Requirements of section 83 (5) of the Environmental Protection Agency acts 1992 and 2003

Part IV of the Environmental Protection Agency Act (No. 7 of 1992) was replaced by a new Part IV under Section 15 of the Protection of the Environment Act 2003 (No. 27 of 2003). Under Section 83(5)(a)(i) to (v) and (vii) to (x) of the Environmental Protection Agency Acts 1992 and 2003 (as defined in Section 1 of the Protection of the Environment Act 2003), the Agency shall not grant a licence or revised licence for an activity unless it is satisfied that the operation of the plant meets certain requirements. This section describes how the operation of Cara Partners will meets these requirements.

Air

Section 83(5)(a)(i) of the Environmental Protection Agency Acts 1992 and 2003 states that the Agency may not grant a licence for an activity unless it is satisfied that any emission from the activity will not result in the contravention of any air quality standard specified under the Air Pollution Act 1987 (No. 6, 1987).

Air quality standards as specified under Section 50 of the Air Pollution Act 1987 are contained in the Air Quality Standards Regulations S.1 No. 244 of 1987, and concern Sulphur Dioxide, Suspended Particulates, Lead and Nitrogen Dioxide. These standards are being replaced on a phased basis, to be completed in 2010, by Air Quality Standards Regulations 2002 (S.1 271 of 2002), which also bring in standards for NOx and Benzene.

Compliance by Cara Partners:

Sulphur Dioxide (S02): The two boilers are potential sources of sulphur dioxide however as the fuel is natural gas this potential is low. There were no breaches in licence limits in 2005.

Nitrogen Dioxide (N02): The two boilers are potential sources of nitrogen dioxide. There were no breaches in licence limits in 2005.

Suspended Particulates: The two boilers are potential sources of suspended particulates, however as the fuel is natural gas this potential is low. Cara Partners does not have an Emission Limit Value for Suspended Particulates.

Lead: Cara Partners does not have an Emission Limit Value for Lead however it does monitor lead levels from some of its dust extraction units.

Benzene: None used

Water Quality Standards

Section 83(5)(a)(ii) of the Environmental Protection Agency Act 1992 and the Protection of the Environment Act 2003 states that the Agency shall not grant a licence for an activity unless it is satisfied that any emission from the facility will not result in the contravention of any standard prescribed under Section 26 of the Local Government (Water Pollution) Act 1977 (No.1 of 1977).

Section 26 of the Water Pollution Act 1977 allows the Minister to set quality standards for water, trade effluent and sewerage. The Local Government (Water Pollution) Act 1977 (Water

Quality Standards for Phosphorus) Regulations, 1998 (S.I. 258 of 1998) are the only quality standards set under this section. Phosphorus is not used extensively at Cara Partners, and the main source of phosphorus emissions to water would be treated effluent from the wastewater treatment plant. Cara Partners has an ELV for Total Phosphorus as P of 35mg/l, which it did not exceed in 2005.

There are currently no other relevant water standards made under this section in place. The subject of this section will be dealt with in Table 1 below in order to avoid duplication, since many of the limit values and standards currently in force were set in accordance with EC Directives.

European Legislation

Section 83 (5) (a) (iii) of the Environmental Protection Agency Acts 1992 and 2003 states that the Agency shall not grant a licence for an activity unless it is satisfied that any emission from the activity will comply with, or not result in the contravention of any relevant standard including any standard for an environmental medium prescribed under Regulations made under the European Communities Act, 1972 or any other enactment. Table 1 below summaries the regulations which have been reviewed and Cara Partners compliance.

Cara Partners does not discharge any material to shellfish waters, as listed in the Schedule to these regulations.

Cara Partners complies with water quality standards laid out in the IPC licence, which take into consideration limits set in these regulations.

Of the substances listed in these regulations Lead is the only one used at Cara Partners. Cara Partners has an ELV For Lead as Pb of 0.5 mg/l.

There are no direct emissions to groundwater and the possibility of accidental ir emissions are minimised by the following measures: -

0 Regular drain surveys to ensure the integrity of all underground piping for the transfer of chemicals and contaminated water in process and foul sewers;

0 Cara Partners has a firewater retention pond. This ensures that firewater arising on site in the event of a fire scenario is retained and does not pose a threat to surface or groundwater sources;

0 Bunding of bulk storage tanks and bunding of liquid material storage areas and procedures to ensure that bunding is adequate and of good integrity.

