Dear Election Committee Members,

Inasmuch as we received no response to our February 15, 2011 letter expressing our concernsand protest regarding the now completed elections we attach and incorporate in total that letter.We also incorporate in total and attach hereto letters of July 12, 2010 (see attachment 2)expressing our concern that the Executive Council ensure the GFT Constitution is followedincluding that the Election Committee had been created, so in turn your committee could create atime schedule of all relevant dates, times, and places and deliver it to the Calendar Committeeand prepare an annual budget and deliver it to the Budget Committee. As of this writing there hasbeen no response to that letter, even after a letter of August 23, 2010 requesting a response to theJuly 12,2010 letter. Since our letter of February 15,2011 to which we have yet to receive aresponse, a fifteen minute briefing of the candidates and two "Meet the Candidate" forums werehastily conducted.

Article ill of our Constitution provides as one of the objectives of GFT shall be "to support andpromote the ideals of democracy as envisioned in the Constitution of the United States ofAmerica" Clearly the one of the purposes intended in requiring your mandatory ElectionCommittee is to ensure the requirements of the GFT Constitution are followed, this failed tooccur. Whether due to your failure or the failure of others is unclear. Regardless of fault, themandates of the GFT Constitution have not been follow resulting in the fiasco of an election thatoccurred. We PROTEST to the GFT election conducted on February 25,2011 as it failed tosupport and promote the ideals of democracy.

Per the GFT Constitution Article IX(A) "The terms of office for each member of a StandingCommittee shall be for one year, from the first Executive Council meeting following theRecognition Dinner/General Membership meeting until the following year's RecognitionDinner/General Membership. If there is a vacancy in a non-Executive Council member positionon any Standing Committee, the other members of the Standing Committee, by majority vote,shall within two weeks of the vacancy, appoint a new member to serve out the remainder of theterm for that position." The failure to appoint an Election Committee as required clearly lead tofurther failures to meet the mandates require of the Election Committee. There seems littlequestion of fact regarding this failure as the chair of the Election Committee comment to themedia in regards to her appearance and comments in the special edition of the Working Family

TV Show released just prior to and during the election to promote the incumbents werecomments she made before she became a member of the Election Committee. (See Attachment1) Additionally, Election Committee member, Albert Perez, stated that he was appointed by thePresident just prior to the election to the poll observers. That this concern was raised at the June29, 20 I0 Executive Council meeting which three of your members are also on and raise again inmy July 12,2010 letter reflect an on-going failures to conduct meaningful elections. WePROTEST the election conducted on February 25,2010 based upon the failure to comply withGFT Constitution Article IX(A) as put forward above and below.

Per the GFT Constitution Article IX(A)(3) "The Election Committee shall consist of two GFTExecutive Council members and three additional members chosen by the two Executive Councilmembers from the general OFT membership. If a member of the Election Committee declarescandidacy in an election, then he or she shall immediately cease to be a member of the ElectionCommittee." Based upon the composition of the Election Committee with four members fromthe Executive Council and one from the general membership the composition of the ElectionCommittee fails to conform to the GFT Constitution. This failure gives incumbents a majority oftheir fellow Executive Council member on the Election Committee contrary to the intent to havea majority of general members. No request where made by the Election Committee for generalmembership involvement for at least the last twelve months. Never was it mentioned on the OFTwebsite when the election committee was formed and the names of its members. The first timeCarol was told who the members were was when she went to OFT to submit her name fornomination as OFT president on January 25, 2011. She was told that the committee consisted ofNeeti Prakash as chair and Albert Perez, Joaquin Tayama, and Michael Bailey as members.Carol wasn't aware that there was another member until Friday, February 25,2011 after ourobservers informed her that John Penaflor was also there as a member of the committee. WePROTEST the election conducted on February 25, 2011 based upon the failure to comply withGFT Constitution Article IX(A)(3).

