IntroductionThe Restricted Substances List (RSL)1 applies to all Levi Strauss & Co. (LS&Co.) products, including apparel, non-apparel, footwear, accessories and other products. The RSL also applies to all materials, parts, chemicals and other goods (including sundries) supplied or used in producing LS&Co. apparel, accessories and other products. The RSL is an important part of LS&Co.’s product stewardship and environmental sustainability programs, and must be shared with all sources of materials, parts, chemicals and other goods, supplied or used in producing LS&Co. apparel, accessories and other products. Each product or other component source agrees the materials, parts, chemicals and other goods supplied or otherwise delivered to LS&Co. comply with the prohibitions, limitations and other requirements described or referred to in the RSL.

Each supplier of materials, chemicals, parts and other goods, (a) to LS&Co., and (b) to any LS&Co. contractor when the supplier knows that the materials, chemicals, parts and other goods will be used during the manufacture or sale of a LS&Co. distributed product, represents and warrants that each of its materials, chemicals, parts and other goods, complies with all provisions of the RSL (including, but not limited to, the RSL’s prohibitions, restrictions and other requirements) and that the supplier will indemnify and hold LS&Co. harmless from any claim, loss, damage or other detriment, resulting from any such supplier’s non-compliance.

PurposeLS&Co. cares about consumers and the environment, and we recognize our suppliers as critical partners in meeting our consumer safety and environmental protection commitments. We publish this list in order

to provide up-to-date information to our business partners, including direct sources and licensees, on product compliance with international consumer products regulations, to the best of our knowledge.

Using the ListThis list contains five core sections: Restricted Substances requirements (Sections 1 & 2), Chemical Phase-out List (Section 3), REACH (Section 4) and Chemical Information Log (Section 5). The appendices provide supplementary guidance to assist our business partners in understanding and complying with the RSL requirements.

We require our suppliers and business partners to study this document carefully, implement management processes in their operations to comply with these requirements and communicate the information to their internal teams and raw material suppliers.

As a supplier of LS&Co. products or raw materials for LS&Co. products, you are required to understand the RSL product standards and deliver only compliant products. You are also responsible for seeking guidance from LS&Co. in any situation where you may have doubts or uncertainties about your product’s compliance with LS&Co.’s RSL product standards. Compliance with LS&Co.’s RSL product standards is a mandatory condition for each and every order placed by LS&Co.

1. Substances Which May Be Found in Some Apparel, Accessories and Other Products

ApplicationThe prohibitions and restrictions listed in this section apply to all LS&Co. products, including all materials, parts, chemicals and other goods, supplied or used in LS&Co. products. Each supplier of materials, chemicals, parts and other goods, (a) to LS&Co., and (b) to any LS&Co. contractor when the supplier knows that the materials, chemicals, parts and other goods will be used during the manufacture or sale of a LS&Co. distributed product, represents and warrants that each of its materials, chemicals, parts and other goods, complies with all provisions of the RSL (including, but not limited to, the RSL’s prohibitions, restrictions and other requirements) and that the supplier will indemnify and hold LS&Co. harmless from any claim, loss, damage or other detriment, resulting from any such supplier’s non-compliance.

PurposeLS&Co. is committed to upholding health and safety by producing safe products. This section identifies the substances of primary interest to LS&Co. and presents those substances along with the corresponding prohibitions or limitations. In addition, analytical test methods for use by the LS&Co. approved laboratory are given for each substance.

LS&Co. may test materials, parts, chemicals and other goods for these substances. LS&Co. suppliers and other contractors have a non-delegable duty to comply with the prohibitions, limitations and other requirement of the RSL. The presence of a substance on the RSL or on any previous RSL should not be interpreted as suggesting that the substance is, or ever was, present in any LS&Co. apparel, accessories or other products.

• Set up an RSL management team in the factory.

• Contact LS&Co.’s RSL team with any questions or to request training.

• Communicate with and educate internal staff responsible for LS&Co. products (staff for material and chemical purchasing, product development, production, etc).

• Communicate LS&Co.’s RSL to all of your raw material suppliers and subcontractors.

• Communicate with your chemical suppliers, ensuring they are aware of all the chemicals and other goods that they supply have to comply with the prohibitions and restrictions listed in the RSL.

• Purchase only materials, parts, chemicals, and other goods which comply with LS&Co.’s RSL requirements.

• Request Material Safety Data Sheets (MSDS) from your chemical suppliers for every chemical purchased.

• Understand all the chemical inputs to your production by requesting Chemical Information Log (Section 5) from your chemical supplier.

