Legislative Update for November 9, 2018
The ND State Legislature has organized into Interim Committees and prioritized
interim studies. We will track the interim process through our legislative tracking
teams. See below for a list of legislative tracking teams, legislative committees and
bills that are in the implementation stage that we will be monitoring. We also have
several tracking teams that monitor ND Center for Nursing policy briefs including
implementation.

Affordable Care Act Status Study Background

Tracking Team Notes The committee wrapped up their work for the interim:
For the Affordable Care Act study they examined applying for a 1332
ACA waiver. This included a waiver analysis report. In order for the
state to apply for the waiver, they will have to take legislative action. The
committee has not drafted a bill for this. There was quite a bit of
discussion throughout their meetings regarding the impact of applying
for a waiver.
For the Managed Care Study, they have received quite a bit of
testimony throughout the interim from many groups including the
NDNPA. At the last meeting, the North Dakotans for the Advancement
of Care Medicaid Work Group had developed a report on this which
includes some model legislation. CHAD also provided a presentation on
their thoughts. There was also a presentation on health care cost
containment strategies. No legislation was drafted by this committee on
managed care.
For the Public Employees Retirement System Health Benefits Study, the
committee approved a bill draft which combined the ideas from 2 earlier
bill drafts. The bill would provide for a self-insurance plan for public
employees, a uniform group insurance law and regulation and includes
an emergency clause.

Tracking Team Notes: The committee has wrapped up their work:
For the Study of Development Disabilities and Behavioral Health Needs, the committee passed a bill draft (that was revised to include 1.5 FTE and $300,000 to administer the substance use disorder voucher program) that: Provides $750,000 to the Department of Human Services (DHS) for establishing and administering a voucher system to address underserved areas and gaps in the state's unified mental health delivery system and to assist in the payment of mental health services provided by mental health providers; Requires DHS to ensure private providers accepting vouchers collect and report process and outcome measures; Requires DHS to develop requirements and provide training and technical assistance to private providers accepting vouchers; Requires private providers accepting vouchers to provide evidence-based services; Requires DHS to provide a report to the Legislative Management regarding the rules adopted to establish and administer the voucher system.
The committee also examined licensing issues for social workers although a bill draft was not presented during the last meeting and voted on by the committee.
A bill draft to amend the definition of brain injury (with a revision to remove reference to an insult from physical force or internal damage) was passed.
The committee received a report on the behavioral health workforce implementation plan., the implementation of the ND Behavioral Health Systems Study. and the children’s behavioral health study. These include possible policy recommendations although the committee did not review any draft bills for them.
The committee reviewed the report from the Diabetes Prevention and Control Program. And the Tobacco Prevention and Control plan. This report included policy recommendations although no bill draft was developed by the committee.

The Higher Education legislative committee also wrapped up their work:
The committee had developed a document with work topics including potential
legislation. They also provided several recommendations to the State Board of Higher
Education including implementation of a direct admissions program, to study whether
SAM or IPEDS data is more accurate for ND and to review distance education
programs offered across the state.
The committee discussed a potential bill draft directing TrainND to become self-
funded. It was too late for the committee to develop a draft but Senator Holmberg
indicated that the appropriations committees could consider during the session.
The committee review a professional student exchange program bill draft but some
committee members opposed the changes- so it was not passed out of the committee.
The committee passed a recommendation to continue the Higher Education Challenge
Matching Grant Program (no bill drafted) including the matching requirements.
The committee passed a draft bill for needs-based scholarships provided through the
student financial assistance grant program.
The committee passed a draft bill creating a higher education funding formula review
committee.
The committee passed a draft bill continuing the Hold Harmless provision of the higher
education funding formula. This bill has an emergency clause.
Board of Higher Education:
The Chancellor outlined his goals for the 2018-2018 year which includes several
strategies to provide more support relating to the upcoming legislative session. They
passed their proposed budget for 2019-2021 which includes several changes to
support salary increases etc.

The committee reviewed the progress of the Social Service Redesign Project and the Implementation of Behavioral health Recommendations.
The committee approved a bill draft to provide for an appropriation for Behavioral Health Prevention and Early Intervention services.
The committee approved a bill draft to implement a community behavioral health program. The bill was revised to remove references to the behavioral health division from the bill draft. There was some debate as to whether to keep the funding part in the bill- it was included.
The committee approved a bill draft to provide appropriation to coordinate the implementation of the Behavioral Health Study.
The committee approved a bill draft to provide an appropriation for targeted case management.
The committee approved a bill draft to implement a peer support services program.
The committee reviewed a memorandum regarding the Information Received Regarding Refugee Resettlement. The committee did not draft any bills related to this study.
The committee approved a bill draft related to the Service Payments for Elderly and Disabled Program. The committee removed section 2 regarding
the sliding fee schedule and added a new sentence to section 1 “The department shall establish biennially a sliding fee scale based on family size and income to determine a recipient's participation fee percentage for services received through the service payments for elderly and disabled program.”
The committee passed a bill draft to create a pilot program for Independent and Community Based Services Case Managers. The committee revised the draft bill by removing the pilot program provisions related to medical assistance hom and community based services to allow the department more flexibility to determine the requirements of the pilot program relating to SPED and Expanded SPED.
The committee passed a bill to require DHS to establish guidelines for Long Term Services Providers to Deliver Home and Community Based Services.
----------Judiciary Committee- will receive reports from the State Department of Health on the implementation of the Compassionate Care Act including the medical conditions that quality as debilitating medical conditions and number of individuals committed to the State Hospital along with assigned

Tracking Team Notes: The committee received testimony on the status of
Medical Marijuana implementation at their last meeting. You can download the
testimony at https://www.legis.nd.gov/files/committees/65-
2017/19_5157_03000appendixb.pdf . The report includes on page 7 a report
about conditions not covered in ND’s law that is covered in other states. In
response to a question about what would happen to the program if
Recreational Marijuana were to pass- they indicated that typically the program
stays intact to allow juveniles to use and possess medical marijuana. No bill
drafts were developed related to Medical Marijuana.

