Item No. 38 :— Opening of New Homoeopathic Dispensary at Nangloi (Ward-32).

The department has a proposal for opening of a new Homoeopathic Dispensary in newlyconstructed building of maternity home at Nangloi which has later to be shifted to proposed new multi-purpose building to be constructed nearby.

Nangloi is a thickly populated area consisting of people from its old village as well asre-settlement people. Residents, by and large, are poor. There is no other Homoeopathic Dispensary ofMCD in and around this area. The proposed site has been visited. For the larger public interest both, theproposed site in maternity home as well as proposed nearby multipurpose building is suitable for running ofa Homoeopathic Dispensary.

Estimated expenditure on above staff would be around Rs. 9.50 lacs per annum (consideringthat most of staff will be deployed on contract basis). Expenditure on furniture, equipment and thecontingencies will be around Rs. 1.00 lac, Rs. 1.00 lac will also be required for medicines. An expense infirst year has been envisaged to be Rs. 1l.50 lacs. This expenditure has been estimated to the extent ofRs. 17.00 lacs p.a. In case full regular staff is provided.

After commissioning, the expenditure for the first 5 years will be incurred under Annual Plantill end of plan period, i.e. 31-March-2017. Thereafter, the dispensary will be regularized and expenditurewill be booked under non-plan. Demand for allocation of funds for this proposal has also been made forthe year 2012-13 and there will be no resource constraint.

O&M Department has considered and cleared the proposal of above mentioned 4 (four)posts. Finance has concurred in the proposal. The observation of Finance will duly be complied with themaximum extent.

As the post to be created are for category A, C & D and expenditure for running thisDispensary will be of recurrent in nature, the proposal for approval is required to be placed beforeCorporation routed through the Standing Committee for opening of Homoeopathic Dispensary at Nangloi(Ward-32) as proposed above including creation of posts and incurring of expenditure.

Item No. 39 :— Grant of four advance increments to the UDCs (Auditors) who have passedthe Departmental Confirmatory Test between the period from 1-1-1973 to31-5-1981—implementation of Hon’ble CAT, Chennai Bench judgmentpassed on 20-11-2002 in OA No. 229/2002 to all similarly placedemployees/retirees in IA & AD.

MCA’s letter No. MCA/Admn./Genl./11-108/Vol.I/481 dated 10-9-2012.

This office follows the staffing pattern of CAG of India office. The Auditors in the IA & ADas well as in this office are required to pass the Departmental Confirmatory Examination for confirmationto the post of Auditor. On passing this examination these Auditors were being granted 4 advanceincrements. This incentive scheme was discontinued w.e.f. 1-1-1973 on the recommendations of 3rd PayCommission. Subsequently, w.e.f. 1-6-1981 this scheme was replaced by the grant of Qualification Payamounting to Rs. 15/- to such Auditors. No benefit was allowed to those Auditors who have passed thisexamination during the period from 1-1-1973 to 31-5-1981.

Accordingly the above said incentives which were also extended to eligible Auditors of thisoffice were not allowed during the period from 1-1-1973 to 31-5-1981.

Subsequently on the basis of orders passed by Calcutta Bench and Chennai Bench of Hon’bleCAT and the said Judgments were being upheld by the Hon’ble Supreme Court of India, the Office of theComptroller & Auditor General of India vide Circular No. 4-Staff (Entt.-1)/2011 No. 118-Entt.-1/65-2011dated 10-2-2011 has extended/allowed the benefits of 4 advance increments to all such Auditors whopassed the Departmental Confirmatory Test during the period from 1-1-1973 to 31-5-1981 from the datefollowing the last day of the Examination in which the candidates have been declared successful. Thisbenefit has been extended to all eligible serving/retired officials on actual basis. In the cases of retiredpersons the pensionery benefits were also to be revised taking into consideration the pay re-fixed aftergranting this benefit.