Per the GFT Constitution Article IX(A)(3)(a) .•• The function of the Election Committee shall be:a) to create a time schedule for all relevant dates, times and places and deliver it to the CalendarCommittee no later than July 1, of each year" The Election Committee was to submit allschedules of dates, times, and places for the events that make up this vital process of our uniondemocracy so that all members can plan and have knowledge of the election process. As putforward above numerous written and verbal requests had been made regarding the constitutionalrequirement of creating a time schedule. Additionally, at an Executive Council meeting on July27,2010 Rector was asked if the election schedule was submitted to which he responded andalso confirmed by an office staff in attendance that the committee has yet to be formed. Theinitial notification put forward regarding the scheduling of the election was provided on the backof the GFT Christmas postcard which provided the dates of the opening and closing of thecandidacy period and the election date. The times and places of the election was not provideduntil well into the candidacy period. Nor was your committee's responsive to candidates requestfor additional access for members to vote.(See attachment 1) That these failures occurred is evenmore compounded where on the day of the election the OFT website made only comment on thecalendar section of the website, there was no article, banner, or any other substantial noticeinforming members that the election was occurring. We PROTEST the election conducted on

February 25, 2010 based upon the failure to comply with OFT Constitution Article IX(A)(3) asput forward above and below.

Additionally, Per the OFT Constitution Article IX(A)(3)( d) and (e). " The function of theElection shall be; d) to conduct meetings to brief the candidates, all stewards, and anyone elsethat will be conducting elections at any site; and e) to conduct a 'Meet the Candidate' forum foreach election".

1. Candidate briefing was held on Sunday, February 20th fifteen minute before the forum(12:45 p.m.) by the committee chair. Candidates were there but the chair did not arriveuntil after 1:00 p.m, Concern were brought up to the chair regarding the list of schoolwithout voting. The chair of the Election Committee stated that those sites not on the list,members will need to vote at the GFT office. I told her of members I have met that couldnot go down to GFT office because their release time was the same as the closing time ofthe OFT. She stated that those members could do absentee voting. Unfortunately,absentee voting is still subject to the same office hour issue. She stated that the officetime will not change.

2. In regards to the stewards and anyone else conducting the election on any site, no meetingoccurred to conduct the required briefing. A brief instruction by the office staff wasprovided as stewards/voting officials came to pick up there election packets. From JFKHigh School, Mr. Joe Von Rodeck was heard stating that he was not aware that he wasselected for his school until just before the election. JFK ballots were not counted due todiscrepancies. This lead to confusion at all voting sites as to what could and what couldnot occur with regard to the times, places, and requirements for valid voting. In addition,it lead to many members not having access to the voting process and inconsistenciesbetween work sites.

3. Last minute announcement of the "Meet the Candidates" forums. As was stated in aletter of February 18, 2011 letter sent to you bye-mail my frustration in theunprofessional form this election as taken I incorporate that letter herein to this protest.(See attachment -) Candidates were informed after 4:00 p.m. on Friday as to the forumsschedule for that following Sunday, February 20th and Wednesday, February 23rd•

Members were informed after 5:00 p.m. on Friday The forum was held on the GFTcompound. It was pretty much a bring your own drinks and cleaning rag in order to cleanthe area where we were to meet the members. The committees failed to providecandidates any meaningful "Meet the Candidates" forum as a result of last notice to bothmembers and candidates.

We PROTEST the election conducted on February 25, 2010 based upon the failure to complywith GFT Constitution Article IX(A)(3)( d)(e) as put forward above and below.

Pursuant to Article VJ(C)(7) "Candidates are entitled to have observers present at the polls andthe final tally of the ballots." There were two observers for candidates present at the ballotcounting conducted at the OFT office on Friday, February 25, 2011 into the early morning hours

of February 26,2011 at or about 12:18 am. the committee chair announced that the observersmust leave. The final taJJywas not complete nor were the ballots secured in the observers'presence. The committee then remain after the exclusion of the observers for about an additionalhour. The integrity of the election comes into clear question when the committee excluded theobservers prior to the final tally of the vote. That question becomes even more concerningconsidering your committee's composition of four Executive Council members and one generalmember as put forward in the above whom are vocal supporters of the incumbent candidates asfurther put forward hereinafter. This act alone so seriously compromises the election process thata re-election is required.

