PETITION METHOD ANNEXATION TO THE CITY OF SNOHOMISH

BRB 04-2012 — SNOHOMISH YOUTH SOCCER ANNEXATION

WHEREAS, Snohomish County has received notice of a proposal from the city of Snohomish to annex approximately 22.8 acres of land located southeast of the city of Snohomish and within the Snohomish Urban Growth Area; and further described in Washington State Boundary Review Board for Snohomish County (hereinafter "Boundary Review Board") File No. BRB 04-2012; and

WHEREAS, the proposed annexation is subject to Snohomish County Code Section 3.52.120, and RCW 35.13.005, 35A.14.005 and .120, .180, and .300, 36.115.050, .060 and .070, 36.93.157, .170 and .180, and 36.70A.020, .110 and .210; and

WHEREAS, the annexation is consistent with the applicable factors and objectives of the Boundary Review Board, County Codes, and other applicable statutes governing the review of annexation actions. The proposed annexation is consistent with adopted Countywide Planning Policies and the county's Growth Management Act (GMA) Comprehensive Plan, as set out in a Planning and Development Services staff report dated December 11, 2012; and

WHEREAS, the city of Snohomish and the county adopted a Master Annexation Interlocal Agreement effective March 26, 2003, that includes the area proposed for annexation; and

WHEREAS, the area proposed for annexation is included in the Urban Growth Area for the city of Snohomish, the logical purveyor of urban services; and

WHEREAS, RCW 36.93.157 requires that decisions of the Boundary Review Board be consistent with the GMA;

SUBJECT: City of Snohomish—Snohomish Youth Soccer Annexation, BRB #04-2012

The following report summarizes issues and information regarding the city of Snohomish's proposed annexation of the Snohomish Youth Soccer area. The report addresses factors and objectives that the Boundary Review Board (BRB) must consider in evaluating the annexation proposal. Those factors and objectives are considered because, if the county council chooses to invoke BRB jurisdiction, those would be the considerations that the BRB would take into account, and only matters related to the factors and objectives could be used to support any county council position regarding the annexation at the BRB. Therefore, they are the logical basis for the decision as to whether or not to invoke BRB jurisdiction.

The report also reviews consistency with applicable comprehensive plans and the Countywide Planning Policies (CPPs), impacts as required under Snohomish County Code (SCC), and comments submitted by Snohomish County departments and other public agencies regarding the proposed annexation. This report is provided pursuant to SCC 3.52.120, and Revised Code of Washington (RCW) 35.13.005, 35A.14.005 and .120, 36.115.050, .060 and .070, 36.93.157, .170 and .180, and 36.70A.020, .110 and .210. The 45-day review period to invoke BRB jurisdiction for the proposed annexation will expire on January 4, 2013.

The Snohomish County Council's authority for reviewing annexations is set forth in RCW 36.93.100 and SCC 3.52.120. The options for the council on this proposed annexation are to invoke, or not invoke, the jurisdiction of the BRB. The council also has the option to state a position to oppose, or not oppose, the proposed annexation, or to not state a position with regards to the proposed annexation. If BRB jurisdiction is invoked by the county council or another party with standing to invoke jurisdiction, the position that the council adopts will be provided to the BRB in writing prior to the hearing on the proposed annexation.

FINDINGS:

I. Background/Land Use/Zoning

The city of Snohomish has submitted a Notice of Intention (NOI) to the Boundary Review Board for a 60 percent petition method annexation of the Snohomish Youth Soccer area.

The proposed Snohomish Youth Soccer annexation area is approximately 22.8 acres, and is located in the southeast unincorporated Snohomish Urban Growth Area (UGA) near the intersection of Lincoln Avenue and Center Street. It is adjacent to the city to the north and west, and bounded by the rural area to the east and south. The assessed valuation is $66,100. The proposed annexation area is composed primarily of property owned by the Snohomish Youth Soccer Club and used as athletic fields. There are no residences within the annexation area. Multiple parcels included in the annexation are split by the current city boundary. One of them is developed with residential condominiums on the portion of the parcel that is already within the city. The county future land use designation for the proposed annexation area is Public/Institutional Use, with A-10 zoning. The city of Snohomish proposes Open Space land use designation and zoning. According to the city's NOI, the existing athletic fields would be allowed to remain as a non-conforming use. The property is within the Floodway Fringe area designated by FEMA and development is restricted in the area.

