    All ratings and other ranks R.M ., excluding W .R.N .S., who are in Age and Service groups Nos. 26 to 28 inclusive and who are serving in ships and establishments abroad, excluding N.W . Europe, are to be returned to depots at home after relief, if necessary, in-accordance with B .R . 1281 (1), Release Instructions.

    2. Endeavour is to be made for these ratings to reach the United Kingdom between 6th November and 31st December, 1945.

    3. W ith reference to A.F.O. 4685/45, paragraphs 1 and 2, the return of ratings in Age and Service groups earlier than 26 should be accelerated, when practicable, so that they reach the United Kingdom before 5th November, 1945.

    4. All ratings and other ranks R.M . exclnding W .R.N .S., who are in Age and Service groups 23 to 25 inclusive and who are serving ashore in N.W . Europe outside the United Kingdom are to be returned to depots at home, reliefs being demanded only where absolutely essential. Endeavour is to be made for these ratings to reach the United Kingdom before 5th November. 1945.

    2. The paragraphs of this section follow serially and should be read in conjunction with Sections T.124/I to T.124/V (A.F.O. 2653/45), Sections T.124/VI to T.124/XII (A.F.O. 2975/45), Section T .124/XIII (A.F.O. 3121/45), and Section T.124/XIV (A.F.O. 3733/45).

    P a r t 1

    Entitlement and Conditions

    181. $n officer*» rating who was domiciled or ordinarily resident abroad and signed his pitesent Agreement outside the United Kingdom is entitled, subject to satisfactory service, to retention on his Agreement until he has been repatriated to the port at which he signed the Agreement.

    182. An officer or rating who was domiciled or ordinarily resident abroad and who, prior to signing his present Agreement, signed any other of the Agreements covered by these instructions outside the United Kingdom is entitled, subject to continuity of service, to retention on his Agreement until he has been repatriated to the port at which he originally signed, provided that his service has been satisfactory.

    183. An officer or rating who was domiciled or ordinarily resident abroad but signed his present Agreement in the United Kingdom and has no claim to repatriation on pay under the conditions laid down in paragraph 182 will be released in the United Kingdom in the normal way, and his pay and allowances will cease at the end of his release leave. He will, however, be entitled to repatriation at public expense to the country in which he normally resided if either of the following conditions is fulfilled :—

    (as) I f he proceeded to and arrived in the United Kingdom on or after 1st September, 1938, or

    (6) I f he proceeded to the United Kingdom for the purpose of attending a recognised educational or training course (including an apprenticeship), the period of which did not exceed four years, which was not completed prior to 1st September, 1938, and joined the Naval Service in the United Kingdom, irrespective of the date of his arrival.

    Note.—The expression “ ordinarily resident ataroad ” applies to any person whose sole or principal home residence is outside the United Kingdom of Great Britain and Northern Ireland (including the Channel Islands and the Isle of Man) or Eire, being the place in which he habitually spent his time and lived, subject to demands of business or profession and periods of holiday.

    184. Entitlement does not extend to individuals normally resident in the United Kingdom, who desire to emigrate. Such cases will be governed by the postwar policy of H.M. Government in regard to emigration generally.

    185. Individuals entitled to repatriation who are serving abroad will have the option of—

    (i) repatriation to the country in which theiy were ordinarily resident -;

    (ii) a substituted passage to another country overseas under the conditions laid down in paragraph 187 ; or

    (iii) return to the United Kingdom.

    Passage granted at public expense under any one of these options is final and will completely exhaust all entitlement to repatriation. Officers and ratings are to be warned that the passage they accept, whether to the United Kingdom as above or as the result of a successful application for repatriation or substituted passage elsewhere, is a final choice and that they will have no further claim to passage at the public expense. A signed undertaking to this effect is to be obtained from all individuals who elect to return to the United Kingdom for release under the normal dispersal procedure.

    186. Individuals entitled to repatriation who are serving abroad will be repatriated direct from where they are serving whenever practicable. Where repatriation necessarily involves a journey via the United Kingdom, they will be repatriated from the United Kingdom.

    Substituted Passage187. An individual entitled to repatriation who wishes to proceed to a country

    other than that to which he is entitled to be repatriated may, at the discretion of the Admiralty, be granted a passage to the country of his choice provided he complies with the emigration regulations in force and fulfils the conditions contained therein. In all such cases permission to enter the country selected must be obtained by the individual, who must produce a certificate of acceptance, bearing the signature and stamp of the accredited representative of the country concerned, within six months of the date of making his claim (see paragraphs 190 and 218).

    Release188. No individual will be entitled to repatriation until his release in Class A,

    or on compassionate grounds, or his discharge from the Service has been ordered (see also paragraph 32 (iv)).

    189. An individual whose repatriation has been approved under paragraph 181 or 182 will be granted leave, as laid down in paragraph 230, starting on the day of arrival at the port of disembarkation for the country to which he is being repatriated. He will be discharged on the last day of that leave and will not be subject to recall. An individual, whose repatriation has been approved tmder paragraph 183, will be dispersed in the United Kingdom by the depot in the ordinary way. The date of dispersal will be deferred until his passage is arranged and his release leave calculated as if it commenced on the date upon which he is ordered to report at the port of

    embarkation.

