably the American Gaming Association (AGA), which supported a full repeal of PASPA. We remain on the lookout for activity on Capitol Hill regarding this matter in 2020. The NTRA plans to be at the table as it has been on all previous Internet and sports betting issues for the past 15 years.

Credit Cards – ADW’s Lifeline EndangeredAfter the industry secured an amendment to the Interstate Horseracing Act (IHA) in 2000 to enable online wagering, advance deposit wagering (ADW) has grown to roughly $4 billion, accounting for almost 40 percent of U.S. pari-mutuel handle.

Since the latter half of 2017, our Congressional allies have met with representatives from four major credit card issuing banks who have disallowed ADW transactions on their cards, stressing the importance of the ADW sector and the economic significance of the equine industry.

In 2018, the NTRA announced that JPMorgan Chase & Co., the largest bank in the United States and the largest credit card issuer in the U.S. with more than 80 million active credit cardholder accounts, has begun approving credit card deposit transactions with U.S. licensed and regulated advance deposit wagering companies.

The decision by Chase to accept its cardholders’ account funding transactions with ADWs approved to use the industry’s 7802 merchant category code is believed to have had a significant and positive impact on overall U.S. pari-mutuel handle, particularly advance deposit wagering, which already is the fastest growing segment of the U.S. pari-mutuel wagering market.

NTRA and its allies on the Hill are using Chase’s leadership on this issue to convince other leading credit card issuing banks to accept these types of transactions. The NTRA will continue its advocacy efforts on behalf of industry ADWs in 2020. NTRA will also seek a legislative solution in the form of language to clarify that the Wie Act of 1961 (aimed at racketeering) does not apply to transactions made permissible by the IHA. Such an opportunity may present itself in any bills related to sports betting (see above).

Horseracing Integrity Act – Reintroduced in the House and SenateA number of bills on racehorse medication have been introduced in the last several Congresses, though none has passed. In March of 2019, Rep. Paul Tonko (D-NY) and co-sponsor Rep. Andy Barr (R-KY) introduced medication-related legislation known as the Horseracing Integrity Act (HIA). The bill, designated as H.R. 1754 in this Congress, would create a private, independent horse racing anti-doping authority, the Horseracing Anti-Doping and Medication Control Authority (HADA), responsible for developing and administering a nationwide anti-doping and medication control program for horseracing. HADA would be governed by a board composed of six individuals from the United States Anti-Doping Agency, and USADA’s chief executive officer. The bill was referred to the House Energy and Commerce Committee. Rep. Jan Schakowsky (D-IL) is an original cosponsor of the bill. She is the Chairwoman of the House Energy and Commerce Subcommittee on Consumer Protection and Commerce. As expected, Rep. Schakowsky held a hearing on the bill in late January of 2020. The bill currently has more than 240 co-sponsors in the House. Meanwhile, S. 1820, a Senate companion to the Horseracing Integrity Act of 2019 also entitled the Horseracing Integrity Act of 2019, co-sponsored by Sen. Kirsten Gillibrand (D-NY) and Sen. Martha McSally (R-AZ), was introduced on June 6, 2019. The Senate version designated as S. 1820, closely tracks the House version and has been referred to the Senate Committee on Commerce, Science and Transportation. No further action has been taken on S. 1820 but the bill has attracted 24 Senate co-sponsors. While the NTRA is neutral on the bill, we are working with all industry stakeholders in an effort to find a consensus approach to nationwide anti-doping and medication control.

Immigration – H-2B Visa Caps are Too LowWhen domestic workers are unavailable, trainers and other industry participants use the H-2B temporary foreign worker visa program to hire grooms and other stable help. However, the H-2B visa program has an annual cap of only 66,000 visas nationally, which is woefully inadequate for the many industries like horse racing that need foreign workers to fill jobs that are not taken by U.S. citizens. There were temporary increases of 15,000 H-2B visas for qualified workers in both FY2017 (October 1 – September 30) and FY2018, and a temporary increase of 30,000 H-2B visas in FY2019 but all three have now lapsed. A similar returning worker exemption program ended in 2016.

The Fiscal Year (FY) 2020 Department of Homeland Security (DHS) funding bill authorized limited H-2B visa cap relief. The legislation gives DHS the authority, “in consultation with the Department of Labor” (DOL), to increase the H-2B visa cap for FY2019 to 130,716 (66,000 + 64,716 (the number of H-2B returning worker visas or H-2Rs issued in FY2007)).

This is the same language that was in effect for fiscal years 2017, 2018 and 2019. This amounts to a potential increase of about 65,000 more visas over the 66,000 annual, statutory cap. In both FY2017 and 2018, this provision resulted in the issuance of only 15,000 extra visas. In FY2019, this provision resulted in the issuance of 30,000 extra visas. None of these supplemental issuances provided flexibility for businesses strapped for temporary workers.

Through its involvement in the H-2B Workforce Coalition, a national consortium of business and industries that rely on immigrant labor, the NTRA and its allies focused efforts on the Administration and urged both DHS and DOL to release the full number of 69,000 authorized visas as soon as possible. On March 5, DHS Secretary Nielsen announced the allocation of an additional 35,000 H-2B visas for the remainder of fiscal year 2020 but once again placed some restrictions on those visas. On April 2, DHS announced that the related Temporary Final Rule was on hold due to the economic uncertainties caused by the COVID-19 pandemic and that no additional H-2B visas would be released until further notice.