• Contact all your chemical and raw material suppliers to ensure their understanding of LS&Co.’s RSL and their commitment to supplying only RSL-compliant chemicals and materials.

• Conduct internal staff training.

• Document all finishing/printing formulations.

• Document all process control variables (e.g., curing temperature/duration).

• Replace unknown materials/chemicals with materials/chemicals that meet LS&Co.’s RSL.

• Do not ship products if you are in doubt about the products’ compliance. Verify RSL compliance through laboratory testing and consult LS&Co. RSL team at the same time.

• Validate only materials and chemicals meeting the RSL requirements are used on LS&Co. products.

• Regularly check process control variables (curing temperatures, liquor ratios, recipes) to validate proper chemical application.

• Perform analytical laboratory testing with random sampling as a routine RSL compliance verification process.

requires LS&Co.’s prior approval.15 Including short chain chlorinated paraffins from C10H22-nCln to C30H62-nCln, where n=1 -28, chlorine content 20% to 70%. Use LC-MS for C20 to C30.16 Metal restrictions are separated into four categories: (1) restrictions for textiles and artificial leather, (2) restrictions for natural leather and coated

natural leather, (3) restrictions for sundries and jewelry (children), and (4) restrictions for sundries and jewelry (adult).17 The concentration is calculated at elemental level.18 Extractable Metal Content—the sample is extracted with aqueous solution/acid, and the metal content is determined from the extract.19 LS&Co.’s antimony limit for natural fibers is 30 mg/kg. For polyester fibers, LS&Co.’s antimony limit is 260 mg/kg.

20 Total digestion metal content—the sample is digested by concentrated acid and the total metal content in the sample is measured.21 Jewelry includes stones and crystals. Man-made leaded crystals are prohibited from use on any children’s products.22 Children’s products are defined as products designed and marketed for children age 12 and below.23 Applicable to metallic parts when the metallic part surface has direct and prolonged skin contact.24 For metallic parts without a surface coating or plating, test in accordance with method EN 1811. For metallic parts with a surface coating or plating,

perform EN 12472 then test in accordance with method EN 1811. The same limit value of 0.5 µg/cm2/week applies regardless of the test method used.

25 EXCEPTION: For baby products (age 0–24 months) intended for the Japanese market, the formaldehyde concentration must be below an absorbancy (A–A0) limit of 0.05 using JIS L1041-1983, Method A.

26 Direct skin contact: any part of the product (e.g.: collar, cuff, body, sleeves) is in direct prolonged contact with the skin (e.g.: leather gloves without inner lining) during normal use.

3. Chemical Phase-Out List

ApplicationThis Chemical Phase-Out List applies to chemicals used in the manufacture of LS&Co. products and raw materials. Suppliers are requested to find alternatives to the substances listed below. While LS&Co. prefers the following substances are not used in the manufacture and production of products, we acknowledge certain challenges may prevent an immediate cessation of use. LS&Co. will continue to support efforts to identify alternatives to these phase-out chemicals with the goal of prohibiting their use at a future time.

PurposeLS&Co. initially developed the Chemical Phase-Out List in 2008 to further advance LS&Co. environmental sustainability initiatives. Between that time and the publication of this 2010 RSL, significant progress has been made where certain substances, such as

phthalates, have been successfully phased-out from our products. While we have found success on certain substances, we recognize additional effort is needed, in partnership with chemical suppliers around the world, to fully phase-out other substances.

LS&Co. encourages our suppliers to identify suitable alternatives to the following substances.

1. Alkylphenol ethoxylates (APEOs) APEOs are non-ionic surfactants which find

wide use in the textile industry in detergent or chemical mixtures as surfactants, emulsifiers or dispersants. APEO-free detergents or chemical mixtures are available in most areas of the world. Each product manufacturer should contact their chemical suppliers to understand if APEOs are present in currently used chemicals and to inquire about APEO-free alternatives.

2. Polyvinyl chloride (PVC) PVC may be found in screen printing systems

and used in packaging materials. Traditionally, plastisol screen printing was a PVC-based printing system. Suppliers of screen printing services should contact the supplier of printing auxiliaries to fully understand the PVC content and identify alternatives to PVC. Water-based (PVC-free) printing systems are widely available in all locations of the world. PVC use is prohibited in packaging materials by LS&Co.

• Determine whether any of the substances listed on LS&Co.’s Chemical Phase-out List are used in production or present in any purchased material or chemicals.

• Consult with supplier or chemical manufacturer to identify replacement chemicals for those listed on the Chemical Phase-out List.

• Identify any process control, equipment or recipe modifications needed to properly use the replacement chemical.