II. County Department/External Agency Review

The NOI for the proposed Snohomish Youth Soccer annexation was circulated for review to county departments and agencies. Comments were received from the Enhanced 9-1-1 Office, Finance, Parks, Public Works, and the Sheriff's Office. Comments, including those from Planning and Development Services (PDS), have been incorporated into the staff report under the relevant sections.

PDS requested that county departments and external agencies evaluate the annexation proposal against the factors and objectives in RCW 36.93.170 and .180 that the BRB must assess when considering an annexation. As required by SCC 3.52.120, fiscal, departmental, and countywide impacts were considered. The proposal was also reviewed for consistency with the Growth Management Act (GMA), CPPs, and other local plans. Review material for the proposed annexation was sent to the following departments and agencies:

III. Analysis of Impacts and Consistency with State Statutes, County Code and Local Plans

A. The following comments relate to RCW 36.93.157 -- "The decisions of a boundary review board located in a county that is required or chooses to plan under RCW 36.70A.040 (the Growth Management Act (GMA) -- who must plan) must be consistent with RCW 36.70A.020 (Goals of GMA), 36.70A.110 (Comprehensive Plans -- Urban Growth Areas) and 36.70A.210 (Countywide Planning Policies)."

1. RCW 36.70A.1 10(4) and 36.115.070 both state that it is the Legislature's intent that cities are to be the primary provider of urban services and that counties are the unit of government most appropriate to provide regional governmental services.

2. The city of Snohomish has provided sufficient documentation in its Notice of Intention for the proposed annexation and in its adopted comprehensive plan to demonstrate that it has the capability to provide an adequate range of utilities and urban services to the subject area.

3. The city of Snohomish and Snohomish County have an adopted Master Annexation Interlocal Agreement that was effective March 26, 2003. The agreement addresses GMA land use, transfer of project and permitting, records transfer, roads and transportation and surface water.

4. Snohomish County and the city of Snohomish have both adopted comprehensive plans under the authority of RCW 36.70A (GMA). Under both plans, the annexation area is identified as urban and in Snohomish's UGA, intended to be eventually annexed to the city.

5. The annexation proposal is consistent with the Countywide Planning Policies (CPPs). The proposal allows for the transition of unincorporated areas to incorporated areas within the UGA, capital facilities planning and the timely and coordinated extension of urban services which is supported by the following CPP policies:

JP-6 — The County and cities shall develop comprehensive plan policies and development regulations that provide for the orderly transition of unincorporated Urban Growth Areas (UGAs) to incorporated areas in UGAs. Mutual agreements may be utilized to address governance issues and expedite the transition.

DP-5 — The County and cities shall adopt comprehensive plans and development regulations (RCW 36.70A.040). In Urban Growth Areas (UGAs), such plans and regulations shall:

a. Achieve urban uses and densities;

b. Provide for urban governmental services and capital facilities sufficient to accommodate the broad range of needs and uses that will accompany the projected urban growth; and

c. Permit the urban growth that is projected to occur in the succeeding twenty-year period (RCW 36.70A.110(2)).

The County shall adopt such plans and regulations for its unincorporated territory. Each city shall adopt such plans and regulations for territory within its city limits. Additionally, cities may adopt such plans and proposed development regulations for adjacent unincorporated territory within its UGA or Municipal UGA (MUGA) to which the city has determined it is capable of providing urban services at some point in the future, via annexation.

When amending its comprehensive plan, the County shall give substantial consideration to the city`s adopted plan for its UGA or MUGA. Likewise, the affected city shall give substantial consideration to the County's adopted plan for the same area.

However, nothing in this policy shall limit the authority of the County to plan for and regulate development in unincorporated territory for as long as it remains unincorporated, in accordance with all applicable county, state, and federal laws. Similarly, nothing in this policy shall limit the authority of cities to plan for territory in and adjacent to their current corporate limits and to regulate development in their current corporate limits, in accordance with all applicable city, county, state, and federal laws.

