2014 off to a great startBetween the polar vortex that swooped down

from up north (wrapping us in a frigid grasp), an ice storm, and news that even the polar bears were finding it a bit cool, I suppose the idiom “cold enough for you?” might not be appreciated. throw in a frost quake or two, and it’s amazing that the locusts didn’t arrive in town at some point. thankfully our “hot” events have been keeping the temperature in check for many of us.

At time of writing, our olympians are proudly representing all Canadians at Sochi. We wish them the best of luck, especially our own travis Gerrits who, in his words, “...is more comfortable upside down on skis than anything else”.

the stars were out in full force on february 4 at our 12th annual Sports Celebrity Din-ner, held at rattleSnake Point Golf Club. We welcomed NHL legends Bobby Hull and Dennis Hull, Canadian Women’s olympic Hockey hero Geraldine Heaney, olympic Cyclist Curt Harnett, recently appointed head coach of the CfL’s Winnipeg Blue Bombers Mike o’Shea (who received our Chamber “Local Sports Hero” Award) and our emcee, tSN sportscaster rod Black. the humourous anecdotes from Den-nis and rod had the crowd burst out laughing more than once. over 210 people attended this event (which supports our Chamber Scholar-ship fund) and thanks to our sponsors and to all who attended and purchased auction items to support our fund, we raised over $15,000. our co-chairs (Heather rickard and Andrew Jack-son) did another great job by bringing this event to Milton. the goal of our Chamber is to create a self-sufficient fund to ensure enough money will be there to support Milton students for many years to come. According to the 2011 census, our average age is 34. Almost 25 per cent of our population is between 0 and 15 years old. And when you visit our farmer’s Market (which starts up in May!) you’ll see all the youngsters with their families. the need is there for our students and with your support, they’ll have ad-ditional access to many opportunities for post secondary education.

We hosted the Mayor’s annual break-fast on february 13 at rattlesnake PointGolf Club and along with Acting CAo Bill Mann, presented Milton’s plans for 2014 under the banner “Partnerships help achieve

vision”. four areas of interest were highlighted at the event – the Boyne residential survey and Derry Green Business Park, ongoing construc-tion of the Velodrome in preparation for the 2015 Pan Am and Para Panam Games, our Milton education Village (including our hope for a positive announcement from the province about establishing a satellite campus for Wilfrid Laurier University) and the expansion of Milton District Hospital. our sponsors always help us provide quality programs and events to our community and, we extend our grateful appreciation to CN (our presenting sponsor) and oLG (our platinum sponsor). our town is set for some extraordinary expansion plans during the next 17 years, when we’re projected to reach 236,000 people by 2031.

this year, the Chamber is hosting two trips for members – your choice of ireland (May 5 – 13) or russia (September 10 – 19 2014)…or both! Perhaps you want to kiss the Blarney Stone, explore the ring of Kerry, visit Dublin, Killarney and Galway, cruise on Lough Corrib or visit trinity College, the oldest University in ireland, founded in 1592 by elizabeth i. or maybe you’re a music and art lover, in which case, the host of palaces, cathedrals, museums in Moscow, Novgorod and St. Petersburg will leave you breathless. for the music lovers, you’ll have a chance to experience the beauty of the country which gave the world Nikolai rimsky-Korsakov, Pyotr Tchaikovsky, Sergei Prokofiev and Dmitri Shostakovich, to name a few. for the art lovers, you’ll visit the Hermitage’s collection of over 2.7 million items, including masterpieces by Leon-ardo DaVinci, raphael, rodin, rembrandt and rubens. Canada’s new Anti-Spam Legislation will impact many businesses

exciting things keep happening at the Chamber. our Marketing & Communications committee has started the process of developing a new website – the rfP is being prepared and will be circulated to member companies in the website development sector. We are working with a member to develop an app for the Chamber – how exciting is that? the new website will be responsive, interactive and easy to navigate. our current site is 6 years old and despite being updated several times during that period it is lagging behind in its ability to meet the needs of our growing chamber and member demands.