Going forward, the NTRA will continue to advocate for racing’s interests in maintaining access to qualified foreign labor when domestic workers are unavailable.

NTRA’S FEDERAL LEGISLATIVE STRATEGYThe NTRA’s government relations team performs a broad array of legislative advocacy services for the horse racing and breeding industry. Working closely with the NTRA membership and Board of Directors, the team determines the industry’s governmental priorities and then develops a comprehensive legislative strategy to achieve these priorities. The current strategy includes building relationships with members of Congress and their staffs, educating them on industry issues and concerns and introducing lawmakers and staff to industry members in the field.

The government relations team is in daily contact with The Alpine Group, the NTRA’s lobbying arm based in Washington, D.C. The Alpine Group’s guidance and expertise are invaluable and help move the horse industry’s legislative agenda through Congressional processes. From meetings with Congressional staffers and members of Congress to bill drafting to committee mark-ups, hearing and votes, The Alpine Group provides the expertise essential to effective advocacy.

One essential element of an effective advocacy strategy is fundraising. The NTRA primarily builds financial support through its Legislative Action Campaign’s ¼% Check-off Program at major Thoroughbred auctions. Industry members who buy and sell at Keeneland, Fasig-Tipton, Ocala Breeders’ Sales Company and the Washington Thoroughbred Breeders & Owners Association may contribute one quarter of one percent of each horse’s sale price to help fund the Campaign.

Industry members also support NTRA fundraising through the Foal Program, an annual direct mail effort targeting owners and breeders who may not buy or sell at auction. Contributions start at $50 per foal. Horseplayers who join the NHC Tour also are considered to be contributors to the NTRA’s Legislative Action Campaign.

Campaign finance also is important to NTRA advocacy. The NTRA government relations team organizes and participates in fundraisers on behalf of Horse PAC®, the political action committee of the NTRA. Horse PAC® has disbursed more than $4 million to upwards of 300 federal political candidates and leadership PACs since 2002. Click here to read the 2019 Horse PAC® Annual Report.

Another component of the NTRA’s government advocacy efforts is the NTRA Safety and Integrity Alliance. Formed in 2008, the Alliance is a standing organization whose purpose is to advocate for the establishment of national uniform standards and best practices related to human and equine safety. While the NTRA legislative priorities are federal in scope and application, the Alliance provides guidance at the state level through accreditation of tracks found to be in compliance with a national Code of Standards. The Alliance Code is enforced in large part by regulations issued and enforced by state racing commissions. Alliance certification standards cover six broad areas: injury reporting and prevention; a safer racing and training environment; uniform medication, testing and penalties; jockey safety and welfare; aftercare and transition of retired racehorses; and wagering security. The Code further sets standards with respect to compliance and enforcement and is amended as new research recommendations warrant.

The horse racing industry is part of a $50 billion agri-business touching every state. Each year, over $11 billion is wagered on horse racing nationwide. Governmental regulation and oversite are critical to horse racing’s economic development and long-term survival. For this reason, the NTRA dedicates significant resources to protecting and promoting horse racing on Capitol Hill.

Starting with a landmark 2000 amendment to the Interstate Horseracing Act that paved the way for online betting on pari-mutuel horse racing, the NTRA has built a significant presence on Capitol Hill. The NTRA strengthened its presence even as federal lobbying expenditures by all industries have skyrocketed. The chart below shows the tremendous growth in lobbying expenditures across all industries, including the gambling sector in particular.

NTRA LEGISLATIVE ACTION CAMPAIGN FREQUENTLY ASKED QUESTIONS

What is the Legislative Action Campaign?The Legislative Action Campaign empowers individuals and corporate members of the NTRA to support federal legislative advocacy services for the horse racing and breeding industry.

How is the Legislative Action Campaign funded? The Legislative Action Campaign raises funds through three programs: the ¼% Check-off Program; the Foal Program; and National Horseplayers Championship (NHC) Tour membership. For the former, buyers and sellers may support the Campaign by pledging ¼ of one percent of the price of their horses sold at Keeneland, Fasig-Tipton, Ocala Breeders’ Sales Company (OBS), and Washington Thoroughbred Breeders and Owners Association. Every $1,000 in a horse’s sale price equates to $2.50 to the Campaign. Individuals also may pledge contributions through the NTRA Foal Program. Horseplayers may support the Campaign when establishing NHC Tour membership.

How do I participate?Sellers, consignors and designated agents may “pre-commit” their pledge on sales entry forms for the ¼% Check-off. Sellers who miss the deadline for pre-commitments may pledge until the close of sale billing. Buyers may include their contribution when submitting payment or by responding to an NTRA-generated invoice. Owners and breeders may contribute through the Foal Program. The NTRA solicits contributions through a bi-annual direct mail campaign. Horseplayers may contribute when joining the NHC Tour at the highest level.

How can Federal lobbying help make the horse racing industry more competitive?By securing tax legislation that benefits industry stakeholder groups such as such as horse owners, breeders, racetracks, advance deposit wagering service providers and horseplayers and by addressing select issues that directly impact the economics of racing, such as taxation, Internet wagering, immigration, sports betting expansion and matters that affect farmers, ranchers and other agricultural producers.

How does the NTRA lobby on Capitol Hill?NTRA fields a government relations team based in Lexington, KY and retains Washington, DC-based The Alpine Group to lobby on federal issues specific to pari-mutuel horse racing and breeding. NTRA coordinates with the American Horse Council on legislative advocacy issues that affect all equine breeds and disciplines.
