City Manager SUBJECT: Shared Use Pathway Easement Deed 1 Town Center Road/CP OTC, LLC RECOMMENDATION: I recommend approval of this Resolution which approves and accepts a public shared use pathway easement deed from CO OTC, LLC over certain real property located at 1 Town Center Road. The shared use pathway will benefit a variety of users including pedestrians, rollerbladers and bicyclists. BACKGROUND: On April 9, 2013, via Resolution No. 32-3013, the City Council accepted and approved a shared use pathway easement deed from Metropolitan Life Insurance Company ("Met Life") over certain lands located at 1 Town Center Road (the "Property"). Essentially, that easement reconfigured the planned pathway to avoid conflict with large AT&T cabinets located adjacent to the trail on Met Life's property. Subsequent to that approval, the Property transferred ownership to CO OTC, LLC. Accordingly, CO OTC, LLC is granting an additional north/south easement to the City that will connect with the Met Life granted easement. This public shared use pathway will be constructed and maintained by the City. Approval and acceptance of this easement deed will add another link to Patch Reef Trail, extending such pathway south along the Lake Worth Drainage District E-3 Canal to connect to Verde Trail South. A Federal grant for the pathway project has been secured and construction is scheduled for Fiscal Year 2015/2016. This Resolution serves as the vehicle for the City Council to approve and accept the easement deed. FINANCIAL IMPACT: There is no financial impact to the City with regard to obtaining the easement.