As the office of the Chief Auditor is still functioning as a combined Audit office for North,South and East Delhi Municipal Corporations, therefore, being the lead Corporation, the North DelhiMunicipal Corporation through the Standing Committee of North Delhi Municipal Corporation is requestedto approve the grant of 4 advance increments to all eligible serving/retired officials of Office of the ChiefAuditor who have passed the Departmental Confirmatory Examination during the period from 1-1-1973 to31-5-1981 and re-fix their pay/pension accordingly.

This may be treated as an item of Urgent Business.

Sub:- Award of works on the basis of Unit Rate System in Horticulture Department, North Delhi Municipal Corporation for one year.

The normal procedure for procurement of supplies and execution of works is to invite tenders as per the settled norms. This procedure is being adhered to by the Horticulture Department in all cases. However, on occasions, it is felt that many works are required to be executed on preference basis as the normal procedure of calling NIT etc. which is lengthy and also many times tenders are not finalized due to formation of cartel by the contractors.

With a view to expedite the works in time bound manner, the Unit Rate System (URM) is one of the novel procedures to be adopted. This procedure is already in vogue in Engineering Department for getting the works executed. For last three years, this system of URM is in practice in Horticulture Department and it has worked well. Previously it was approved by the Standing Committee vide its Resolution No. 665 dt. 18.11.2010. The validity of the rates approved, expired in November,2011.

Common items of work for which unit rates can be fixed have been identified

with a view to facilitate work / purchase so as to meet out their urgent requirements. In this regard, an NIT was floated on 18.10.2011 in the shape of ‘Expression of Interest’ (EOI) for 324 items by giving wide publicity in local news papers, display on Notice Boards etc. (Annexure-A). A total of 82 contractors documents were found in order in response to the EOI. List of eligible contractors is placed at Annexure-‘B’.

For evaluation of rates and working out Justification of Rates(JOR) of all

different 324 items enlisted in the Unit Rate System, as shown in Annexure-‘A’, a Technical Sub Committee was constituted as follows:-

The Sub Committee surveyed the market to know the trend of market rates of various items. After taking the feed back from the market, considering CPWD rates, DSR etc. it arrived at Justification of Rates. The minutes of the meeting of the Committee are placed at Annexure-‘C’. The Justification of the Rates arrived at by the Committee, the lowest rates received from the contractors and rates approved for work are compiled and are placed at Annexure-‘D’ for each items. After analysis of rates offered by the contractors vis-à-vis Justification of Rates it is observed that in some cases, the contractors had quoted abnormally high rates or abnormally low rates for some of the items which were not acceptable/workable. Accordingly, it is considered that rates within 15% of lower limit of justification of rates were considered reasonable for such big quantity of work etc., which has to work for entire period, and quality of work/supply is to be maintained. The accepted rate is calculated as follows :-

(i) Justified rate if lowest quoted rate is higher than or equal to the

justified rate. (ii) 15% below the justification, where lowest quoted rate is less than 15%

below the justification. (iii) Lowest quoted rate, if lowest quoted rate is more than or equal to the

(-)15% justified rate and below justified rate. This is as per the practice in vogue in Engineering Department of erstwhile

MCD for URM. The participating contractors were asked to give their acceptance in the form of affidavit as per the performa at Annexure-E to these rates for execution of work. All of them have given their acceptance in the form of affidavit to these rates for execution of work/supply. The Technical Evaluation Committee was also formed consisting of the following members to over see the recommendations of Sub Committee and ensure that the procedure for adoption of rates as well as formulation of scheme including agency, is in order :-

1. Director of Horticulture Chairman. 2. SE(Planning) Member 3. DCA(HQ) Member 4. DDH(HQ) Member 5. DDH/City Zone Member 6. DDH/Rohini Zone Member 7. ADH(HQ) Member Secretary

This Committee has also recommended for adoption of the scheme. The following procedure is to be followed for Unit Rate System :- 1. The estimates shall be prepared/sanctioned by the competent authority as

per procedure in vogue. 2. System of allotting work will be done in serial order and weekly draw may be

made for the same as per the requirement. 3. The allotment of zones to the contractor will be done as follows :

(a) Each contractor will be allotted two zones. (b) One Zone will be allotted to a contractor as per his willingness as far as

possible. (c) One Zone will be allotted to a contractor randomly by the department.