PS-1 — Jurisdictions should support cities as the preferred urban service providers.

B. The following comments relate to RCW 36.93.170 — Factors to be considered by the Boundary Review Board. The comments listed below describe how the factors apply to this annexation, elaborating on those topics within each factor that are particularly relevant to this annexation. BRB factors contained in RCW 36.93.170 incorporate 1997 amendments that provide for integrated consideration of the GMA and related GMA implementation statutes:

Factor 1. Population and territory; population density; land area and land uses; comprehensive plans and zoning, as adopted under chapter 35.63, 35A.63, or 36.70 RCW; comprehensive plans and development regulations adopted under chapter 36.70A RCW; applicable service agreements entered into under chapter 36.115 or 39.34 RCW; applicable interlocal annexation agreements between a county and its cities; per capita assessed valuation; topography, natural boundaries and drainage basins, proximity to other populated areas; the existence and preservation of prime agricultural soils and productive agricultural uses; the likelihood of significant growth in the area and in adjacent incorporated and unincorporated areas during the next ten years; location and most desirable future location of community facilities.

The proposed Snohomish Youth Soccer annexation area is outside the Surface Water Management (SWM) service area in the Snohomish Watershed Management Area, and is in the French Slough Flood Control District. There are no known County surface water facilities and no pending County surface water projects in the annexation area.

Factor 2. Municipal services; need for municipal services; effect of ordinances, governmental codes, regulations and resolutions on existing uses; present cost and adequacy of governmental services and controls in area; prospects of governmental services from other sources; probable future needs for such services and controls; probable effect of proposal or alternative on cost and adequacy of services and controls in area and adjacent area; the effect on the finances, debt structure, and contractual obligations and rights of all affected governmental units.

i. The county is not a full municipal service provider. The city of Snohomish is a provider of urban municipal services as identified under RCW 36.70A.

ii. The city of Snohomish has provided sufficient documentation in its NOI for the proposed annexation and in its adopted comprehensive plan to demonstrate that it has the capability to provide an adequate range of utilities and urban services to the subject area.

iii. The proposed annexation does not change SWM service area boundaries, and does not affect SWM revenues or programs.

iv. Snohomish County Budget and Finance responded that, given the size of the area, and the fact that it is vacant land in the floodplain, that the annexation proposal would have minimal financial impact on the county budget. The annexation will have no impact or minimal impact to each of the following revenue sources: sales tax, real estate excise tax, road levy, permit fees, parks fees, parks mitigation fees, grants, animal control, District Court fines, emergency management, or Sheriff's Office. The annexation is expected to have minimal impact to county expenses as well. There are no county roads, surface water or parks facilities in the annexation area.

Factor 3. The effect of the proposal or alternative on adjacent areas, on mutual economic and social interests, and on the local governmental structure of the county.

There were no comments applicable to factor 3.

C. The following comments relate to RCW 36.93.180 - Objectives of the Boundary Review Board:

Objective 1. Preservation of natural neighborhoods and communities.

The proposed annexation area is within the Snohomish UGA, and would include all of the remaining contiguous unincorporated urban area in the UGA at this location. The proposed annexation area is adjacent to the city of Snohomish to the west and north. The city boundary on the west edge of the annexation currently runs through multiple parcels, splitting them between city and county jurisdiction. This annexation would eliminate the split jurisdiction of those parcels. Therefore, the proposed annexation would further this objective.

Objective 2. Use of physical boundaries, including, but not limited to bodies of water, highways and land contours.

The proposed annexation would extend the city boundary to the UGA boundary, and would include all of the remaining contiguous unincorporated urban area in the UGA at this location. The city is adjacent to the proposed annexation area to the west and north, and it is bounded by the rural area to the east and south.

Objective 3. Creation and preservation of logical service areas.

