Open Public Hearing – Mayor Piehler opened the public hearing on the Open Space Application as noted above at this time. Close Public Hearing – There being no questions or comments on the Open Space Application; Mayor Piehler closed the public hearing. Mayor Piehler stated that no written comments have been received from the public with regard to the application.

TITLE: AUTHORIZE APPLICATION FOR BERGEN COUNTY OPEN SPACE TRUST FUND – IMPROVEMENTS TO BASKETBALL COURT AT HOGAN PARK Motion Second Name

Councilman DeLisio Councilwoman Macchio Councilman Shepard Councilman Small Councilman Sokoloski Councilman Sotiropoulos

WHEREAS, the Bergen county Open Space, Recreation, Farmland & Historic Preservation Trust Fund (“County Trust Fund”), provides matching grants to municipal governments and to nonprofit organizations for assistance in the development or redevelopment of municipal recreation facilities; and, WHEREAS, the Borough of Northvale desires to further the public interest by obtaining a matching grant of $15,395.63 from the County Trust Fund for improvement to the basketball court at John L. Hogan Memorial Park, and, WHEREAS, the Mayor and Council has reviewed the County Trust Fund Program Statement, and the Trust Fund Municipal Program Park Improvement application and instructions and desires to make an application for such a matching grant and provide application information and furnish such documents as may be required; and, WHEREAS, as part of the application process, the governing body held a public hearing on June 14, 2017 to receive comments prior to the submission of this application; and, WHEREAS, the County of Bergen shall determine whether the application is complete and in conformance with the scope and intent of the County Trust Fund; and, WHEREAS, the Borough of Northvale is willing to use the county Trust Fund in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the County of Bergen for basketball court improvements at John L. Hogan Memorial Park; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Northvale:

1. That it is hereby authorized to submit the above completed project application to the County of Bergen by the deadline of June 30, 2017, as established by the County; and,

2. That, in the event of a County Trust Fund award that may be less than the grant amount requested above, the Borough of Northvale has secured the balance of funding necessary to complete the project, or modify the project as necessary; and,

4. That the Borough of Northvale agrees to comply with all applicable federal, state and local laws, rules and regulations in it performance of the project; and,

5. That this resolution shall take effect immediately. WHEREAS, Sgt. Michael Graham was at a pool party with his family in his hometown of Emerson, New Jersey on May 28, 2017 when he heard screams for help from the children by the pool; and WHEREAS, Sgt. Graham saw a parent jump in the pool and pull a unresponsive child from the water; and WHEREAS, Sgt. Graham immediately began CPR on the unresponsive child and after compressions and rescue breaths the young child began to expel water and breathe on his own; NOW, THEREFORE BE IT RESOLVED, that we, the Mayor and Council of the Borough of Northvale commend Sgt. Graham for relying on his training and experience and for taking control of the situation which resulted in saving the life of this young victim and we find that his actions that day were nothing short of heroic.

TITLE: APPROVE CONDITION RESOLUTION FOR LIQUOR LICENSE FOR NOELEEN LLC T/A BIDDY O’MALLEY’S PUB – 191 PARIS AVENUE WHEREAS, Noeleen LLC t/a Biddy O’Malley’s Pub, 191 Paris Avenue, in the Borough of Northvale, has applied for renewal of its Plenary Retail Consumption License; and WHEREAS, in January of 1988, a condition was placed upon said license with the consent of the license holder to the extent that the emergency fire door on the west side of the building was to be kept closed at all times and not opened except in case of an emergency and an alarm placed on said door, and that a letter be submitted yearly citing no objection to the liquor license from St. Anthony’s Church; and NOW, THEREFORE, BE IT RESOLVED, that the Plenary Retail Consumption License of Noeleen LLC t/a Biddy O’Malley’s Pub, License No. 0240-33-011-007, is hereby renewed for the time period effective July 1, 2017 through June 30, 2018.

RESOLUTION #2017-90

TITLE: A RESOLUTION AUTHORIZING INCLUSION IN THE BERGEN COUNTY COMMUNITY DEVELOPMENT PROGRAM WHEREAS, certain Federal funds are potentially available to the County of Bergen under Title I of the Housing and Community Development Act of 1974, as amended and HOME Investment Partnership Act of 1990, as amended; and the Emergency Solutions Grant of 2012; and WHEREAS, the current Interlocal Services Agreement contains an automatic renewal clause to expedite the notification of the inclusion process; and WHEREAS, by June 12, 2017 each municipality must notify the Bergen County Division of Community Development of its intent to continue as a participant in the Urban County entitlement programs noted above; and WHEREAS, it is in the best interest of the Borough of Northvale and its residents to participate in said programs; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Northvale that it hereby notifies the Bergen County Division of Community Development of its decision to be included as a participant municipality in the Urban County entitlement programs being the Community Development Block Grant Program, the Home Investment Partnership Program and the Emergency Solutions Grant Program for the Program Years, 2018, 2019 and 2020 (July 1, 2018 – June 30, 2021); and BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Bergen County Division of Community Development no later than June 12, 2017.

