Deep within the hundreds of pages of the Patient Protection and Affordable Care Act (PPACA) is Section 9006, “Expansion of Information Reporting Requirements.” The provision amends Section 6041 of the Internal Revenue Code, which deals with reporting of
income. Businesses are well acquainted with Section 6041 because it’s the section that requires preparing 1099 forms for all independent contractors from which the company received more than $600 worth of services in the preceding tax year.
The new law makes two significant changes: It amends the term ‘person’ to include corporations, which means businesses will need to send 1099s to every business, not just sole proprietors. It also inserts the phrase, “amounts in consideration for property,” which means businesses will need to do 1099s for every company with which it spends more than $600 a year. That includes the
phone company, the gas station where you fill up your work truck and the garage where you bought tires for it, the office supply store where you buy pens and copy paper, all your materials suppliers and subcontractors.
The rationale behind the provision is that countless companies
under-report their taxable income. The reporting requirement is designed to make sure the government has the money to pay for health care reform. The unintended consequence is extra
tax preparation paperwork for every business owner, starting in 2012. This has nothing to do with health care. This misguided provision will certainly increase costs on all small businesses, especially home builders. It’s another example of just how badly Congrss has been out of touch with the real world.

United States Congressman Mac Thornberry discussed the prob-lems that face the new Congress with the area home building industry at the February Membership Luncheon of the North Texas Home Builders Association, held Thursday, February 3, at the Wellington Convention Center.
He opened by saying it was still the American dream to own your own home. However, he noted that the role of government, coupled with the problems of Fannie Mae and Freddie Mac, greatly affected the industry and its ability to build affordable housing.
Rep. Thornberry then discussed the challenges facing the new Congress. “Most of the country did not like where government was going during the past two to four years. That’s why 63 seats changed hands in the House of Representatives. This gave the Republicans the majority with the highest number of Republican seats since 1946. “The election also led to a closely divided Senate.”
He said the first order of business is changing the way Congress works. “In the past we’ve had 2,000-3,000-page bills with one-hour debate and no amendments. Thus, we’ve had no open transparency. The new rules require a minimum of three days for a bill to be on the floor before a vote so everyone can read it. The sponsoring representative also must cite the provision in the Constitution that allows the bill.”
Other improvements in Congress should make it easier to cut spending. They will decrease the number of committees and cut House costs by five percent.
The second order of business was the vote to repeal Obama Care. Rep. Thornberry noted that the Senate voted along party lines 51-47 to defeat the repeal. These votes were just the first step in the repeal process.
The third order of business is to begin cutting spending by setting up a process to cut spending to 2008 levels for non-defense and non-entitlement programs. This should save $70 billion.
Upcoming issues include raising the debt limit. This vote could force changes in the way government operates, budgets are created, and spending decisions.
Discussions also will include tax simplification and dealing with regulations and out-of-control government agencies. “The way to deal with regulations is to cut funding to the agencies, increase oversight on particular regulations and consequences, have the federal courts deal with agencies, or to propose bills to kill specific regulations.”
As for good news, Rep. Thornberry said, “In Congress, it won’t get any worse.” He added that the Senate voted to repeal the 1099 provision of Obama Care and he believes the House will soon vote to repeal.
As for the deficit, he noted that tax revenues historically averaged 19 percent of GDP “Currently, it is 14 percent of GDP.” So, improv-ing the economy is one way to cut the deficit, along with spending restraint and cuts. However, he noted that half the budget is Social Security, Medicare, and Medicaid.
As for the situation in the Middle East, Rep. Thornberry noted that Egypt is the second largest receiver of foreign aid in the region behind Israel. He noted that actions locally can affect actions abroad. For example, food shortages and food inflation are factors leading to the unrest in several Middle East countries. “Interconnectedness of the world we live in is a trend that is going to grow.”
He also complimented the Wichita Falls community for its con-tinued strong support for Sheppard Air Force Base. As for immigra-tion reform, he said it will not occur until the government secures the border. He said immigration reform must include a guest worker program, secure borders, a way to deal with illegal immigrants already in this country, and a way to deal with persons waiting within the law to legally immigrate into our country.
In the new Congress, Rep. Thornberry is the vice chairman of the Armed Services Committee and is the chairman of the Unconventional Threats Subcommittee.

BUSINESSES JOIN TOGETHER TO SHOW APPRECIATION TO RETURNING VETERAN

Hospital man Third Class Zackary S. Hammonds of the United States Marine Corps returned to Wichita Falls in late 2010 after spending a year in Afghanistan. Acting as a mentor and corpsman for multiple Afghan units, he trained medics from two Kandaks on combat lifesaving and field medicine.
He participated in more than 100 combat patrols in a highly contested area of Wardak Province, operating out of remote and austere combat outposts manned with as few as two marines. He was involved in multiple combat situations against anti-Afghan forces, where he directed the fire of the Afghans and coordinated fire with the U.S. Army.
During operation Wardak eviction, Hammonds was in combat for three consecutive days. Leading his Afghan unit under fire, he effectively maneuvered on the enemy at close range without sustaining a single casualty. For that action, Hammonds
was awarded the Commendation medal that described his initiative, perseverance, and loyal devotion to duty that reflected credit upon him and were in keeping with the highest traditions of the Marine Corps and the United States Naval Service.
After Hammonds arrived home with his American flag, local business owners donated their time and services to show their appreciation for his service to our country.
Dutch Watson of Watson Cabinets constructed the frame for a wall hanging for the flag. Shelia Hammonds, mother of Zack Hammonds, and Stan Mountain of Mountain Construction stained and sealed the wood while Michael and Janice LaBrie of All Glass fitted and placed the glass over the historical symbol. Everyone who was involved in this labor of love and appreciation agreed that their part was a small gesture towards
Hammonds’ enormous sacrifice for our country.
Stan Mountain noted, “We have so many vets coming back from similar situation. Our duty as civilians to our men and women in the military should be to show our appreciation to them for our everyday freedoms that we sometimes take for granted. Let’s put them to a higher place and show our respect as small business owners and citizens to make them feel their sacrifices are not overlooked or underappreciated.”