Committee Memorandums
State Supervision of Occupational and Professional Licensing Boards-
Background Memorandum
Tracking Team Notes. At the December meeting 2017 , the Attorney General’s
Office provided Testimony of the Attorney General Office which provides some
interesting background and their thoughts on the occupational and licensing
boards study.
At their July 2018 meeting the committee decided to wait until a grant funded
study is completed to determine possible policy regarding licensing boards. The
Department of Commerce, Job Service North Dakota, and other agencies worked
together to apply for a federal grant to study the potential barriers to
employment in the requirements of occupational and professional boards. They
have contracted with an out-of-state contractor to conduct the study.

Future ND Center for Nursing Legislative Update Calls- The ND Center for Nursing
will be hosting Legislative Update calls every Friday at 12:00 PM CST during the
legislative session starting January 11th. A calender invite will go out to Leadership
Team members and the updates will be posted Friday mornings on our advocacy

2019 Potential Bills
High Priority- related directly to the mission of the ND Center for Nursing. If we have a policy brief- Patricia will actively lobby and encourage all nurses and organizations to actively push for passage. These will receive the highest level of monitoring and attention.
Mission: Through collaboration, guide ongoing development of a well-prepared
and diverse nursing workforce to meet health care needs in North Dakota through
research, education, recruitment and retention, advocacy and public policy.
Governors Workforce Policy Agenda Policy Brief- unknown at this time what
will be included. Will include a subset or all of recommendations from
Workforce Development Council Report.
Nurse Salary and Nurse Faculty Salary Policy Brief- This will support
recommendations from the Governors Nursing Shortage Task Force related to
increasing salaries including increasing reimbursement rates for health care
facilities and increasing nurse faculty salaries. Will be developed in conjunction
with NDHA and NDLTC.
Higher Education Policy Brief- This will support full funding for all state funded
nursing education programs. Will need to watch for addition of Possible Higher
Education Bills/Topics from the Higher Education Committee.
Expedited Licensure Bill- Interstate Compact for Temporary Licensure- would conflict
with Enhanced Nurse Licensure Compact- we have not seen a bill draft yet, but the
Governor’s office is very interested in this. Would work to have nursing exempted
from the bill
Occupational Board Reform Act- Need to watch for bills related to this Nebraska bill-
presented at Health Services Meeting in July- but no bill draft yet or further discussion
during meetings. Nebraska’s 2018 Legislative Bill 299- Occupational Board
Reform Act
Bills of Interest or related to Mission that will be included in Tracking System and on the tracking spreadsheet. Any bills submitted from the nursing community will be added to this list too.
Possible Public Health bill related to dispensing birth control pills in clinics Possible Aesthetic nursing bill
NDNPA bill- to allow NP to ok for person disabled to shoot from stationary vehicle.
NDNPA bill- Will do language update on health care provider language with Work
force safety.

Physician Assistant Practices Act Modernization- being pushed from the National PA Association, has been talked about in the state

Call for Interested Leadership Team Members interested in Volunteering
for the Rapid Response Legislative Team
For the next legislative session, the North Dakota Center for Nursing will change how we are
monitoring bills. The first change will be prioritizing the bills for which we actively track and
attend committee hearings/testify. Priority bills will be those directly related to our mission
and the ND Center for Nursing Board of Directors will develop guidelines and a process at
their Fall Board meeting. Bills of interest especially in the health arena but that are not
prioritized will be added to our electronic tracking and will be included in the weekly tracking
report.
We will also not be hiring a legislative monitor due to budget constraints. Instead, the ND
Center for Nursing will increase the amount of electronic monitoring and tracking during the
session and utilize a Rapid Response Team. This team will be connected via cell phone group
and will take turns attending priority bill committee hearings and sharing notes with the team.
Team members will need to be located in the vicinity of Bismarck or willing/able to travel to
Bismarck as needed. When applicable, the team will also be called on to testify on priority bills
that are related to their group or expertise. If you are interested in joining this team, please

organizational meeting later in December for this team.
Leadership Team Legislative Opportunities

2019 Session Rapid Response Team- This is a new group for the upcoming session.
Members of this group will be included in a text group and will take turns attending
committee hearings for priority bills and share with group and during Friday calls.
Members need to live in the Bismarck area or be willing to travel to attend hearings.
Nurse and Faculty Salary Policy Brief Team- will develop and lobby/advocate for a
policy brief to increase reimbursement for health care facilities to increase nursing
salaries and to increase nursing faculty salaries in conjunction with the NDLTC and
NDHA- Team will meet 2-3 times to develop brief by December 2018 and then will be
asked to help push during legislative session
Governors Workforce Policy Agenda- this team will lobby/advocate for a policy brief
supporting nursing shortage strategies included in the Governor's Policy agenda
(TBD). It is anticipated that this group will meet once before the session and will be
asked to help push during the session.
Higher Education Legislative Committee and Board of Higher Education and
Education- During the legislative session this team will lobby/advocate for nursing
education program funding in the Higher Education Budget.