4. For allocation of work, a roster of contractors / firms of the zone will be prepared in alphabetical order in each zone and work will be allotted as per lottery system. On the basis of requirements of works in zones, estimates will be prepared on these approved unit rates and proper sanction with concurrence of finance shall be obtained. The contractor will be required to deposit the required Earnest Money and Tender Cost etc. for the particular / individual works.

5. On the basis of number of works required, works will be awarded by the DOH

/ DC of the Zone (in all cases of URM). 6. The list of empanelled contractors and unit rates finalized shall remain in

force for a period for one year from the date of finalization but could be extended further after obtaining approval from the competent authority. The contractors whose names have been included in the list of contractor under this method will have no bar to take work under normal procedure of tendering.

7. To ensure timely completion of the work before accepting fresh application

from the contractors, a written undertaking from the contractors may be taken about the current status of work in hand already awarded to them.

8. On the basis of number of works required, draw of lots may be made and

work may be awarded to the contractors on rotation after following all formalities.

9. The cost of individual tenders will not exceed Rs.2 lacs even after revised

work order. 10. The work order should specifically mention the period of execution of work

alongwith undertaking and other technical contractual formalities. 11. In case after issue of supply order, the contractor fails to execute the work

within the stipulated time, he will be issued notice to show cause as to why he should not be removed from the system and the said firm shall not be considered for allotment of work till decision of the show cause notice is finalized.

12. Quality assurance/auditing shall also be applicable as being carried out for

other similar works as per circular vide No.D/SE(QC)/2006/1571 dated 25.10.2006 and further circulars issued from time to time.

13. This system will be used for executing the works of maximum Rs.2.00 lacs

per ward in a month and maximum of Rs.10.00 lacs per ward in a year. Obligation of the Contractor :-

1. They will have to register themselves with the NDMC by paying security of Rs.50,000/- as Registration Fee.

2. Tender fee will be charged @ Rs.150/- for work order upto Rs.1 lac

and Rs.500/- if the supply order exceeds Rs.1 lac and upto 2 lacs only.

3. Security @ 10% of the work order shall be deducted in the first

running bill while making payment of bill. 4. The contractor shall abide by the terms and conditions as approved by

the Corporation.

Checking :- Checking shall be made by the Staff as under :-

1. Dy. Director(Horticulture) – 20% of the work & supply. He will also ensure complete execution of the work/supply.

2. Asstt.Director(Hort.) – 50% Test Check and he will also ensure

complete execution of the work/supply. 3. S.O(Hort.) – 100% Test Check.

The proposal was sent to Finance Department for concurrence. As per the advise of the Finance Department Sl.No.30 to 57, 59 to 63 and 311 to 312 of the URM have been dropped, as being supply items. Further as per the advise of the Finance Department Item No.64 to 310 of the URM will be treated as Supply and Planting items instead of supply items. As the proposal in the NIT was these items being supply items, therefore an affidavit has been obtained from all the participating contractors in this regard for treating items from Item No.64 to 310 as Supply and Planting items. With the modifications, Finance Department, NDMC has concurred the proposal. The above proposal for adopting URM Scheme with following specific proposals are submitted for approval for implementation of the Scheme :- 1. Approval of 82 contractors alongiwith allotment of zones to them be

approved as agency for execution of work under the URM as shown in Annexure-‘B’.

2. Approval of rates for execution of work as shown in Annexure-‘D’ (these are

the items after deleting the items suggested by the Finance Department) as Accepted Rates.

3. Approval of Terms & Conditions as shown in NIT in Annexure-A and the

procedure to be adopted, including obligation of contractors as already set out in the proposal at previous pages.

The proposal may be placed before the Corporation through Standing Committee for approval as an urgent business, so as to start the execution of works.

/ DC of the Zone (in all cases of URM). 6. The list of empanelled contractors and unit rates finalized shall remain in

force for a period for one year from the date of finalization but could be extended further after obtaining approval from the competent authority. The contractors whose names have been included in the list of contractor under this method will have no bar to take work under normal procedure of tendering.