The proposed annexation furthers this objective by annexing an area that is within the Snohomish UGA and is contiguous to the city limits to the west and north and the UGA boundary to the east and south. The proposed annexation would include all of the remaining contiguous unincorporated urban area in the UGA at this location. The city boundary on the west edge of the annexation currently runs through multiple parcels, splitting them between city and county jurisdiction. This annexation would eliminate the split jurisdiction of those parcels. Because the area is within the Snohomish UGA, the city is the logical provider of urban services. Therefore, this annexation creates a logical service area.

Objective 4. Prevention of abnormally irregular boundaries.

The proposed annexation does not create an abnormally irregular boundary. The proposed annexation furthers this objective by annexing an area that is within the Snohomish UGA and is contiguous to the city limits to the west and north and bounded by the UGA boundary to the east and south. The proposed annexation would include all of the remaining contiguous unincorporated urban area in the UGA at this location. The city boundary on the west edge of the annexation currently runs through multiple parcels, splitting them between city and county jurisdiction. This annexation would eliminate the split jurisdiction of those parcels. Therefore, the proposed annexation would further this objective.

Objective 5. Discouragement of multiple incorporations of small cities and encouragement of incorporations of cities in excess of ten thousand population in heavily populated urban areas.

Objective 6. Dissolution of inactive special purpose districts.

This objective does not apply to the proposed annexation.

Objective 7. Adjustment of impractical boundaries.

The proposed annexation would create a practical boundary. The proposed annexation furthers this objective by annexing an area that is within the Snohomish UGA and is contiguous to the city limits to the west and north and the UGA boundary to the east and south. The proposed annexation would include all of the remaining contiguous unincorporated urban area in the UGA at this location. The city boundary on the west edge of the annexation currently runs through multiple parcels, splitting them between city and county jurisdiction. This annexation would eliminate the split jurisdiction of those parcels. Therefore, the proposed annexation would further this objective.

Objective 8. Annexation to cities or towns of unincorporated areas, which are urban in character.

The proposed annexation would further this objective to the extent the annexation area is inside the Snohomish UGA, intended to be eventually annexed to the city.

Objective 9. Protection of designated agricultural and rural resource lands.

The county future land use designation for the proposed annexation area is Public/Institutional Use. The proposed annexation area is not designated agricultural or rural resource land on the county Future Land Use Map While the zoning is A-10, which is generally an implementing zone for agricultural land, it is not a designation. The land is not current farmland. It is inside the UGA. The city of Snohomish proposes Open Space land use designation.

D. The following comments relate to SCC Section 3.52.120 — Council Request for Review

1. Total assessed value, and impacts upon comprehensive plans, transportation systems, utility plans.

a. The proposed Snohomish Youth Soccer annexation area is approximately 22.8 acres and is located in the southeast portion of the Snohomish UGA. The NOI states that the assessed valuation of the proposed annexation area is $66,100. The annexation area is composed primarily of property owned by the Snohomish Youth Soccer Club and used as athletic fields. There are no residences within the annexation area. The county future land use designation for the annexation area is Public/Institutional Use, with A-10 zoning. The city of Snohomish proposes Open Space land use designation. The property is within the Floodway Fringe area designated by FEMA and development is restricted in the area.

b. It is PDS's view that the proposed annexation would have minimal impact on the transportation system and utility plans, because the

proposed annexation area is small, undeveloped, and has limited development potential.

c. The proposed Snohomish Youth Soccer annexation area is outside the Surface Water Management (SWM) service area in the Snohomish Watershed Management Area, and is in the French Slough Flood Control District. There are no known County surface water facilities and no pending County surface water projects in the annexation area.

2. Law enforcement, courts, parks, county budget, and community comments.

a. There is minimal impact to the Snohomish County Sheriff's Office through this annexation. As described in the NOI, The Sheriff's Office provides law enforcement in the city of Snohomish under contract.

b. The proposed annexation poses no issues for emergency response.

c. There are no negative impacts identified for parks as a result of this proposed annexation.

d. Snohomish County Budget and Finance responded that, given the size of the area, and the fact that it is vacant land in the floodplain, that the annexation proposal would have minimal financial impact on the county budget. The annexation will have no impact or minimal impact to each of the following revenue sources: sales tax, real estate excise tax, road levy, permit fees, parks fees, parks mitigation fees, grants, animal control, District Court fines, emergency management, or Sheriff's Office. The annexation is expected to have minimal impact to county expenses as well. There are no county roads, surface water or parks facilities in the annexation area.