TITLE: RESOLUTION TO URGE REPRESENTATIVES FROM THE STATE OF NEW JERSEY TO SUPPORT THE LEGISLATIVE ACTION TO RE-AUTHORIZE AND EXTEND THE NATIONAL FLOOD INSURANCE PROGRAM (“NFIP)

WHEREAS, floods are the most common and most destructive natural disasters

in the United States; and WHEREAS, the National Flood Insurance Act authorizes a National Flood

Insurance Program (“NFIP”); and WHEREAS¸ the NFIP is a Federal program created by Congress to mitigate

future flood losses nationwide and to provide access to affordable, federally backed flood insurance protection for property owners; and

WHEREAS, the NFIP is designed to provide an insurance alternative to disaster

assistance to meet the escalating costs of repairing damage to buildings and their contents caused by floods; and

WHEREAS, New Jersey is fourth in the nation in the number of NFIP policies

enforced and third in total value of claims paid; and

WHEREAS, five hundred and fifty-two communities in New Jersey participate as members of the NFIP which amounts to over 230,000 policies enforced throughout the State of New Jersey; and

WHEREAS, the NFIP maintains a significant role in providing financial

protection against flood events to New Jersey residents; and WHEREAS, the NFIP is set to expire on September 30, 2017; and WHEREAS, the expiration of this program could cause catastrophic loss of

insurance coverage against flooding which is the number one cause of loss of property throughout the United States; and

WHEREAS, in the event the program were to expire, the consequences in the

form of disruption of coverage and the potential financial burdens to residents throughout the State of New Jersey will be of great economic significance; and

WHEREAS, the purpose of this Resolution is to urge the Northvale Federal

Representatives to support the extension of the NFIP which promotes the public health, safety and general welfare and minimizes public and private losses due to flooding events in the State of New Jersey

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council hereby

urges its Federal Legislators and Representatives to take any and all necessary action to insure that the National Flood Insurance Program is extended beyond the September 30, 2017 expiration date.

BE IT ORDAINED by the Mayor and Council of the Borough of Northvale that Section 166-3 of the Code be amended as follows: Section 1. That Section 166-3 be amended to include the following: 166-3 PERMIT APPLICATION PROCEDURES FOR MINOR SOIL MOVEMENTS. That a new section 166-3 – F. be added to read: “The Borough Engineer, upon receipt of the Minor Soil application, shall make a field inspection and shall issue the permit or deny it, giving his/her reasons for such denial in writing. letter to the Construction Official, Borough Clerk and the applicant and shall retain a copy on file. The Borough Engineer may classify any Minor Soil Movement application as a Major Soil Movement application if he/she determines that the application poses a substantial drainage problem or adversely affects the adjoining contiguous lot or lots. Such a determination will trigger compliance by the application with all provisions governing Major Soil Movement Permits.” The addition of wording under Minor Soil Movement, “and when lower amounts of soil over 50 cubic yards of soil are moved, the following wording be added: “No stormwater improvements required if: 1. No substantial change to grading with the backing setbacks is proposed 2. All runoff is directed to the interior of the site 3. All roof runoff is captured by leaders 4. Improved lot coverage pursuant to Northvale Zoning Code increases 500 square feet or less” “If stormwater improvements are required the applicant shall: 1. Construct on-site stormwater management system to accommodate two inches of runoff for the area of proposed improvements 2. Ensure that no increase in runoff occurs on any adjoining property. That upon review of application for a Minor Soil Movement Permit by the Borough Engineer, the applicant shall post escrow in an amount to be determined by the Engineers office for said review. He asked if the Mayor and Council would like to contribute $3,000 for the parade. Mayor Piehler stated that the Mayor and Council would take the request under consideration and get back to the Chief. MAYOR & COUNCIL REPORTS – Councilman DeLisio – Good Evening. As the liaison to the recreation department I attended the May meeting. The report from the baseball/softball commissioners was that opening day was a success despite the weather. The season is now fully underway and things are running smoothly. Picture night is May 30th at the Northvale School. Summer basketball started June 11th and will run through the end of July. There was a discussion of having registration for all recreation activities go paperless. Some members are working on the process to put this in place by the fall of 2017. Finally, the director is working with some Northvale residents to set up a Facebook page, which would be utilized to promote recreation department activities.