Pursuant to Article IV(C)(8)(a)(c) an eligible candidate must be a regular member, ArticleV(B)(2) excludes from regular membership those who hold any management or supervisoryposition. As stated in my protest letter of February 15,2011, "as such, as management of theemployees and the union itself, Mr. Rector is ineligible as a regular member to seek electedoffice ...Additionally, our constitution provides 'No candidate's name shall be printed on theballot unless the candidate has filed a signed "Announcement of Candidacy' with the ElectionCommittee during the candidacy period ...The 'Announcement of Candidacy' shall include, as aminimum, the candidate's full name, signature, mailing address, worksite, membershipverification, and name of the candidate's union." GFf is not a worksite that is organized and Mr.Rector is not in the teacher's union as he is not a teacher or even eligible to be one."

Pursuant to Article VI(C)(8)(f)(1) restricts the use of any union funds to promote a candidacy ofany person in a union officer election. As stated in my letter of February 15,2011 "The recentspecial edition of the Working Family TV Show that seems to put forward a recollection of theactions of the current incumbents with praise for the incumbent candidates coming directly fromthe Election Committee Chair." That letter additionally raised concerns about the wave of e-mails coming from the union praising the current president and other candidates. It alsoexpressed concern about the Super Bowl commercial featuring all the current incumbents paidfor with union funds. Since that letter surprisingly the wave of e-mails seem to stop, butcandidate Rector used the "Together We Win" slogan in his re-election campaign, as well as,what appears to be the GFT background and print format of many of GFT's materials thus givingthe impression of union support of that candidate. (See attachment 4) The Election Committeetook no action with regard to my earlier concerns. Clearly no such offer to the use of union fundson an equal basis was made to other candidates. As a result of these actions the incumbents wereprovided an unfair advantage over other candidates.

Union funds were also used in violation of Article VI(C)(8)(f)(l) when candidate Rector took itupon himself to campaign during his instructional time at the union office with members whomhad enrolled in his teacher's rights class. This campaigning even included a statement that hewas not to be campaigning followed by the differences between himself and the other candidates.Such actions are also a clear violation and create an additional violation of Article VI(C)(8)(f)(2)as it oreates amongst the members a fear that they may be subject to a penalty or reprisal shouldthey show any signs of unwavering support for the candidate/instructor. Additionally, ArticleVI(C)(8)(f)(2) was violated when on the morning of February 24,2011 candidate Sharmaassaulted a member for distribution of campaign material. These actions clearly reflect reprisal

by a union official for supporting the candidate of their choice.

In violation of Article Vl(C)(8)(f)(4) the Election Committee did not ensure no campaigningwould occur in the polling areas as on February 22, 20 II candidate Rector conducted an event atthe GFT office at 10:00 a.m. (See attachment 5) Although the general election was notconducted until February 25,2011 the GFT office was a designated polling site for absenteeballots on February 22,2011 and pursuant to the election procedures, rule number 5, candidateRector, must be declared ineligible for the position of President.

In violation of Article VI(C)(8)G) which provides "the Election Committee shall include everyworksite except those where no union member is found to conduct the election", There are anumber of work sites that did not have onsite voting. One has to question what effort, if any, theElection Committee took to find members to conduct the elections at their worksite. Review ofthe materials sent out to members describing the election makes no request for members toconduct elections at their work sites, if they are not listed. As a result, members of sevenschools, as well.as, other work sites were not able to participate in the election process.

Lastly, violations of Article VI(C)(8)G) occurred throughout the February 25, 2011 election asthose un-briefed members conducting the election did not ensure that the members sign theirname next to their printed name on the Membership Roster before they receive a ballot. As putforward above, failure to ensure all voting officials were thoroughly trained as was in the casewith JFK High School where the voting official did not know that he was selected. Resulted inthe ballots for JFK not being counted nor were the ballots of Ordot Chalan Pago Elementary for asimilar reason. This also caused an inconsistency when the Election Committee decided not tocount the JFK and Ordot Chalan Pago Elementary ballots because the sign-in roster was notcompleted, yet based on information from our observers there were other polling sites where thenumber of ballots did not match the sign-in roster, yet at these sites the ballots were counted,specifically the observers noted the difference of three votes that were accepted although thesign-in roster reflected three less signatures than the number of ballots. This does not representconsistency, nor does it support the integrity of the election process. This further brings graveconcern with regards to the integrity of the voting process based upon the failures expressed inthis letter. Failure to ensure in advance that all work sites were assigned a trained voting officialcombined with the failure to provide onsite voting for all members has created an election wheremembers who did vote have not had their votes counted and where members who wanted to votewere not provided access to the polling sites based upon the times of voting imposed by theElection Committee. Our union represents nothing if we do not represent democracy.Democracy is not measured in words but in efforts to ensure that all people have the right to beinvolved in the democratic process. One would hate to think that our union democracy and ourmandates to allow all members the right to vote in the union election was controlled to avoidwork sites dissatisfied with the actions of the current leadership.

