BACKGROUND

This annual report has been prepared pursuant to Local Law 196 of 2017 (“Local Law
196”), which was passed by the New York City Council on September 27, 2017 and
signed by the Mayor on October 16, 2017.
When fully phased-in on September 1, 2020, Local Law 196 will require that certain
workers at certain job sites receive 40 hours of safety training and that supervisors
receive 62 hours of safety training.
The job sites to which Local Law 196 is applicable are sites that are required to
designate a Construction Superintendent, Site Safety Coordinator or Site Safety
Manager.
The workers and supervisors to which Local Law 196 is applicable are workers and
supervisors who engage in construction or demolition work at the aforementioned sites.

MAJOR IMPLEMENTATION MILESTONES

Local Law 196, as amended by Local Law 119 of 2019, phases-in site
safety training requirements in three parts:
o By March 1, 2018 workers were required to have a minimum of 10
hours of training.
o By December 1, 2019 workers will be required to have a minimum
of 30 hours of training and supervisors will be required to have 62
hours of training.
o By September 1, 2020 workers will be required to have 40 hours of
training.

Leading up to the first and second major implementation milestones, March 1, 2018 and
December 1, 2019, the Department has performed and continues to perform extensive
outreach to stakeholders to ensure that information about the site safety training
requirements reaches those who need it. Such outreach includes:
o Visiting Construction Sites. For several months, the Department’s inspectorial units
have been distributing palm cards in multiple languages directly to workers. The
Department’s Community Engagement Unit has started distributing palm cards as
well, visiting 500 sites the week of September 9th alone. This work will continue
through September 1, 2020. To date, the Department has distributed nearly 57,000
palm cards in thirteen different languages.
o Direct mailings. The Department has conducted multiple mailings to both permit
holders and site safety professionals. The mailings to permit holders inform such
permit holders that site safety training is required for work that is conducted under
their permit. The mailings to site safety professionals, including Construction
Superintendents, Site Safety Coordinators, Site Safety Managers and Concrete
Safety Managers, remind them that they must have 62 hours of training by
December 1, 2019.

o Creating Online Tools.
• Website Updates. The Department has reorganized its website to create
content specific to workers, supervisors, employers and course providers.
• Site Safety Construction Map. The Department created a Site Safety
Construction Map, which identifies the sites throughout New York City where
site safety training is required. This map allows workers to search the job
sites where they currently work or where they plan to work to confirm whether
the training is required at such sites.
• Course Provider Map. The Department created a Course Provider Map, which
identifies the course providers who offer site safety training throughout New
York City. Additionally, workers can find out what languages are supported by
course providers who offer training.
o Information Sessions. Since the enactment of Local Law 196, the Department has
hosted eighteen information sessions to inform the public about the site safety
training requirements. These information sessions were attended by more than
1,000 members of the public.

o Service Notices. Since the enactment of Local Law 196, the Department has issued at
least a dozen Service Notices that provide information to the public regarding the
implementation of Local Law 196. These Service Notices are distributed widely, including
through Buildings News, our electronic newsletter with a circulation of more than 50,000.
o Advertising. The Department is running 1,000 subway ads and multilingual
advertisements in 30 community newspapers through the end of the year. Additionally,
advertisements will appear on bus stop shelters and LinkNYC kiosks beginning this
month. These ads will be focused on making the public aware of the upcoming December
1, 2019 implementation milestone. The Department also ran television and radio
commercials throughout the summer of 2019.
o Rulemaking. The Department promulgated a rule to require worker information signs
within construction sites that provide information to workers about site safety training in
all languages spoken at the site.
o Social Media. The Department has been posting Local Law 196 updates on Social Media
regularly and will continue doing so through September 1, 2020.

Through September 2019, course providers have issued 28,203 Site Safety
Training Cards. This includes:
Additionally, course providers have issued 67,335 OSHA 10 and 27,212 OSHA 30
cards since 2015, which may all be applied towards a Site Safety Training Card.
This number does not account for the OSHA 10 and OSHA 30 cards that workers
have received from OSHA-authorized trainers who are not approved by the
Department. For the purposes of December 1, 2019 training deadline, an OSHA
30 card will serve as acceptable proof that a worker has received required
training.

The Department is performing both course audits and training provider
administrative audits.
o Course audits include investigators auditing courses as they are being
held, ensuring courses are the proper length, checking sign-in logs for
accuracy, and recording the names of trainers and attendees to compare
against training providers’ records. To date, the Department has
performed 16 course audits.
o Training provider administrative audits include ensuring that course
providers are maintaining appropriate records, keeping the credentials of
instructors on hand, utilizing an electronic database to track and readily
validate training records upon the request of the Department, and that
providers are issuing Site Safety Training cards acceptable to the
Department. To date, the Department has performed 45 training provider
administrative audits.

ENFORCEMENT

Last year, the Department created a new unit, the Construction Safety Compliance
(CSC) Unit, which is dedicated to performing proactive safety compliance inspections.
The CSC Unit inspects active construction sites, reviews construction Site Safety Plans,
and enforces site safety training requirements. Since September 2018, when the CSC
Unit launched, the CSC Unit has conducted nearly 20,000 inspections at nearly 10,200
unique sites. Nearly 15,000 or 75% of inspections required no enforcement actions by
the Department. The Department has issued 11,233 violations and 2,470 Stop Work
Orders to the sites that did not pass inspection.
The CSC Unit is also responsible for enforcing Local Law 196. Through September
2019, the Department has found that 97% of jobsites visited are in compliance with
Local Law 196. The Department found 229 jobsites where a total of 504 construction
workers did not have required site safety training. The Department has issued 2,202
violations and 229 Stop Work Orders to the sites where workers did not have required
site safety training. The Department has also made 50 referrals to the New York City
Department of Investigation where it has found workers who possess fraudulent OSHA
cards or where there have been allegations of suppliers of fraudulent OSHA cards.
