Spring Ahead March is the month we “spring ahead”. At 2 a.m. on the second Sunday of every March, Congress says we’re supposed to set our clocks forward one hour ahead of standard time.

Not everyone embraces change, even when it’s mandated. Hawaii doesn’t follow Daylight Saving Time and neither do the territories of Puerto Rico, Virgin Island, Guam and American Samoa. Arizona and Indiana, on the other hand, straddle the fence. The Navajo Indian Reservation in Arizona DOES observe daylight savings time, the rest of Arizona doesn’t. The Eastern Time Zone section of Indiana doesn’t change their clocks but the rest of the state does.

Confused yet? Try figuring out what’s happening in real estate. Today’s news reported promising increases in new housing starts and existing home sales, followed by a story on massive job loss within the construction industry. So, exactly who is building the new houses? I read that a record number of homeowners have opted to invest in home improvement instead of selling. Try comparing that data to The National Association of Home Builder study reporting the remodeling market is continuing to deteriorate. Say what?

Based on what’s being reported, I’m not quite sure if the real estate market is springing ahead yet or not. To be honest, I’m not even sure I know exactly what time it is where you live. It’s a good bet, though, that warmer weather and the slow emergence of spring in the Northeast will bring an upswing in the housing marketing. We’re all rooting for it!

Pending legislation May Make Loans More Expensive If you’re planning on--or just dreaming about buying a house, it may pay to hurry up. Although interest rates are currently low, in the not-too-dis-tant future the costs of financing a home may be so high many consumers simply will not be able to afford it. That could happen if a piece of leg-islation before the U.S. Senate comes to fruition, warn people familiar with the situation.

The financial reform bill “Restoring American Financial Stability Act” includes something called a “risk-retention” provision. This would require all lenders to hold at least 10 percent of the “credit risk” for each loan they originate and ultimately sell off to investors. The idea is that this will prompt lenders to be more diligent in qualifying clients, as it forces them to have exposure to risk in the loans they write.

It’s also believed to mean lenders will have to have 10 percent of cash on hand for each and every loan they write.

“While I am sure our elected officials have good intentions, the unintended consequences of this legislation would be staggering,” said Scott Stern, chairman of the Community Mortgage Lenders of America, a national group dedicated to increasing competition and consumer choice in the mortgage industry. “In reality, what will happen is a mass closing of small community and regional lenders, who will simply not be able to carry the amount of cash required by the legislation. This is significant, as local lenders write nearly 40 percent of all mortgages.”

Consider this: If a small community lender writes $100 million in loans, after only five years it will be asked to hold as much as $50 million in cash reserves--impossible for most lenders.

Lenders warn the net result could be a smaller pool of lenders, with those who remain forced to charge significantly higher rates to cover the cost of risk retention.

“I have to wonder if the government is familiar

with the lending process. Lenders already retain the risk on the loans they write. If they do not meet the investors’ guidelines, the lender must buy that loan back,” Stern said.

Many lenders, and consumers, are watch-ing this one very closely. You can write your legislators to let them know that you oppose risk retention and limited choice at www.house.gov and www.senate.gov. (NAPSI)

tame Your tweetsYou shred your mail, and protect your debit card, but did you know tweeting or posting information on FaceBook about your employment status, home foreclosures in your neighborhood, or other potentially sensitive information could impact your personal finances?

SmartMoney.com is reporting that lenders are starting to look at social networking sites, especially FaceBook, Twitter, and Linkdin to get information about their customers.

Here’s what you need to know:A company called RapLeaf.com is already providing lenders with data taken from customers’ FaceBook pages. It’s only a matter of time before more of these data scanning companies come on line.

So far, RapLeaf insists it’s only providing data for targeted marketing campaigns and that the information is not used to make lending decisions. But it’s anybody’s guess when information you post or tweet starts to affect your credit score.