Noise Regulations

Section 83 (5) (a) (iv) of the Environmental Protection Agency Acts 1992 and 2003 states that the Agency shall not grant a licence for any activity unless it is satisfied that any noise from the activity will comply with or not result in the contravention of any regulations under Section 106 of the EPA act. This section enables the minister to make regulations for the purpose of the prevention or limitation of noise, which may cause a nuisance.

Although no noise control regulations have been made, the EPA Guidance Note for Noise in Relation to Scheduled Activities recommend that to avoid disturbance the noise level at sensitive locations should not exceed a LAeq T value of 55 dBA during the daytime and a LAeq T value of 45 dBA at night-time. It also recommends that audible tones and impulsive noise at sensitive locations at night should be avoided.

The most recent noise survey, completed. in November 2005, indicated that Cara Partners was compliant with EPA Guidance Note for Noise in Relation to Scheduled Activities.

Attachment D.5.A provides further information on Noise Emissions.

Significant Environmental Pollution

Section 85 (5) (a) (v) of the Environmental Protection Agency Acts 1992 and 2003 states that the Agency shall not grant a licence for an activity unless it is satisfied that any emissions for the activity will not cause significant environmental pollution.

All monitoring and measurements taken to date indicate that Cara Partners currently has no significant impact on the environment.

Production and Disposal of Waste

Section 83 (5) (a) (vii) of the Environmental Protection Agency Acts 1992 and 2003 states that production of waste should be prevented or minimised, and where waste is produced, it will be recovered, and where it is not economically and technically possible to recover it, be disposed of in a manner which will prevent or minimise any impact on the environment.

Waste is prevented or minimised where possible at Cara Partners. Recovery is the preferred disposal method for waste produced by Cara Partners where this is technically and economically feasible. All wastes are disposed of in compliance with the Waste Management Act 1996 and associated regulations.

Energy

Section 83 (5) (a) (viii) of the Environmental Protection Agency Acts 1992 and 2003 states that energy is to be used efficiently in the carrying on of the licensed activity.

Energy consumption is controlled primarily by use of real time monitoring of both gas & electricity usage on site. Energy consumption is reported to the Agency annually in the Annual Environmental Report. Cara Partners is committed to the conservation of energy. Attachment G provides further information on Energy Conservation.

Accident Prevention

Section 83 (5) (a) (ix) of the Environmental Protection Agency Acts 1992 and 2003 requires that necessary measures be taken to prevent accidents in the carrying on of the activity. In addition, it is required that where an accident occurs, its consequences for the environment are limited, and where there are consequences, these consequences are remedied.

Details relating to accident prevention have previously been submitted in the original IPC Licence application in 1995. The Emergency Plan is maintained and updated regularly. Under the SEVESO II regulations, EU Directive 96/82/EC Cara Partners is not classified as a Seveso Site.

Attachment F provides further information on Accident Prevention.

Cessation of the Activity

Section 83 (5) (a) (x) of the Environmental Protection Agency Acts 1992 and 203 requires that necessary measures are taken upon the permanent cessation of the activity (including such a cessation resulting from the abandonment of the activity) to avoid any risk of environmental pollution and return the site of the activity to a satisfactory state.

On the cessation of the activity or any part of the activity, Cara Partners will take the necessary measures to avoid any risk of environmental pollution. In addition, Cara Partners will return the site to a satisfactory state.

Attachment H provides further information on Cessation of the Activity.

Designated Areas

The activity is not carried out in such that it is liable to have an adverse effect on:

0 A site placed on a list in accordance with Chapter 1 of the European Communities (Natural Habitats) Regulations, 1994 (S.I. 94 of 1997);

A site where consultation has been initiated in accordance with Article 5 of the EU Habitats Directive (92/43/EEC); or

A European site as defined in Article 2 of the European Communities (Natural Habitats) Regulations.

Water Quality

As discussed above earlier in this attachment, the operation of Cara Partners is unlikely to have an adverse effect on water quality with respect to the Local Government (Water Pollution) Act, 1977 (Water Quality Standards for Phosphorus) Regulations, 1998.

Requirements of Environmental Protection Agency (Licensing) (Amendment) Regulations 2004

The Environmental Protection Agency (Licensing) (Amendment) Regulations 2004 (S.I. 394 of 2004) specify indicative lists of principal polluting substances to be taken into account by the Agency, if relevant, in the fixing of emission limit values.

The table below lists the polluting substances for Air that are given in the Schedule to these regulations, with an indication of whether they are likely to be present in air emissions at Cara Partners. Cara Partners does not emit process effluent directly to waters therefore water emissions are not considered here.