V. Conclusions

Based on county review, PDS concludes that the subject annexation proposal is consistent with the applicable statutory provisions governing municipal annexations. This conclusion has been reached by comprehensively reviewing the annexation against the applicable BRB factors and objectives, County Codes, and other applicable statutes and determining, overall, that the relevant factors and objectives that the BRB must consider would be advanced by the annexation.

The recommendation to the Council from PDS is to not oppose the annexation and not invoke the jurisdiction of the Boundary Review Board.

III. FACTORS THE BOARD MUST CONSIDER:

1. OVERVIEW:

A. Population: The subject area contains no residential dwellings and no population. The City of Snohomish population is 9,215 according to the latest figures from the Washington State Office of Financial Management.

B. Territory: The area proposed for annexation is approximately 22.8 acres.

C. Population density: There is currently no population within the proposed annexation.

D. Assessed valuation: $66,100 (2012 valuation)

2. LAND USE:

A. EXISTING: All parcels and portions of parcels within the proposed annexation are maintained as private outdoor recreation area, primarily as athletic fields for soccer practice and competition.

B. PROPOSED: No development or change of use is proposed as part of this annexation request. The entire annexation area is mapped as a Special Flood Hazard area (Floodway Fringe) on FEMA Flood Insurance Rate Map 53061C1062F. The floodplain designation will significantly restrict future development and land use. The City's adopted Land Use Map designates the site as Open Space, which provides for a limited range of land uses. The existing sports club use is nonconforming with respect to the uses permitted in the Open Space designation. The City's nonconforming use regulations in Chapter 14.80 of the Snohomish Municipal Code would permit the existing use to continue provided the use is not changed, enlarged, or extended in a manner that increases or reinforces its degree of nonconformity and provided the use is not abandoned or discontinued for a period of twelve consecutive months.

3. COMPREHENSIVE PLANS:

A. Snohomish County Comprehensive Plan

1. What comprehensive plan or policies specifically support this proposal?

Snohomish County Comprehensive Plan policies applicable to this proposal address annexation of areas of Special Flood Hazard (LU-1 .A. 12) and the transition of urban services (Policies IC-1.B.1 and IC-1.B.2). An interlocal agreement between the City and Snohomish County concerning annexation and

The Snohomish County sub-area plan for the City of Snohomish UGA was supplanted by the updates to the Snohomish County Comprehensive Plan adopted in 2005. No adopted Snohomish County community plan currently governs this proposal.

3. What is the adopted plan classification/zoning?

The subject properties are designated Public/Institutional on the Snohomish County Future Land Use Map effective October 15, 2011. Adopted zoning is Agriculture 10-Acre (A-10).

b. Snohomish County Surface Water Management Plan:

The Snohomish UGA Drainage Needs Report (December 2002) issued by Snohomish County Surface Water Management Division identifies existing and future problems associated with flooding, habitat and future land use conditions and recommends capital improvement projects to mitigate or resolve the problems. The report notes Lower Pilchuck River habitat issues, which are generally associated with bank armoring, flood control levees, and invasive plant species. The Lower Pilchuck River is contiguous to the proposed annexation for distance of about 250 feet. No capital projects are recommended within or in the immediate vicinity of the proposed annexation.

B. Proponent's Comprehensive Plan

1. Is this proposal in your adopted comprehensive plan or will a plan amendment be required? If so, when will that amendment be completed?

The proposed annexation is within the area identified in the City's Comprehensive Plan as the City's UGA. No amendment to the City's Comprehensive Plan is required.

The most recent general Comprehensive Plan update was adopted February 15, 2005, with amendments last adopted December 25, 2011.

The City of Snohomish enforces zoning regulations as represented by land use designations on the Comprehensive Plan Land Use Map. Land use designations for areas within the City and the UGA are currently adopted. No separate pre-annexation zoning agreement has been adopted.

4. What is the proposed land use designation in your adopted comprehensive plan? When were your zoning regulations adopted?

