The top local home builders took the spotlight April 18 with the presentation of the 2012 American Dream Awards. More than 200 people attended HBA’s Spring Awards Ceremony at the Truman Forum in the Plaza Library as the awards winners were announced. Each spring local home builders compete for top honors in the awards competitions held in conjunction with the Spring Parade of Homes. The 50th annual Parade provided consumers the opportunity to visit 287 new homes throughout metropolitan Kansas City during the 16-day, three-weekend event that opened April 14 and continued through April 29. The American Dream Awards are the premier honor for new home construction in the Greater Kansas City region. Builders’ entries were rigorously judged on architectural design, construction techniques, craftsmanship and selection of materials. Homes competed in categories based on price range. Teams comprising seventeen industry professionals from across the United States canvassed the Kansas City region April 13 and 14 to evaluate the entries. Twenty-two Grand Award winners were selected, and twenty-four First Runner-Up honors were awarded. Local governments are reviewing changes to their local building codes and some new changes in policy can be effective as soon as October 1. The Overland Park City Council is poised to adopt the 2012 International Code Council family of codes at their May 7 meeting. Most local governments opted to not change their codes in 2009 when the latest family of International Codes Council were released. The HBA formed a Codes Task Force to review the various changes to the International Residential Code (IRC) and the International Energy Efficiency Code (IECC). The group met numerous times since September 2011 to identify erroneous additions to the code and to identify possible amendments to best suit local needs. The HBA Board of Directors adopted a formal position on building codes, stating: Support adoption of 2012 International Residential Code (IRC), with amendments Support full adoption and implementation of 2006 International Energy Efficiency Code (IECC) Support adoption of 2009 IECC no sooner than 2 years Last fall the City of Overland Park created their own Code Adoption Task Force which included residential and commercial builders, developers, architects and city staff. The conference is on Wednesday, June 6 and is a day-long event that coincides with the NAHB spring board meeting in Washington, D.C. HBA members came out in full force for the 2010 Annual HBA Golf Tournament on Friday, June 9th at the Falcon Ridge Golf Club in Lenexa, KS. Renewed interest in the tournament was gratifying for everyone involved with 144 golfers and a portion of the proceeds benefiting two important charities. The Salvation Army and Hillcrest Transitional Housing were presented with checks from Home Builders Association Foundation Fund to support their important work.

The day started with a continental breakfast and registration where golfers could purchase mulligans and skirts to raise extra money for the charities on hand. A putting contest sponsored by The Kansas City Star where the winner brought home a new putter.

To spice up this year’s event, co-chairs Tommy Angotti (Factory Direct Appliance) and Deb Swearingen (Pinnacle Bank) offered games throughout the day to keep golfers entertained. The longest drive, longest putt, and everyone’s favorite hole, where golfers could opt to put on a skirt and tee off from the women’s tee box. Finishing the day was a lunch and awards ceremony where checks were presented to the charities and tournament winners.

The top local home builders took the spotlight April 18 with the presentation of the 2012 American Dream Awards. More than 200 people attended HBA’s spring Awards Ceremony at the Truman Forum in the Plaza Library as the awards winners were announced.

The American Dream Awards are the premier honor for new home construction in the Greater Kansas City region. Builders’ entries were rigorously judged on architectural design, construction techniques, craftsmanship and selection of materials. Homes competed in categories based on price range. Teams comprising seventeen industry professionals from across the United states canvassed the Kansas City region April 13 and 14 to evaluate the entries. Twenty-two Grand Award winners were selected, and twenty-four First Runner-Up honors were awarded.

Local governments are reviewing changes to their local building codes and some new changes in policy can be effective as soon as October 1. The Overland Park City Council is poised to adopt the 2012 International Code Council family of codes at their May 7 meeting. Most local governments opted to not change their codes in 2009 when the latest family of International Codes Council were released.

The HBA formed a Codes Task Force to review the various changes to the

International Residential Code (IRC) and the International Energy Efficiency Code (IeCC). The group met numerous times since september 2011 to identify erroneous additions to the code and to identify possible amendments to best suit local needs.

Kansas City Mayor sly James will be the featured speaker at the next Missouri North Area Council membership lunch on Tuesday, June 12, 11:30 a.m. at Tiffany Greens Golf Club. James was elected mayor on March 22, 2011.