    Claims190. Every officer or rating who desires repatriation to the country in which

    he is normally resident, or a substituted passage elsewhere, is to make a claim, if serving at home, as soon as his release or discharge from service has been ordered, or, if serving abroad, as soon as the order referred to in paragraphs 22 and 23 for his return to the United Kingdom has been received. In the case of an officer or a rating who has been invalided, the claim is to be made at the time of the final survey. An officer or rating who has applied for postponement of release and been accepted for further service is to make a claim as soon as his release is eventually ordered ; if he is not accepted for further service, he is to make a claim as soon as his application for postponement of release has been rejected. Claims made subsequently will only be entertained in the most exceptional circumstances, and, except as provided for in paragraphs 191 and 193, all entitlement to repatriation at public expense will lapse as soon as the individual has been released. Claims are to be made on the established form of application in accordance with the directions in paragraphs 208 and 209. An officer or rating claiming repatriation who desires to attend a course of training sponsored by the Ministry of Labour and National Service is to make application accordingly at the same time as his application for repatriation is made. Particulars of these courses and the necessary instructions

    will be promulgated later.

    Deferred Repatriation191. In certain cases in which repatriation is not immediately possible through

    causes beyond the control of the individual (e.g. the continued occupation of the country by the enemy), he will be asked whether he wishes to remain in the Service until his repatriation becomes possible, or to be released in his turn in the normal way, retaining a deferred right to repatriation at public expense to be exercised when conditions in the country to which he desired to go no longer render his return impossible. The competent authority for granting or withholding the right to deferment of repatriation under this paragraph will be the Repatriation Office, London (see paragraph 216), in the case of applicants dealt with by that office, and the Commander-in-Chief concerned in the case of applicants serving abroad who are being repatriated direct. The grant of the right to deferred repatriation will be subject to its being exercised as soon as a passage to the country concerned is offered by the repatriating authority

    192. An individual whose entitlement to repatriation is under paragraph 181 or 182, but who elects to be released in the normal way, with a deferred right to

  • 5150 24repatriation, will be in the ‘same position as any other released person. His pay and allowances will cease at the end of his release leave and he will be entitled to no further benefits other than those specified in paragraph 203.

    193. Individuals entitled to repatriation who are eligible for, and desire tQ take advantage of, the courses of training sponsored by the Ministry of Labour and National Service, are to be granted leave without pay for the period of the course. On completion of the course they are to return to depot to await repatriation,

    194. Deferred repatriation will not be allowed on any ground other than those laid down in paragraphs 191 and 193.

    Dependants

    195. Dependants, as defined below, of individuals referred to in paragraphs 181, 182 and 183, will also be entitled to repatriation provided they were dependent upon the individual concerned at any time during the period of his service :—

    (i) Wife.

    (ii) Legitimate, legitimated, and statutorily adopted children and stepchildren who are dependant upon the officer or rating.

    Note.— In this connection a child is deemed to be dependent if under 18 years of age in the case of a male, and if unmarried in the case of a female.

    (iii) Unmarried dependant living as a wife, and dependent children under hercare, who have been in receipt of an allotment, provided in either case that repatriation cannot be claimed both for a wife and an unmarried wife.

    (iv) Persons not covered by the above who are dependant wholly orsubstantially upon the individual, for whom he intends to provide a. home with him overseas, and in whose cases he can establish that considerable hardship would result if free passage were not granted.

    196. Any person who is entitled to claim repatriation both.in his or her own right and as a dependant of another (e.g. a member of the W .R.N .S. who is married to an officer or rating) may be repatriated under whichever title he or she prefers, but the provision of passage under one title will exhaust entitlement to passage under the other.

    197. Claims for the free passage of dependants are to be made by officers and ratings concerned at the same time as they claim their own repatriation, except that in the case of dependants acquired since a claim for repatriation was made, the claims for their passage should be made as soon as they become entitled.

    198. Whenever possible passage for dependants will be arranged in the same ship or convoy as that in which the claimant is travelling, but in no case will dependants be required to precede the claimant without the latter’s consent. Dependants who are resident at such a distance from the claimant that their passage with him is not practicable will be repatriated separately.

    Dependants of Deceased Persons

    199. Dependants, as defined in paragraph 195 of individuals who have been killed or who have died while in’ the service will have the same entitlement to repatriation as they would have had if the individual concerned were still alivfe; or will be entitled, if appropriate,- to repatriation to their own normal place of residence abroad, even though the deceased individual, had he lived, would have had no claim to repatriation in his own right, provided they embarked from the country in which they normally resided during the lifetime of the individual concerned.

    200. Applications from the persons referred to in paragraph 199 will be called for by public announcement. Naval authorities who receive any such applications are to forward them to the appropriate Admiralty department, if at home, or to the Commander-in-Chief, if abroad, and advise the senders accordingly.

    Permission to Enter the Country

    201. In all cases repatriation is subject to prior approval by the Government of the country to which the individual wishes to proceed. All necessary entry permits, passports and visas required to enable the individual and his dependants to enter and take up residence in the country desired, and, if applicable, to carry on a trade or profession or take up employment there, must be obtained before Uny passage can be provided (see paragraph 218).