• Substitute the chemicals used in production line to eliminate chemicals listed on the Chemical Phase-out List.

• Communicate to LS&Co. if you have difficulties in finding alternatives, or if you have found an alternative chemical that LS&Co. should know about.

• Communicate to LS&Co.’s RSL team on the timeline when the chemicals listed in Chemical Phase-out List will be phased out in production.

• Ensure the replacement chemical does not violate other provisions of the RSL.

• Contact chemical suppliers other than your current chemical suppliers to check if they may offer alternative chemicals that do not contain any of the phase-out and restricted substances.

34 Substances of Very High Concern (SVHC) are defined as CMR 1, CMR 2, PBT or vPvB substances. as given in the legal text of REACH, Annex XVII for CMR, and on the European Chemical Bureau website, http://ecb.jrc.ec.europa.eu/esis/index.php?PGM=pbt. The listing below is inclusive of SVHCs, candidate substances and pre-candidate substances, as defined below:

4. REACH

The European Union’s Regulation Concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals

ApplicationThis section applies to all suppliers manufacturing or supplying materials, parts, chemicals and other goods supplied for use in LS&Co. apparel, accessories and other products, which are intended for sale in any European Union member state.

PurposeThe information provided below is intended to assist our suppliers to comply with REACH (Regulation (EC) Number 1907/2006 of the European Parliament and of the Council).

Every LS&Co. supplier agrees to inform LS&Co. of any substances in “LS&Co. Concern List” with the concentration over 0.1% in any and all products, including apparel, non-apparel, footwear, accessories and other products. In supplying this information, LS&Co. does not intend to assume all or any part of our suppliers’ duty to comply with the regulation.

What Suppliers Should DoAll LS&Co. suppliers shall visit the European Chemicals Agency (ECHA) website (http://www.echa.eu) regularly and comply with the published obligations and guidance regarding chemicals and consumer articles.

Of particular note for REACH is the speed at which new substances may become listed as a SVHC34. Therefore, LS&Co. will undertake the task of monitoring the REACH requirements and attempt to publish semi-annually an updated list of potential SVHCs. To ensure all products supplied to LS&Co. comply with REACH at the time of market, each supplier is obligated to track not only the current SVHCs, as listed on the ECHA website, but also the entire list of potential SVHCs shown below. This

action will prevent the situation where a substance is listed as an SVHC during the time between manufacture and market. Suppliers shall map each step in their supply chains, including the sourcing and processing of raw materials, parts, chemicals and other product ingredients, and be able to immediately inform LS&Co. according to Information Duty (Article 33) of all cases where a substance listed in the “LS&Co. Concern List” is presented in the product at or above a 0.1% concentration, calculated by weight. SVHCs also restricted in Section I of this RSL are not included in the following list.

The “LS&Co. Concern List” will be updated every January and July. Suppliers shall refer to latest list and review their supply chain for Information Duty.

5. Chemical Information Log

ApplicationLS&Co. suppliers should communicate with their chemicals suppliers about the LS&Co. RSL. A best practice in chemical management is to request a comprehensive Chemical Information Log from each and every chemical supplier. Chemical suppliers should review LS&Co.’s RSL to determine which substances in their preparations (chemical mixtures), if any, may violate LS&Co.’s RSL policy.

The CIL should also be sent to LS&Co. by e-mail ([email protected]).

The CIL should be completed for each preparation used in the manufacture of any LS&Co. product. The CIL includes 6 columns. The first column should be completed with the chemical trade name, as indicated on product packaging documents, MSDS and label. For each preparation, the chemical supplier shall indicate whether such chemical:

(1) contains an RSL substance, or

(2) may form an RSL substance during normal processing conditions.

When a preparation contains, or may form, an RSL substance in a concentration that could cause an LS&Co. product to exceed corresponding RSL restrictions, the chemical supplier should indicate this by identifying the RSL substance and concentration on the CIL. The concentration indicated on the CIL must be the concentration of the RSL substance in the chemical preparation.

PurposeLS&Co. acknowledges the wealth of specific chemical information resides with the chemical company and not necessarily with the product manufacturer. It is therefore imperative to compliant product manufacturing that the chemical supplier properly communicates the existence of RSL listed substances to their customer (the product manufacturer). Such

information flow from chemical supplier to product manufacture allows the product manufacturer to properly understand the potential for each chemical to meet the RSL requirements. We believe the CIL allows for such information flow in a clear and concise manner.