The subject properties are designated Open Space in the City's Comprehensive Plan. Zoning regulations were last amended October 2012.

4. PLANNING DATA:

A. Revenue/Estimates

1. Estimate expenditures affected by the proposal.

At the current level of public and private improvement in the proposed annexation area, City expenditures are anticipated to be negligible. Costs currently accrue to the City with soccer events at the site. These costs are not anticipated to increase or decrease as a result of annexation. Due to regulatory limitations and the location of the proposed annexation within the floodplain, new development is anticipated to be minimal. Therefore, future costs are anticipated to be consistent with current costs. Provision of City services is not anticipated to require additional staffing at present and in the future.

2. Estimate revenues to be gained by the proposal.

The annexation will not result in an increase of property tax revenues to the City. The City currently receives all property taxes for the condominium property that extends into the proposed annexation. The current land owner for the southern 20 acres is exempt from property taxes. There are currently no utility services within the annexation area that would return utility taxes to the City. Unless utilities are extended into the subject parcels, no increase in revenues is anticipated.

As the City currently receives all property tax revenues from the condominium property and the Snohomish Youth Soccer Club is exempt from property taxes, no revenues will be lost to Snohomish County.

Due to the existing level of development and use of the property, service demands are assumed to be minimal. Therefore little or no expenditure reduction is anticipated to result from the proposed annexation.

5. Estimate fire district revenue lost.

Not applicable. No change in fire service provision.

7. Estimate other special district revenue/loss.

No special districts will lose revenue as a result of the proposed annexation.

B. Services

1. Law Enforcement

Both the City and the subject area are currently served by the Snohomish County Sheriff's Department for patrol and investigations. The City contracts for services with Snohomish County.

b. Current emergency and normal response time being experienced

Not applicable. Response times will not change as the service provider will not change.

c. Initial police protection plan contemplated

d. Back-up plan (mutual aid and/or reserve)

The City's contract with Snohomish County for police services may be modified to preserve or enhance the current level of service as conditions within the City change. The proposed annexation is not anticipated to increase demand for police services in the short or long term.

f. Source of dispatch

Snohomish County Sheriff deputies are radio dispatched through the E-911 PSAP (Public Safety Answering Point) in Everett at the consolidated SNOPAC PSCC (Public Safety Communications Center). Administrative functions are handled locally at the police station at 230 Maple Avenue in Snohomish.

2. Fire Service: Fire suppression and protection services will remain with Fire District 4 following annexation.

a. Nearest station(s)

Fire District 4 operates Fire Station No. 41 at 427 Maple Avenue, approximately 0.9 miles northwest of the proposed annexation.

b. Response time

The Fire District's response time goal is three to five minutes.

c. Are they fully staffed? How many part-time and full time personnel?

At least three firefighters are on duty at each Fire District station 24 hours a day. In addition, the Fire District maintains a medic in the City.

d. Major equipment at station location (including type and number of emergency vehicles)

Major equipment at Fire Station 41 includes one fire engine and one aid car.

e. How many fully certified EMT personnel do you have?

All volunteer and regular staff are EMT certified.

f. What fire rating applies?

Fire District 43 has a fire rating of 5 within the city limits and 6 outside the city.

Dispatch is through SnoPac.

3. Water

The proposal is within the City's water service area. There is currently no development within and no water service to the proposed annexation area.

b. Storage location(s) and capacity

The proposed annexation is within the 218 pressure zone, which is served by two reservoirs of 5.0 and 1.5 million gallons located at 301 Thirteenth Street.

c. Mains to serve the area (diameter and location)

The closest water main to the subject area is a looped six-inch main in Pine Avenue, one block east of the proposed annexation.

d. Pressure station location and measured flow

The City's water system does not use booster pumps. Measured now in the vicinity of the site is about 1,400 gpm.

e. Capacity available

Yes

f. Water source (wells, Everett, etc.)

The City is supplied by water from the City of Everett Transmission Line #5 near the north end of the City and the City's water treatment plant on the Pilchuck River approximately five miles southeast of the city of Granite Falls.

g. Financing of proposed service (LID, ULID, Developer Extension)

Extensions to provide service for new development, if any, will occur by developer extension.