Anything you post on the Internet is public information and there’s nothing illegal about lenders using it however they wish. Now, if a lender denies you a loan based on information taken from your FaceBook page, without disclosing the source, it could violate the Fair Credit Reporting Act.

The bottom line is you have to be very careful about what you post or tweet. To their credit, RapLeaf.com does allow consumers to opt out of its database at www.rapleaf.com/opt_out (Source: Crown.org)

Carbon Monoxide

Detectors Required Under New LawOn February 22, 2010, Amanda’s Law went into effect throughout the State of New York, requiring that all residences have carbon monoxide alarms installed on every level of a home where there is an area utilized for sleeping. The new legislation was introduced after the tragic story of 16-year-old Amanda Hansen who died from carbon monoxide poisoning while at a sleepover at her friend’s house.

Prior to Amanda’s Law, residential dwellings that were constructed or offered for sale after July 30, 2002, had to be updated with a carbon monoxide detector. Amanda’s law effectively removed the construction and sale provisions, and provided that all homes regardless of construction or sale date must be outfitted with a carbon monoxide detector. In addition, any two-family dwelling, dwelling accommodations located in a building owned as a condominium or cooperative in the State, or any multiple dwelling must have an operable carbon monoxide detector. Such structures include, but are not limited to, a tenement, flat house, apartment, duplex, hotel, nursery school, fraternity/sorority, school dormitory, nursing home, or convalescent home. newsshortsForeclosures May Top 20 MillionForeclosures are likely to top 20-million homes in

the U.S. if government officials don’t take action to

lessen the impact of the foreclosure crisis, according

to a report by Housing Predictor.

The real estate research firm was the first to forecast the

foreclosure epidemic, triggering the worst economic

turmoil since the Great Depression.

In a recent Housing Predictor survey nearly 1 in 3

mortgage holders say they will walk away from their

homes if housing prices continue to fall. The action

would leave bankers on the hook for trillions of dollars

in unpaid mortgages and send the U.S. economy

into a worsening financial crisis, resulting in the highest

number of renters in the housing market in decades.

Consumers are saving more in light of the economic

turmoil and home sales are improving in many especially

hard hit areas of the country with the assistance of

first time home buyers tax incentive.

Foreclosures compose the majority of home and

condo sales nationally. Nearly 6-million additional

through 2010 and more than three-quarters will not

be able to be refinanced under current mortgage

guidelines. As a consequence, millions of more

homes will go into foreclosure and provide a growing

driveway sealant scam: Deeply discounted driveway

services may use inferior products that wear away

type of material is used and the method of application

then do some research.

chimney repair: This scam often begins with a

cheap offer for cleaning gutters. Once the gutter

work is performed, the contractor claims the chimney

is in need of repair and may even go so far as to remove

bricks and mortar from your chimney. Another popular

scam is when a contractor claims there is a threat of

carbon monoxide poisoning if the chimney is not

repaired immediately. Always get a second opinion

from a reputable contractor.

roofing: Some contractors may use substandard

materials and only after your roof leaks, possibly

resulting in interior property damage, you realize

you have been scammed. You should request that

your contract have a hold-back clause where the final

payment is withheld until 30 days after the completion

of the project. This provides time for the roof work

to withstand some weather patterns such as rain,

wind, snow or ice.

Credit Card Reform enactedEffective February 2010, many unfair credit card industry

practices were outlawed. The new protections are the

latest phase of the federal Credit Card Accountability,

Responsibility, and Disclosure Act. The most significant

reforms include:

limits on interest rates Hikes during the first Year

-- The interest rate on a new credit card cannot be

increased during the first year, unless it’s a variable

rate card, the “introductory rate” expires after a minimum

of six months, or the cardholder is more than 60

days late in making a minimum payment.

limits on “Penalty” interest rate Hikes -- If the interest

rate is hiked because you were more than 60 days

late in making a minimum payment, the old interest

rate must be restored if you make all your payments on

time during the first six months after the rate increase.

fairer Payment Allocation -- If your card has more

than one interest rate on balances, any amount you

pay above the minimum payment must first be applied

to the balance with the highest interest rate.

clearer due date and time -- Payments must be

due on the same day each month. If the due date

falls on a weekend or holiday, no late penalty can

be assessed if payment is received the next business

day. Payments received by 5 p.m. must be credited

the same day.