As a result of the failures and violations of the OFT Constitution put forward herein, it isrequested that a new election be conducted, with an impartial Election Committee composed ofmembers from each of the candidates choosing, that complies with the provisions andrequirements of the GFT Constitution. With regard to candidate Rector, based upon his

ineligibility and violation of the election rules, he should be deemed ineligible. Additionally,attached hereto are statements of members protesting the election that was conducted onFebruary 25,2011.

Dear Election Committee Members,

In the past we have expressed concern regarding the functions of the Election Committee.In meeting its mandates under our constitution, this past summer we expressed our concern to theExecutive Council regarding the creation of the time schedule including all relevant dates, times,and places for the election no later than July I, 2010 [please see Article ~ A 3 (a)].

As well as, to date there bas been no meetings to brief the candidates, stewards, or anyoneelse who will be conducting elections at any site. Nor have we been informed of the format orthe date of the "Meet the Candidates" forum for each election [please see Article IX, A 3 (d) (e)].

At the same time one can not help notice actions taken by the incumbents tbat eveninclude a member of the Election Committee. The recent special edition of The Working FamilyTV Show that seems to put forward a recollection of the actions of the current incumbents withpraise for the incumbent candidates coming directly from the Election Committee Chair.Additionally, one can not help but notice the increase, ifnot a wave of'e-mails coming from theunion praising the current president, and the not to be missed Super Bowl commercial featuringall four incumbents all paid for with union funds.

Pursuant to our Constitution Article VI, C 8 (f) (1) "Fedemllaw prohibits the use of anyunion or any employer funds to promote the candidacy of any person in a union officer election."One has to wonder how based upon the excessive use of union funds to support the currentincumbent candidates, why you as the Election Committee have not intervened already,particularly in light of Mr. Smith's correspondence regarding this upcoming election. In hisletter he specifically states,

"In closing, close attention must be paid to:• Forming an Election Committee according to the GFf Constitution and performing

the functions as outlined in Article IX.. Section 3 A-F."

In as much as we candidates have not had an opportunity to interact with the ElectionCommittee regarding the conduction of the election, as well as, the qualification of thecandidates we now put forward, in addition to each of the above mentioned paragraphs, thefollowing additional items of protest regarding conduction of this election.

1) One can not help but note the failure of the election process to consider the workingschedule of members in that the polls at GFf are only open from 7:00 a.m. to 5:00

p.m, making it difficult for those members that do not have onsite polling.

2) Information which was revealed on KUAM and PNC television news broadcasts inwhich the incumbent candidate, for president, Matt Rector announced that there werethree individuals running for the office of president. Such informatiQn provided theincumbent clearly reflects inside knowledge as to the "goings-on" of the ElectionCommittee not.afforded to other candidates.

3) There is an appearance of management involvement in the conduction of the electionwithout providing other units the opportunity to have management assistance in theelection For example, Captain Mark Cbarfauros and perhaps other management areinvolved in the conducting of this election, whereas, based on Informanon and beliefAlutiig management has offered to assist in the election process, but we note no onsite voting for them.

4) Eligibility of Candidates Rector as he is not a regular member or Constitutionexcludes from regular membership those who hold any management or supervisoryposition, as such, as management of the employees and the union itself, Mr. Rector isineligible as a regular member to seek elected office (please see Article V, B 2).Additionally, our constitution provides "No candidate's name shall be printed on theballot unless the candidate has filed a signed" Announcement of Candidacy' with theElection Committee during the candidacy period. ..The 'Announcement of Candidacy'shall include,as a minimum, the candidate's :full name, signature, mailing address,worksite. membership verification, and name of the candidate's uniOD."OFT is nota work site that is organized and is not in the teachers union as he is not a teacher oreven eligible to' be one,

As the election rapidly approaches we request you provide corrective action plan to each of theseissues immediately.

