Software License Agreement----------------------------------------------------------------------Copyright of this software product remains the property of the Author,Eugene V. Muzychenko. Use of this software is allowed only uponagreement of this license. The Author (here in after refereed to as theLicensor) grants you (here in after refereed as the Licensee) anon-exclusive license to use this software in accordance with the termsof this agreement.----------------------------------------------------------------------1. CONCLUSION AND TERMINATION OF THIS AGREEMENT- The Licensee is deemed to have concluded this agreement when theLicensee copies part or the whole of this software, or when theLicensee starts to use the program included in this software. Here, useof the program refers to executing the program executable files on a PC.- This agreement may be terminated by the Licensee at any time.- This software and any copy of it shall be erased upon termination ofthis agreement.2. RIGHTS AND OBLIGATIONS- Free TRIAL version of this software can be used, reproduced anddistributed freely on non-profit basis. Only a FULL version, lawfullyobtained, is permitted for any kind of commercial usage. A copy of theFULL version can be distributed only together with its lawfullypurchased license.- Audio Repeater application included into distribution package can beused freely, even without installing entire VAC product. There are nofunctionality limitations for this application in the TRIAL package.- The Licensee is permitted to distribute the TRIAL version of thissoftware in accordance with the following terms:(1) The Licensee agrees not to modify content and structure of thissoftware. However, the Licensee may compress/archive this software ifit can be unpacked using commonly used methods.(2) The Licensee agrees not to profit from provision of this softwareto a third parties. However, TRIAL version of this software can befreely distributed together with another product, including commercialones.- For the FULL version, a lawfully obtained software copy can be used inaccordance with the following terms:(1) if the software is used for non-commercial purposes in a private homeenvironment, a single license is enough for all home computers;(2) if the software is used for commercial purposes and/or for real-timeoutdoor broadcasting (for example, network audio streaming), eachadditional running instance, regardless of whether real or virtual machine,requires an additional license. Thus, number of instances running at thesame time must not exceed number of licenses acquired.The "running instance" means VAC driver that transfers audio streamsthrough Virtual Cables. If there are no active streams (Virtual Cabledevices are not used), there are no running instances in the system.Copies of FULL version distribution package can be made for backup purposesonly.- Owner of a lawfully purchased license (or multiple licenses) to theFULL version is permitted to pass (not to replicate) them to a thirdparty. In such case, a third party became a new Licensee and mustacknowledge this Agreement. Licenses obtained from the licenser withouta payment can be passed without a payment too.- When the Licensee passes last of licenses owned, the Licensee losesall rights to the FULL version and must not retain any copies of theFULL version.3. SUPPORT POLICYThe Licensor provides TECHNICAL support for the software product.Technical support is free of charge for all cases when the productworks not as described in the documentation, within one year sinceproduct purchase.The user must consult the documentation before asking for support.Three support levels are available, chosen in order form:- Self-support. This level is intended for advanced users only. Onlydetailed, technically competent bug reports, formed as described in theuser manual, are accepted. Additionally, technically competentquestions about important technical details not described in the usermanual are accepted. Other requests are not accepted. Before sending arequest, the user must carefully read all the documentation and clearlyunderstand all product specialities. The user also must ensure that theproduct is used as described in the documentation and take measures toisolate the problem. Lost download details recovery is not supported.- Basic support. Free-form informative problem reports and technicalquestions not answered/explained in the documentation are accepted. Asupport request must be detailed enough to explain the problem clearly.Before asking for support, the user must read all the documentation and usecontext search feature with keywords specific to a problem to findinformation and possible solution. Non-informative problem reports like"the product does not work" and requests asking for prepared solutions like"how to setup application X to use it with the product" are not accepted.Requests that require testing the product with third-party software are notaccepted. For lost download details, one recovery request is allowed.- Extended support. All support requests are accepted. Before asking forsupport, the user must read important parts of the documentation("Principles", "Basic usage rules", "Examples", "How to...","Troubleshooting", "Frequently asked questions"). Informative problemdescription will speed-up request processing. Requests that require testingthe product with third-party software are satisfied only if all neededsoftware is available for free download (no payment, subscripton or evene-mail address specification requirements). For lost download details,three recovery requests are allowed.Bugfixes and upgrades/downgrades within the same major product versionare provided freely for all support levels.Support requests are processes within 2-3 business days.For user requests not related to incorrect product functioning and/orissued after one-year period, additional processing time and/or paymentmay be required.The Licensor provides no training in product, three-party software,operating system or general computer usage.4. REFUND POLICYRefunds are possible only if ALL conditions listed below are met:- The software is installed and used exactly as described.- The software works not as described and some of its key featureslisted in the documentation are not supported.- There is no workaround to make the software working properly.5. LIABILITYTHIS SOFTWARE IS DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND ISEXPRESSED OR IMPLIED. YOU USE IT AT YOUR OWN RISK. THE LICENSOR WILLNOT BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KINDOF LOSS WHILE USING OR MISUSING THIS SOFTWARE.