Appraisals - Focus of Missouri South Council Lunch

Appraisals continue to be a major issue impacting home builders and are one of the key reasons cited as an impediment to a full housing recovery. Mark H Maschger, sRA is the owner of AppraisalBridge, LLC and Verity Valuation, LLC, and the immediate past president of the Kansas City Chapter of the Appraisal Institute. He spoke at the April Missouri south Area Council membership lunch about the state of the appraisal industry and how builders can best navigate the appraisal process.

Maschger knows that both builders and appraisers depend on the same industry for their living and wants to erase the knowledge gap about the role of the appraisers and the methods used to value real estate.

“Our industry needs to change significantly” said Maschger. “And, fortunately, the strengthening partnership between our organizations at the national and local levels will improve the industry for all involved.”

one person’s opinion. Try to identify specific, factual errors and omissions. study the comparable properties chosen, and consider that the value may be right. After the appraiser has signed and delivered the report, the builder shouldn’t communicate with the appraiser. However, communicate with the lender and request reconsideration. The lender should review the appraisal, the evidence provided and determine whether reconsideration is warranted. Don’t include active, pending, cancelled or withdrawn listings as comparables.

“Keep the information focused on the facts, be reasonable and right rather than emotional,” said Maschger.

He also recommended hiring an appraiser consultant.

Many regulatory changes are afoot in the appraisal industry. The Home Valuation Code of Conduct (HVCC) was sunsetted by Fannie Mae in late 2010, although it is maintained by substantially similar requirements via selling Guide updates. The Dodd-Frank Act and Revised Interagency Guidelines are making federally regulated lenders more focused again on the issue of appraiser independence. And new laws in Missouri and Kansas will soon require third party appraisal management companies to operate under the accountability of state regulatory agencies.

Appraisers must abide by Uniform standards of Professional Appraisal Practice (UsPAP). Maschger spoke of the Competency Rule under UsPAP, emphasizing that appraisers must be competent to appraise in the specific geographic location, competent to appraise the property type and at the market level required by an appraisal assignment.

Most appraisals developed for mortgage related transactions are reported on the 1004 URAR form. It’s a one-size fits all form designed to value homes throughout the country. Its use is moving beyond the read only PDF, as the Gses (Fannie/Freddie) are now requiring the

delivery of appraisals in a format that allows for extraction of data. This impacts all residential volume, includes new descriptions for quality and condition, new reporting format for basement finish, and requires appraisers to more consistently report architectural design, location and view attributes.

Maschger told attendees that good changes were coming to the industry, including increasingly stringent requirements for becoming an appraiser, improved oversight and various technology advances.

NAHB’s legal experts recently completed a helpful guidance document for employers on the importance of establishing official company policy regarding distracted driving.

You should know that your employees’ use of cell phones while driving can generate potential liability issues, particularly if an accident occurs. In addition to civil liability, the employer also has a legal responsibility under the Occupational safety and Health Act to safeguard drivers at work.

The Occupational Safety and Health Administration (OSHA) has now officially declared that companies are in violation of the law if by policy or practice they require texting while driving or create incentives that encourage or condone it, or if they structure work so that texting is a practical necessity for workers to carry out their job.

As outlined in NAHB’s guidance, an employer must make it clear to employees that the company’s distracted driver policy applies to personal cell phones whenever the employee is driving a company vehicle or on company business, and also applies to company cell phones even while the employee is off the clock. SNews from the HBA is optimistic as the

March 2012 residential permit statistics indicate a significant jump over 2011 for the same quarter last year. This year’s first quarter recorded 712 total units compared to last year’s first quarter number of 391. The numbers were bolstered by 41 multi-family rental units in Kansas City, Kansas. with the addition of 269 starts in March, the Greater Kansas City area has not seen a first quarter this good since the first quarter of 2008 prior to the financial crisis.

“Builders have been selling homes as fast as they are building them recently. This could be the release of pent up demand combined with record low mortgage rates averaging 3.9% last week,” said executive Vice President sara Corless. “It will feel like more like a recovery if we are still looking at numbers like this in september.”

An activity of note for the quarter is that as a percentage of total single family units Clay, Jackson and Platte counties all increased market share for a combined increase from 42% in 2011 to 53% in 2012.