4. Sewer

a. Directly or by contract

Sanitary sewer service will be provided directly by the City of Snohomish.

b. Mains to service the area (diameter and location)

An existing 8-inch main is located in Pine Avenue, one block west of the proposed annexation.

c. Gravity or lift station required

If sanitary sewer service is required, it may be necessary to pump effluent to the main in Pine Avenue. Flows from developed properties in the immediate vicinity are conveyed by two sequential pump stations to the City's wastewater treatment plant.

d. Disposal (city or district treatment plant)

Future sewage flows from the subject area will be processed at the City's treatment facility.

e. Capacity available

The City's waste water treatment plant has adequate capacity to accommodate future flows from the site.

IV. GENERAL:

1. In case of extensions of services, has an annexation agreement been required? If so, please attach a recorded copy of this requirement.

No annexation agreements have been executed with regard to prior extension of services. An annexation covenant was recorded under AFN 8410260206 for the Pilchuck Gardens Condominium property when the condominium project was approved in 1984. Among other provisions, the covenant states that "all owners shall sign an annexation petition and any other legal document necessary to promote the annexation, and will not protest the annexation of the portion of the ... property which lies between the City limits and the Pilchuck River." The covenant was not required to meet the statutory threshold for a sufficient petition to annex.

2. Describe the topography and natural boundaries of the proposal.

The subject area is flat with a flood levee at the northeast corner adjacent to the Pilchuck River. The north and west boundaries are the existing city limits and the east and south boundaries are contiguous with the Urban Growth Boundary.

3. How much growth has been projected for this area during the next 10-year period? What source is the basis for this projection?

The site is entirely within the 100-year floodplain. No development is assumed for the subject parcels.

4. Describe any other municipal or community services relevant to this proposal.

Apart from fire service, all municipal urban services, including utility, land use, legislative, and administrative, will be provided to the subject area by the City of Snohomish. The City contracts for police services with the Snohomish County Sheriff. There are no issues for provision of City services to the proposed annexation.

5. Describe briefly any delay in implementing service delivery to the area.

No delay is anticipated.

6. Briefly state your evaluation of the present adequacy, cost or rates of service to the area, and how you see future needs and costs increasing. Is there any other alternative source available for such services?

Per RCW 36.70A.110(4), cities are the units of government generally most appropriate to provide urban governmental services. The City is prepared to provide urban governmental services to this portion of the City's UGA.

The subject parcels are currently improved as turf athletic fields with no structures. The site is used by the Snohomish Youth Soccer Club for events that attract large numbers of people and impact City streets and services. The circumstance following annexation are not anticipated to change.

It is not evident that services are currently provided to the subject properties by other purveyors than the City, the Snohomish County Sheriff, and Fire District 4. Provision of services by these agencies will continue following annexation. Police services would occur under the City's contract with the Snohomish County Sheriff.

There are no alternative service providers for utilities. City water and sewer rates have increased in recent years and are anticipated to increase in the future. The City of Snohomish bases its water and sewer rates on the cost of service, maintenance and replacement of the current system, and future system expansion.

7. Comparative property and utility tax cost to homeowner before and after annexation.

There are currently no homeowners within the annexation area and highly limited or no development is anticipated due to the floodplain location. The northern parcel is a portion of the Pilchuck Gardens condominium parcel that is bisected by the city limits. The Snohomish County Assessor currently assigns all property tax from this parcel to the City's tax district. Therefore, the condominium owners' property tax costs will not change as a result of the proposed annexation. The condominium is currently subject to

the City's utility tax. The remainder of the annexation parcels are owned by the Snohomish County Youth Soccer Club, which is exempt from property tax. Therefore, tax liability for these parcels will not change with annexation.

The current (2012) levy rate for properties within the proposed annexation area is about $14.46 per thousand of assessed valuation. With annexation to the City of Snohomish, the applicable levy rate would drop to about $13.79 per thousand of valuation. The excess levy portion, $0.08 per thousand of assessed valuation, will be end in 2014. The City currently assesses a six percent tax on water, wastewater, solid waste, electric, natural gas, and telephone service, to which the area is not currently subject.

