Further, the European Patent Office (EPO) provided a notice of an intent to grant for European patent application EP09165106.7. The patents expand protection to the company’s liposomal-based delivery capability, which includes both the Smarticles and DiLA2 platforms as well as an emerging third platform that represents a combination of key delivery attributes from these two platforms. Since the acquisition of the Smarticles delivery technology, an amphoteric-based liposomal delivery system, in 2010 from Novosom AG, Marina has invested substantial resources to advance both this technology and the DiLA2 delivery technology, an amino acid-based liposomal delivery system. Part of this endeavour involved determining whether the DiLA2 and Smarticles delivery technologies could be integrated, and novel formulations developed that take advantage of the benefits of each platform. Newly-published study comparesSurfaxin LS and Curosurf in well-established RDS model

Discovery Laboratories Inc, aspeciality biotechnology company thataims to advance a new standard inrespiratory critical care, reported thatdata from a pre-clinical study ofSurfaxin LS (lyophilized KL4surfactant) was recently published inthe May 2012 issue of PaediatricResearch. The results of the studydemonstrate that improvements inlung function following administrationof Surfaxin LS compare favourably toimprovements in lung functionfollowing administration with pig-derived Curosurf, the leadingsurfactant product in Europe for thisapplication. In addition, physiologicfindings suggest that Surfaxin LS mayhave a more favourable safety profileat the time of surfactantadministration. The objective of thestudy was to compare the effects ofSurfaxin LS and Curosurf onpulmonary function, as well as thephysiologic reactions to surfactantadministration in preterm lambs withrespiratory distress syndrome (RDS).

ONY, the makerof a competing neonatal lungsurfactant, had filed suit on 2 Dec2011 in connection with an articleappearing in the 1 Sep 2011 onlineissue of the Journal of Perinatology.The article was based on aretrospective study in infants with

RDS that concluded that Curosurfwas associated with a significantlyreduced likelihood of death whencompared with ONY’s product. ONYalleged that the conclusions of thearticle were unreliable andmisleading. The Court ruled that thearticle was not misleading withrespect to the facts on which it wasbased, and dismissed ONY’s claimsagainst Cornerstone and all the othernamed defendants. Curosurf(poractant alfa) is an intratrachealsuspension indicated for thetreatment of RDS in prematureinfants.

Following a request from US groupDow Chemicals, the EuropeanCommission is to review its currentantidumping measures againstethanolamines imported from theUSA. The Commission is thought tobe ready to reconsider its positionnow that Dow (one of the largestexporters of ethanolamines to theEU) has increased its prices and iswilling to do so regularly in future.The group will have to provide theEU with additional information toprove that it has corrected itsposition. The Commission hasagreed to lift its current measureswithin 15 months.