Dear Council Members:

As of this writing I have received no response to my concerns regarding the Executive Council's failureto ensure that GFTs Constitution is followed On July 12. 2010 I expressed my concerns regarding OFT'sstanding committees (see attached letter). Specifically my concerns were related to their chairs and members,minutes of meetings, and most importantly the committees' mandatory actions required by July 1, 2010 aspursuant to Article IX A 2(b), 3(a) and (b), and 4(b). More than a month has past and Ihave received noresponse to my concerns including those directly asked during the Executive Council meetings' open forumwhich followed.

Iam further disappointed that efforts to ensure a transparent union have yet to be realized. Under thecurrent management the minutes for the Executive Council meetings have yet to be updated since they wereposted in May 2010. This is clearly contrary to our constitution which requires the filing within ninety-sixhours of the meeting at which they were approved. Finally, Iwould continue my request; as has now beenoffered in the media, to review credit card account and check registry of GFT for the past four years.

Re: Noticeof Forums

Dear GFT Election Committee,

After 4:00 p.m. today, Friday February 18,2011, I received a call from the Chairpersonof the GFT Election Committee whom stated that the election committee had just yesterdaydetermined to conduct forums on Sunday, February 20, 2011 and Wednesday, February 23,2011. Inasmuch as the Election Committee has completely failed to timely perform the dutiesrequired of it in the Constitution and its proposed public session, that no members up to now

. have been notified about is completely unacceptable. The Election Committee intends uponnotifying members on a pay day weekend after most employees of the Department of Educationare no longer on duty is both disrespectful to the Employee and the candidates. Additionally,inasmuch as GFT and the current president controls who can have access to the Guam Federationof Teacher's property, clearly this was not ever intended for the community.

That you have provided absolutely no outline as to how the forums are to be conductedand also intend to have a briefing of the candidates that same Sunday is ill thought at best anddiscriminative to the candidates at worst. Until you have responded in writing with the correctedaction plan including the other issues mentioned in my letter of February 15,2011, I find yourresponse inadequate and unacceptable. That it was also mentioned that a second forum would beheld on Wednesday, February 23, 2011 after the election process has started is yet anotherexample of the Election Committee's failures to timely conduct the business of the GuamFederation of Teachers Elections as required by the Constitution. Your actions are unacceptableand reflect poorly upon the Guam Federation of Teacher's, its membership. and mostimportantly a truly democratic process has been sabotaged by your actions. I expect prior toconducting any forum that reasonable notification be provided to all members.

On Friday, February 25, 2011 at about 11:30am, during my lunch, I went to the JFK counseling

office to vote during the 6FT election. I went to Mr. Joe Von Rodec!c's office to vote. Mr. Joe Von

Rodeck was assigned to administer the GFT election at JFK. The light in the office was turned off andthe door was closed. On the door was a note that stated: f will be back in 15 minutes.

Mrs. Quintana, one of our school's counselors, saw me as Iread the note. She asked me if Iwanted to vote. Isaid. "Yes." She went inside Mr. Von Rodeck's office. The door was unlocked. Inside

his office, close to the door, was a table. On the table was a roster of names. She used a blue marker tohighlight a name on the roster in front of me. Iwas unable to see the roster or if my name washighlighted. She handed me a ballot, an envelope, and a blue marker to vote. She did not ask me for anyidentification.

Iused the blue high lighter to mark my ballot. I inserted my ballot into an envelope. Itried to

close the envelope. Ihad a hard time securing the envelope for it could open easily. Iasked for glue.

Mrs. Quintana was not able to find glue. I asked her for the tape. I was given tape. I used tape to securethe envelope which contained my ballot. Ihanded the envelope to Mrs. Quintana. Mrs. Quintanaplaced the envelope in a gift box which had an unsecured cardboard top. I left worried about the

security of my ball~ot£.~

OFT Election 2/25/201 1, held on JFK High School campus

On 2/25/2011 a violation occurred throughout the February 25 election at JFK High Schollcampus due to the union members were not able, nor instructed to sign their name on themembership roster. As a result JFK votes were voided by the election committee. As JFKteachers and GFT members, we would like have our votes counted, therefore we are requestingfor a new vote for JFK union members.