Councilwoman Macchio – Reported that the James F. McGuire Senior Center is holding their Fish Fry on July 26, 2017 at 12:00 PM at the center. On Wednesday, June 8th, Emerson Health Care was there to discuss “Holistic Fitness” and they also provided breakfast. There is a collection box for Tissues for our Troops. The Seniors are collecting travel-sized tissues for the troops and a shipment was already sent on Friday. She further reported that Camp Northvale will visit the Senior Center on June 28th from 9:30 – 11:30 for a fun-filled morning of Bingo! Save the date for the Hot Dog social on Wednesday, August 23rd at 12:00 p.m. The price is $10 per person and includes hot dogs, baked beans, beverage and ice-cream. There is a limit to 100 people so please sign up early. Councilwoman Macchio further reported that May 10th was the Golden Age Club Anniversary Party at Madeleine’s Petit Paris and this year’s Christmas Party will be on December 13 at the Old Tappan Manor. Councilwoman Macchio reported that the next Town Day meeting will be held on 6/21 at 7PM at the Borough Hall and everyone is welcome. She stated that volunteers are needed. Ms. Moses of the Northvale Pre-School is having their art show on Wednesday, June 14th beginning at 7:00 PM at the Northvale Schools. Lastly, the Beautification Committee plantings is moving right along. The next day for small plantings will be on Saturday, June 25 at 8:30 a.m. and that there are 30 one gallon pots that need to be planted.

Councilman Shepard – The DPW has been maintaining both Hogan and Veterans Parks. The chipper has been going out weekly around town to pick up branches that are put at the curb. They have also been picking up logs and stumps from residents. They have started repairing catch basins. The DPW has been mulching the berms in Veterans Park. They installed the Hometown Hero Banners on the poles on Paris Avenue and Livingston Street, which look great. The DPW received a donation of stones for Hogan Park so they built a stone wall at the park on the side of Field 4. If a resident has a white good to dispose of, call the Borough Hall after it is brought to the curb, and the DPW will pick it up within 5 days. They have begun pot hole repair throughout the town. If you would like to report a pothole, please call the Borough Hall.

Council President Small – Building Department revenues for the month of May were $38,063.00 with a year to date total of $86,282.00. All permits issued were for alterations to existing buildings; none for new construction. Our construction code/zoning officer/property maintenance and code compliance officer, Mike Sartori left our employ on 5/31/2017. The Borough has hired Joe Zavardino our long time fire marshal and building subcode official as the new construction official effective 5/30/2017 and Tracy Jeffery as our zoning/property maintenance/code compliance officer, also effective on 5/30/2017. We thank Mike Sartori for his service to the Borough and welcome Joe and Tracy to their new positions. Councilman Small further reported that property taxes are due 2/1, 5/1, 8/1 and 11/1 – the Borough has adopted our budget in May and must now await the state approval of their budget before the county can strike the tax rate. We expect that the new tax bills will go out sometime in July. He reported that new capital request forms for equipment and improvements have been distributed to all departments. We will be holding meetings with the department heads over the summer in order to prepare for the introduction of a bond ordinance in early fall. Lastly, he reported that he is very happy to report that we did not experience any flood emergencies over the past month. Councilman Sokoloski – reported that activity on the Planning Board continues to be quiet. The last several meetings have been cancelled. He further reported that the Board of Health had their most recent meeting on Thursday June 8. One significant issue is the need to update our animal census in Northvale. The Board has authorized that this state required census be conducted this year.

He stated that the Code Committee is currently looking at changes to the parking and sign ordinances and that the Pre School is having their art show this evening at the Northvale Schools. Councilman Sotiropoulos - reported that the Police interviewing process is continuing for the Police new hire. The Chief has it narrowed down to the top 9 applicants, more to follow. The gas company has been in town digging up the streets replacing main gas lines that need updating, Where you see the gas company personnel, you will see a police officer there sometimes from neighboring towns. They are there to direct traffic and to keep everyone safe. PSE&G is reimbursing the town for the cost of our police on these details. He further reported that the third week of May is EMS Week, this year the squad did a mini fundraiser by collecting donations outside of Shoprite and raised approximately $1000.00. Many members of the Ambulance Corps attended the indoor ceremony at the American Legion for Memorial Day. He further reported that the statistics for the Ambulance Corps for the month of May are as follows: Rig 226 (primary rig) 16 calls and Rig 227 (backup rig) 3 calls. BOROUGH ENGINEER REPORTS – Mr. O’Brien reported that the Borough of Northvale is looking to have a busy summer with construction. The Livingston Streetscape is moving along nicely. The 2017 municipal paving project will be improving about 8 roads within the town. The County will be paving Paris Avenue and Tappan Road this summer too. It will be a busy summer in Northvale. BOROUGH ATTORNEY REPORTS – Mr. Shahdanian reported as the governing body is aware, because of the New Jersey law called OPRA or the “Open Public Records Act” and because of certain requirements of the New Jersey Open Public Meetings Act, any matter involving potential litigation or personnel, among other things, will normally be discussed during the closed session of the meeting. The closed session is the portion of the meeting that the public is not permitted to attend. For the month of June, all legal matters that need to be discussed involve potential litigation or personnel.
