LIMERICK TOWNSHIP - BOARD OF SUPERVISORS REGULAR MEETING MINUTES
APRIL 2, 2019 7:08P.M.
A meeting of the Limerick Township Board of Supervisors was held on Tuesday, April 2, 2019, in the Public Meeting Room of the Limerick Jown~li.ip Municipal Building, located at 646 W. Ridge Pike, with Kenneth W. Sperring, Jr\ Chairman,' presiding. This meeting was advertised in The Mercury on January 10, 2019.
~ Members Present: Supervisors Kenneth W. Sperring, Jr., Thomas J. Neafcy, Jr. (arrived to the co meeting at 7:40 P.M.), Patrick M. Morroney, D. Elaine De Wan, and Kara Shuler

Call To Order: Mr. Sperring called the meeting to order at 7:08 P.M. and led the Pledge of Allegiance.

Mr. Sperring announced that the Board held an executive session prior to the meeting for matters of real estate and litigation. Mr. Sperring then offered the following announcements are available for viewing on the agenda:

Consideration of Minutes: Motion was made by Ms. Shuler and seconded by Mr. Morroney, to approve the Minutes of the March 19, 2019 Board of Supervisors meeting. Motion passed 3-0-1, with Ms. De Wan abstaining due to her absence at the 3/19/19 meeting.
Public Comments on Agenda Items: None.
Bills List: Motion was made by Ms. Shuler and seconded by Mr. Morroney, to approve Bills List #7, 3/16/19 through 3/29/19, $123,975.53. Motion passed unanimously.
Approval - Appointment to Parks & Recreation Committee: Mr. Sperring summarized that Liam Kaufman, a Freshman at Spring-Ford High School, is interested in filling the current student representative vacancy on the Parks and Recreation Committee. Mr. Sperring expressed his gratitude towards Mr. Kaufman for stepping up and serving the Township.
Motion was made by Ms. DeWan and seconded by Ms. Shuler, to appoint Mr. Liam Kaufman to the Parks & Recreation Committee. Motion passed 3-0-1, with Mr. Morroney abstaining because he never met him (Liam Kaufman).
Appointment:
Police Specialist {Part-Time): Mr. Skelton summarized that Heather Chiarlanza accepted the job offer and is excited to begin working for the Limerick Township Police Department.
Motion was made by Ms. De Wan and seconded by Ms. Shuler, to appoint Heather Chiarlanza to the part-time position of Police Specialist. Motion passed unanimously.
Subdivision and Land Development
Extensions:
a. Raven's Claw-Parcel A Subdivision (#19-01): Extended to 7/22/2019
Motion was made by Ms. Shuler and seconded by Mr. Morroney to accept the development time review extension. Motion passed unanimously.
Confirmed Appointments:
Roger Lehmann (AU County & A sociates, Inc.) - 400 Sunset Road: Roger Lehmann and Stephen Tabakelis were present. Mr. Lehmann summarized the proposal of a two-lot subdivision along Sunset Road which currently has a single-family home on the parcel. Discussion ensued regarding the required road improvements, sidewalk installation, and waiver fees, which would prove too costly, making the project infeasible. Discussions continued over the required variance for lot size. The Board encouraged Mr. Lehmann to first seek a variance for the project and come back before the Board to discuss sidewalk deferrals, waiver fees, road improvements, etc. Upon a

question by Mr. Lehmann concerning their concern of spending zoning application money if the Board would still impose the required road· improvements, Mr. Sperring noted the Board's previously tract record of working with small property owners. Mr. Lehmann thanked the Board and indicated he will pursue a variance. .

LAP Lot 4 (#17- (3) Linfield Autopark Lot #4 (99 Autopark Boulevard) Revised Final Plan Discussion
The applicant's engineer, Adam Brower, summarized the proposed minor building expansion to the proposed Subaru dealership. Discussion ensued regarding impervious coverage and circulation concerns from the Planning Commission. Mr. Brower indicated that the addition proposes no increase in impervious coverage and a proposed concrete bump-out has been removed on the plan, allowing for safer circulation.
Motion was made by Ms. Shuler and seconded by Mr. Morroney, to authorize the Township Solicitor to prepare a Revised Final Resolution for Board consideration for the LAP Lot #4 SLD project (#17-13), conditioned that the Board see the revised plan. Motion passed unanimously.

Raven's Claw Parcel A Subdivision (#19-01) Masters Drive Preliminary/Final Discussion
The applicants, Joe Clement, Michael Clement, applicant's engineer, Nick Feola, and Raven's Claw HOA board attorney, C. Robert Lewis, were present. Joe Clement summarized the 7-lot subdivision plan for the Board and clarified that the house designs would resemble those of the existing neighborhood. Discussion ensued regarding the Raven's Claw community's involvement in discussing the project. Mr. Sperring noted the Board's belief that they were under the assumption the entire HOA membership would be involved in discussing the project and be required to have at least a minimum of 51 % approval, not just the HOA Board. Mr. Sperring indicated that he doesn't want the HOA board making a decision for the entire Raven's Claw community, and the Board would have opposed the applicant's ZHB application, but they were told that the applicant had HOA support for the project. Mr. Sperring further clarified that "HOA approval" means the entire membership, not just the sitting HOA board members. Mr. Kerr further clarified that the township message to all interested parties looking to develop this lot, is that the entire community would need to support so no opposition would be directed at the sitting Board of Supervisors. Ms. DeWan recommended the applicant go back to the Raven's Claw community to gamer feedback to see if they could acquire a majority of the community's support for the proposal and come back before the Board. Discussion ensued regarding the regulations for the proposed lots. Mr. Lewis clarified that the lots would not be included in the existing HOA of the Raven's Claw Community, therefore, a separate set of regulations will be provided. The proposed regulations were distributed to the Board at the meeting for their review. Mr. Clement