CASL – Canadian Anti-Span Legislation comes into effect July 1, 2014 and it will impact every one of us who uses email to communicate with clients. We hosted a meeting february 20, 2014 and we are working on other dates to offer the information you require in order to use CeM – commercial electronic mail to solicit, sell or notify clients or potential clients of your goods or services.

We participated in a webinar with the Canadian Chamber of Commerce in late January. the following questions were asked of the experts as it pertains to communication with our members some of this information may answer some of your questions as well:

Q. We collect information on all businesses in our community including non-members. each year we update the information in several ways: insert in our newsletter requesting their information; telephone follow-up; and site visits looking for new businesses. on the form we ask if we can send emails to them and in turn they either say yes verbally or in writing. Does this provide implied permission if they are non-member businesses?

a. there are several options to answer this question…if your newsletter is not electronic (sent by conventional mail), CASL does not apply and you are free to send those without fear of violation of CASL. Nor do telephone conversations or in person meetings. in fact, this will have to become your standard for acquiring express consent. if you ask in any of these formats to send commercial electronic messages and they agree and you have a record of that agreement, then you have express consent and the electronic messages you send must have the prescribed information and an unsubscribe mechanism. if there are verifiable, two way communications between your chamber and those businesses or

individuals and you can demonstrate that the relationship falls under one of the exemptions (family, Personal or Business or non-business), then you have implied consent.

Q. if a member cancels their membership are they then also cancelling the express permission given when joining?

a. Businesses who are members of your Chamber would be considered to have implied consent under the business or non-business exemption. Where this breaks down is in the record of communication once a member resigns or is written-off. if a period of two years elapses without two way communication, there is no longer implied consent and you may be in violation. You could decide as a matter of policy to request express consent from all of your members. express consent does not expire. it can only be withdrawn. But then you have to keep in mind that you would be obligated to include prescribed information and an unsubscribe mechanism in every message going forward.

Q. We use the database of non-members to recruit new members – in order to send them membership information via email would we need to contact them by phone and then send them the information? Did you say that permission was good for only that email?

a. for member recruitment, you can only send a message via email in one of three circumstances: you can demonstrate a business or non-business relationship or you contact them by phone and ask for their express consent to send them a message or you use the referral approach which limits you to one email asking for further communication. in the referral approach, you are required to disclose who provided the referral along with their contact information.

Q. if a member cancels but updates his annual form and says he wishes to be contacted by email – is this valid?

a. if a member cancels their membership but you have a record indicating they still wish to receive emails, this constitute express consent and would be valid.

the issue is complicated and that is why we will continue to offer information sessions on CASL and how to work within the rules. Stayed tuned for times and dates.

Canada s Anti-Spam Legislation: fast factsCanada’s new anti-spam law was

passed in December 2010 and, fol-lowing a Governor in Council order, it will enter into force on July 1, 2014. once the law is in force, it will help to protect Canadians while ensuring that businesses can continue to compete in the global marketplace. on January 15, 2015, sections of the Act related to the unsolicited installation of computer programs or software come into force.

When the new law is in force, it will generally prohibit the:

• sending of commercial electronic messages without the recipient’s consent (permission), including messages to email addresses and social networking accounts, and text messages sent to a cell phone;

• alteration of transmission data in an electronic message which results in the message being de-livered to a different destination without express consent;

• installation of computer programs without the express consent of the owner of the computer system or its agent, such as an authorized employee;

• use of false or misleading repre-sentations online in the promotion of products or services;

• collection of personal information through accessing a computer sys-tem in violation of federal law (e.g.

the Criminal Code of Canada); and• collection of electronic addresses

by the use of computer programs or the use of such addresses, with-out permission (address harvest-ing).

there are three government agencies responsible for enforcement of the law. When the new law is in force, it will allow:

• the Canadian radio-television and telecommunications Commis-sion (CrtC) to issue administra-tive monetary penalties for viola-tions of the new anti-spam law.