Technical Knowledge and qualifications

The site has an environmental department and team that are dedicated to environmental management of site operations. This ensures the day-to-day operation of the waste water treatment plant, performance of waste shipments in accordance with the companies internal procedures as well as all legal requirements including the IPC Licence and performance of relevant routine monitoring in accordance with IPC licence requirements. The site is preparing for IS0 14001 certification. The environmental management team also drive continuous improvement measures and is committed to implementing environmental excellence measures.

Resources

Cara Partners are insured under the Environmental Impairment Liability Policy underwritten with AXA Corporate Solutions by SCRAS S.A. , on its behalf and the behalf of the holding company IPSEN S.A.and all its subsidiaries ( see attachment No. B.I.)

In the event of a site closure the Corporate insurance program could operate under the following conditions,

The closure of the site is notified to the insurer within three months after the site closure date

0 The closure of the site is done in compliance with local regulations

Once the site is closed or sold there is an insurance coverage of maximum €15,000,000 for five years after the site closure provided that the event which led to the damage occurred before the site closure.

1.1. Re-use of Liquid Ammonium Sulphate Solution.

Cara Partners supplies Liquid Ammonium Sulphate solution to farms in the region for use as a fertiliser. The liquid Ammonium Sulphate solution generated during the Cara Partners process is a 25% aqueous solution of ammonium sulphate and is not re-usable in the process. All potential users of the liquid ammonium sulphate solution are inspected before a decision is made to supply the material to the farm. Cara Partners uses licensed haulage contractors to transport the liquid ammonium sulphate solution off site to user farms. A sample is taken from each road tanker for laboratory analysis. On completion of analysis, a delivery docket for the load is prepared. All deliveries of liquid ammonium sulphate solution must be accompanied by a delivery docket. The farmer who receives the delivery must complete the delivery docket, which the driver then returns to Cara Partners personnel. Deliveries can only take place under certain conditions and only when the farmer is present to accept the delivery. Data relating to each shipment is retained on a database, which can be interrogated to give regular updates on the delivery status for each farmer.

Cara Partners has made available to users of the liquid ammonium sulphate solution detailed information covering the following topics:

0 Background company and process information;

0 Full chemical analysis of the material and a detailed description;

0 Instructions to the farmer to ensure safe unloading of the liquid ammonium sulphate solution;

0 Instructions on the safe storage of the liquid ammonium sulphate solution;

0 Information relating to spreading of slurry containing ammonium sulphate;

0 Odour control during slurry spreading; and

0 Nutrient Management Planning.

Following discussions with the Department of Agriculture and Food, Cara Partners wish to propose that the Liquid Ammonium Sulphate Solution be classified as a fertiliser as opposed to a pharmaceutical waste. The requirements from the Department of Agriculture and Food is that the by-product to be marketed as a fertiliser is a listed product under EU or national legislation and that it is in accordance with the standards laid down for that product. In our case the product is to be designated a “Low Nutrient Fertilisefas the Nitrogen and the Sulphur contents are low. The standards laid down for Low Nutrient Fertiliser are detailed under national legislation in S.I. No. 24811978: MARKETING OF NON-EEC FERTILISERS.

It is our intention to leave open the option to classify any batch of liquid ammonium sulphate solution that does not fall under the “Low nutrient fertiliser “ category as a pharmaceutical waste product .The land spreading of this waste will be managed

such that it complies with SI. No. 378 of 2006,European Communities (Good Agricultural Practice for Protection of Waters) Regulations 2006 and is in accordance with a Nutrient Management Plan specifically referencing the liquid ammonium sulphate solution supplied by Cara Partners. 3.2 Environment

Ammonium sulphate is a nitrogen based fertilizer. Heavy spillage may cause adverse environmental impact such as eutrophication in confined surface waters. (See Section 12.)

3.3 Other

Fire, heating and detonation

It is not combustible and does not support combustion.

Thermal decomposition products include sulphur oxides and ammonia.

Combustion of ammonia could result in emission of toxic nitrogen oxide gases.

Can produce thermally sensitive mixtures with potassium chlorate and potassium nitrate and can enhance the explosive properties of ammonium nitrate.

4.1 Product

Skin Contact

Wash the affected area with soap and water.

Eye Contact

Flush/irrigate eyes with copious amounts of water for at least 10 minutes.

Obtain medical attention if eye irritation persists.

Ingestion

Do not induce vomiting.

Give water or milk to drink.

Obtain medical attention if more than a small quantity has been swallowed or when relevant symptoms occur after swallowing.

Inhalation

Remove from source of exposure to dusts.