also clarified that only a few trees would be removed within the rear of the properties, but the steep slopes would be untouched. Ms. Shuler recommended the applicant send the residents the regulations and proposed plan so that they can review it before their next community meeting and also have the Township's meeting date posted so the community can come out. Mr. Morroney inquired if the current decisions were made by any HOA members at the end of their term. Mr. Lewis clarified that the decisions were made much earlier before any term expiration of any HOA member.
Chris Blackmore (96 Masters DR) inquired of who will enforce the regulations on the proposed lots. Mr. Clement clarified that it is their intention that regulations would be enforced by Limerick Township.
Matthew Medveckus (237 Masters Drive) inquired of why the proposed lots can't be included into the existing HOA. Mr. Lewis clarified that 100% of the Raven's Claw community would have to agree to include the proposed lots into the HOA, which he believes is an impossibility.
Daniel Walker (71 Bella Rosa CT) thanked the Board for looking out for the community members of the HOA of the Raven's Claw. He urged the Board to look out and fight for communities without an HOA and provide those communities with same transparency and voice as provided to the Raven's Claw community.
Motion was made by Ms. DeWan and seconded by Ms. Shuler, to table the discussion until a future meeting. Motion passed unanimously.
New Business
Authorization - Advertise Outdoor Burning Amendment Ordinance: Mr. Kerr summarized the proposed changes to the current outdoor burning ordinance.
Motion was made by Ms. Shuler and seconded by Ms. De Wan, to authorize advertisement of a Public Hearing for consideration and approval of an Outdoor Burning Amendment Ordinance. Motion passed unanimously.
Authorization - Advertise SLDO Amendment Ordinance: Mr. Kerr summarized the proposed changes to the current SLDO ordinance.
Motion was made by Ms. Shuler and seconded by Ms. De Wan, to authorize advertisement of a Public Hearing for consideration and approval of a SLDO Amendment Ordinance. Motion passed unanimously.
Authorization - Adverti e Parking Amendment Ordinance: Mr. Kerr summarized the proposed changes to the current Parking ordinance. Mr. Neafcy inquired if parking permits could be given to the residents along the subject portion of Ridge Pike. Mr. Kerr clarified that parking permits could be issued, if needed.

Motion was made by Ms. Shuler and seconded by Mr. Neafcy, to authorize advertisement of a Public Hearing for consideration and approval of a Parking Amendment Ordinance. Motion passed unanimously.
Resolution - DCNR Grant Application - Limerick Community Park - Phase I:
Motion was made by Mr. Morroney and seconded by Ms. DeWan, to approve Resolution No. 2019-13, authorizing a grant application to the DCNR for the Limerick Community Park- Phase 1. Motion passed unanimously.
Resolution - Support Limerick Fire Department DCED Grant Application:
' Motion was made by Ms. DeWan and seconded by Ms. Shuler, to approve Resolution No. 2019-14, supporting the Limerick Fire Department's grant application to the DCED. Motion passed unanimously.
Approval - Tree Vitalize Grant - Letter of Intent:
Motion was made by Mr. Neafcy and seconded by Mr. Morroney, to approve a letter of intent to submit a grant application to the Tree Vitalize grant program. Motion passed unanimously.
Manager's Report:
Mr. Kerr provided updates on: a current Right-to-Know request (requesting all residential permits from 1980 to current day). A cost of $14,000 dollars and 6 months of an employee's time is estimated to meet this request. PSATS is supporting an effort to establish an amendment to the R TK laws to allow municipalities to include employee wages in calculating fees to produce the requested documentation, and we (members of the Board and staff) will be going out to the PSA TS convention in two weeks; crews are making good progress on the sewer line installation project at the Limerick Community Park; the Township will be requesting PennDOT to reimburse costs incurred with sign installations and sign rental fees related to the Main Street detour; the Township will be contacting the County, based on a request from a resident of the Willow Run community, to install signs along a portion of Swamp Pike prohibiting the use of Jake Brakes. Mr. Skelton summarized that the Township is coordinating with the County's Community Service program to aid in trash collection along Township Line Road and LinfieldTrappe Road.
Public Comments:
James Oehlert (268 Steinmetz RD.) inquired of the status of the native plant ordinance update. Mr. Kerr updated Mr. Oehlert that the Streetscape & Buffering Committee will convene soon to undertake the study. The Township Planner will be involved to review native plants and how they can be applied to the Township, as well as assessing the streetscaping along Ridge Pike and

Lewis Road. He will include Mr. Oehlert in the meetings if so desired and Mr. Kerr noted that any other resident interested in participating is welcomed to do so.
Preston Luitweiler (2 Woodmont CT.) congratulated the Board and the Township for their efforts in installing a sewer line to the restrooms at the Limerick Community Park. He also thanked Mr. Sperring and Ms. De Wan for their sensitivity to the concerns of the residents of Raven's Claw and expressed appreciation for their comments that residents who move into a community, should be informed of what is happening next door. He also updated the Board that five people from the Mountain View Estates community appeared in opposition at last week's ZHB meeting, to a variance request from a neighbor on Woodmont Ct. who is proposing a detached garage with in-law quarters.
Supervisor Comments:
Mr. Neafcy passed along gratitude he received from residents regarding the rental inspection program and the professionalism and kindness they received from the Department of Emergency Services. He also personally thanked the Department of Emergency Services for their service to the residents.
Mr. Morroney would like the Board and Township Staff to look into the feasibility of video recording all public meetings and posting online. The Board agreed to look into the request.
Adjournment: There being no further business, motion was made by Mr. Neafcy and seconded by Mr. Morroney, to adjourn the meeting at 8:25 P.M.