• the Competition Bureau to seek administrative monetary penalties or criminal sanctions under the Competition Act.

• the office of the Privacy Com-missioner to exercise new powers under an amended Personal infor-mation Protection and electronic Documents Act.

it will also allow all three agencies to share information with the government of a foreign state if the information is relevant to an investigation or proceeding in respect of a contravention of the laws of a foreign state that is substantially similar to the conduct prohibited by this Cana-dian law.

the law will also allow individuals and organizations who are affected by an act or omission that is in contravention of the law to bring a private right of action in court against individuals and organi-zations whom they allege have violated the law. once into force, the private right of action will allow an applicant to seek actual and statutory damages. Statu-tory damages may not be pursued if the person or organization against whom the contravention is alleged has entered into an undertaking or has been served with a Notice of Violation.

Before filing a lawsuit against an in-dividual or organization, get legal advice. An individual or organization could be responsible for paying considerable legal fees incurred by the alleged violator if they file an improper claim or one that is not considered to have merit.

How to plan for the “what if’s” in business When operating a business, we often find ourselves living “within” the organization on a Plan Bdaily basis, and we can sometimes forget to look “outside” to see what external events could have an impact on our operations or even the viability of our business.

there are always going to be circum-stances that are beyond our control that can have direct or indirect impacts on a business. While it is nearly impossible to predict every potential scenario, it is crucial to think about some of the “what if ’s” and develop strategies to prepare for any situation.

this is what is called contin-gency planning. Contingency planning can take on many elements of a business from sales and marketing to financing and operations. it is a process that can help a business or organization properly prepare for a vari-ety of outcomes so that they can respond efficiently to an unplanned event.

there are a lot of ways that a busi-ness can help prepare for potential cri-sis. take look at your business and think of any external forces that could affect your operation. You can do this by:

• Checking the media for trends or events

• Keeping an eye on your competition• Brainstorming some potential crisis

situations

• Monitoring for new technologies or funding opportunities

A simple methodology for proper con-tingency planning is to look at segments of your business independently and to focus on one element at a time.

Some examples could be:• Sales: Are there any new rules or

regulations on soliciting business that are being talked about in the media?

• finances: Are there any new financial instruments available in the future, changes in interest rates?

• operations: Are there any emerging technologies or changes that could be implemented for efficiencies?

once you have come up with some potential

scenarios, think about what you would do in the event that change is imple-mented and come up with a plan. We may not be able to catch every potential change, but if we stop and take a look outside, we can often see issues that may be coming our way. this is contingency planning and is a great tool to keep on top of external factors.

oCC encouraged by new predictable process for determining minumum wage

the ontario Chamber of Commerce is encouraged by the Government of ontar-io’s decision to tie future rate increases in the minimum wage to the Consumer Price index (CPi), as the Chamber had recom-mended to the Minimum Wage Advi-sory Panel in fall 2013.

“tying minimum wage to the CPi brings much needed predictability, transparency, and fairness to the entire process,” says Allan o’Dette, President and Ceo of the ontario Chamber of Commerce. “today’s decision is a positive development for businesses who have long been calling for an end to political interference in how we set the minimum wage.”

the ontario Chamber also notes that businesses are pleased that the govern-ment is providing them with six months notification before a rate change can

come into effect.However, the Chamber expresses

disappointment in the government’s deci-sion to hike the minimum wage rate to

$11 an hour in the short-term. “While a bump in the minimum wage is not ideal for ontario busi-nesses, today’s outcome is better than almost any other scenario that the ontario government has been consider-ing, including a one-time hike to a $14 an hour minimum wage,” adds o’Dette.

in its 2013 submission to the Mini-mum Wage Advisory Panel, the ontario Chamber of Commerce called on govern-ment to: tie the minimum wage to the provincial CPi; introduce increases to the minimum wage every two years; give businesses ample notification before a change in the minimum wage takes ef-fect; and avoid a one-time bump in the minimum wage.

