Do I need a D
riveway Perm
it?
Any business or private party wishing to construct an access
driveway along a State highw
ay is required to apply for, andobtain, a D
riveway Perm
it from IN
DOT
prior to beginning anyconstruction. A
Drivew
ay Permit is also required for any pro-
posed relocation or alteration of an access, approach, or cross-over and is governed by the sam
e regulations and standardsas for a new
access driveway.
Why is drivew
ay access to State highways regulated?
Each driveway introduces potential conflict points betw
eenthrough traffic on the highw
ay and turning traffic into and outof the drivew
ay. Therefore, the driveway m
ust be designedand located in an appropriate m
anner to afford both you andother m
otorists the greatest possible safety.
What happens if I don’t get a perm
it?
If a property owner fails to obtain the appropriate perm
it—or
if the permit conditions and provisions are not satisfied—
theDepartm
ent may halt any construction activity and/or rem
ovethe
driveway.
Perm
it enforcem

ay also
require the
involvement of the State Attorney G
eneral’s office. All construc-tion w
ork by the applicant within State right-of-w
ay must pro-
ceed in accordance with the conditions and provisions speci-
fied in the issued access permit. Any costs incurred by the
Departm
ent in correcting a failure to comply w
ith the terms
and conditions of a permit, or a failure to obtain a perm
it, areborne by the property ow
ner.
What form
should I use?
The appropriate INDOT
application form, entitled “D
riveway
Permit”
[Form
1945(RS/3-00)],
is used
for all
routinerequests for drivew
ays along State highways. The form
canbe
obtained

Is there any cost?
There is a non-refundable permit fee for each D
riveway
Permit application. The fee am
ount will be determ
inedbased on the type of land use associated w
ith the appli-cation. The fee covers the D
epartment’s costs associated
with review
ing the permit application and issuing the per-
mit if the drivew
ay is approved. Contact your local INDOT

ation.
How
long does INDOT’s application review
take?
INDOT’s review
process is dependent upon the type ofperm
it requested and the nature of the permit request.
More
complicated
applications usually
take longer
toreview
and process, and may involve the Central O
ffice inIndianapolis. Contact your local IN

Additional Disclosure Form– A
document used for the pur-
poses of identifying and notifying other parties (persons,organizations, com
panies, agencies, etc.) that are, or will
be, served by the subject driveway approach.
Permit Bond
– Should the applicant/permittee fail to per-
form properly, this notarized docum
ent is used to guaran-tee that the w
ork performed on the right-of-w
ay by theapplicant/perm
ittee will be com
pleted as required in theconditions and provisions of the perm
it.
Traffic Impact Analysis (TIA)
– Atechnical study, prepared by
a registered professional engineer, may be required to eval-
uate the impact of present and future traffic generated by
the proposed development. The TIA
should be prepared inaccordance
with
the Applicant’s Guide
to Traffic
Impact
Studies, an
INDOT
publication that
can be

Agreement to Execute an Access Control Docum
ent– In con-sideration for IN
DOT
granting a driveway perm
it, the appli-cant m
ay be required to sign an agreement to execute an
access control document conveying the access rights for the
balance of property frontage owned by the applicant. This
agreement allow
s INDOT
to issue a permit to begin drive-
way construction before the actual deed relinquishing the
remaining access rights is prepared and recorded on the
property. This document is required for m
ost developments
with over 400 feet of frontage along a State controlled high-
way.