7. To ensure timely completion of the work before accepting fresh application

from the contractors, a written undertaking from the contractors may be taken about the current status of work in hand already awarded to them.

8. On the basis of number of works required, draw of lots may be made and

work may be awarded to the contractors on rotation after following all formalities.

9. The cost of individual tenders will not exceed Rs.2 lacs even after revised

work order. 10. The work order should specifically mention the period of execution of work

alongwith undertaking and other technical contractual formalities. 11. In case after issue of supply order, the contractor fails to execute the work

within the stipulated time, he will be issued notice to show cause as to why he should not be removed from the system and the said firm shall not be considered for allotment of work till decision of the show cause notice is finalized.

12. Quality assurance/auditing shall also be applicable as being carried out for

other similar works as per circular vide No.D/SE(QC)/2006/1571 dated 25.10.2006 and further circulars issued from time to time.

13. This system will be used for executing the works of maximum Rs.2.00 lacs

per ward in a month and maximum of Rs.10.00 lacs per ward in a year. Obligation of the Contractor :-

1. They will have to register themselves with the NDMC by paying security of Rs.50,000/- as Registration Fee.

2. Tender fee will be charged @ Rs.150/- for work order upto Rs.1 lac

and Rs.500/- if the supply order exceeds Rs.1 lac and upto 2 lacs only.

3. Security @ 10% of the work order shall be deducted in the first

running bill while making payment of bill. 4. The contractor shall abide by the terms and conditions as approved by

the Corporation.

Checking :- Checking shall be made by the Staff as under :-

1. Dy. Director(Horticulture) – 20% of the work & supply. He will also ensure complete execution of the work/supply.

2. Asstt.Director(Hort.) – 50% Test Check and he will also ensure

complete execution of the work/supply. 3. S.O(Hort.) – 100% Test Check.

The proposal was sent to Finance Department for concurrence. As per the advise of the Finance Department Sl.No.30 to 57, 59 to 63 and 311 to 312 of the URM have been dropped, as being supply items. Further as per the advise of the Finance Department Item No.64 to 310 of the URM will be treated as Supply and Planting items instead of supply items. As the proposal in the NIT was these items being supply items, therefore an affidavit has been obtained from all the participating contractors in this regard for treating items from Item No.64 to 310 as Supply and Planting items. With the modifications, Finance Department, NDMC has concurred the proposal. The above proposal for adopting URM Scheme with following specific proposals are submitted for approval for implementation of the Scheme :- 1. Approval of 82 contractors alongiwith allotment of zones to them be

approved as agency for execution of work under the URM as shown in Annexure-‘B’.

2. Approval of rates for execution of work as shown in Annexure-‘D’ (these are

the items after deleting the items suggested by the Finance Department) as Accepted Rates.

3. Approval of Terms & Conditions as shown in NIT in Annexure-A and the

procedure to be adopted, including obligation of contractors as already set out in the proposal at previous pages.

The proposal may be placed before the Corporation through Standing Committee for approval as an urgent business, so as to start the execution of works.

PROCEDURE AND CONDUCT OF BUSINESS[REGULATIONS, 1958]

Subject :— Nomination of six elected sitting Members of Delhi Municipal Corporation to theHardayal Municipal Public Library (for merly Hardinge Library).

Commissioner’s letter No. F. 33/CSD/3605/C&C dated 8-7-1997.

The Hardinge Library Building was crected in 1915-1916 by the Hardinge Memorial FundExecutive Committee on the site provided by the then Delhi Municipal Committee by a resolution of theHardinge Memorial Fund Executive Committee passed on 22nd December, 1916. The said building washanded over to the Municipality as a Public Trust Delhi Municipal Committee vide its Resolution No. 5dated 28-8-1942 (Annexure-I) agreed to meet the financial requirements of the Library in accordance withthe agreement of June, 1942 between the Municipal Committee & Committee of Management of theHardinge Library Building.

2. As per terms of this agreement, the governance of the Library shall vest in a ManagingCommittee, comprising of eleven persons, namely :—

(i) The President of the Municipal Committee, who shall be the ex-officio President of theManaging Committee of the Library;

(ii) Six elected sitting members of the Municipal Committee nominated by it to the ManagingCommittee; and

(iii) Four persons elected by the subsctibers of the Library.