Artisans are available on weekdays to demonstrate the methods of working with antique glass and lead cane to repair windows. (Note that we do not make custom windows (or window frames) for customers although our artisans are open to doing com-missioned repairs or custom made windows on occasion).

tackling the top 10 Barriers to Competitiveness 2014Canada’s competitiveness continues

to be severely challenged as traditional and emerging economies aggressively strive to occupy the global economic landscape. in fact, our country’s ability to remain a leader among nations continues to decline. A 2012 World economic forum report ranked Canada 14th in global economic competitiveness—down two places from 2011 and sliding five places since 2009. improving Canada’s competitiveness requires an ambitious, aggressive and innovative private sector. Strategic thinking and smart public policies are also needed to address long-standing structural impediments that hinder businesses at a time when they need much greater f lexibility to compete.

in 2012, in consultation with its members, the Canadian Chamber of Commerce launched the top 10 Barriers to Competitiveness. this ongoing initiative aims to direct attention to the key impediments holding back Canada’s progress and to urge all levels of government to act more swiftly in increasing our country’s ability to compete globally.

the need for action is urgent. the standard of living of every Canadian depends on how well we as a people respond to the challenge. We must identify and implement real, tangible solutions for breaking down the barriers to our competitiveness and for creating

more opportunities and greater prosperity for Canadian businesses and families.

sKiLLs sHoRtagEsCanada’s labour market is affected

by a demographic shift resulting in retirements and a growing gap between the skills needed and those available. Business, governments and academia must work together to address the current and future skills needs of the workplace, concentrating particularly on four key areas: upskilling; education and employment connections; immigration; and Aboriginal workforce development. to better address skills shortages, Canada also needs improved data on the skills gap and the mobility of individuals.

Public investment in infrastructure has not kept up with Canada’s economic needs. Now Canada’s investment needs far exceed the availability of public funds. Bringing infrastructure in Canada back to the level needed to support prosperity will require an ongoing commitment by all levels of government, an active engagement with private sector stakeholders and a greater appreciation of the opportunities that exist for Canada to be more competitive through more modern public infrastructure.

faced with a small domestic market, Canada’s ability to compete depends on reliable access to foreign customers and production capabilities. But due largely to policy and regulatory barriers and operating challenges in foreign markets, Canadian businesses are not globalizing as quickly as their oeCD peers. Canada must successfully negotiate trade agreements with key markets, renew its commitments to trade promotion and commercial diplomacy and update its tariff and customs policies.

intERnaL BaRRiERs to tRaDEthe lack of a single domestic market

in Canada is a serious and self-imposed weakness in the Canadian economy. tariff barriers amongst provinces are banned by the Canadian constitution, yet the national economy is fractured by a host of non-tariff barriers, particularly in procurement, energy, agriculture and transportation, and in the mobility of labour. the federal government must promote more meaningful sanctions against jurisdictions that practice protectionism against other Canadians while supporting those that embrace free internal trade.

a coMPLEx anD costLy tax systEMCanada over-relies on income and profit

taxes rather than on taxes on consumption, which are relatively easy to collect and are least harmful to growth. Canada’s tax code is also overly complex and imposes significant compliance costs on businesses and consumers while governments spend billions of dollars each year administering and enforcing convoluted tax laws. Canada must undertake a comprehensive review of its tax system with the aim of reducing its complexity and improving the way it raises tax revenue.

