DECLARATION OF ANNEXATION ALIANA, SECTION SIXTY-FOUR (64)

This Declaration of Annexation is made as of the date hereinafter stated by ALIANA

DEVELOPMENT COMPANY, a Texas corporation ("Declarant").

WITNESSETH:

WHEREAS, Declarant executed that certain Declaration of Covenants, Conditions and

Restrictions for Aliana Single Family Residential Areas dated August 1, 2007, which is filed

under Clerk's File No. 2007097598 and recorded in the Official Records of Real Property

Records of Fort Bend County, Texas (the "Official Records"), as amended by that certain

Amendment dated February 26, 2008 which is filed under Clerk's File No. 2008022614 and

recorded in the Official Records (the "Original Declaration"), which imposed covenants,

conditions and restrictions on certain property described therein; and

WHEREAS, Declarant executed that certain Amended and Restated Declaration of

Covenants, Conditions and Restrictions for Aliana Single Family Residential Areas dated

July 15, 2010, which is filed under Clerk's File No. 2010067279 and recorded in the Official

Records which superseded and replaced the Original Declaration in its entirety, that certain

Amendment dated January 21, 2011 which is filed under Clerk's File No. 2011007842 and

recorded in the Official Records, and that certain Second Amendment dated January 21, 2014

which is filed under Clerk's File No. 2014006466 and recorded in the Official Records (as

amended, the "Declaration"); and

WHEREAS, Declarant is the owner ofthat certain 18.918 acre tract of land contiguous to

or in the general vicinity of the property described in and encumbered by the Declaration, which

property has been platted and subdivided as ALIANA, SECTION SIXTY-FOUR (64) according

to the plat thereof recorded as Plat No. 20180152 in the Plat Records of Fort Bend County, Texas

(the "Annexed Property"); and

WHEREAS, Section 1 of Article VIII of the Declaration gives the Declarant the right as

the owner, or if not the owner with the consent of the owner, to annex additional property into

the jurisdiction of the ALIANA HOMEOWNERS ASSOCIATION, INC., a non-profit

corporation organized to administer the provisions of the Declaration (the "Association"), and to

subject such annexed property to the provisions of the Declaration; and

WHEREAS, the Declarant desires to annex the Lots (as defined in the Declaration)

within the Annexed Property into the jurisdiction of the Association and to subject the Lots in the

Annexed Property to all of the provisions of the Declaration.

NOW, THEREFORE, the Declarant hereby annexes the Annexed Property into the

jurisdiction of the ALIANA HOMEOWNERS ASSOCIATION, INC. and declares that the

Annexed Property shall be a portion of the Properties (as defined in the Declaration) and shall be

subject to all provisions of the Declaration, including without limitation, the right of the

Association to levy assessments as set forth in Article III of the Declaration.