3. The six selected sitting members nominated by the Municipality and the four persons electedby the subscribers shall hold office for one year.

4. On coming into existence of Municipal Corporation of Delhi in 1957, the aforesaid agreementdevolved upon the Corporation by the virtue of clause (b) of sub-section (2) of Section 516 of the DMCAct—Annexure-II.

5. Hardayal Municipal Public Library formerly Hardinge Library is getting grant-in aid ofRs. 25.00 lacs per year of the total provision of Rs. 85 lacs from the Community Services Deptt. of theMunicipal Corporation of Delhi for carrying out social welfare activities. As per constitution of HMPL, theMayor shall be ex-officio President of the Managing Committee of the Library. The Hony. Secretary videhis letter dated 7-4-94 (Annexure-III) has requested the Mayor for holding election of the four membersfrom amongst subscribers so that the new Managing Committee could be constituted wherein six membersare also to be nominated by the Corporation.

Copy of Resolution No. 5 passed at a Special Meeting of the Delhi MunicipalCommittee, held on the 28th August, 1942.

5—Read the following Resolution No. 30 of the Executive and Finance Sub-Committee dated29-7-42 :—

30—The Committee vide Resolution No. 2 of the Special Meeting held on 25th March, 1942,referred the case to the Municipal Counsel for opinion, on legal position and for drawing a draft agreementfor the Delhi Municipal Public Library in consultation with the counsel of the Hardinge Library.

Draft agreement for Hardinge Library :

The following draft agreement has been prepared by the Municipal Counsel in consultationwith the counsel of the Hardinge Library.

DRAFT AGREEMENT

“An agreement made the __________ day of June, 1942 between the Municipal Committee,Delhi (hereinafter called ther Municipality) of the one part and the Committee of Management of the DelhiLibrary and Reading Rooms in Hardinge Library Building, Queen’s Gardens, Delhi, a Society registeredunder the Societies Registration Act (No. 21 of 1860), hereinafter called the Library of the other part.

Whereas the Hardinge Library Building in Queen’s Gardens, Delhi, was crected in 1915-1916by the Hardinage Memorial Fund Executive Committee on the site providsed by the Municipality for thepurpose.

And whereas by a resolution of the Hardinge Memorial Fund Executive Committee, passed onthe 22nd day of December, 1916, the said building was handed over to the Municipality as a Public Trustsubject to the condition that the Municipality shall undertake its upkeep and shall invest the LibraryCommittee with full control of the uses of the building, to which the Municipality assented by ResolutionNo. 7 of its Ordinary Meeing held on the 8th day of May, 1917, and accepted the Trust.

And whereas in pursuance thereof the Library took possession of the building and has sincebeen in possession thereof.

And whereas the Municipality has fulfilled its commitments and obligations in accordance withits aforesaid resolution and has recently extended the building by the addition of a Hall to the south thereofand supplied furniture at an approximate cost of Rs. 21,000/- for the benefit of the Library.

And whereas after negotiations with the Library, the Municipality resolved by ResolutionNo. 5 of its Special Meeting held on the 5th day of March, 1942, to finance the Library almost entirelysubject to certain conditions therein set out and made a proposal in accordance therewith to the Committeeof Management of the Library.

And whereas the Committee of Management of the Library at its meeting held on the 9th dayof March, 1942, accepted the said proposal.

And whereas the Municipality thereafter finally confirmed its provious resolution at its specialmeeting held on the 25th day of March, 1942.

Now it is agreed and declared as follows :—

1. That the Library shall be designated and henceforth known as the Hardinge MunicipalPublic Library or by such othe name as may from time to time be determined by theparties.

2. That the Municipality shall henceforth be responsible and from time to time makeadequate grants for the meeting of the financial requirements of the Library and for themaintenance and up-keep of the Library together with its Reading Rooms, Buildings,furniture and fitting.