Appendix 2: Definitions

Accessories – Accessories are products other than typical pants and shirts. Accessories can include both apparel and non-apparel products such as belts, caps, shoes, handbags, gloves, socks, scarves, eyewear, watches, home textile products, and wallets. The examples covered here are neither exhaustive nor all inclusive, they simply provide examples of products defined as accessories. All accessories are covered by LS&Co.’s RSL.

Allowable Trace (TR) – The allowable trace is identified by the TR designation in the Limit Value column. The trace amount represents the permitted unavoidable trace presence of a substance that is allowed to be found on the garment when the substance has been prohibited from use.

Article – Means an object which during production is given a special shape, surface or design which determines its function to a greater degree than does its chemical composition.

Chemical Abstract Service (CAS) Number – The CAS number is a unique number that identifies a particular chemical structure. While there may be various synonyms for a chemical and different naming conventions, there is only one CAS number. Mixtures of chemicals do not have CAS numbers, only individual chemical components have CAS numbers. When there is doubt about the chemical name used in the RSL, always check the CAS number.

Children’s Products – A children’s product is that which is made for, marketed for use by, or marketed to, children age 12 and under. All Girls size 0-16 and Boys size 8-20 are included within the definition of children’s products.

Concentration Limit – The concentration limit is set for each substance as measured on the final product and represents the maximum allowable amount of the respective substance which can be found in a RSL compliant product. The concentration limit is shown in the Limit Value column. The limit is specified as the amount of the substance on the amount of substrate, by weight (e.g., milligrams substance per kilogram of product [mg/kg]). Concentration limits are applicable to any single part of a garment or accessory, not an average over the whole product.

Detection Limit – The detection limit specifies the test method detection sensitivity that a laboratory must be able to achieve when measuring the substance in the product.

LS&Co. Product(s) – LS&Co. final products covered by the RSL include all LS&Co. branded products, including Levi’s®, Dockers®, and Signature by Levi Strauss & Co.™ products. LS&Co. Products include those sourced directly by LS&Co., products sourced by an agent, and those designed and sourced by our licensee partners.

Non-Apparel Products – Non-apparel products are those that are made from materials other than fabric or leather. Some products included in non-apparel products are mobile phones, home furnishings, ties, hats, watches, jewelry, eyewear, and electronics. All non-apparel products are covered by LS&Co.’s RSL.

Plastisol Ink – Plastisol ink may be used during screen printing. Plastisol inks are sold by the chemical supplier pre-mixed, meaning the color and the binder are purchased as one preparation. The vast majority of plastisol inks available on the market are based on polyvinyl chloride (PVC). Plastisol inks are also sometimes called solvent printing inks.

Polyvinyl Chloride (PVC) – Polyvinyl chloride, or PVC for short, is a hard plastic that may be found in packaging materials, flashers and screen printing. PVC is prohibited for use in packaging for all LS&Co. products. Alternatives to PVC packaging include polyurethane (PU), polyethylene (PE) and polyethylene terephthalate (PET). In addition, PVC screen printing, which utilizes phthalates, is prohibited for products.

Preparation – Means a mixture or solution composed of two or more substances.

Reporting Limit (RL) – The reporting limit is the lowest concentration the laboratory is allowed to report. If the laboratory detects an amount of the substance below the RL, the laboratory report must state Not Detected.

Sundries – Sundries are items that are permanently attached to the garment or footwear and may include zippers, rivets, buttons, care labels, name labels, and tags.

usage Ban – A usage ban is defined as a prohibition of intentional use of the substance during any and all stages of product manufacturing. However, the RSL identifies an allowable trace amount of the substance due to unavoidable contaminant.

Water-based Printing – Water-based inks and binders are used during screen printing. The ink and binder are sold separately and must be mixed at the printing factory to obtain the required color. Water-based printing (inks and binders) do not contain PVC.

Appendix 3: Product Testing

LS&Co. currently maintains various product testing programs to validate RSL compliance. Notwithstanding LS&Co.’s testing programs, the supplier shall be fully responsible for obtaining all necessary knowledge and information required to understand and execute business processes that ensure RSL compliance. The supplier is also responsible for performing analytical testing on products to verify the product’s compliance to all RSL requirements. The supplier should test products only at LS&Co. approved laboratories (Appendix 7).

Products can be tested as prescribed in the following tables. Table A provides testing guidance based on material type. Table B provides testing guidance based on finish type; Table C provides testing guidance for screen prints; and Table D provides testing guidance for footwear material. These tables only define the most probable tests but not limited to. In addition to the testing guidance provided in the following tables, LS&Co. may at any time request additional testing to validate product compliance with the RSL. All costs associated with product testing are the responsibility of the supplier.
