The topic of the lawsuit against the Asso- ciation regarding actions related to remediation after Hurricane Charley was again brought up at last week ’ s Board meeting. Since this is pending litiga- tion, members of the Board are limited to what infor- mation can be shared with owners. However, for some of the new owners who may be playing catch up, I will provide an overview of the suit, what is scheduled to happen next, possible outcomes and an estimate of what this suit has cost owners so far. I apologize to the long term owners for whom this is just rehashing old news but I feel that it ’s important to level set the same facts to all owners. Here is what we can share: What is the nature of the Law Suit? The litigation is brought by a unit owner against the Emerald Pointe Condo Association and members of a previous board. It arises out of dam- age sustained by those two Condominium units, allegedly from Hurricane Charley, and the subse- quent use of insurance proceeds. What is the anticipated settlement/judgment date, if any? The court has set the estimated date for trial as December 5, 2014. Any party would have the right to appeal the verdict. If applicable, is there sufficient insurance to pay out a settlement/judgment without affecting the financial stability of the association? There may be sufficient coverage if there is no trial. In the event of a jury trial the outcome is unpredictable. If the association were to be found at fault and our insurance is not sufficient to cover the judgment, all Emerald Point Association owners will need to be assessed the remaining amount. More clearly, if judgment is against Emerald Pointe Condo Association, each and every owner will pay for what is not covered by insurance. The Insurance company that was in place at the time of Hurricane Charley cancelled our policy once the suit was filed. The new policy cost approxi- mately 10 thousand dollars a year more than the previous policy. ( $32 per 313 units annually ) . Legal fees, for Emerald Pointe, over the past several years have greatly exceeded budget in direct relationship to the law suit. Please refer to the published financials. To date the suit has not affected the trans- fer of title nor has it affected the rights of owners. In the desire to maintain an optimistic outlook; in the event the judgment is in favor of Em- erald Pointe Condo Association, we can look for- ward to a financially improved situation. As many of us leave for the summer, I wish

you a healthy and relaxing time away from EP and

look forward to seeing you back here next fall for

another season.

The topic of the lawsuit against the Asso-

ciation regarding actions related to remediation after

Hurricane Charley was again brought up at last

week ’ s Board meeting. Since this is pending litiga-

mation can be shared with owners. However, for

REMINDERS Please be sure to check in with the office upon your leaving and your return, we need to mark in our system if you are here or not. If you change a phone number (or disconnect) or change an address, please be sure to notify us at the office so that we can keep our records up to date. Remember, if you are selling something on the bulletin board; be sure to sub-mit it to the office so that it may be added to the sheet for you. If you sell it, please let the office know so that it may be removed from the sheet. Deliveries need to be made by vendors between the hours of 8am and 5pm, And through the Osceola Gate. Let them know when you are making delivery dates that any truck bigger than a pickup need to use that gate. We are still in the process of sorting out the lockers in the Yacht Club. We will contact you when we have assigned the lockers to the owners on our waiting list. We have removed the land line phone from the tennis courts. Don’t forget your cellular phone, in case of an emergency! Finally I would like to wish everyone an enjoyable and safe summer! ANNOUNCEMENT FROM GAZETTE EDITOR Effective with the June edition I will be handing responsibility for producing the EP Gazette over to Emer-ald Pointe’s staff for the summer. During this time I will be working closely with the Office to maintain the continuity of our newsletter. I have loved every minute of writing the Gazette over the past 10 years (well, maybe not every minute!) – but now it’s time to hand stewardship over to someone new. The mission statement for the Gazette is to provide owners and residents with news and information about issues and activities relevant to the Emerald Pointe Community. During the October through May snowbird season the Gazette serves as the primary communication about current events and happenings at EP.

The template of the Gazette has evolved based on input from residents and currently includes: Monthly Letter from the BoD President highlighting current events impacting EP Message from the office Administrative Assistant Manager’s Report News and Notices Schedule of Events

Recap of prior month Social Activities Calendar of regularly Scheduled Events and upcoming Social Committee events

It Goes without Saying – a column that reminds residents of the rules governing our community Contact phone numbers and email addresses of EP staff, BoD members and Committee Chairman Articles of Interest – submitted by residents for consideration that is included on a space available

basis The content of the Gazette does not include ‘Letters to the Editor’ discussing EP issues, whining

about what Is or IS NOT happening at EP nor classified ads (other than a periodic list of Homes for Sale). Complaints and concerns belong in the office. There is never anything published anony-mously.

The Gazette is distributed by the last day of the month.

The editor’s role is to edit and format material to be included. The majority of the editor’s involvement

occurs during the week immediately prior to publication. The time commitment is 8 to 10 hours per month.

The Board is accepting proposals from anyone (or 2 people co-editing) who would be interested in

taking over production starting in the fall. If you are interested in volunteering, email Emerald Pointe Manager, [email protected] with your name and why you think that you would be the right person for the job! Please submit your name by August 31

Emerald Pointe End of Season Party:

The Pizza Party at the end of each season is

always a great success. This year was no exception

and only made better by the auction that was held.

For several years our front entrance was pro-

tected by Soldiers of the Nutcracker variety. Like

many such decorations they had deteriorated and

had to be removed. Many of us missed them and so

it was decided that they should be replaced. In her unflappa-

ble style, Joan Geoghegan and her minions went to work. A

seamstress was located that had the pattern and was willing

to do the work. In no time a deal was struck, but how to pay

the $800.00?

Joan was our fund raiser extraordinaire for many

years, and even though she has moved away from EP now,

her parting gift was organizing the auction that provided the

money needed. Owners had a good time bidding against

each other for items desired and as always supported the

effort with gusto. Two paintings by resident artist Bob Doyle,

put the bidding into a near frenzy.

Come Christmas 2014, our soldiers will once again

grace our entrance and remind us all of the originals and

their creator, Nancy Reichle as well as remind us how spe-

cial Joan Geoghegan will always be to all of us.

The Social Committee meets the first Wednesday of each month at 3 PM, during season. Everyone at EP is consid-ered a member. It Goes Without Saying….But

Thermostats in the clubhouse and in the midrise com-

mon areas are not to be changed by owners.

Doors to midrise lobbies are to remain closed.

AC/Heat is costly. Not to mention the dirt and critters

that get in. Remember we have snakes and gators.

No owner has the right to plant anything in a common

area. Keep your plants in your own yard or Lanai.

Going to a pool. Don ’ t forget a cover up is required

by everyone.

Everything you do affects your

neighbors, be sure it ’ s in a posi-

tive way.