3. That the governance of the Library for the purposes of discharging functions inconnection with the management and control of the Library in general or otherwise inrelation to the execution of the purposes of the Library shall vest in a Governing Bodyhereinafter called the Managing Committee comprising of 11 (eleven) persons, namely :—

(a) The President of the Municipal Committee, who shall be the ex-officio President ofthe Managing Committee of the Library;

(b) Six elected sitting members of the Municipal Committee nominated by it to theManaging Committee; and

(c) Four persons elected by the subscribers of the Library.

The six elected sitting members nominated by the Municipality shall hold officefor one year. The four persons elected by the subscribers of the Library shall hold officefor three years but shall be eligible for re-election at the expiry of their term of office.

A Secretary, shall be appointed by the Managing Committee of the Libraryaccording to its Rules and Regulations.

4. That any change in the Constitution of the Library shall be subject to ratification by theMunicipality.

5. That the Managing Committee of the Library shall be an autonomous body and shall havethe absolute management and entire control of the Library together with its ReadingRooms, funds, buildings, books, furniture, fittings and other articles.

6. That the Managing Committee of the Library shall have power to make, rescind, alter oradd to its own rules and regulations (not being inconsistent with this deed) from time totime as it may think fit, and shall have full liberty of action in the day-to-day administrationof its affairs including the fixity of the days and hours when and of the conditions underwhich the Library may be used by the subscribers as well as the public. The ManagingCommittee of the Library shall always respect the wishes of the Municipality in largermatters of policy.

7. That the managing Committee may from time to time open and maintain in the name ofthe Library a banking account. All cheques shall be signed by its Secretary and counter-signed by the President or one of the members of the Managing Committee.

8. That the Managing Committee may apply any part of the funds of the Library in thepurchaee of such books, pamphlets, periodicals, manuscripts, reports and other documentsfurniture and other articles or things as it may deem expedient and may also at any timesell or otherwise dispose of any of the books, periodicals, furniture and other articles orthings purchased under this clause or otherwise acquired for the general purposes of theLibrary and all moneys arising form any such sale or other disposition as aforesaid shallform part of its funds and shall be applicable accordingly.

9. That all students of the schools and colleges in Delhi together with persons engaged in anysuch of public administration and the general public or such portion thereof as theManaging Committee from time to time think proper shall subject to the rules andregulations for the time being in force have access to and be at liberty to use the ReadingRoom or Rooms and the Library.

10. That the Managing Committee may any time permit any part of the premises of theLibrary to be used either gratuitously or on reasonable payment for lectures, meetings orother purposes provided that the use thereof as and for the purposes of the Library shallnot thereby be interfered with.

11. That meetings of the Managing Committee shall be held at such times (not being less thanonce in three months) as the Managing Committee shall prescribe and five days notice ofevery meeting shall ordinarily be sent to each member of the Managing Committee by itsSecretary.

12. That at each meeting of the Managing Committee the President of the Municipal Comitteeor if he is not present then such person as the members present may appoint shall be theChairman. (Four members shall form a quorum.) Every question shall be determined bythe majority of the members present and voting thereon. In case of the votes being equal,the Chairman shall have a second or casting vote.

13. That a minute book shall be kept by the Managing Committee and all proceedings of theManaging Committee shall be entered therein.

14. That six reading rooms shall be opened for the time being in the different parts of the cityof Delhi, viz, (1), Subzi Mandi, (2) Bara Toti, (3) Karol Bagh, (4) Hauz Qazi, (5) Daryaganjand (6) Kashmere Gate, but this member may be increased as the demand for then growsand funds are available.

(a) The reading rooms shall be deemed to be the branches of the Library.

(b) They shall be open to the public free of charge.

(c) They shall be circulating libraries also.

(d) A fixed pereentage of the books in English, Hindi and Urdu shall be distributed amongthe reading rooms by rotation quarterly.

(c) A copy of selected books of general interest which shall be purchased by the Libraryin duplicate shall remain in circulation, but books on literature, fine arts, philosophy,history and science and reference books shall be housed in the Library.

(15) In the event of the dissolution of the Library the entire property of the Library and of itseach reading rooms shall revert to the Municipality.