V. OBJECTIVES :

1. Preservation of natural neighborhoods and communities:

Access to the subject properties is currently from City streets. All structures associated with and under the same ownership as the subject properties are currently within the city limits and several of the parcels extend across the current corporate boundary. There is no development within the annexation and no adjacent unincorporated neighborhood with which the land could be associated.

2. Use of physical boundaries, including but not limited to, bodies of water, highways, and land contours:

The proposed annexation is bounded by the existing city limits and the Urban Growth Boundary. There will be no unincorporated urban growth area contiguous to the subject properties following annexation. Therefore, the objective is not applicable to this proposal.

3. Creation and preservation of logical service areas:

The subject properties are within the City's utility service area and are currently served by the Snohomish County Sheriff for police protection and Fire District 4 for fire protection. Services from all three agencies will continue after annexation. No new service areas will be created and existing service areas will be preserved through this annexation.

4. Prevention of abnormally irregular boundaries:

No irregular boundaries will result from the proposed annexation.

5. Discouragement of multiple incorporation of small cities and encouragement of incorporation of cities in excess of ten thousand population in heavily populated areas:

The subject properties do not contain development that is urban in character due to the location within the 100-year floodplain. However, the properties are designated Urban Growth Area in the Snohomish County Comprehensive Plan.

9. Protection of agricultural and rural lands which are designated for long term productive agricultural and resources use by a comprehensive plan adopted by the county legislative authority:

This area is not designated for agricultural or resource use in the Snohomish County Comprehensive Plan.

VI. COMPLIANCE WITH THE GROWTH MANAGEMENT ACT :

1. RCW 36.70A.020 Planning Goals:

The subject properties provide open space and recreational opportunities consistent with Goal 9. These amenities will not change as a result of the proposed annexation. Due to the existing circumstances of the subject properties including the existing use and limitations on future development within the floodplain, the Growth Management Act planning goals do not specifically apply.

2. RCW 36.70A.110 Comprehensive Plans — Urban Growth Areas:

The annexation proposal is within the City's UGA, as designated by the City and Snohomish County. The City has adequate public facility and service capacities to support potential future development within the annexation area.

3. RCW 36.70A.210 County-wide Planning Policies:

In compliance with Policy DP-5, the City has adopted a comprehensive plan and development regulations to achieve urban uses and densities where unencumbered by critical areas and similar constraints; to provide urban governmental services and capital facilities sufficient to accommodate the broad range of needs and uses that will accompany projected urban growth; and to permit the projected urban growth. That the following such hearing, and subsequent to approval by the Boundary Review Board for Snohomish County ; if such is convened, the City Council determine by ordinance that such annexation shall be effective; and that property so annexed shall become a part of the City of Snohomish, Washington subject to its laws and ordinances then and thereafter in force, including a Comprehensive Plan to become effective upon annexation.

3. That the zoning for the area proposed for annexation be amended consistent with the City's Comprehensive Plan and that said zoning be implemented and effective upon annexation.

Section 1 . The property legally described in Exhibit A and the boundaries depicted on the map attached as Exhibit B are hereby approved for annexation into the City of Snohomish and shall be so annexed by ordinance of the City of Snohomish upon receipt of a favorable decision/report from the Snohomish County Boundary Review Board.

Section 2 . Pursuant to the annexation petition and the City's current Land Use Map, upon annexation the property described in Exhibit A shall be subject to the City of Snohomish Comprehensive Plan and Zoning Code and shall be designated Open Space for the purposes of the Zoning Code unless otherwise amended by the City Council.

Section 3 . Upon annexation of the property described in Exhibit A, it shall be assessed and taxed at the same rate and on the same basis as other property within the City of Snohomish, including assessments or taxes for the payment of its pro rata share of indebtedness the City contracted or incurred prior to and existing on the effective date of the annexation.

Section 4 . The City Planner is hereby authorized to transmit a County Assessor's map or other appropriate map and all files on this annexation proceeding to the Snohomish County Boundary Review Board for consideration and review.
