ground floor the proposed works include - alterations to the main entrance door to replace the double door with a single door; removal of single leaf door to
left of main entrance as this door is currently unused; remove/replace and reposition fixed seating and screen detail as shown upon the plans; full height
partition with waiter station to be added adjacent to central emergency exit; creation of a guacamole counter at which customers will be seated to dine. Drinks

to the building and to the local area to make use of otherwise empty space. There are internal stairs connecting the ground floor area to the first floor, It is
proposed that the ground floor continues operating as it currently stands, with the first floor to be used for pre-booked groups and for functions (on
Wednesdays to Saturdays only). The whole of the premises would be used in accordance with the existing licence conditions. The first floor area has been
used for the service of alcohol and late night refreshments under TENs on a large number of occasions without complaint or issue. Many other pubs in the
area are operated across two levels, with the first floor being used for pre-booked groups and functions, as is proposed here.

Café Baku Ltd, 22-24 Lansdowne Row, W1 (West End Ward / not in cumulative impact area)
This was an application to vary the existing temporary licence, increasing the hours when the tables and chairs could be used from 23:00 to midnight every
day of the week. The Applicant’s Representative was aware that it is rare for the Council to approve external seating beyond 23:00 other than in central
locations such as Leicester Square. The Council’s guidance normally does not allow the highway to be used after 23:00 for placing tables and chairs. The
reasons given by the Applicant’s Representative as to why the application should be granted included that she believed that there was a lack of residents in
the vicinity of the premises, that the clientele would not be intoxicated or loud (the emphasis was more on shisha at the premises) and that the conventional
hours limited the customers.
Environmental Health objected to the application on the grounds that it would add to public nuisance. Environmental Health advised that there were local
residents in the vicinity. There had previously been complaints towards the premises. The Sub-Committee did not consider that there were exceptional
reasons for extending the use of the tables and chairs beyond 23:00 and refused the application.

Belgravia Ward)

32 Henrietta Street, WC2 (St James’s Ward / West End Cumulative Impact Area)
This was an application for a new premises licence at the seafood restaurant. The Applicant had agreed the Council’s model restaurant condition and the
Applicant’s Representative amended the hours the premises are open to the public so the application was in keeping with the Council’s Core Hours policy.
The Responsible Authorities’ concerns were addressed. A local resident had concerns about the lateness of the terminal hours and that people loitered
outside near the entrance to the front door. She added that other premises in close proximity were not open as late and she was concerned about the
Applicant applying for tables and chairs in the future. The Applicant’s Representative made the point that there were premises amongst those she referred to

which did have the ability to operate Core Hours even if they chose not to. In the event that that tables and chairs were applied for on the public highway
then the local resident would be consulted. The Sub-Committee decided to grant the application, considering that it promoted the licensing objectives.

The Applicant’s Representative explained that the main intention of the application for the variation of the premises licence was to extend the terminal hour
by half an hour for the sale of alcohol in the downstairs restaurant to the rear of the premises to 01:00. He was also looking to remove out of date conditions
on the licence. Environmental Health and the Licensing Authority had maintained their representations due to the later hour for the capacity of 120 in the
West End Cumulative Impact Area but had also referred to the improved clarity of the proposed conditions. These conditions included alcohol being ancillary
to a table meal and there being no entry or re-entry apart from smokers after 23:00 and also out of date conditions being removed.
The Sub-Committee granted the application and agreed the addition/amendment of conditions except one. The proposed removal of this condition would
have had the effect of making the premises drink led and it was therefore not removed.
Restaurant and Bar, Ground Floor, Strand Palace Hotel, 372 Strand, WC2 (St James’s Ward / West End Cumulative Impact Area)
These were two separate applications for new premises licences for a restaurant and bar at 372 Strand. The Joe Allen premises which had traded in Exeter
Street were moving to the ground floor at Strand Palace Hotel and it was proposed that the area would be de-licensed from the Hotel. The Applicant was
seeking the same hours for the Restaurant and Bar areas, including on and off sales of 10:00 to midnight Monday to Saturday and 10:00 to 23:30 on Sunday
and opening hours of 09:00 to 00:30 Monday to Saturday and 09:00 to midnight on Sunday.
The Sub-Committee noted that the existing hotel licence permitted hours for a restaurant which the Applicant was now seeking for the Joe Allen restaurant.
The hotel licence permitted half an hour less for a bar than was sought for the Joe Allen bar. Members were aware that these were new applications and that
the policy was to refuse in the West End Cumulative Impact Area unless there were exceptional grounds. Members considered that there were exceptional
grounds given the similar existing licences, the nature of the existing premises licence and that there were a number of benefits from the conditions offered.
The hotel licence had few restrictive conditions whilst the new licences included the model restaurant condition for the restaurant, prevented drinks being
taken outside from the bar area and there were set capacities for the two areas.

This was an application for a new premises licence for licensable activities until 01:00 including the sale of alcohol. The Applicant amended the application so
that it was proposed that members of the public would be able to have a drink without food there until 20:00. After this time the premises would operate
purely as a restaurant. It was also proposed that there would be pre-booked private or corporate functions.
The Sub-Committee granted the application. There would be at least one licensed door supervisor on duty from noon each day until closing time. Private,
pre-booked functions would be limited to 20 per year.
11 Great Cumberland Place, W1 (Bryanston and Dorset Square / not in cumulative impact area)
Two Temporary Event Notices (‘TENs’) were submitted by the Premises User. The Premises User was seeking an extension of one hour for the sale of alcohol
at the shop until midnight for the first TEN on 28 July and 29 July and the second TEN on 5 August. The Representative of the Premises User advised at the
hearing that the second TEN was being withdrawn. He offered an undertaking to have a security person outside the premises from 22:00 if the TEN was
permitted to proceed.
The Police had concerns that this is a very high risk location and that it would potentially be a destination venue. It would be vulnerable to those who had
already been drinking including street drinkers. There was also the potential for public nuisance and urination. Whilst the Police did not blame the premises
for an incident where staff were threatened and one member of staff had been involved in an altercation, the Police did believe this was an example of the
high risk of the location and why it should not open for an additional hour on 28 July and 29 July. The Sub-Committee decided that the TEN should not
proceed and gave a counter notice based on the strong evidence of the Police.