Provided that no such order shall be made after the expiration of two years from theestablishment of Corporation.

516 (1) As from the date of the establishment of the Corporation :—

(a) The Delhi Joint Water and Sewage Board Act, 1926, and the Delhi Road TransportAuthority Act, 1950, shall stand repealed; and

(b) the enactments specified in the Thirteenth Schedule shall case to have effect withinDelhi.

(2) Notwithstanding the provisions of Sub-section (1) of this section or of Clause (a) of Sub-section (2) of section 286,

(a) any appointment, notification, order, scheme, rule, from, notice or bye-law made orissued, and any licence or permission granted under any or the Acts or enactmentsreferred to in Sub-section (1) of this section or under the Act referred to in clause (a)of sub-section (2) of section 286 and in force immediately before the establishment ofthe Corporation shall, in so far as it is not inconsistent with the provisions of this Act,continue in force and be deemed to have been made, issued or granted, under theprovisions of this Act, unless untill it is superseded by any appointment, notification,order, scheme, rules, form, notice or bye-law made or issued or any licence orpermission granted under the said provisions;

(b) all debts, obligations and liabilities incurred, all contracts entered into and all mattersand things engaged to be done by, with or for any of the bodies or local authoritiesspecified in the Second Schedule before such establishment shall be deemed to havebeen incurred, entered into or engaged to be done by with or for the Corporation orthe municipal authority concerned;

(c) all budget estimates, assessments, valuations, measurements or divisions made by anyof the aforesaid bodies or local authorities shall in so far as they are not inconsistentwith the provisions of this Act, continue in force and be deemed to have been madeunder the provisions of this Act unless and until they are superseded by any budgetestimate, assessment, valuation, measurement or division made by the Corporation orthe municipal authority concerned under the said provisions;

(d) all properties, movable and immovable and all interests of whatsoever nature and kindtherein vested in any of the aforesaid bodies and local authorities immediately beforesuch establishment shall, with all rights of whatsoever deseription, used, enjoyed orpossessed by any such body or authority, vest in the Corporation;

(e) all rates, taxes, fees, rents and other sums of money due to any of the aforesaidbodies or local authorities immediately before such establishment shall be deemed tobe due to the Corporation;

(f) all rates, taxes, fees, rents, fares and other charges shall, untill and unless they areveried by the Corporation continue to be levied all the same rate at which they werebeing levied by the aforesaid bodies or local authorities immediately before suchestablishment;

(g) all suits, prosecutions and other legal proceedings instituted or which might have beeninstituted by or against any of the aforesaid bodies or local authorities may becontinued or instituted by or against the Corporation.

A senior staff member shall ascertain the identity of the voter byverifying from the card and the photograph affixed to it. The ballot box will be opened by the ex-officioPresident, or by any other person authorised by him and the result will be placed before the ex-officioPresident who will sign the same.

Since the newly elected Corporation is in existence it is time to have four members from thesubscribers being elected. The election of the subscriber members is to be held at the earliest so that newManaging Committee is constituted.

Sec-516] The Delhi Municipal Corporation Act 583

Government may, be order as occasion requires, do anything which appears to it to be necessary for thepurpose of removing the difficulty.

Proviso attached to this section provides that no such order shall be made after the expirationof two years from the establishment of the Corporation.

516. Repeal, etc. and savings—(1) As from the date of the establishment of theCorporation

(a) the Delhi Joint Water and Sewage Board Act, 1926 (23 of 1926), and the Delhi RoadTransport Authority Act, 1950 (13 of 1950), shall stand repealed; and

(b) the enactments; specified in the Thirteenth Schedule shall cease to have effect withinDelhi.

