As used in this section, a“substance use disordercounselor” is a personproviding counseling servicesin an alcoholism or drugabuse recovery andtreatment program l icensed,cert i f ied, or funded underPart 2 (commencing withSection 11760) of Division10.5 of the Health and SafetyCode. 

A clergy memberIncluding a priest, minister, rabbi,religious practitioner, or similarfunctionary of a church,synagogue, temple, mosque, orrecognized religiousdenominat ion or organizat ion, butexcluding any unpaid volunteerswhose principal occupation orvocation does not involve active orordained ministry in a church,synagogue, temple, mosque, orrecognized religiousdenominat ion or organizat ion,and who periodically visit elder ordependent adul ts on behalf of thatchurch, synagogue, temple,mosque, or recognized rel igiousdenominat ion or organizat ion.

An employee of a county adultprotective services agency or a local lawenforcement agency;All officers and employees of financialins t i tu t ions are mandated repor ters ofsuspected f inancial abuse; andAny notary public who, in connectionwith providing notary services, hasobserved or has knowledge ofsuspected financial abuse of an elder ordependent adul t i s a mandatoryreporter of suspected f inancial abuse.

a physician’s diagnosis of dementia and there isno serious bodily injury, the reporter shall reportto the local ombudsperson or law enforcementagency by telephone immediately or as soon asreasonably practicable and by writ ten reportwithin 24 hours.

If the abuse occurred in a state mental hospital or astate developmental center and the al leged abuse orneglect resulted in death, sexual assault , an assaultwith a deadly weapon by a nonresident of a statemental hospital or a s tate developmental center , anassault with force likely to produce great bodily injury,an injury to the genitals where the cause isundetermined or a broken bone where the cause of thebreak is undetermined, then the report shal l be madeimmediately (but in any event within 2 hours of theevent) to designated investigators of the StateDepartment of State Hospitals or the State Departmentof Developmental Services and also to the local lawenforcement agency.

Colorado Any of the following, whether paid orunpaid, who observes the mistreatment ofan at-r isk elder or an at-r isk adul t with anintellectual and developmental disabili ty(IDD), or who has reasonable cause tobel ieve that an at-r isk elder or an at-r iskadult with IDD has been mistreated or is atimminent r isk of mistreatment shal l reportsuch fact:

For Long-Term Care Facilities:

Report shall be made immediately by telephone or inperson to the depar tment .If an immediate report to the department is notpossible, the report shal l be made to the appropriatelaw enforcement agency or prosecuting at torney.A wri t ten report shal l be made to the departmentwithin 24 hours after the init ial report .

A financial institution whose employeeor officer has direct contact with theelder or reviews or approves the elder’sfinancial documents, records, ortransactions, and within the scope ofemployment or professional practice:

Observes or has knowledge of anincident the officer or employeebelieves in good faith appears tobe financial abuse; orIn the case of officers oremployees who do not have directcontact with the elder, has a goodfaith suspicion that f inancialabuse has occurred or may beoccurring, based solely on theinformation present a t the t ime ofreviewing or approving adocument, record, or t ransact ion.

Oral report is to be made promptly.Writ ten report should follow oral report as soon aspossible.Suspected financial abuse shall be reportedimmediately or as soon as practicably possible.

Oral report should be made by telephone immediatelyor as soon as reasonably practicable, and by a writ tenreport sent within two working days from the date ofthe reported incident .If the conduct involves criminal activity, a mandatedreporter or any person shall report i t immediately tothe appropriate law enforcement agency.