Your credit card bill must disclose how long it will

take to pay off the existing balance, and the total

cost in interest fees, if you pay only the minimum

amount due each month.

To compile the findings and determine the latest kitchen and bath trends, the organization surveyed those members who designed a kitchen or bathroom during the last quarter of 2009. According to NKBA, the top 10 trends for 2010 are:

Making a big statement throughout the kitchen in 2010 is the addition of functional drawer appliances. One such example, which has been specified by nearly a third of NKBA’s kitchen designers, is modern refrigeration technology. Turning convenience into a luxury, under-counter refrigerated drawers feature adjustable horizontal and vertical dividers to keep frequently used items close at hand. Perfect for the ultimate entertainer, refrigerated drawers are quite roomy, typically tall enough to store a 2-liter bottle and wide enough to hold items such as serving trays and pizza boxes.

If you’re tired of running the dishwasher when it’s only half-full, consider installing a dishwasher drawer. Because it’s independently operated, you can wash small loads as economically as large ones. According to NKBA, just under half of bathroom designers utilize marble, as it provides a sophisticated look that’s reminiscent of Roman baths with its regal, refined detail that exudes a sense of luxury. Plus, marble countertops provide a stain-resistant, water-resistant, rugged and durable surface - ideal for child-friendly bathrooms or homes with just one bathroom that see a lot of traffic throughout the day.

NKBA also forecasts that integrated sink tops will be a popular choice this year, as you can easily use existing items to achieve this look. By adding a sink into an antique dresser or chest, designers are creating one-of-a-kind vanities for nearly 30 percent of all clients.

Polished chrome finishes are another bathroom design trend for 2010. Look to incorporate this chic metal accent into all your hardware by updating the accessories in your bath, as well. First, let me tell you that mortgage debt is the only kind of debt I don’t yell about. I don’t borrow money - ever. But, I know most people won’t do the “100% Down Plan” when it comes to buying a home. So what are your options?

For those of you who are in debt (which is most of you), let me tell you what Sharon and I did. Nearly 20 years ago my wife, Sharon, and I hit the financial bottom because of our debt. We did an unpopular thing to help turn things around. After years of marriage and owning hundreds of pieces of real estate, we became renters. Normal mindset is that you should buy and not rent but remember normal is broke. All these years later, I can see that that was probably THE best sacrifice we made. We were able to pay off our debts and save money for a house.

Although that’s the smartest and safest route, if your heart is set on buying a home you can still do it wisely. But if you can’t pay cash for a house in full, how do you figure how much house is too much?

Take some time to sit down and do the math. Your mortgage payment should not be more than 25% of your take-home pay and you should get a 15-year or less fixed-rate mortgage. Notice I said a 15-year mortgage, not 30. Don’t be tempted by the smaller monthly payments of a 30-year mortgage. The truth is 30-year mortgages are for people who enjoy being in debt so much they want to extend it for 15 more years and pay thousands of dollars more in interest for the privilege!

Now, you can probably qualify for a much larger loan than what 25% of your take-home pay would give you. But it’s really not wise to spend more on a house because then you will

be what I call “house poor.” Too much of your income would be going out in payments, and it will put a strain on the rest of your budget so you wouldn’t be saving and paying cash for furniture, cars and education.

The point is your house payments shouldn’t take over your budget. Don’t let your mortgage payments cause you major stress every month for years and years to come. Your dream home needs to be just that, a dream. You don’t want it turning into a financial nightmare.

You worked hard, saved your money, secured a company pension, built up a 401(k), and invested well. In short, you made all the right choices in planning for retirement.