LacK oF cLEaR sustainaBiLity PoLiciEsPublic concerns over Canada’s ability to

responsibly develop its natural resources has led to project delays, constrained investment and limited access to some markets. international concerns have also

overshadowed Canada’s diplomatic and trade initiatives on occasion. for Canada to claim its rightful place as the world leader in responsible resource development, it must establish a credible climate policy, clarify businesses’ duty to consult with Aboriginal peoples and aggressively contest unfounded allegations about it environmental stewardship.

tHE sEvERE sHoRtagE oF EconoMicDEvELoPMEnt tooLs FoR BusinEssEs incanaDa’s tERRitoRiEs

the federal government has a critical decision to make regarding Canada’s territories if it is to fully leverage their economic potential. that decision is whether or not to provide them with tools to become more financially independent in the belief that doing so will unleash their ability to help the entire country be more competitive. Businesses see themselves as the means for the territories to achieve more financial independence from the federal government if they are provided with additional tools to enable them to do so.

inconsistEnt REguLatoRy PoLiciEs BEtWEEn canaDa anD tHE u.s.

inconsistencies between regulatory standards in Canada and the U.S. cost unnecessary time and money as these minor differences result in additional verification, inspection or testing of goods once they cross the border. Given the integrated nature of the two countries’ economies, greater alignment

and better mutual reliance in their regulatory approaches would lower costs for businesses and consumers, create more efficient supply chains, facilitate cross-border trade, reduce regulatory administrative costs for government and make Canada a more attractive location for foreign investment.

insuFFiciEnt suPPoRt FoR innovation in canaDian ManuFactuRing

Manufacturing, the largest sector of the Canadian economy, has not yet fully recovered from the 2008 recession and remains significantly reduced from its pre-recession size. Canadian companies can no longer rely on traditional manufacturing processes to solve this problem. they must innovate to capitalize on new technology and processes that improve productivity in order to remain competitive. Businesses also need a policy framework that reflects the importance of the innovation ecosystem imperative.

the Milton Centre for the Arts launchs new accessibility app

the Milton Centre for the Arts is pleased to announce the launch of Stagefly: a new application for the iPhone, iPad and iPod Touch created specifically for the Centre to provide an accessible live entertainment experience to audience members who are Deaf, deafened and hard of hearing.

“i am proud to announce the launch of Stagefly at the Milton Centre for the Arts,” said Milton Mayor, Gord Krantz. “We are so excited to have the opportunity to be forerunners in the development of this groundbreaking application, making live performances accessible to the large population of Milton residents who are Deaf, deafened and hard of hearing.”

thanks to the generosity of tD Bank Group, this live streaming application will allow for the broadcast of American Sign Language (ASL) interpretation within the theatre, making every seat in the house accessible. Designed to make the performing arts inclusive for all facility patrons, Stagefly makes every audience member a full participant in the live performance experience.

Development and consultation for the application began in 2011 and involved participation from representatives of both the deaf community of Milton, as well as members of the Milton Accessibility Advisory Committee (MAAC). in order to customize the application to fit the needs of the Milton community, participants attended initial meetings and had

the opportunity to test the system and provide feedback throughout the development process.

The system is currently in the final testing phases and staff continue to work with community partners and performing arts groups to assist with the final live trials. Community members who are interested in participating in live trials are invited to contact Milton Centre for the Arts staff at [email protected] or 905-878-7252, ext. 4906.

Stagefly is designed for use with the iPhone, iPad and iPod touch, and will be available for free download through the Apple App Store in the next few weeks. Use of the application during Milton Centre for the Arts performances and shows will begin with the start of the 2014 - 2015 season in September 2014, and a full listing of supported performances will be outlined in the Milton Centre for the Arts 2014 -2015 Season Brochure, which will be available in all town of Milton facilities and distributed to Milton households through Canada post in early May 2014. once the application is complete and in use, staff will be working with surrounding performing arts centres to ensure this important tool will be utilized outside of the Milton community.

this exciting application was conceived of, designed and created by Bill Zeilstra of the Milton Centre for the Arts and Sebastian Dwornik of Applied PDA Software through sponsorship funding received through tD Bank Group.