(2) Notwithstanding the provisions of sub-section (1) of this section or of clause (a) of subsection (2) of section 286—

(a) any appointment, notification, order, scheme, rule, form, notice or bye-law made or issued,and any licence or permission granted under any of the Acts or enactments referred to insub section (1) of this section or under the Act referred to in clause (a) of sub-section (2)of section 286 and in force immediately before the establishment of the Corporation shall,in so far as is not inconsistent with the provisions of this Act, continue in force and bedemand to have been made, issued or granted, under the provisions of this Act, unless anduntil it is superseded by any appointment, notification, orde, scheme, rules, notice or bye-law made or issued or any licence or permission granted under the said provisions;

Kasturba Hospital is Major Hospital under NDMC having 450 bed capacity 

&  providing  mother  &  child  care  service  to  the  patients  of  walled  city  and 

minorities. The existing Operation Theater was constructed and handed over for 

services  in 1975.  It does not  fulfill as on date norms  for Operation Theater & 

requires  improvement  immediately  to  reduce  the  rate  of  infection.  Hospital 

authorities are approaching for the renovation of the same. 

As per requirement of hospital authorities estimate amounting to Rs.47.73 

Lac was framed for the same and got checked from S.W. This estimate includes 

granite stone on the walls & plateforms, marble stone on flooring and aluminum 

work. 

  Wards  Committee  City  Zone  vide  resolution  No.16  Item  No.14  dated 

20.01.2012  has  pleased  to  accord  administrative  approval  of  Rs.47.73  Lac  for 

renovation of main Operation Theater at 3rd Floor administrative block Building 

Kasturba Hospital. (Annexure ‘A’) 

After  getting  the  administrative  approval  from  Wards  Committee  City 

Zone  NDMC,  tenders  for  the  aforesaid work were  called  vide  NIT  No.EE(M)‐

II/CZ/TC/11‐12/61 dated 06.02.12 for tendered amount Rs.30,50,541/‐ after due 

publicity in the following daily Newspapers.

The rates offered by the lowest tenderer M/s Amba Contractors @ 7.99% 

above estimated rates are reasonable against the justification of rates works out 

by Planning Department @ 27.65% above estimated rates and recommended for 

acceptance. The  total  cost of work  is Rs.32,94,279/‐  (Rs. Thirty Two Thousand 

Ninety Four Thousand Two Hundred Seventy Nine Only). 

The validity of rates extended up to 31.10.2012. 

Finance has seen & concurred in the proposal. 

The case may be placed before  the Standing Committee  for approval of 

rates and agency  in  favour of M/s Amba Contactors @ Rs.7.99% Above  to  the 

estimated rates based on DSR‐2007 for the total cost of the work Rs.32,94,279/‐ 

under head of Account XL‐IX‐Med. as per NIT  conditions and  to authorize  the 

Commissioner  to enter  into  the contract with  the  lowest  tenderer as  required 

under DMC Act 1957 (Amended to date) under sanction 202(c).

Road (photo copy enclosed as Annexure-A). The said scheme (Now renamed as Development of Sanjay

Gandhi Transport Nagar Phase-II) was also executed entirely at site but due to court cases in Hon’ble

Delhi High Court and various courts allotment of the plots could not be made at that time.

Decision to execute Phase-II of the scheme was taken in a meeting taken by the Hon’ble L.G. on

29.7.2002 and it was decided that “ The entire plan would be re-developed by giving the study to School

of Planning and Architecture”. Accordingly, a fresh proposal was made for 746 nos. of plots, due to

increase in no. of allottees as per directions of Hon’ble Courts. Since, serial no.2 of the originally

approved scheme had been executed earlier, no provision of this component has been taken in Phase-II.

Similarly, no provision for third component has been made in Phase-II of the Development of Sanjay

Gandhi Transport Nagar.

Sanction for the proposal to develop phase-II, was accorded by the Corporation vide Resolution

No. 647 dated 04.01.2010. The total cost of the scheme is Rs. 22,56,20,800/- which contains various

components of works. Details of these components are as given below.

A detailed estimate for dense carpeting amounting to Rs. 1,74,30,000/- was technically

sanctioned by the competent authority. Draft NIT amounting to Rs. 1,34,30,633/- was also approved by

the competent authority and tenders were called vide NIT No. 27/1 dated 21.11.2011 due on 19.12.2011.

The tenders were loaded on MCD website known as http//mcdetenders.com and tender no.

146443 was allotted by the computer. Due publicity was given in the leading newspapers in various
