Dear Mr. Voser,

We the undersigned write to express our concern about the ongoing impact of oil pollution on

economic, social and cultural rights in the Niger Delta region of Nigeria. We are calling on

Shell to contribute $1 billion as an initial payment towards an independent fund to clean up pollution.

Oil contamination has devastated the lives of the people in the Niger Delta – destroyed their

livelihoods, undermined their access to clean water and food, and put their health at serious

risk. Hundreds of thousands of people are affected, particularly the poorest.

The failure by the oil industry to properly address pollution exacerbates human suffering and environmental damage. For example, the two major oil spills which occurred in 2008 in Bodo,

Ogoniland continued for weeks before they were stopped, and three years on Shell has still not cleaned up the pollution.

In August 2011, following its landmark assessment of oil contamination in Ogoniland, the UN Environment Programme (UNEP) found that Shell has failed to effectively clean up oil

pollution for years. While significant responsibility for the ongoing human rights abuses in the Niger Delta rests with the government of Nigeria, it is clear from UNEP’s report that

substantial responsibility also rests with Shell.

We urge you to acknowledge Shell’s responsibility for the impacts of oil pollution in the Niger

Delta, and we call on the company to:

Contribute the full $1 billion identified by UNEP as the start-up amount needed to

establish an independent fund to clean up pollution in Ogoniland.

Carry out a comprehensive clean-up of all oil pollution and environmental damage in Bodo, in consultation with the community.

Undertake a transparent review of all its operating practices in the Niger Delta,

including in relation to clean up processes, oil spill investigations, community

consultation, and compensation payments. Support the need for a further assessment of oil pollution, similar to the UNEP

study, across the wider oil-producing Niger Delta region.

Pay fair and adequate compensation to all affected communities.

27 เมษายน 2555 ปีเตอร์ โวเซอร ์ประธานผู้บริหาร รอยัล ดัชท ์เชลล์ เรียน คุณโวเซอร ์ พวกเรา ผู้รว่มลงนามในจดหมายนี้ (939 คน) ตระหนักถึงผลกระทบในด้านเศรษฐกิจ สังคมและวัฒนธรรมจากมลภาวะทางน้า้มันในสามเหล่ียมปากแมน่้้าไนเจอร ์ เราต้องการให้เชลล์แสดงความรับผิดชอบดว้ยจ้านวนเงินเริม่ต้นหนึ่งพันลา้นบาทในการขจดัมลพิษและปรับปรุงสภาพแวดล้อมซึ่งถูกท้าลายจากกรณทีี่น้า้มนัรัว่ไหล การปนเป้ือนทางน้้ามันส่งผลเสียอย่างรา้ยแรงต่อประชาชนที่อาศัยอยู่ในบริเวณสามเหล่ียมปากแมน่้้าไนเจอร ์ทา้ลายวิถีชวีิตความเป็นอยู่ สารพิษที่ปนเป้ือนเป็นอุปสรรคต่อชาวบ้านในการไดร้ับน้้าดื่มและอาหารที่ถูกสุขลักษณะ ทั้งยังเป็นการเส่ียงต่อสุขภาพพลานามยัของผู้คนหลายพันคน โดยเฉพาะกลุ่มชาวบ้านผูย้ากไร ้ ความลม้เหลวในการขจัดมลภาวะทางน้า้มนัซึ่งเกิดจากการขุดเจาะของบริษัทส่งผลกระทบอย่างร้ายแรงต่อชวีิตความเป็นอยูข่องชาวบ้านในพื้นที่ดังกล่าวทัง้ยังท้าให้สภาพแวดล้อมเส่ือมโทรม การรั่วไหลของน้า้มันสองครั้งใหญ่ในปี 2551 ท่ีโบโด โอโกนแิลนด ์ดา้เนินอยู่เป็นเวลาหลายสัปดาห์กวา่ที่เหตุการณ์จะหยุด และกว่าสามปีทีผ่า่นมาทางบริษัทก็ยังไม่มีการดา้เนนิการแก้ปัญหาอยา่งเหมาะสม ในเดือนสิงหาคม ปี 2554 หลังจากการประเมนิความเสียหายจากการรัว่ไหลดังกล่าวในโอโกนิแลนด ์โครงการสิ่งแวดล้อมแห่งสหประชาชาติ (UNEP) พบว่าเชลล์ล้มเหลวในการขจดัมลภาวะทางน้า้มนัอย่างมีประสิทธภิาพมาเป็นเวลาหลายปีแล้ว ในขณะที่หน้าทีแ่ละความรับผดิชอบในการละเมดิสิทธิมนุษยชนดังกล่าวในสามเหล่ียมปากแมน่้้าไนเจอร์เป็นของรัฐบาลไนจีเรีย อยา่งไรก็ตามเป็นที่ชัดเจนในรายงานของโครงการสิ่งแวดล้อมแห่งสหประชาชาติท่ีวา่ ยังคงเป็นหนา้ทีข่องบรษัิทที่จะต้องออกมาแสดงความรับผิดชอบในเรื่องนีด้้วย พวกเราเรียกร้องให ้ บริษัทเชลล์แสดงความรับผิดชอบตอ่ผลกระทบอันร้ายแรงที่เกิดขึ้นจากมลภาวะทางน้า้มนัในบริเวณสามเหล่ียมปากแม่น้า้ไนเจอร ์ดังนี ้

จัดสรรเงินจ้านวนหนึ่งพันลา้นบาทตามการประเมินของ UNEP ซึ่งเงินจ้านวนนีจ้ะเป็นเงินเริ่มตน้ในการจัดตั้งกองทนุอิสระในการทา้ความสะอาดมลภาวะที่เกิดจากน้้ามันรั่วไหลในโอโกนิแลนด ์

ท้าความสะอาดมลภาวะที่เกิดจากน้า้มนัรัว่ไหลและส่งผลให้เกิดความเส่ือมโทรมของสภาวะแวดล้อมในโบโดอย่างครอบคลุม โดยต้องมีการปรึกษาหารือรว่มกับชมุชน

จัดใหม้ีการทบทวนอย่างโปรง่ใสต่อกระบวนการการจดัการทั้งหมดในบริเวณสามเหลี่ยมปากแมน่้้าไนเจอร์ ไมว่่าจะเป็นกระบวนการในการท้าความสะอาด การสืบสวนการรั่วไหลของน้้ามัน การปรึกษาหารือกับชุมชน และการจา่ยเงินค่าชดเชยความเสียหาย

สนับสนุนต่อความจา้เป็นทีย่ังต้องมีการประเมนิอย่างต่อเนือ่งถึงผลกระทบที่จะเกิดจากมลภาวะทางน้้ามันในพ้ืนที่อ่ืนๆ ทีม่ีการขุดเจาะน้า้มันในบริเวณพ้ืนที่สามเหล่ียมปากแม่น้า้ไนเจอร ์

รบัผิดชอบคา่ชดเชยต่อทุกชมุชนที่ได้รับผลกระทบอย่างเพียงพอและเป็นธรรม.