    202. All necessary expenditure (including the cost of photographs) payable in connection with the issue of passports, visas and entry permits will be chargeable

    to public funds.

    Conveyance203. Individuals whose repatriation has been approved will be entitled to the

    following(i) Rail conveyance to port of embarkation.(ii) Ocean passage with free messing, except in the case of officers’ families

    liable for messing contributions from whom messing charged at the appropriate rate, for the estimated duration of the voyage will be recovered before embarkation.

    (iii) Conveyance by rail or water from port of disembarkation to the nearestpoint to final destination which can be reached by such means, including conveyance of baggage on the scale laid down in (v) below.

    (iv) Accommodation and subsistence in kind, appropriate to the rank orrating of the individual, for the officer or rating and his dependants, for periods during which they are necessarily detained at ports of

    transhipment en route.(v) Conveyance by sea and rail or water of baggage, up to the weights shown

    in the table below (inclusive of the quantities carried free by the railway or shipping companies) :—

    No refund will be made of any charges incurred privately in connection with the conveyance of baggage. Except as provided by A.F.O. 6813/44, the Admiralty will accept no responsibility or liability for loss of, or damage to, baggage or property in transit, and individuals desiring to protect themselves against such loss or damage should do so by private insurance.

    (vi) Subsistence allowance for the (¡fficer or rating only in respect of the railjourney from the port of disembarkation at the following rates, provided the entitlement to repatriation is under paragraph 181 or 182.

    204. The class of accommodation will be appropriate to the rank or rating of the individual concerned, but if it is not possible to provide the appropriate grade of accommodation, the best alternative must be accepted. Similarly, the class of accommodation provided for a wife or dependant will be that appropriate to the rank or rating of the individual in respect of whom the entitlement to

    repatriation lies.

    205. A rating husband who is being repatriated in company with an officer wife may travel in the same class as his wife provided the excess cost of the passage is paid before embarkation. Ratings availing themselves of this concession are not to wear uniform during the voyage.

    206. Entitlement to repatriation is, in all cases, subject to acceptance of conveyance under Government arrangements. In no circumstances will a refund be made of expenses incurred privately.

    Medical and Dental Treatment207. Individuals who are repatriated will not be eligible for medical or dental

    treatment at the cost of Naval funds during passage and final leave in the country of their destination, since the facilities of the Naval medical service will not normally be available. Where such facilities do exist, however, an officer or rating may be treated free of charge by a Naval Medical Officer, or in a Naval hospital, during the period of passage and final leave.

    Application Forms.208. Claims for repatriation or substituted passage, and for passage for depend

    ants, by officers and ratings serving at home are to be made in duplicate on FormS. 1598. One copy of the form is to be sent to the appropriate Admiralty department and not as directed on the form ; the other copy is to be sent to the Commanding

  • 5150 26Officer of the depot. The appropriate Admiralty department is defined in the preamble to Section T. 124/1 promulgated in A.F.O. 2653/45, which also indicates the appropriate Depot.

    209. Form S. 1598 is also to be used for claims by officers and ratings serving abroad, and it is to be sent in duplicate to the Commander-in-Chief who will verify the entitlement of all persons to be repatriated direct and of such dependants as are resident on the Station. Should the Commander-in-Chief be in doubt regarding an individual’s entitlement, one copy of the form is to be sent to the appropriate Admiralty department, by the quickest means, for verification, which will be communicated to the Commander-in-Chief by signal. In the case of persons to be repatriated via the United Kingdom, one copy of the form is to be sent to the appropriate Admiralty department and the other copy to the Commanding Officer of the Depot (see preamble to A.F.O. 2653/45). In the case of dependants who are not resident on the Station, one copy of- the form is to be sent to the appropriate Admiralty department.

    210. Commanding officers are to check each form of application from such information as is available on board. I f the applicant is in possession of a passport, it is to be forwarded with the form of application.

    Rejected Claims

    211. Individuals whose applications for repatriation have been rejected are to be released in accordance with the normal dispersal procedure, those serving abroad being given the option of release on the Station on which they are serving under the conditions laid down in paragraphs 43 and 44 for the release abroad of persons normally resident in the United Kingdom.

    Cancellation of Claims

    . 212. Any applicant may cancel his application for repatriation at any time before orders have been received for his embarkation. In this event he is to be released in accordance with the normal dispersal procedure, and, except in the most exceptional circumstances, his entitlement to repatriation will lapse.

    Repatriation from the United Kingdom

    213. All officers and ratings to be repatriated from the United Kingdom are to be discharged to their appropriate depots (see preamble to A.F.O. 2653/45) to await passage as soon as their forms of application have been sent to the appropriate Admiralty department. They are not to be discharged to the R.N . Barracks, Portsmouth.

    214. All officers and ratings serving abroad whose repatriation or substituted passage necessarily involves a journey to the United Kingdom (see paragraph 186) are similarly to be discharged to their respective depots (see preamble to A.F.O. 2653/45).
